("Consultant"), a Washington Corporation. The City and the Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed by the Parties,this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-17-125, dated June 14, 2017, to provide necessary services for the Boathouse Float Design (referred to herein as the "Agreement"); Whereas,the Parties wish to amend the Agreement to change the scope of work,and change the compensation in order to add additional services. NOW THEREFORE, It is mutually agreed upon that CAG-17-125 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit 1, which is attached and incorporated herein. 2. Time of Performance: Section 3, Time of Performance, is amended pursuant to the schedule(s)set forth in Exhibit 1.All Work shall be performed by no later than September 1, 2018. 3. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased from $20,548.08 to $45,698.08 , plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actua) performed according to the rate(s) or amounts specified in Exhibit 1 of the Agreement. 4. All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. August 10,2017 ( Page 2 • Pre-submittal Coordination:Coordination by PND wili consist of project initiation with the ab�ve noted agencies and one site visit with agency staff prior to applications subrnittal,if needed.PfJD wiil initiate contact to introduce the project scope prior to submittal of applications. Agency specific concerns will be discussed and submittal requirements con�rmed. • Agency Review:At the federal level, aquatic projects such as this generally only require a Corps Nationwide 3 Maintenance Permit under Section 1a af the Rivers and Harbars Act. During the review process the Corps will request Endangered Species Act Section 7 Consuita#ion from the National Marine Fisheries Service and the U.S. Fish and Wiidiife Service(tagether known as the Services)depending on the species and habitats that may be affected by the project.The Services will look at affects to species and habitats listed under the Endangered Species Act(ESA)and the Magnuson-Stevens Fishery Conservation and Management Act based on the provided abbreviated eiologica!Evaluatian.The Corps will also consult with the Department of Archaeology and Historic Preservation for any historic or arthaeologica) issues under Section 106 of the National Historic Preservation Act, as well as any tribes who hold usual and accustomed fishing grounds in the area.Due to the e�ctensiueness and length of federal review,abtaining the Sedion 10 permit will likely be the criticat path.At the state level,PND wili work to obtain a modification to the previously appraved HPA.WD�W will have 45 days, upon complete package submittal,to issue or deny the permit. • Pe�mit Application Preparation: o JARPA: • Updated JARPA as necessary for submittal of the JARPA package to the WDFW and Corps. • Abbreviated Biofogical Evaluation(BE}to be used during Endangered Species Act consultation as part of#he Carps'review. ■ Mitigation Plan addendum,if needed by the Corps,Servites,and WDFW to assess impacts to aquatic habitat.
