Blaylock, Zoning Administrator I recently responded to Mr. John Vidmar concerning an extension of his filing date for his approved short plat. An error was made in that original letter in establishing what was the appropriate expiration date. The Ordinance states that it should be from the date of submission and not of the date of approval of the short plat by the Hearing Examiner. Therefore, this extension date should be changed from July 22, 1982, to June 9, 1982. The applicant's formal request of January 12, 1982, is after the expiration date of December 9, 1981. However, both the applicant and his engineer were working with this department prior to the expiration date and the formal request was an oversight. Based upon this continued effort to finalize the plat and documentation of telephone calls prior to the expiration date, I have made the administrative determination that the six month extension is still valid; however, the date of the expiration will have to be modified to correspond with six months after the first expiration date of December 9, 1981. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on January 7, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 13, 1981 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat Map with staff comments Utilizing the blackboard in the Council Chambers, Mr. Blaylock indicated the lot setbacks as determined by Section 9-1102.8 of the Subdivision Ordinance. He noted the opinion of the Planning Department that the rear and side yard setbacks as calculated by that section legally conform to requirements contained in the Zoning Code. He also referenced recently adopted Ordinance No. 3493 which establishes allowable grades for streets and driveways, noting that grades over eight but no more than 15% would be allowed upon proper application in writing to and approval by the Board of Public Works prior to issuance of a building permit. The Hearing Examiner indicated his opinion that he is not authorized to approve creation of a lot which is not legally conforming, and suggested that the hearing be continued until approval of the grade is secured. Mr. Blaylock advised that the grade of Lot 3 is approximately from 10 to 12%, the grade of Lot 2 is approximately from 8 to 10%, and although Lot 1 is an established lot, he was uncertain of the finished grade. Responding to the Examiner's inquiry regarding the location of the frontage of the properties, Mr. Blaylock advised that although the lots front on Renton Avenue S. , functional access is currently from the Seattle Pipeline Road. The Examiner requested testimony by the applicant. Responding was: John Vidmar 508 Renton Avenue S. Renton, WA 98055 Mr. Vidmar clarified that access to Lot 1 and an accessory garage exists on Renton Avenue S. and has an existing grade of approximately 20. He noted that the driveway for Lots 2 and. 3 do not currently conform to the allowable 8% grade requirement, but the possibility exists to further grade the property to conform. Responding to the Examiner's inquiry regarding the location of the proposed driveway to Lot 3, Mr. Vidmar indicated that a separate driveway will be installed which will not access to the pipeline road. He also confirmed that all grades will conform to the requirement. The Examiner requested testimony in support or opposition to the application. There was no response. He then indicated concern regarding the steep grade of Lot 2. Mr. Vidmar 5 ' Sh. P1 . 128-80 Page Two indicated that the current plateaus on the lots will remain in their current condition and grading will occur solely on driveways and parking pads. The Examiner advised that if the request is granted, grades must conform to the 8% requirement or conditions imposed to enforce establishment of the grade. The Examiner requested further testimony. Since no further comments were offered, the hearing regarding File No. Short Plat 128-80 and E-130-80 was closed by the Examiner at 9:22 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a three-lot short plat together with a variance to permit access via a pipestem extension. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. , 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-706 (R-1 ; Single Family Residential ; Minimum lot size - 7,200 square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located in the vicinity of 506 Renton Avenue S. in the area of the city known as Renton Hill . The site is part of the original plat of the city. Two existing single family homes are located on the site. The site is covered with lawn grasses and some trees and shrubs. 9. The site slopes upward both to the south and east. The site has been graded in such a manner as to create three terraces. The existing homes are located on the northerly and southerly terraces. The applicant proposes constructing a new single family residence on the remaining terrace. 10. The applicant proposes a three-lot short plat of the subject site in order to provide an additional lot for a third single family home pursuant to Section 9-1105. The applicant has proposed a pipestem extension to provide access to Renton Avenue for proposed Lot 2. The applicant has applied for a variance pursuant to Sections 9-1109 and 9-1108(23) (F) (3) (d) in order to provide the pipestem extension. 11 . The Seattle Cedar River Pipeline Road runs along the northeast boundary of the subject property and proposed Lots 1 and 2 have nominal access to the pipeline road. 12. The record indicates that the property and access driveways have been graded to create a driveway with a slope of less than 8% as permitted by Section 4-2204(2) (G) . 13. The subject site and surrounding areas are zoned R-1 . The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family residences. The general area of Renton Hill is similarly designated. 14. Elementary, middle and high schools are located within one mile of the subject site. Philip Arnold Park is about one-quarter mile from the subject site and Liberty and Cedar River Parks are within three-quarter miles. 15. The area in which the subject property is located is primarily single family in character. Immediately surrounding the subject site are single family uses. 16. Proposed Lot 1 will be approximately 8300 square feet. Proposed Lot 2, the pipestem lot, will be approximately 8400 square feet, or approximately 7300 square feet without the pipestem extension. The remaining lot, Lot 3, will be about 8400 square feet. Each of the lots has access via Renton Avenue S. Sh. P1 . ILo-80 Page Three 17. As originally proposed, the rear yards and side yards were insufficient to meet code requirements but the Planning Department has indicated that those problems have been overcome. The applicant has indicated acceptance of minor lot line adjustments to provide required yards. 18. The ITE trip estimate is approximately 10 vehicle trips per day. The Traffic Engineer has determined that at least $20 per trip will be required to improve trafficways in the area. CONCLUSIONS: - 1 . The proposed short plat represented in Exhibit #2 with the lot lines adjusted to provide the required rear yards and side yards appears to serve the public use and interest. 2. The proposed subdivision will provide an additional lot upon which to construct a new single family home. The short plat will also provide three lots which exceed the lot area requirements of the R-1 zone in which they are located. 3. The additional lot will increase the tax base of the city without measurably increasing the demand for public services in the area. The current utilities can accommodate the one dwelling unit addition. 4. The proposed use, single family, is compatible with the designation of the site for single family uses. The use is also compatible with the surrounding single family uses on Renton Hill . 5. The driveway grades for each of the lots will have to be held to 8% or less as required by ordinance. Deviation from the 8% grade would have to have the approval of the Board of Public Works. 6. The proposed short plat will add one new unit to the existing housing on Renton Avenue S. and the anticipated vehicle trips using the roads in the area will be approximately 10 per day ( ITE Standards) , and therefore, at cost of $20 per trip, the trip generation fee is $200 payable towards the improvement of the trafficways in the ara. DECISION: Exhibit #2 with the adjusted lot lines is approved subject to the provision of access to each lot or driveway with 8% grade or less. The variance for pipestem access is approved.
