It was pointed out there will be landscaping along the Creek with a review of the tree types to be used; the level area adjacent to the pathway will be planted in grass with the banks in rye grass; the area will contain sprinklers. Mr. Blaylock stated the requested modification is appropriate for the site and staff would recommend approval subject to the applicant fulfilling four (4) conditions. The conditions imposed would be the modification of the on-site play area to a passive picnic area with a minimum of three picnic tables, the addition of five benches, !ry maintenance of the public recreational area until six months after the landscaping has been installed and the installation of an,. . ._. underground sprinkler system separate from the main system which, Orillia Limited Partnership SA-044-86 August 8, 1986 Page 3 will be maintained by the applicant on the site. He had no further comments. The Examiner called for testimony from the applicant or their representative. Responding for the applicant was Douglas Gardner, 201 Elliott Avenue West, Suite, #400, Seattle, Washington, 98119. Mr. Gardner discussed the underground water system stating previously he had discussed a water system with the Parks Department and was not informed of the need for an underground system. He requested Roger Blaylock to point out what area was to contain the separate system. He said a new set of plans will be submitted to the City showing the changes requested in this modification. He stated the reason for the modification to the plans and said they now will have more parking; there is perimeter landscaping on adjacent properties all around the property; and stated the setback would be no problem, and if need be another lot line adjustment could be accomplished. He said the building could be moved if necessary to meet the setback requirements. The Examiner clarified the irrigation system, and Mr. Blaylock reported there will be a 12 ft. pathway, 3 ft. cinder trail, and approximately 40 ft. of landscaping; no irrigation system will be provided for the rye grass, but the area immediately under the trees would have to be irrigated. Mr. Gardner acknowledged this was his understanding of the proposed irrigation system. There was no one else wishing to testify in support of this proposal. There was no one wishing to testify in opposition to the proposal, and no further comments were offered by staff. The hearing closed at 9:50 A.M. FINDINGS. CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1. The applicant, Orillia Limited Partnership, filed a request for approval of a site plan which modifies a previously approved site plan. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3 . The Environmental Review Committee (ERC) , the City's responsible official issued a declaration of non-significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. Orillia Limited Partnership SA-044-86 August 8, 1986 Page 4 6. The subject site is located on the north side of the 900 block of S.W. 39th Street. The subject site is just west of Lind Avenue S.W. 7. The site was annexed into the City in April, 1959 with the adoption of Ordinance 1745, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961, respectively. The site was rezoned in December, 1969 with the adoption of Ordinance 2533. A site plan was approved in February, 1986. 8. The site is currently zoned M-P. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Manufacturing Park/Multiple Option uses, but does not mandate such development without consideration of other policies of the plan. 9. The original plan contained two buildings. A lot line adjustment was approved which modified the property line of the subject site. The easterly portion of the original plan, Building Eleven, will not be modified by the current request. The request is to reduce the size of the required on-site recreation area for Building Twelve from 1 acre to approximately . 67 acres, while developing and improving the adjacent pubic right-of-way along Springbrook Creek. 10. The general building design and placement of the buildings on the two lots will not change, although it appears as a result of the lot line adjustment that there may be insufficient setback between Building Twelve and its northerly lot line. 11. The applicant proposes more active on-site recreation. The applicant proposes a jogging exercise station, a children's play area, and a passive sitting area. These amenities would be located on the subject site. The applicant proposes to maintain the basketball court proposed for the adjacent lot associated with Building Twelve. Staff has suggested that a child's play area may not be appropriate for the resident population in the valley. The area will serve mainly employees and there will be few children present. Additional on-site seating and picnic areas were proposed as an alternative. 12 . In addition, the applicant proposes landscaping and developing approximately 2,300 lineal feet along the creek. It would contain the 12 foot wide pathway to meet the original ERC requirements and a newly proposed 3 foot wide cinder jogging path. To supplement the landscaping along this frontage, the applicant proposes, in place of the smaller on-site recreation area, the planting of 84 additional trees consisting of: 51 northern Red oaks (2" caliper/12 to 15 feet tall) ; 15 Scotch pines (6 to 8 feet) ; and 30 Douglas fir (6 to 8 feet) . The applicant agreed to install an irrigation system to irrigate the landscaped areas. 14. The applicant was to provide 2 benches. Staff and the applicant agreed that 5 benches interspersed along 2,300 feet would be more appropriate. CONCLUSIONS 1. The proposed modification to the approved site plan appears to serve the public use and interest. While the additional open space on the site would be preferable to more asphalt and land dedicated to parking, the proposed improvements to the public right-of-way present a reasonable balance in this project. 2 . The addition to the lineal landscaping of 84 additional trees will make the banks of Springbrook Creek more park-like. The subject site's setting immediately adjacent to the creek allows the site to take advantage of the amenity and more or less bask in its reflected beauty, hopefully. 3 . With the incorporation of the following staff suggestions - the additional benches, the irrigation system, and the substitution of additional seating and picnic space for the play area, the project as a whole serves the public. DECISION The site plan is approved subject to the following conditions: 1. Modification of the Children's Play area to a picnic area containing at least 3 picnic tables. 2. With the approval of the Parks Department, the installation of 5 benches within the Springbrook Creek public right-of-way. 3. With the approval of the Parks Department, the installation of an irrigation system for the Springbrook public right-of-way. 4. Maintenance by the applicant of the new landscaping for one growing season after its complete installation. 5. The provision of the appropriate setbacks along all property lines. The Environmental Review Committee has issued a memorandum of concurrence dealing with the application since it is within the scope of the original environmental determination issued under ECF-124-85 on January 8, 1986. 3. The subject site is a result of the modification of the original lot by lot line adjustment, LLA-004-86. The new lot consisting of 4.4 acres would allow the construction of a 59,300 square foot two-story tilt-up concrete building identical to the one originally proposed in the previous site plan along with parking for 368 motor vehicles. The access circulation is not modified from that originally approved by the Hearing Examiner dated February 5, 1986. The proposal complies with the dimensional and numerical requirements of the Parking and Loading Ordinance as revised. In fact, 6.2 parking spaces are provided for every 1,000 square feet of building. A larger building could have been constructed on the site. • 5. The applicant proposes intensifing on-site recreation by constructing (1) a jogging exercise station, (2) a play area, and (3) a passive sitting area. A basketball court will be located on the adjacent lot to the east which was part of the original two building complex design. 6. Previous off-site environmental recreational requirements: Pathway: The applicant will also include the construction of approximately 2,300 lineal feet of a 12 foot wide asphalt pathway along Springbrook Creek as required by the Environmental Review Committee in their decision of January 8, 1986. The applicant is proposing adding a three foot wide cinder path on the channel side of the asphalt walkway for joggers from the industrial complex. Benches: The original ERC decision required the placement of two benches per the approval of the Parks Department. The applicant is proposing placing the passive sitting area on their own site adjacent to the proposed play area. The landscape plan would basically consist of: • Fifty-one (51) Northern Red Oaks would be spaced approximately 40 feet on center to create the general theme along Springbrook Creek. These two inch caliber deciduous trees will be approximately 12 to 15 feet tall at the time of planting. • Fifteen (15) Scotch Pines approximately six to eight feet in height along with.. • Thirty (30) six to eight foot tall Douglas Firs would be interspersed with the decidious trees. In addition, the applicant is proposing that the level area adjacent to the pathway will be planted in grass, while the bank area will be hydroseeded with rye grass seed. 6. Landscape Maintenance/Sprinklers: The grassed area adjacent to the walkway will have to be maintained for approximately four to five mowings before the Parks Department will take over the maintenance. The formal lawn areas will have to sprinklered which will assure that the grass and trees will receive sufficient water for growth. The Parks Department and the City's landscape architect agree that the proposal is appropriate for the subject site. 7. The proposal appears to be a reasonable modification of the previous approval because it allows the installation of a completely landscaped public recreational area along Springbrook Creek. Normally the modification of land use decision by reducing city or environmental standards or requirements shoulg only be consider if it is clearly in the "public's benefit". The full installation of a public recreational areas is definitely of "public benefit". The public has acquired actual improvements without the expenditure of public funds. 8. The proposal appears overbalanced in favor of the active recreational needs of the employees. Only two benches are provided on-site and none are provided off-site in the public recreational area. A pathway in excess of 2300 feet is proposed without any areas to sit and enjoy the wildlife inhabiting the drainage channel. Even if five (5) benches were evenly placed they would still be approximately a city block apart. The Parks Department has verbally suggested that the passive on-site recreational areas should be supplimented with picnic tables. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner approve the requested site plan modification, File Number SA-044-86, by Orillia Limited Partnership, subject to the following conditions: 1. Modification of the proposed on-site "Play Area" to a passive picnic area consisting of a mininum of three (3) picnic tables. 2. The addition of five (5) benches to be approved by the Parks Department along the public pathway. 3. Maintence of the public recreational area until July 1, 1987. 4. Installation of an underground sprinkler system to City Standards that is separate from the subject properties sprinkler system and can be maintained separately by the Parks and Recreation Department. The modifications will reduce the recreational area from one acre to 0.67 acre. To replace this area, Orillia will construct a 12 foot wide paved roadway for fire access and pedestrians.
