It was noted that the legal description in the original application was in error. Mr. Erickson advised the council, orally, that the legal description had been corrected for purposes of advertising the hearing on appeal. Mr. Erickson further noted, by memorandum of May 8 to the City Clerk that the original application had not been corrected to that date . It is the purpose of this letter, to advise that the error in the description as set forth in the original application was inadvertant and not an attempt to include more property than Mr. Patas actually owns . The fact that Ordinance does not at present allow trailer park development in a residential area was acknowledged but rezone of only a portion was deemed illogical . The legal was read and noted correct. Also ,Mr . Patas had ownership of seven acres in prior rezone requests but now owns a ten acre parcel . Division of the property at proposed road rather than the area line picked was recommended . .Reversal of Commission decision and rezb a of the entire parcel to R- 3: .was requested . '. The Planning Director .read excerpts .from. the ,City-of. Tacoma Zoning Ordinance which defined the term 4"professional:" as• •being applied to medical and dental offices and :clinics', attorneys., engineers , etc . The proposed .City of Renton Zoning Ordinance ,.(presently' under review and revision) states', "Professional .offices .mean .offices maintained and used as a place of business conducted by persons engaged in the healing arts for human beings, such as .doctors- and dentists (but wherein no overnight care for patients is given) , and by engineers , attorneys, realtors , architects, accountants and other persons pro- viding services utilizing training in and knowledge of the mental discipline as distinguished from training in occupations requiring mere skill or manual dexterity or the .handling of commodities" . The Chairman stated if the Commission feels that it wants profes- sional offices only in the proposed building, the motion could carry the term "professional" . In case of later dispute, the City attorney could be asked to define the term. . The applicants stated they were in agreement with the term "professional" as applied to their proposed office building. The Chairman described the application and read a communication from the Traffic Engineer which stated that the Traffic Engineer- ing Department has reviewed the proposed plan submitted by Mr. Patas and advises that it finds no unusual circumstances regarding access to the property in question. Definite access control will be es- tablished with the development of off-site improvements . The Chairman stated the Fire Chief had indicated .objection to the proposed plan; specifically, the lack of a proper turn around at the rear of the development, and feels that cars will be parking along the interior street preventing free access for fire equip- ] ment. A communication from the Engineering Department was also read by the Chairman which stated. .in .reference to subject application, that future street development to-serve-this property has not as yet been determined by-other property development in the area. King County recently improved S.E. 128th Street and plans a simi- lar improvement of 138th Avenue S.E . School District No. 403 has indicated a *desir.e to see S.E. 124th Street (6th Place N. ) built in connection with the new "Middle School" . Street development patterns will largely be determined by property .development in King County which adjoins this' property on the easterly. and northerly sides . Preparation of a street plan to' serve the area should be a cooperative effort with the Planning Department. Utility plans for the area are in a preliminary stage with the Renton Planning Commission Meeting March 26 , 1969 Minutes - Page 5 engineer of the property .developer., - -Future-utility. growth in the general area is complicated by the presence of .Water District No. 90 which serves the easterly area adjoining this property. The Water District is planning to enter the .sewer business which would adjoin the City' s present service area.. . ' The existing Comprehen- sive Sewer and Water Plans presently indicate future development in the area within the .limitations mentioned above. The Planning Director.. stated that while the .applicant ' s proposed plan indicates a trailer park development, it is not the issue be- fore the Commission at this time; just the .rezone request is under consideration at this time.. The proposed' .tr.ailer park would not be permitted under the present R-3 zoning classification. The Comprehensive Plan does not show a trailer park use. The planning staff had previously prepared a proposed amendment to the Zoning Ordinance which would permit trailer and mobile home parks in the R-3, R-4, and B-1 zones by special- permit approved by the Planning Commission. This matter has not, however, .been incorporated into ' the existing ordinance to date. Slides of subject property were shown. The Planning Director stated that with reference to the Comprehen- sive Land Use Plan, the applicant' s. request does exceed the present iarea designated in the multiple .residential use category and extends into the area indicated as single family .residential to the north. Stredicke stated that inasmuch as the surrounding area was largely , undeveloped, that rezoning the entire parcel to R-3 could prove detrimental to the undeveloped surrounding area if it should sub- , sequently develop to single family residential as. the present trend indicates as evidenced by the construction of. several new homes in the area. However, regardless, rezoning of ..the entire parcel to R-3 would be in conflict with the Comprehensive. Plan as. the north- erly portion .of the property under- consideration is shown as single family residential on the Comprehensive .Plan. Commissioners Teegarden and Sterling indicated their .agreement with Stredicke ' s thoughts on• the subject. Audience comments were invited. There were none. • Moved by Teegarden, seconded by Stredicke,. .that the .hearing be closed. Motion carried. FURTHER ACTION: STREDICKE STATED HE WOULD CHANGE HIS• MOTION TO READ "THAT THE AP- PLICATION OF DINO PATAS FOR REZONE FROM G TO R-3 BE APPROVED FOR THE SOUTHERLY 640 FEET OF SUBJECT PROPERTY AND THAT THE REMAINING PORTION OF SUBJECT PROPERTY BE REZONED TO SR-1; THAT THIS RECOM- MENDATION BE FORWARDED TO CITY COUNCIL FOR ACTION AS IT AGREES WITH THE COMPREHENSIVE PLAN. TEEGARDEN SECONDED THE AMENDED MOTION. On the question, .Mola stated he believed the applicant should be given the opportunity to accept or' reject the Planning Commission' s Renton Planning Commission Meeting March 26,• .1969 Minutes - Page 6 recommendation .as .it differs -from the .request .shown- -on his application. Stredicke stated he changed his original motion to allow the appli- cant better use of the northerly .portion--of his property; if it remained G zone each home .site would .require- -3-5 000 square feet, but by rezoning to SR-1 each home site -would require 7,500 square feet. Mr. Leigh Williams, architect for the -applicant, stated that under the present motion only one-half of the applicant' s proposed devel- opment could be built. The Chairman reminded Mr. Williams that the applicant' s proposed development plan was not .under discussion at this time, only the rezone request. The Chairman stated further that the proposed mobile •home .park development .has .no bearing on . the rezonerequest presently before the Commission. In any event, the applicant' s proposed development could -only be accomplished if and when the .ordinance amendment presently .in process and pre- viously referred to is .adopted,. and -then ,only .by special permit. The .Chairman .stated-.that .discuss.,-on .of the .proposed -trailer park would .only cloud the issue of the rezone request. Stredicke stated that in his opinion even: though an area is shown as multiple use on the Comprehensive Plan, .it .does not mean that it is a proper time to develop subject property as multiple. A year from now it may be thatthe adjacent properties would have developed so that, .this property should be- -developed fully. It was .Stredicke'.s feeling .that .zoning .more .than- -half--of subject property to multiple use would be wrong.- He statedfurther that if the applicant does not want to accept the- .SR-1 zone on the rear of the property, he would withdraw his amended motion and let his original motion stand. The applicant stated he did not want his application modified. Whereupon question was called for on the original motion for R-3 zoning on the southerly 640 - feet of subject property; application affecting remaining northerly portion of subject property be denied. The details of the improvements will be determined during the plans checking proceedure. r . 13. Dino Patas property Future. street developement to serve this property has not as yet been determined by other property developement XX in the. area. As you know, King County recently improved Southeast 128th Street, and plans a similar improvement of 138th Avenue Southeast. School District No. 403 has indicated a desire to see Southeast 124th Street built in connection with the new "Middle School". Street developement patterns will largely be determined by property developement in King County, Which adjoins this property on the easterly and northerly sides. Preparation of a street plan to serve the area should be a cooperative effort with the Planning Department. Utility .plans for the area are in a preliminary stage with the Engineer of the property developer. • Future utility growth in the general area is complicated, to a certain extent, by the presence of Water District No. 90, who serves the easterly area adjoining this property. The Water District also is palnning to enter the sewer business, which would adjoin the City's present service area. The existing Comprehensive Sewer and Water plans presently indicate future developement in the area with in the limitations mentioned above. R. The Traffic Engineering Department has reviewed the access as indicated on the plot plan submitted by the appli- cants for a proposed office building.
