APPLICANT: Metro Industrial District, Inc. FILE NO. SH. PL. 085-80 (Valley Office Industrial Park) LOCATION: Between the East Valley Road and Lind Avenue S.W. on the south side of S.W. 16th Street to proposed S.W. 19th Street. SUMMARY OF REQUEST: • The applicant requests approval of a four-lot short plat for the purpose of future industrial development. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with restrictive covenants. • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Hearing Examiner on September 9, 1980. PUBLIC. HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner . conducted a public hearing on the subject as follows: The hearing was opened on September 16, 1980 at 10:20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report: Roger Blaylock, Associate Planner, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat as submitted Exhibit #3: Short Plat with staff comments Responding to the Examiner's inquiry regarding applicability of Resolution No. 1923 to the subject site, Mr. Blaylock' advised that 2% for wildlife' habitat mitigation would be required. Responding to the Examiner's inquiry regarding the width of right-of-way requested by the city on S.W. 16th Street, Mr. Blaylock discussed the proposed configuration and advised that 15 to 20 feet would be required to maintain consistency on the arterial . The Examiner requested testimony by the applicant. Responding was: Jacob Fox Austin Company 800 S.W. 16th Street Renton, WA 98055 Mr. Fox advised that the name, Metro Industrial District, Inc. , had been legally changed to ,Valley Office Industrial Park, although the ownership 'remains the same. He concurred in Planning Department recommendations for dedication of additional right-of-way on S.W. 16th Street, and drainage provisions on Lots 2, 3 and 4. The Examiner discussed the configuration of Lot 4, partially divided by a narrow parcel , which may create potential development problems, and inquired whether it would be advisable for the applicant to proceed instead with a formal plat for' five lots at this time.. Mr. Fox indicated that no plans currently exist for development of Lot 4, and the applicant is aware of state laws restricting further subdivision of the lot for a five year period following short plat approval . ' The Examiner requested .further testimony in support or opposition to the application. Since no further comments were forthcoming, the hearing was closed by the Examiner at 10:35 a.m. • • • • • Sh.. F , ., 385-80 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . . The request is for approval .of a four-lot short plat of +28.42 acres of property located on the south side of S.W. 16th Street between the East Valley Road and Lind Avenue S.W. 2.' The application file: containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C.., as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject site is essentially level as the result of grading and filling operations on the site. Most of the natural vegetation has been removed from the site. Subject to review and implementation of storm drainage plans, no filling of the south half of the subject site has been permitted. The permit has only been issued for the northern half of the property. In addition, a moratorium on filling has been enacted by the City Council for this and other property located in this vicinity. 8. Additional right-of-way on S.W. 16th Street is required to bring the street width up to the minimum city standards for that thoroughfare. A strip varying from 15 to 20 feet in width will have to be dedicated for this purpose. The corner radii of both •16th S.W. and 19th S.W. where they intersect Lind Avenue S.W. must be dedicated to the city to provide for safe turning movements' at these locations. 9. The installation of off-site improvements on both S.W. 16th Street and S.W. 19th Street will be accomplished under LID 314. All improvements along Lind Avenue S.W. have been installed except, sidewalks, which will have to be installed. 10. The applicant proposes dividing the subject property into four lots. The lots will vary 'in"size from under 200,000 square feet to over 500,000 square feet. Lot 4 is quite irregular with two almost independent segments connected by a strip approximately 30 feet wide by 120 feet long. Further division of this lot into its two component segments would require a formal plat if attempted within five years. 11 . Part of the site is wetlands which provides both a water course and a natural retention system for waters in the area. LID 314 includes provisions to drain the site. Until that time the Public Works and Nanning Departments have recommended that natural water drainage be maintained on the site. 12. The area is at the northern extreme of the growing industrial complex in the south end of the city bounded by FAI-405 on the north and the East Valley Highway on the east. The Comprehensive Plan designates the area in which the subject property is located as suitable for the development of manufacturing park type uses. 13. The site is zoned both H-1 (Heavy Industry) and L-1 (Light Industry) . The L-1 zoning applies to the northern segment of, proposed Lot 4. 14. The applicant agreed to all dedications for streets, corner radii , and drainage easements . • 15. .The subject property is part of the area in which the provisions of the City Council Resolution. No. 1923 are in effect. The applicant will have to comply with its provisions by restoring 'wildlife habitat to at least 2t of the site. Sh. Pl . 085-80 Page Three CONCLUSIONS: ' . 1 . The proposed short plat appears to serve the public use and interest. The area is 'designated as suitable for the development of manufacturing park type of applications and the proposed'subdivisionwill enable appropriate smaller scale development to 'acquire lots in this area. 2. ,The subdivision will provide for the necessary public right-of-ways and public safety by dedicating land for public right-of-ways along S.W. 16th Street and at the corners of S.W. 16th Street and S.W. 19th Street at Lind Avenue S.W. for safe turning radii . 3. , The installation of 'sidewalks 'along Lind Avenue S.W. will complete the complement of improvements to the area and will provide continuity with the off-site improvements along the other street frontages in the area. 4. • Because of the complex drainage system and current status of the subject property as 'a natural drainage path and retention system, the property will have to continue serving in this capacity until LID 314 is completed. To assure that the natural drainage of the area is not altered until LID 314 accomplishes its intended purpose the applicant will have to dedicate an easement across its property as a condition of subdivision approval. The dedication will provide for the continuation of the natural drainage flow onto and through the subject property unimpaired by development. This would also require the natural retention of the property to be unaltered. 5. Since the area is designated in the Comprehensive Plan as manufacturing park use, approval of potential development should be required as it is in areas which are zoned for manufacturing park uses. Site approval shall therefore be required subject to' a public hearing and review. DECISION: Exhibit #3 is approved subject to the dedications indicated on that exhibit for S.W. 16th Street and the corner:;radii at S.W. 16th and S.W. 19th Streets at their respective intersections with Lind Avenue S.W. , and subject to the following: • 1 . The execution of 'restrictive covenants requiring site approval by the Hearing Examiner for all subsequent development. 2. The dedication shown on the short plat of easements to retain the natural drainage detention/retention and flow of the subject property. 3. 'Installation of sidewalks along Lind Avenue S.W. HISTORY/W/ACKGR DfUND: The subject site was annexed into the City by Ordinance #1745 dated April 14, 1959 . It was rezoned H-1 by Ordinance #1845 and 1955 dated January 9 , 1960 and May 14, 1962 respectively. The L-1 zoning was established by Ordinance #2039 of May 13 , 1962 . A Special Permit for fill and Grade of approximately 300 , 000 cubic yards was approved for the subject site by the Hearing Examiner on April 24, 1979 for the northern portion of the site. D . PHYSIICAL 4 ACKCNB®UIN®: 1 . Topography : The site is essentially level . 2 . Soils : Urban Land (Ur) . The erosion hazard is slight to moderate. No capability or woodland classification . Puget silty clay loam (Pu) . Permeability is slow . The seasonal high water table is at or near surface. Runoff is slow to ponded, and the erosion hazard is slight. Stream overflow is a severe hazard. The soil is used for row crops and pasture. 3 . Vegetation : With the exception of a few scattered deciduous trees , the site is predominantly covered with grass and scrub brush. 4. Wildlife : Existing vegetation may provide suitable habitat for birds and small mammals . 5 . Water : The site is part of a natural drainage area . Thus the filling of the site was restricted until L .I .D . was formed and the storm water diverted. 6 . Land Use : An automobile repair garage and service station are located to the north of the subject site while a lumber company and light industrial uses are situated to the west . An existing single family residence and mini-warehouse are to the south and easterly is the East Valley Freeway . E . NEIGHBORHOOD HOOD CHARACTERISTICS : The area consists of a combination of presently developed industrial property and undeveloped land in the process of being prepared for such development . F . Off-site improvements along Lind Avenue S .W. have been made for the street , curbs , and lighting . The sidewalks will need to be installed along the west sides of Lots 1 and 2 . The sidewalks and improve- ments on S .W. 16th Street , East Valley Road and S .W. 19th Streets will be included in LID 314 which has been formed and the applicant has signed a • agreement to participate in and the City has approved , the project will need to be financed to this point and constructed . Additional right-of-way on S .W. 16th Street will be necessary to complete LID 314 . 5 . LID 314 also includes provisions for draining the existing wetlands on the site . The filling and grading of the site was reviewed under Special Permit , File #SP-320-79 . The problem is complex in that surface water from the Renton Village Shopping Center and office complex located on the northeast side of the freeway inter- change drains through the subject site . Thus the Public Works Department has required that the natural drainage channels not be filled {until LID 314 is constructed or an alternative drainage system be developed. Sufficient drainage easements will be required across the property as a result of the final designs of the LID . It is anticipated that thos easements will be added by separateC, documents at a later time . Development of the site will result in the permanent loss of the wetlands . The mitigating measure of providing additional on-site landscaping appears to be only cosmetic in nature. . The actual development of proposed lots 2 , 3 and 4 may be limited by this physical problem and the timing of LID 314. 6 . The area is undergoing a rapid commercial and industrial development after the improvement of Lind Avenue S .W. The Austin Company has constructed a 200 ,000 square foot office complex to the west of the proposed short plat . To the north of the site is an old established subdivision and small light industrial uses are gradually filtering into that area during the past three years . Immediately south of S .W. 19th Street the land is still undeveloped. However , further south on Lind Avenue S .W. are major new industrial developments including Garfield Transfer , Superior Fast Freight , Brady Hardwoods , Service Paper and Mercury Marine all presently under construction or completed within the last one year . East of East Valley Road the property has remained in its present state waiting the improvement through LID 314 .
