HomeMy WebLinkAboutORD 6109CITYOFRENTON,WASHINGTONORDINANCENO.6109ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGTITLEVIOFTHERENTONMUNICIPALCODEBYADDINGCHAPTER33,CREATINGANEWCRIMEFOREXPOSINGMINORCHILDTODOMESTICVIOLENCE,AUTHORIZINGCORRECTIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityofRentonrecognizesthatexposuretodomesticviolencecanharmachild’semotional,psychologicalandevenphysicaldevelopment;andWHEREAS,childrenexposedtoviolencearemorelikelytohavedifficultyinschool,abusedrugsoralcohol,actaggressively,sufferfromdepressionorothermentalhealthproblemsandengageincriminalbehaviorasadults;andWHEREAS,intheCityofRentonin2022,onehundredninety-four(194)childrenwereexposedtodomesticviolence;andWHEREAS,theCityofRentonseekstoreducetheimpactofdomesticviolenceincidentsonallvictimsandwitnesses,includingminorchildrenwhoarepresentwhendomesticviolenceoccurs;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsorarenotexplicitlyrepealedhereinremainineffectandunchanged.SECTIONII.TitleVIoftheRentonMunicipalCodeisamendedtoaddchapter33,entitledExposingMinorChildtoDomesticViolence,toreadasfollows:1
ORDINANCENO.6109CHAPTER33EXPOSINGMINORCHILDTODOMESTICVIOLENCESECTION:6-33-1:Purpose6-33-2:Definitions6-33-2:ExposingMinorChildtoDomesticViolence6-33-3:NonmergerofDomesticViolenceCrimes6-33-1PURPOSE:Itistheintentofthischaptertoacknowledgethedetrimentaleffectsthatwitnessingdomesticviolencehasonminorchildren,andtopunishthosewhoperpetuateacycleofdomesticviolencebycommittingactsofdomesticviolencethatarewitnessedbyminorchildren.Thischapterisintendedtoaddadditionalpunishmenttoviolatorswhocommitcrimesofdomesticviolenceifthosecrimesarewitnessedbychildren.6-33-2DEFINITIONSA.“Domesticviolence”shallhavethesamemeaningsetforthinChapter1099RCWorasmaybeamended.B.“Immediatepresence”meanswithinsightof,withinearshotof,orwithinthesameroomorcavityofabuilding,dwelling,vehicle,orotherproperty.C.“Minorchild”meansapersonoflessthaneighteen(18)yearsofageatthetimeoftheviolation.6-33-2EXPOSINGMINORCHILDTODOMESTICVIOLENCE:2
ORDINANCENO.6109A.Apersoncommitsthecrimeofexposingaminorchildtodomesticviolencewhenheorshecommitsacrimeofdomesticviolence,asdefinedbyRCW10.99.020,whileknowinglyintheimmediatepresenceofaminorchild.B.Exposingaminorchildtodomesticviolenceisagrossmisdemeanor.Anypersonconvictedofthiscrimeshallbesentencedtonotlessthanthirty(30)daysinjail.Ifthepersonconvictedissentencedtolessthanthemaximumstatutorysentenceofthreehundredandsixty-four(364)daysinjail,thecourtshallplacethedefendantundercourtsupervisionandthecourtshallimposeconditionsofsentencingthatinclude:successfulcompletionofaDomesticViolenceVictimsImpactPanel,andanevidence-basedtreatmentprogram,suchasDomesticViolenceMoralRecognitionTreatment(DV-MRT).6-33-3NONMERGEROFDOMESTICVIOLENCECRIMES:Everypersonwho,inthecommissionofacrimeofdomesticviolence,shallcommitanyothercrime(s),maybepunishedfortheothercrime(s)aswellasforthecrimeofdomesticviolence,andmaybeprosecutedforeachcrimeseparately.SECTIONIII.UponapprovaloftheCityAttorney,theCityClerkisauthorizedtodirectthecodifiertomakenecessarycorrectionstothisordinance,includingthecorrectionsofscrivenersorclericalerrors;referencestootherlocal,state,orfederallaws,codes,rules,orregulations;orordinancenumberingandsection/subsectionnumberingandreferences.TheCityClerkisfurtherauthorizedtodirectthecodifiertoupdateanychapter,section,orsubsectiontitlesintheRentonMunicipalCodeaffectedbythisordinance.3
ORDINANCENO.6109SECTIONIV.Ifanysection,subsection,sentence,clause,phrase,orwordofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtofcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phrase,orwordofthisordinance.SECTIONV.ThisordinanceshallbeinfullforceandeffectJune1,2023.PASSEDBYTHECITYCOUNCILthis24thdayofApril2023.APPROVEDBYTHEMAYORthis24thApprovedastoform:ShaneMoloney,CityAttorneyDateofPublication:4-27-2023SummaryORD-PD:2255:3/13/23dayofpril2023.4

Hello, I am authorizing the correction of the following scrivener’s errors identified in Ordinance No.
6109 which was recently submitted for codification. See below:
It’s come to our attention that in Section II of Ordinance 6109, there is a scrivener’s error within in the
numbering of the subsections for Chapter 6-33. The second occurrence of 6-33-2: Exposing Minor
Child to Domestic Violence should be numbered 6-33-3; and 6-33-3: Nonmerger of Domestic Violence
Crimes should therefore be numbered 6-33-4.
Additionally, this error occurs again within the text of the ordinance.
Please correct the numbering as referred above. Please let me know if you have any questions. Thank
