A2 S`5 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN TIFF CITY OF RENTON FROM BUSINESS DISTRICT (B-1) TO LIGHT INDUSTRY DISTRICT (L-1) WHEREAS under Chapter VII , Title IV (Building Regulations) of Ordinance Nc. 1628 known as the "Code of General Ordinances of the City of Renton' , as amended, and the maps adopted in conjunction therewith, the property hereinbelow described has heretofore been zoned as Business District (B-1) ; and WHEREAS a proper petition for change of zone classification of said property has been filed with the City Clerk on or about Sept. 2, 1970 1969, which petition was duly referred to the Planning Commission for investigation, study and public hearing , and a public hearing having been held thereon on or about Sept. 23 , 1970 , and said matter having been duly considered by the Planning Commission and said zoning request being in conformity with the City' s Comprehensive Plan, and the City Council having duly considered all matters relevant thereto and all parties having been heard appearing in support thereof or in opposition thereto, NOW THEREFORE , BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, AS FOLLOWS : SECTION I ? The Planning Director pointed out property location on the zoning map and described surrounding uses and zoning. The Comprehensive Land Use Plan indicates light industrial use for the area. Proposed use is for equipment storage and repair. The use as proposed is not specifically stated in the zoning ordinance under the light industrial district; however, the staff feels the Com- mission may grant the use under provisions outlined in Section 4-712 (a) (20) which states, "Other uses which can be reason- ably considered similar or related to the uses above listed, upon approval of the Planning Commission" . Slides of the property were shown. The Planning Director stated the applicant proposes to retain the existing single family residence on the property and con- duct the storage and repair facility to the rear of the lot. Required setbacks for the single family residential use will be maintained, and it was felt desirable that a screening fence be provided to protect adjacent uses. Audience comments, were invited. Mr. Tom Tobacco, 7243 Taft S. , Seattle, the applicant, spoke on behalf of the rezone appli- cation. Bowden stated that inasmuch as there were residential uses in the immediate vicinity of subject property, he would appreciate the Planning Director' s recommendation relative to this rezone application. The Planning Director stated the area is presently zoned for business. It is a transitional area, and it is his opinion that rezoning from B-1 to L-1 would not present a problem, with proper controls, and was appropriate for the area in view of its potential development. The applicant proposes to park construction equipment on the rear portion of the property with retention of the existing single family residence on the front portion of the property. Slides of the property were shown. It was noted that the subject property is flanked by an apartment house on one side and a single family residence on the other. The Comprehensive Land Use Plan indicates potential light industrial use for the area. in question. Commission discussion ensued and it was noted that access to that portion of the property proposed to be used for equipment storage would be from Tillicum Avenue. VARIANCE APPLICATION (g) SUNSET VENTURES, Appl. No. V-661-70; variance from previous Planning Commission requirement restricting access from Kirk- land Avenue NE; property located NW corner NE 10th St. and Kirkland Ave. NE The Planning Director reviewed the history of subject applica- tion. At the time of the rezone hearing on September 20 , 1966, there was considerable neighborhood opposition to the rezone for multiple use. As a result, the applicant, as a concession to the objecting property owners , agreed to restrict access to the parking lot from Kirkland Avenue NE. However, this con- cession has not been honored, and Kirkland Avenue NE is being used for ingress and egress. The Planning Department has no record of any complaints being filed by the adjacent residents, but this matter will be checked with the Building Department and the Traffic Engineering Department. The installation of off-site improvements, including curbs, gutters and sidewalks, on NE 10th Street is underway at the present time due to action by the Board of Public Works. The required improvements on Kirkland Avenue NE have been delayed by the Board pending the improvement of the entire street which is slated for some widening, repaving and installation of curbs, gutters and sidewalks. A bond had been posted by the applicant to insure the installation of all off-site improvements. The applicant feels that ingress-egress from Kirkland Avenue NE has presented no problems to the neighborhood and is requesting a waiver of the access restriction requirement. The Planning Director stated further that this application has been published and will be posted on the property so that the neighborhood will be aware of the applicant' s request. It is anticipated that there will be a good neighborhood turnout at the public hear- ing meeting on this item on September 23rd. CITY COUNCIL REFERRAL (h) Houseboats--review existing legislation re: location thereof; Planning Commission study and recommendation requested The Chairman stated this Council referral is a study matter. , Apparently there. is some problem within the Seattle area where houseboat usage is being excluded from certain locations. There have been some inquiries from persons wishing to locate house- boats in the Renton area. The Council has requested Commission study and recommendation with reference to possible legislation either excluding or permitting houseboats.
