I have had discussions with Mr. Lloyd and Mr. Cugini over the past several months,indicating that such an extension would be unlikely. Your decision(issued January 28, 1999) states under Condition No. 5: "This permit shall expire either upon revocation of the U.S. Army Corps of Engineers' permit or five years from the date of approval,whichever occurs first." I apologize that I did not forward this letter to you sooner. I mistakenly thought that I could issue the letter responding to the request. MAY 6 2000200MillAvenueSouth Renton, Washington 98055 RECEIVED RE: Barbee Mill Company Dredging Permit Extension Request Dear Ms. Henning: Since completing a portion of the dredging in the fall of 1999, dredging for bark and wood debris in Lake Washington has been postponed to coordinate our efforts with the Endangered Species Act even though we had secured all necessary permits. Because of the regulatory delay we are requesting an extension to our existing permit from the City of Renton. The Barbee Mill Company was requested to complete a Biological Assessment and to coordinate with the National Marine Fisheries Service (letter from USACE to Barbee Mill Company, 1/21/00). A biological assessment was completed in the spring of 2000 to follow up on our baseline habitat studies that go back several years. This assessment was submitted to Ms. Cindy Barber of the USACE in May of 2000. According to our records, the Biological Assessment and related paperwork was submitted to the National Marine Fisheries Service (NMFS) by USACE on 12/27/00. It does not appear that NMFS will be able to provide a timely review and consultation to allow for work to be conducted this summer. It is our understanding that the consultation has not yet been assigned to staff for review. At this time we have no indication how long it will take NMFS to complete its task. The measures are as follows: a. The bottom of the Temporary Storage Area (TSA) for dredged materials should be checked before each season of use to ensure that it allows free-draining infiltration. Periodic checks during operation, as the bark/wood debris is removed, should also be made to ensure that the free-draining nature is maintained. b. The berms of the TSA should be maintained at the current 2:1 slope angle. Berms should be repaired when damaged by equipment transit, using free-draining medium to coarse sands, gravel and cobble materials. In no case should the berms consist of fine sands and silts. c. The water quality of waters discharging from the TSA should be periodically checked, to ensure that the adequate filtering by the infiltration zone has occurred. d. Silt fencing should be constructed around the perimeter of the TSA, in non-access areas, to limit the transport of silt to the lake. These will also serve to limit erosion of the base of the berms. e. Configuration of the TSA and the surrounding area must be maintained so that there is no access of May Creek stormwater into the TSA. This review has been undertaken to evaluate adequacy of measures being taken to protect the environment during planned dredging activities in 1999 and beyond. The current TSA is understood to have been used during previous dredging programs at the Barbee Mills Site, for the protection of the shoreline environment. Future dredging programs are for the purpose of continuing the current shoreline protection. This engineering review is based on reports and other materials provided by Lloyd & Associates, Inc.. It is assumed that the information provided in those documents is factual and truly represents the current conditions and the planned dredging program. A listing of the reports reviewed is contained in Attachment A. The information provided by Lloyd & Associates was reviewed with respect to the following issues: Sufficiency of the TSA sufficient for the purpose of de-watering the anticipated volumes of dredged materials Measures to be taken to maintain the effectiveness and integrity of the TSA Measures that will minimize any risk of unanticipated discharges from the TSA to Lake Washington Review of the provided documentation indicates the following with respect to the TSA and dredging program: The TSA is intended for de-watering, through infiltration, of dredged materials from the near-shore areas. It is not intended to have any other use during the lifetime of the dredging program The TSA has been constructed as shown in drawings provided to the City of Renton, with 2:1 (H:V) side — slope angles. The storage area is understood to have been constructed from onsite fine to medium grained silty sands and gravels The storage area is re-seeded and maintained while not in use for de- watering (between periods of permitted dredging) Dredged materials will be placed in the TSA for de-watering to a level that maintains several feet of freeboard between the placed dredge materials and the top of the perimeter berm (to prevent uncontrolled release over the berm top) The configuration of the TSA is adequate, provided the above-mentioned freeboard is maintained, for containment and gradual release through infiltration of the 25 year / 24 hour storm-water event. This is predicated on the assumption that the TSA need only deal with storm-water collected inside the TSA perimeter Periodic removal of de-watered bark and wood debris will be effected with a loader, and then trucked to upland areas for further offsite disposal Dredging is intended to remove only bark, wood debris and intermingled silt/sand from the offshore areas. The applicant requests approval of a special permit for grading and filling operations that would allow them to dredge approximately 10,000 cubic yards of bark,wood debris and some sediment from the log boom area in Lake Barbee Mill Company Barbee Mill Dredging File No.: LUA-99-058,SP,SM June 28, 1999 Page 2 Washington for an approximate 5 year period of time. This is an extension of an existing permit with a different time frame and for a larger quantity of material. The project site is located in the Kennydale area of the City adjacent to Lake Washington. In January 1998 applicant was granted a special permit to dredge both the mouth of May Creek for flood control purposes and also to remove about 200 cubic yards of wood debris from the bulkhead area. Because of the large amount to be dredged,the applicant was required to apply for this separate permit. The applicant also has a three-year permit from the Army Corps of Engineers to dredge this site. The applicant intends to commence dredging during this summer if approved. The area of the work to be done is 5.8 acres in size and parallels the lake shore. A barge-mounted clam-shell dredge will be used. The material will be transferred to a temporary storage area along the lake. The storage area will have a berm surrounding it,thus preventing the material from getting back into the lake or May Creek. The intent for the dewatered material is to mill it or chip it and create a soil amendment from it. The height of the temporary storage area would not exceed 15 feet above grade and would cover about 1,800 square yards. In order to control erosion of the wood waste and the sediment back into the lake,the applicant is proposing to install a silt curtain if needed and control the runoff from dewatering and storm events with vegetative cover. As part of the prior permitting effort, fish habitat studies were accomplished which indicated that the fish habitat in the log boom area are currently very low. The wood waste is essentially creating an anaerobic environment for the fish. There is prime fish habitat south of May Creek and the State Department of Fish& Wildlife has historically restricted the dredging on this portion of the lake,and dredging may occur only after July 15 and before April 14 of each year. The Environmental Review Committee(ERC)issued a Determination of Non-Significance-Mitigated with one mitigation measure,which is to implement proper erosion and sedimentation control measures. This project is expected to transport 10,000 cubic yards of material with an average of 1 to 2 trucks per day hauling via I-405. A total of about 167 round trip truck trips would be expected to occur in each of the three seasons before the permit expires with the Army Corps of Engineers. The noise generated from the dredging is not expected to exceed the noise levels from the existing sawmill operation. Staff recommended approval of the special permit,subject to the following conditions: (1)compliance with the ERC's mitigation measure. (2)The dredging spoils may be stored in the temporary storage area for no more than six months from the date that the dredging is complete. The applicant shall provide the City with the date that the maintenance dredging is started and completed and the date by which the dredging spoils are to be removed each year that it is necessary to complete the maintenance dredging. (3)The temporary storage area where the spoils are dewatered shall be hydroseeded within two weeks of the removal of the dredge spoils. In the event that this occurs when hydroseeding is not effective,the applicant will need to provide some other type of erosion control measure. (4)The applicant shall be responsible for the maintenance and survival of vegetation in the temporary storage area. (5) The permit shall expire either upon revocation of the Army Corps of Engineer's permit or five years from the date of approval,whichever occurs first. Mike Lloyd,38210 SE 92nd, Snoqualmie, Washington 98065, applicant representative herein, stated that one of the primary purposes of this project is to restore the lake bed. The bark and wood debris is oxygen- consuming and it is believed that removing this material will have a substantial environmental benefit. He further stated that the applicant would abide by the Department of Fish&Wildlife's dates for dredging of this area. It was also pointed out that the 10,000 cubic yards projected to be removed is the upper range. He further explained the process of the actual dredging. There was no one else wishing to speak,and no further comments from staff. The hearing closed at 9:40 a.m. FINDINGS.CONCLUSIONS & DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1.The applicant, Barbee Mill Company,filed a request for approval of a Special Permit for dredging in Lake Washington. 2.The yellow file containing the staff report,the State Environmental Policy Act(SEPA) documentation and other pertinent materials was entered into the record as Exhibit#1. 3.The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance-Mitigated(DNS-M)for the subject proposal. 4.The subject proposal was reviewed by all departments with an interest in the matter. 5.The subject site is located at 4101 Lake Washington Boulevard. The location of the operation is just off shore of the site,north of the mouth of May Creek. This is the log boom area where logs float in the lake along the shoreline. May Creek flows southwest across the site. 6.The subject site is occupied by a lumber mill which straddles May Creek. 7.The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of office and residential center,but does not mandate such development without consideration of other policies of the Plan. 8.The subject site is zoned COR(Center: Office/Residential)a zoning category applied in June 1993 with the enactment of Ordinance 4404. 9.The subject site has an existing permit to dredge in the May Creek area and do minor dredging in the log boom area. The Army Corps of Engineers has granted an expanded permit to dredge approximately 12,000 cubic yards of material from within the lake itself. This Corps permit would expire on November 25,2001 unless revoked or extended by them. 10. As indicated,this site was reviewed for a previously approved permit. There have been few, if any, changes to the area. 11. The area covered by the permit is approximately 5.8 acres or 250,000 square feet. It follows approximately 800 linear feet along the shoreline and extends out into the lake approximately 340 feet. The material that would be dredged ranges up to approximately 4(four)feet thick. 12. As with the other materials the applicant has dredged from the creek and lake,they will be dewatered. This dewatering will occur just to the north of the mouth of the creek where these operations have occurred under the other permits. The area would be approximately 5,000 square feet and bermed. Water will drain from the materials back into the lake. This area will provide temporary storage while water drains from the materials. If the materials are not immediately sold they will be stockpiled away from the shoreline. Erosion control measures will be required to prevent the materials from either running or blowing back into the creek or the lake. 14. If the materials are not sold in a reasonable period of time,upland storage will be required. The current application does not envision reuse of these wood debris products on this site. 15. State review will occur and appropriate timing to avoid interference with fish spawning will be monitored. 16. The export of the materials from the site would require approximately 500 round trips. The applicant and staff estimate this will add approximately one or two(1 or 2)additional trips over those now permitted by other dredge operations. If the applicant attempts to remove all of the materials in 3 seasons,there would be approximately 167 trips per year. 17. Traffic flow will follow the same route used by the logging trucks that serve the subject site. Exiting trucks would turn left to gain quick access to I-405. The reverse route will provide access to the site. Staff does not anticipate adverse impacts on traffic flow from these trips. 18. The wood debris consumes oxygen as it decays. This can deprive aquatic life of oxygen resources needed to create a productive shoreline environment. 19. Materials testing in the past have demonstrated that the materials that will be excavated are acceptable and show no significant levels of contamination. There are some low levels of hydrocarbons and diesels. Additional sampling of materials will be accomplished as necessary. Most sites that accept materials also require the materials to be tested. 20. All operations will be monitored by appropriate state and federal agencies to assure that fisheries are not interfered with and water quality is maintained. CONCLUSIONS: 1.The proposed dredging operation appears to serve the public use and interest. The accretion of woody debris is the result of the applicant's surface log booms. Bark and other woody material drop off the floating logs. The slow decay of this material in that area robs the water of oxygen thereby making the area a less hospitable habitat for salmon and other native aquatic life. The removal of the materials will help restore the natural environment in this area of the lake. 2.A number of permits and agencies will be involved in reviewing and approving the time and nature of the operations. That should ensure that all work is done in a responsible manner and the environment is protected and not further degraded. All operations will remain subject to review by agencies with appropriate jurisdiction and expertise. 3.While only a small amount of these materials have been removed under existing permits, it appears that the actual dredging operations have not generated any problems in the way of traffic,contamination or noise. Since the larger operations have not caused any particular problems,this modest increase in material export should not create any new problems. Although in this case more of the lake bed or sediments on that bed will be stirred up, it is not anticipated that this new work will create any long term deleterious affects. 4.This permit appears to be similar enough including the stockpiling of materials. Therefore,the prior limitations should be sufficient to govern this work. While it appears that much less material shall be recovered,the conditions still can be imposed to avoid any confusions between the various permits now Barbee Mill Company Barbee Mill Dredging File No.: LUA-99-058,SP,SM June 28, 1999 Page 5 applicable to dredging near and around this site. Those conditions were that the materials will have to be removed from the subject site within a reasonable time.The previous limitations of not more than two years' worth of dredge materials seems to have worked and shall be continued. Prior to the start of any third sequence,the materials accumulated by any two prior dredge-dewatering-storage operations shall be removed permanently from the applicant's property. 5.The other previous conditions regarding the temporary storage of the materials on the site in a location that is at least 200 feet from the outer edge of any landscaping located along May Creek or the shoreline of Lake Washington are still appropriate. 6.Any storage or placement of materials on the site that results in any permanent or topographical changes of the applicant's property shall be subject to separate review under the Mining,Excavation and Grading Ordinance. 7.The conditions recommended by staff are appropriate given the sensitive nature and location of the subject site. 8.The size and intensity of the operation and restoration efforts appear appropriate given the nature of the site and its current uses. The additional truck traffic will not unnecessarily burden the adjoining streets. DECISION: The Special Permit for Grade and Fill is approved subject to the following conditions: 1.The applicant shall comply with the ERC mitigation measures prior to the commencement of grading activity. 2.The dredging spoils may be stored in the temporary storage area described in the permit for no more than six months from the date that the dredging is completed. The applicant shall provide the City with the date that the maintenance dredging is started and completed,and the date by which the dredging spoils are to be removed each year that it is necessary to complete the maintenance dredging. 3.The temporary storage area where dredge spoils are dewatered shall be hydrodeeded within two weeks of the removal of the dredge spoils. In the event that this occurs during a time period when hydroseeding is not effective,the applicant shall provide other erosion control measures to the satisfaction of the Development Services Division. The applicant shall inform the Development Services Division in writing why the hydroseeding is being delayed and what temporary erosion control measures will be performed,and when hydroseeding will be conducted. 4.The applicant shall be responsible for the maintenance and survival of the vegetation in the temporary storage area in order to prevent wind or hydraulic erosion during those years in which no dredging occurs. 5.This permit shall expire either upon revocation of the U.S. Army Corps of Engineers' permit or five years from the date of approval,whichever occurs first. Prior to the start of any third sequence,the materials accumulated by any two prior dredge-dewatering-storage operations shall be removed permanently from the applicant's property. 7.The applicant shall be permitted to temporarily store spoil materials on the site in a location that is at least 200 feet from the outer edge of any landscaping and along May Creek or the shoreline of Lake Washington. 8.The applicant shall complete the installation of all required landscaping within this calendar year. 9.Any storage or placement of materials on the site that results in permanent or topographical changes to any part of the applicant's property shall be subject to separate review under the Mining,Excavation and Grading Ordinance. 10. Approximately 2,000 cubic yards of material would be dredged each year for five years. In late 1997, Barbee Mill was granted a special permit to dredge the mouth of May Creek and to remove approximately 200 cubic yards of wood waste from Lake Washington each year for 5 years. Recently, the existing dredging permit with the Army Corps of Engineers was amended to permit the removal of an additional 12,000 cubic yards of material from the lake bottom in front of the sawmill. However, the Corps Permit expires on November 25, 2001, unless revoked or specifically further extended. The five-year approval granted by the Corps commenced with the authorization granted by the Secretary of the Army on November 25, 1996. Dredging is proposed to commence during the summer of 1999 and would be accomplished in the log boom area in order to maintain adequate depths for navigational purposes. The area of work is approximately 5.8 acres in size and parallels the lake shore for approximately 800 lineal feet. Removal of the wood waste would be accomplished with a barge-mounted clamshell dredge. Dredge material would be transferred to a temporary storage area for dewatering. The temporary dredge storage area has been designed to accommodate dewatering, while minimizing run-off to Lake Washington. The temporary dredge storage areas, dredging procedure, drainage control measures, dredged spoils handling, and measure to minimize environmental impacts have been previously considered and approved under land use File No. LUA-98-156,SP,ECF. Sampling of previously dredged material has demonstrated that the spoils are free of contaminants. The maximum height of the dredge spoils during dredging operations in the temporary storage area, adjacent to the shoreline would not exceed 15 feet above grade. Immediately following dewatering, the dredge material would be moved upland away from the shoreline for handlinc and off-site transport. The applicant has indicated that the wood debris would be milled/chippec and soil as a soil amendment. Measures inherent in the proposal to prevent erosion of the wood waste and sediments into LakE Washington include construction of a temporary dredge spoil area, installation of a silt curtain and control of runoff from dewatering and storm events with vegetative cover. The temporar dredge storage area would be used to hold sediments during dewatering. The dredge storag area plus berm is estimated to cover approximately 1,800 square yards. The interior flat portio of the dredge storage area would be about 1 to 2 feet above the ordinary high water linE approximating a natural grade. All bermed slopes would be less than a 2:1 grade and re-seede with grass and vegetation to minimize erosion from storms. The storage areas would conta' sufficient area to contain the dredge material, and stormwater runoff from a 100-year 24-ho' event Studies conducted for the 1997 permitting action, indicate that prime fish habitat exists south May Creek, but that fish habitat in the area proposed for dredging is of low quality. State F and Wildlife has historically restricted dredging on this portion of Lake Washington to occur o between July 16 and April 14th. Dredging would not be allowed during those times when adve impacts to fish habitat could occur. 2.ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 amended), on May 4, 1999 the Environmental Review Committee issued a Determination f Non-Significance— Mitigated (DNS-M). A 14-day appeal period commenced on May 10, 1999 and ended on May 24, 1999. No appeals of the environmental determination were filed. The applicant is required to comply with the following mitigation measure: 1. The applicant shall implement erosion and sedimentation control measures as proposed in the drainage report submitted with the project application. 4.STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5.CONSISTENCY WITH SPECIAL PERMIT FOR DREDGING CRITERIA: In order to grant a special permit, the Hearing Examiner shall make a determination that the activity would not be unreasonably detrimental to the surrounding area. The Hearing Examiner shall consider, but not be limited to, the following: GENERAL CRITERIA A. SIZE AND LOCATION OF THE ACTIVITY The project site is located on the west shore of Lake Washington, in the lake in front of the, Barbee Mill property. The applicant is seeking a five-year special permit for grade and fill than would allow the removal of up to 2,000 cubic yards of wood bark and wood debris each yer from Lake Washington. The applicant was previously granted a special permit for grade and in order to dredge up to 2,000 cubic yards of sediment from the mouth of May Creek and 2( cubic yards of bark per year for a five-year period. Since the applicant is proposing a maj increase in the quantity of dredged wood bark from that which was previously permitted, a of application is required. The dredge storage area plus berm will cover approximately 1,800 square yards. The inter flat portion of the dredge storage area would be about 1 to 2 feet above the ordinary high wa line, approximating a natural grade. All bermed slopes would be less than a 2:1 grade and i - seeded with grass and vegetation to minimize erosions from storms. The storage areas woiild contain sufficient area to contain the dredge material, and stormwater runoff from a 100-year ::4- hour event. B. TRAFFIC VOLUMES AND PATTERNS The applicant is limited to a total of 10,000 cubic yards of dredged wood debris over the life of this permit. Dredging of an additional 1,000 cubic yards of wood bark and wood debris v;as previously permitted, and that permit is still in effect. Since atypical truck can accommodate 20 cubic yards of material, it is expected that up to 500 additional round-trip truck trips would be generated over the life of the permit, or an average of an additional 100 round-trips annually. The Army Corps of Engineers has restricted the time frame in which the activity could be accomplished, and it is possible that the applicant would prefer an option that permits dredging of the 10,000 cubic yards prior to expiration of the Corps permit in November of 2001. If this course of action is followed, then approximately 167 round-trip truck trips would be expected to occur in each of the three seasons before the permit expires. The applicant has estimated that the number of truck trips currently generated by site activity is 50 to 100 per day. With the proposal, that number is expected to increase by one or two trips per day. Trucks would travel north on Lake Washington Boulevard and enter Interstate 405 via on-ramps at NE 44th Street. Trucks returning to the project site are expected to use the same travel route. Logging trucks from the sawmill presently follow this transportation route. The temporary increase in truck activity would be of a limited duration, and would not be expected to result in adverse impacts to the local or regional road network. C. SCREENING, LANDSCAPING, FENCIING AND SETBACKS No screening, landscaping, fencing or setbacks are required for the dredging portion of the project as it is located in Lake Washington. The dredge material will be temporarily stockpiled near the lake shore in order to dewater the spoils before chipping and transport off-site. The size of this area has been estimated to be about 1,800 square yards. A 5 to 7 foot high berm would surround the temporary storage area in order to contain the dredged material. The applicant would remove the dredge spoils from the temporary storage area to an upland location near May Creek after approximately one month. During dredging conducted in April of 1997, dredges material were moved concurrently with the dredging. After the dredged material is removed, the entire storage area would be re-seeded with grass to prevent wind-blown or hydraulic erosion. For the upland storage area, the applicant intends to use an area depicted on the drawings a the "Interim sand and gravel storage area" generally located on the eastern portion of the site adjacent to the railroad tracks and the Barbee Mill employee parking area. Temporary erosior control measures would be installed and maintained in accordance with City Code requirements D. UNSIGHTLINESS, NOISE, DUST Noise would occur associated with the dredging of the area and the removal of the dredge spoi after they are dewatered. These noise levels are not anticipated to exceed the noise levels the existing sawmill operation on the site. In addition, the noise would be of a limited duratio Noise from the proposed activity is not expected to have an adverse impact on adjace properties. It is anticipated that the temporary erosion control measures proposed by the applicant woui.l prevent dust from impacting surrounding areas. These measures include: placement of wet sediments behind berms to minimize off-site transport; cessation of operations in the event of fish distress, fish kill, or other water quality problems; placement of silt curtains to prevent movement of materials potentially eroded from the site to the adjacent water of La,;e Washington; and, no stockpiling of material in the water. 6. REUSE OF SITE Any redevelopment on this site would require the appropriate level of review by City staff. Cue to the size of the project site and the level of development that could occur here in the future, it is anticipated that a public hearing before the Hearing Examiner would be required. PERMIT EXPIRATION Staff recommends that the permit expire either upon revocation of the U.S. Army Corps of Engineers Permit or five (5) years from the date of approval, whichever occurs first. Furthermore, staff recommends that the special permit for grade and fill be conditioned such that the permit becomes null and void if the applicant has not begun the activity within six (6) months after the granting of the permit, unless the Hearing Examiner grants an extension of time. If the applicant can not obtain a window for the dredging from State and Federal agencies within six months of the date of approval of this permit, the applicant would need to inform the City in writing of the dates when dredging would occur. 9. REVOCATION OF PERMIT The Planning/Building/Public Works Department is authorized to revoke any annual license issued pursuant to the terms of the Grading, Excavation and Mining Regulations if after due investigation is determined that the permittee has violated any of the provisions of this Ordinance. Notice of revocation shall have reasonable time not to exceed forty-five (45) days in which to remedy the defects or omissions specified. In the event that the licensee fails or neglects to do so within the time period, the order of revocations shall be final. A total or partial stop work order may be issued for good reason. G. RECOMMENDATION: Staff recommends approval of the Barbee Mill Dredging, Project File No. LUA-99-058, SP, SM, ECF subject to the following conditions: 1) The applicant is required to comply with the Mitigation Measure, which was required by th Environmental Review Committee Threshold Determination prior to the commencement grading activity. 2) The dredging spoils may be stored in the temporary storage area described in the permit for more than six (6) months from the date that the dredging is completed. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. 1.Earth Impacts: The applicant seeks approval of a 5-year permit to dredge bark and wood debris from Lake Washington. The Special Permit for grade and fill would allow the applicant to dredge approximately 2,000 cubic yards of material each year over the life of the permit. In late 1997, Barbee Mill was granted a special permit to dredge the mouth of May Creek and to remove approximately 200 cubic yards of bark and wood waste from Lake Washington each year for 5 years. Recently, the existing dredging permit with the Army Corps of Engineers was amended to permit the removal of an additional 2,000 cubic yards of material annually from the lake bottom in front of the sawmill. Department of Ecology Department of Fish and Wildlife is expected to issue Hydraulic Permit Approval following completion of the City's SEPA process. Removal of the wood waste would be accomplished with a barge-mounted clamshell dredge. Dredge material would be transferred to a temporary storage area for dewatering. The temporary dredge storage area has been designed to accommodate dewatering, while minimizing run-off to Lake Washington. The temporary dredge storage areas, dredging procedure, drainage control measures, dredged spoil handling, and measures to minimize environmental impacts have been previously considered and approved under land use File No. LUA-97-156,SP,ECF. Previous soil sampling has demonstrated that the spoils are free of contaminants. The maximum height of the dredge spoils during dredging operations in the temporary storage area, adjacent to the shoreline would not exceed 15 feet above grade. Immediately following dewatering the dredge materials would be moved upland away from the immediate shoreline for handling and off-site transport. The applicant has indicated that the wood debris would be milled/chipped and sold as a soil amendment. Applicant has proposed measures to prevent erosion of the wood waste and sediments into Lake Washington. Construction of a temporary dredge spoil area, installation of a silt curtain/fence, and control of runoff from dewaterinc and storm events with vegetative cover. The temporary dredge storage area would be used to hold sediments durinc dewatering. The dredge storage area plus berm will cover approximately 1,800 square yards. The interior flat portior of the dredge storage area would be approximately 1 to 2 feet above the ordinary high water line, approximating a natural grade. All bermed slopes would be less than a 2:1 grade and re-seeded with grass and vegetation to minimiz erosion from storms. The storage areas will contain sufficient area to contain the dredge material, and stormwater runoff from a 100-year 24-hour event. Mitigation Measures: The applicant shall implement erosion and sedimentation control measures as proposed in the drainage report submitted with the project application. Nexus: Environmental (SEPA) Ordinance; Mining, Excavation and Grading Ordinance 2.Water Impacts: The proposed dredging in Lake Washington would increase turbidity of the lake during dredging activity an for a short time following disturbance. Previous consideration by the City's Environmental Review Committee discussed potential impacts to fish habitat in the vicinity of the project. Studies conducted in 1997 indicate that prin fish habitat exists south of May Creek, but that fish habitat in the area proposed for dredging is of low quality. The window for dredging activity is established and controlled by the Department of Fish and Wildlife. Dredging would ! :t be permitted during times when adverse impacts to fish habitat could occur. Bark and wood debris from log decking and storage has accumulated on the lakebed and should be removed. Removal of bark and wood debris from the lakebed will have a positive benefit on fisheries and shallow water habitat. The City of Renton has previously issued a Special Permit for Grade and Fill (Maintenance Dredging, 1997), as well as an exemption from the Shoreline Management Substantial Development Permit requirements for maintenance dredging at the site. A dredging permit has been obtained from the Corps of Engineers for this work. Dredging will be accomplished with a barge mounted clamshell dredge. Dredged materials will consist principally of bark,wood debris and some bottom sediment. As dredged, the spoils will be transferred to the temporary storage area for dewatering. The temporary dredge storage area was designed to accommodate dewatering, while minimizing run-off to Lake Washington. The temporary dredge storage area, dredging procedures, drainage control measures, dredged spoil handling, and measures to minimize environmental impacts have been previously considered and approved by the City of Renton. Dredging conducted in 1997 under a special Permit from the City of Renton for Grade and Fill has established the efficacy of these plans and measures. The maximum height of dredge spoils during dredging operations in the temporary storage area, adjacent to the shoreline, will not rise over 15' above existing grade. Immediately after dewatering, the dredge materials will be moved upland away from the immediate shoreline for handling and off-site transport. Previous sampling history indicates that dredged materials are not contaminated. Uplands, adjacent to the dredging area, are zoned Center Office Residential and Residential. The site is currently a sawmill/lumber mill producing dimensional lumber. Numerous mill structures exist, upland from the shoreline. Existing improvements include the sawmill, storage warehouses, lumber storage areas, etc. No new structures are proposed, and no upland improvements are proposed. Dredging costs are estimated at approximately$75,000. Special site features. Barbee Mill Company is located on the shoreline of Lake Washington. May Creek crosses the eastern portion of facility. The dredge site is located adjacent to the sawmill on aquatic lands leased from the Department of Natural Resources. No steep slopes are located immediately adjacent to the dredge site. Dredged materials are anticipated to be principally bark and wood debris. Proposed property use and improvements. No change in proposed property use will occur as a result of this project. No structures will be built or demolished. Granting a new Special Permit for Grading and Filling will substantially improve shallow water habitat by removing oxygen consuming bark and wood debris from the lakebed. Page 1 of 1 Item 8 Project Narrative.doc r Barbee Mill Company Bark&Debris Dredging Permit Application Item 9 -• Construction Mitigation Description This project is for maintenance dredging of bark and wood debris that has accumulated on the bottom of Lake Washington adjacent to the sawmill complex at Barbee Mill Company. Proposed Construction Dates. Dredging will occur during HPA permitted windows in accordance with Department of Fisheries requirements (Hydraulic Project Approval required). The intent is to protect potential spawning fisheries in Lake Washington and May Creek. Historically, the Department of Fish & Wildlife has not allowed dredging to occur from April 15 to July 15. Dredging will likely occur during a six to eight week window, depending on the weather, availability of equipment, permit approvals, etc. Dredging will occur during daylight hours on week days to minimize noise to neighboring businesses and residences; to protect worker safety; and to better allow for visual observation of dredging and potential impacts. Proposed hauling/transportation routes. No hauling or transportation routes will be impacted during dredging operations because dredging will occur from Lake Washington. Subsequent to dewatering in the temporary dredge storage area, dredged materials will be moved upland for handling. Bark and wood debris will be milled/chipped and sold as a soil amendment. These materials will be then be removed by truck, moderately increasing the number of vehicles entering and leaving the facility. When the mill is operating, approximately 50-100 trucks enter and leave daily. As a result of this project, an estimated increase of 1-2 trucks entering and leaving daily is anticipated for approximately six months until dredged materials are removed. Trucks will leave the facility, and will most likely travel north on Lake Washington Boulevard to on ramps for I-405. Site Mobilization. Crane-mounted barge with clamshell will be located at the site before/after fishery closures to insure that fisheries are not impacted. On-site Review Meeting. Prior to dredging operations, an on-site review meeting will be conducted to review project requirements, construction measures, erosion control measures, worker safety, etc. Temporary Storage Area Re-Vegetation. Subsequent to dredged sediment removal, the temporary storage area will be re-seeded with grasses and plants as a permanent site improvement. Project Oversite/Activity Audits. Project activities will be observed and audited to insure that all aspects of the dredging and filling permit are implemented. Oversite activities include maintaining a photographic record, conducting water quality measurements, and preparing a final report. Oxygen levels and TSS will be monitored in the dredge area and in Lake Washington during dredging to protect against oxygen depleting conditions from. Similarly, turbidity will be visually monitored to protect against turbidity impacts in Lake Washington. If such impacts are observed, dredging will be immediately halted until the problem can be corrected. Measures implemented to minimize dust, mud, noise, and other noxious characteristics. Because sediments are wet, no special dust abatement measures are required or necessary. Sediments are principally sand and gravel with a very low potential for creating a dust problem. Mud Control. Dredging operations shall be conducted at all times to minimize disturbance or siltation to adjacent waters as required by the Department of Ecology. Control measures include: (1) placement of wet sediments behind berms to minimize off-site transport; (2) cessation of operations in the event of fish distress, fish kill, or other water quality problem; (3) placement of silt curtains to prevent movement of materials potentially eroded from the site to the adjacent waters of Lake Washington; and (4) no stockpiling of material in the water will be allowed. Noise Control. Dredging will occur during daylight hours to minimize noise to neighboring businesses and residences. Some temporary increase in noise is unavoidable from the operation of clamshell dredging equipment. Noise levels approximate those generated by diesel equipment currently operated at the sawmill by Barbee Mill Company. Other Noxious Characteristics. Sediments have been previously sampled and tested for potential contamination. Sediment test results indicate no sediment quality criteria have been exceeded; and sediments present no environmental threat to human health or the environment. Materials to be dredged are principally bark and wood debris mixed with fine sand, some silt, and gravel. Dredging equipment will be serviced and refueled in a manner to protect against potential spillage into Lake Washington. Removal of bark and wood debris will have a substantial and beneficial impact on near-shore, shallow water habitat. Removal of bark and wood debris will have a substantial beneficial impact on fish and wildlife shallow water habitat near the Barbee Mill Company. An exemption from the shoreline permitting process is appropriate because this project is fundamentally a watershed restoration project, as defined by the City of Renton. Dredging of oxygen depleting bark and wood debris from the lakebed will have a substantial benefit to fish and wildlife habitat in the near-shore, shallow waters of Lake Washington. This permit application for dredging of bark and wood debris should be considered in concert with the existing dredging permit granted by the City of Renton in 1997 for dredging in the May Creek delta. Drainage control measures and systems (temporary dredge storage area) are currently permitted by the City of Renton, Corps of Engineers, Department of Fish and Wildlife, and the Department of Ecology. The efficacy of these measures and systems has been established and reported with minimal impact on water quality in Lake Washington. Previous dredging results indicate that dredged materials are not contaminated in the proposed dredge area as reported by RETEC in 1998. Additionally, chemical analyses of dredged materials from the May Creek delta have also proven to be free from contamination. These sediment and water quality test results have previously been provided to the City of Renton and are a matter of record. Renton bark transmittal summary.doc Dredging is anticipated to occur in the summer of 1999 and subsequent years, subject to HPA closure dates. Historically, dredging has been allowed after July 15th, after the spring fisheries closure. Dredging of the May Creek Delta (a permitted fully permitted activity) will occur concurrently with the dredging of bark and wood debris from aquatic lands. As provided for in the current dredging permit, dredge spoils will be initially dewatered in the temporary dredge storage area. As soon as dredge spoils are dry (a matter of minutes to hours), dredged materials will be removed from the shoreline to an upland storage area. The primary purpose is to minimize the potential for dredged material to reenter the waters of the State of Washington. Bark and wood debris will be sorted and milled on site to generate a fine organic pulp-like material suitable for sale as a soil amendment. Larger logs and similar materials may be chipped and sold as hog fuel or other potentially valuable raw material. Dredged sediments will be trucked off site for fill. The sale of these materials will help offset the cost of permitting and dredging. No structures will be built or demolished as a consequence of completing this project. SOUTH t Barbee Mill Company Bark&Debris Dredging Permit Application Item 14/15 - Drainage Control Plan This drainage control plan was previously approved by the City of Renton for dredging activities conducted by the Barbee Mill Company at the May Creek Delta, adjacent to the proposed bark and wood debris dredging area. This plan has been updated to include or to address additional issues associated with bark and wood debris removal. Implementation of this plan during dredging operations conducted by Barbee Mill Company in 1997 was shown to be effective. The objectives of this drainage control plan are (1) to minimize impacts to Lake Washington during dredging operations and (2) to prevent upland erosion of dredged materials. This section describes drainage and erosion control planning associated with maintenance dredging of sediments and bark and wood debris accumulating on the lake bottom adjacent to the shoreline as shown in plans. Drainage control has two principal components: (1) controlling dewatering of dredged sediments; and (2) prevention of off-site erosion in the upland temporary storage area. This plan addressees soil characteristics,vegetative covers, topography, and climate considerations. Upland soils at the site are principally sands and gravels carried by high-energy stream flows in May Creek and deposited in the May Creek Delta. These sands and gravels are well drained and graded. Sediments adjacent to the sawmill in the bark and wood debris removal area will have a higher proportion of silt than those in the May Creek Delta. Copies of drainage plans (8.5 x 11) are provided in Item 11/12 - Grading Plans and as a separate attachment (22 x 34). SURFACE WATER COMPLIANCE The King County Surface Water Design Manual, as adopted by the City of Renton, was utilized in the preparation of this section. The following discusses applicability of core requirements to this project. Core Requirement #1: Discharge at the Natural Location. Conduct of this project will not result in a surface water discharge that changes or alters natural discharges. Lake Washington is considered the downhill property. Core Requirement #2: Off-Site Analysis. No new proposed impervious surfaces will be created as a result of this project. Therefore an exemption is appropriate. Nevertheless, potential drainage problems exist currently at the site associated with upstream erosion: (1) sediments currently accumulating at the mouth of May Creek (caused by upstream erosion) create flooding problems and potential economic loss to mill property operated by Barbee Mill Company. As a consequence, the banks of May Creek are also subject to greater erosional forces during severe storm events even. This dredging project will allow for the removal of bark and wood debris that has accumulated on the lake bottom as a consequence of log storage. Previous dredging experience indicates that erosion of dredged materials does not pose potential drainage problems. These sediments have been removed, as required under the Special Permit granted by the City of Renton (1997). Core Requirement #3: Runoff Control. Runoff control will be managed to control peak rate by infiltration to minimize erosion and silting in Lake Washington (see sections below). Core Requirement #5: Conveyance System. No conveyance systems will be constructed as part of this project. U Core Requirement #6: Erosion/Sedimentation Control Plan. See following sections below of this plan. Core Requirement #7: Maintenance and Operation. Systems and procedures to control runoff, erosion, and sedimentation are described below for temporary control systems to be implemented during the conduct of project. Recent experience with maintenance and operation measures during dredging operations (1997) indicates the effectiveness of this approach SPECIAL REQUIREMENTS The proposed dredging project does not currently exist within a critical drainage area Requirement #1) The project does not currently lie within an approved Master Drainage Plan area Requirement #2) although the May Creek Basin drains to Lake Washington. Given the limited scope of this project, the dredging project does not require a master drainage plan (Requirement #3) for the entire facility. The proposed project does not lie within an adopted Basin or Community Plan (Requirement 4) although upstream investigations have been conducted in the May Creek Basin. Special water quality controls (beyond those proposed and previously implemented) are not required because no impervious area will be created (Requirement #5). Nevertheless, water quality controls are described below. The effectiveness of proposed water quality controls has previously been demonstrated. A coalescing plate oil/water separator is not required since no impervious surface area will be constructed (Requirement #6) and sediments are known to be very clean sands and gravel which readily dewater without significant increases in turbidity or oxygen depletion. No closed depressions exist at the Barbee Mill Facility or at the proposed temporary dredged sediment storage area (Requirement #7). However, the temporary dredged sediment storage area will be designed to control runoff(see below). DREDGE MATERIAL DEWATERING Dredged materials are expected to be principally bark and wood debris mixed with sands and some silts. Previous dredging experience indicates that dredged materials contain/cause very little turbidity from suspended fine particles. Dredge materials rapidly dewater, and dredged sediments are relatively dry prior to placement in the temporary storage area adjacent to the proposed dredge site. Remaining water in contained sediments will be allowed to infiltrate into subsurface sands and gravels, composing the temporary storage area. The temporary dredge storage area will hold dredged materials will be immediately from the temporary dredge storage area adjacent to the shoreline to the upland interim storage area. The Page 2 of 3 Item 14 Drainage Control Plan.doc Barbee Mill Company Bark&Debris Dredging Permit Application purpose is to minimize potential erosion and the accumulation of large volumes of dredged materials adjacent to the shoreline. After the dredged materials have been removed, the entire storage area will be re-seeded with grass. The design life of the temporary storage area/berm is anticipated to be approximately one year. Temporary Dredge Storage Area The temporary dredge storage area will be located as indicated in project figures. A typical cross- section of the storage area is provided in project plans. The temporary storage area has been constructed form existing site materials and provides for approximately 1200 square yards of level storage. Including bermed area, the temporary storage area covers approximately 1800 square yards. A berm will enclose the temporary storage area. Berm height will be approximately 5-7 feet above the OHWL (21.8 feet MSL, as maintained by the Army Corps of Engineers/Core Datum) of Lake Washington. The interior flat portion of the dredge storage area will be approximately 1-2 feet above OHWL, approximating a natural grade. The storage area will contain sufficient excess containment volume, subsequent to dredged sediment placement, to hold approximately 6000 cubic feet of storm and/or dewatering water. This storage volume is sufficient to contain the anticipated total runoff for a 100 year, 24 hour storm. Dredged Sediment Removal The temporary dredge storage area will hold dredged sediments for approximately one month, although it is anticipated that sediments will be removed as soon as dry and reasonably possible. During dredging conducted in April 1997, dredged materials were removed concurrently with dredging with no adverse impact. After the dredged materials have been removed, the entire storage area will be re-seeded with grass. SPECIFIC EROSION CONTROL MEASURES Principal erosion control measures include: (1) construction of a temporary dredge spoil area (as discussed previously); (2) placement of a silt curtain/fence; and (3) controlling runoff from both dewatering and storm events with vegetative cover. Subsequent to dewatering, dredged sediments will be removed from the temporary dredge storage area. Experience indicates that dredged materials were typically dewatered in a matter of minutes. Slopes. All bermed slopes will be less than 2:1 and re-seeded with grass and vegetation to minimize erosion from severe storm events. Dewatering and Stormwater control. See Above. Vegetative Cover. Temporary storage berms will be seeded with grass to provide vegetative cover to reduce the potential for erosion. Subsequent to removal of dredged sediments, the entire temporary storage area will be seeded, returning the site to a more natural condition.
