LUA 99-053). WHEREAS, under Section 4.2.020 of Chapter 2, Land Use Districts, of Title 4 (Development Regulations), of Ordinance No. 4260 known as the "Code of General Ordinances of the City of Renton," as amended, and the maps and reports adopted in conjunction therewith, the property hereinbelow described has heretofore been zoned as Residential-8 DU/AC (R-8); and WHEREAS, the City of Renton initiated a proceeding for change of zone classification of said property. This matter was duly referred to the Planning Commission for investigation, study, and public hearing, and a public hearing having been held thereon on or about July 14, 1999, and said matter having been duly considered by the Planning Commission, and said zoning request being in conformity with the City's Comprehensive Plan, as amended by Ordinance No. 47 9 6 and the City Council having duly considered all matters relevant thereto, and all parties having been heard appearing in support thereof or in opposition thereto; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Th• applicant is requesting the Residential Options/R-10 zoning to allow transfer of some of the potential from the areas with coal mine hazards to the buildable portions of the site. Coal mine hazards are not a-ducted from buildable area under the City's current net density formula. As a result the site has a th,oretical density which can not be realized in practical application. The attached unit types would b needed to realize this density. The R-10 zoning allows attached units in clusters up to fourplex-s for 50%of the units in a project and as a result density is easier to achieve.(Policies LU-53, LU-54) While this is not a development application, the applicant has submitted a project concept narrative which describes approximately 36 units of detached and attached housing. The R-10 zoning will require that at least 18 units be detached. The applicant estimates that without the rezone, the R-8 portion could only be developed with 14 detached units. The rezone would allow development of 22 units in this same area: 11 detached and 11 attached. In addition, all of the units could be located any place on the site. The difference in the two scenarios is as follows. With R-10 zoning the modeled capacity only increases by 2 units to 32 units. The numbers in the theoretical model are different from the developer's estimate of capacity because the City formula assumes environmental, right-of— way , vacancy factor and public facilities discounts to calculate a net density estimate. For any particular site the actual capacity and theoretical capacity will vary depending on how well site conditions match the city's assumptions. In this case the developer's estimate of the actual density which can be realiz d matches the City's theoretical assumptions fairly well, but the developer's estimate of theore ical net capacity (48 units, 38 on R-10 portion and 30 on R-8 portion) is higher than the City's estim te. City theoretical capacity with R-8/R-10 zoning is 30 units ( 13 in R-8, 17 in R-10)(34 with bonus). COMP' HENSIVE PLAN COMPLIANCE In order to re-designate the 4.8 acre site to Residential Options, the site must comply with at least three of the following criteria. Policy LV-50. Residential neighborhoods may be considered for the Residential Options Designation if they m et three of the following criteria: a. e area already has a mix of small scale multi-family units or had long standing duplex or low d sity multi-family zoning; b. D velopment patterns are established. c. V cant lots exist or parcels have redevelopment potential. d. F w new roads or major utility upgrades will be needed with future development. e. e site is located adjacent to a Center designation. In this c se the site complies with criteria "c". in that the parcel is developed with only one house on 9.8 acre . Criteria "d" is met because the property has access from an existing dedicated easement. Criteria `e"is met because the parcel is located adjacent to the Benson Center. While this Center is in the unincorporated area it is mapped in the city's Comprehensive Plan. Properties around the Center are mapped R-10. Objecti e EN-P sets the goal of returning coal mine sites to productive use, and Policy EN-81 support allowing uses on these sites provided hazards are appropriately addressed. ZONII4G CONCURRENCY No zoning text amendments are required for this application. CONCLUSION Staff supports this application because the Residential Options land use provides a viable opportunity to achieve the expected density for the site. The total number of units that would be allowed is a modes increase over the allowed density with the existing zoning. The theoretical capacity difference is 2 un ts, the developer's estimate is 6 units. The bonus available under the R-10 zoning would allow a mor significant difference, but the requirement of 100 percent detached housing makes the bonus unlike on this site. The more important difference between the proposal and existing zoning is not densi but unit types. The additional attached units are justified at this location due to the proximity of the Center. The Residential Options Designation is intended to allow a transition of density and uses from the more intense Centers to the surrounding single family areas. The proposed mix of attached and detached unit types is an appropriate way to provide this transition. Sincere , rtildalz/ J Woods WOODS REZONE ATTACHMENT B PROJECT NARRATIVE This is a proposal to rezone the westerly 4.8 acres of a 9.6 acre parcel from R-8 to R-10. The easterly half is currently zoned R-10. There is one single family residence on the part currently zoned R-10. There are extensive coal mines under the property which have shown evidence of subsidence in the past and severely affect its usability. The easterly portion that is zoned R-10 has a potential density of about 38 units but impacts from the mine workings will reduce the units to 12 or 14 units at the most. The westerly 4.8 acres which is proposed for rezone has a theoretical density of about 30 units but with mine impacts, and the fact that this is the lower part of the property and would be the only suitable area for storm detention, the actual number of units that could be built is around 14. This rezone would allow this density to be increased to about 22 units, which is less than would be possible under the current zoning were it not for the coal mine hazard. The density for the entire 9.8 acre parcel, with the rezone, would be about half what could be achieved under current zoning without the mine hazard. The property to the west and south is mixed zoning of R-8 and R-10, and is currently vacant, and due to steep slopes and potential wetland and mine hazards would make it a candidate for rezone to a higher density in the future. A. This rezone would allow a single parcel to have a single rather than split zoning. And would allow it to be built with a mixture of single family and attached housing at overall lower density than what would be available with the current split zone were it not for mine impacts. B. The rezone addresses the reduced usability of the property as a result of circumstance not know at the time the zoning was placed. C. The rezone is compatible with Comp plan goals as the overall density will be less than what was envisioned when the current zoning was placed. D. The proposed zoning would allow a mixture of detached and attached housing. The unusable portion of the property would create a buffer zone between new and existing houses. E. The overall impact to community facilities will be less than what the original zoning could allow. F. The proposed zoning would allow the property to be developed in accordance with current development guidelines. Staff Recommendation 05/13/99 ATTACHMENT C ADDITIONAL COMPREHENSIVE PLAN POLICIES Land Use Policies Policy LU-51. The net development densities should be 10 dwelling units per acre. If 100% of the dwelling units are detached, a density bonus may be allowed to a maximum of 13 dwelling units per acre. Policy LU-53. Detached single family housing,townhouses, and small scale multi-family units should be allowed in Residential Options. Policy LU-54. A maximum of 50% of units allowed within an individual RO development may consist of attached units which includes townhouses, and small scale multi-family units. Policy LU-55. Development in Residential Options should be compatible with existing development patterns and be sensitive to unique features and differences among established neighborhoods. Development standards should reflect single family neighborhood characteristics such as ground related orientation, coordinated structural design, and private yards. Environmental Policies Objective EN-P: Reduce the potential for damage to life and property due to abandoned coal mines, and return this land to productive uses. Policy EN-81. Allow land uses to locate in coal mine hazard areas,provided the hazards are precisely located and all significant hazards associated with the mines are eliminated,making the site as safe as a site which has not been previously mined. The easterly half is currently zoned R-10. There is one single family residence on the part currently zoned R-10. There are extensive coal mines under the property which have shown evidence of subsidence in the past and severely affect its usability. The easterly portion that is zoned R-10 has a potential density of about 38 units but impacts from the mine workings will reduce the units to 12 or 14 units at the most. The westerly 4.8 acres which is proposed for rezone has a theoretical density of about 30 units but with mine impacts, and the fact that this is the lower part of the property and would be the only suitable area for storm detention, the actual number of units that could be built is around 14. This rezone would allow this density to be increased to about 22 units, which is less than would be possible under the current zoning were it not for the coal mine hazard. The density for the entire 9.8 acre parcel, with the rezone, would be about half what could be achieved under current zoning without the mine hazard. The property to the west and south is mixed zoning of R-8 and R-10, and is currently vacant, and due to steep slopes and potential wetland and mine hazards would make it a candidate for rezone to a higher density in the future. A. This rezone would allow a single parcel to have a single rather than split zoning. And would allow it to be built with a mixture of single family and attached housing at overall lower density than what would be available with the current split zone were it not for mine impacts. B. The rezone addresses the reduced usability of the property as a result of circumstance not know at the time the zoning was placed. C. The rezone is compatible with Comp plan goals as the overall density will be less than what was envisioned when the current zoning was placed. D. The proposed zoning would allow a mixture of detached and attached housing. The unusable portion of the property would create a buffer zone between new and existing houses. E. The overall impact to community facilities will be less than what the original zoning could allow. F. The proposed zoning would allow the property to be developed in accordance with current development guidelines.
