AGREEMENT BE'iWEEN THE CIT'Y OF RENTON AND TNE SALVATION ARMY TO
TEMPORARILY USE THE OLD HIGHlANDS LIBRARY BUILDING
WHEREAS, the City af Renton (Cityj owns the atd Highlands library building which is
currently vacant;and
WHEREA5, the Renton Housing Authority(RHA} is purchasing the old Highlands library
Building from the City in mid-December 2017;and
WHERF.AS„ the Salvation Army wlshes to use the building far its holiday food and tays
dist�ibution;and
WHEREAS, the City and the RHA are willing to allow such use under the terms and
conditions set forth below;
NOW,THEREFORE,the Ciry,RHA and the Salvation Army do agree as foflows:
1. The City a�d RHA hereby agree to allow the Salvation Army to use the old Highlands
library building for its food and toys distribution for the period af November I5, 2017 through
January 7,2018, between the hours of 7:00 a.m.to 7:00 p.m.
2. The use of the buiiding shall be at no cost to the Salvation Army.
3. All distribution of food and toys to mernbers of the generel pubiic shall be done by
the Salvation Army staff and volunteers.The Salvatian Army shall limit the number of inembers
of the general public to 20 at any one time.
4. 1'he Salvation Army shall have a staff membe�or volunteer on site during ail hours of
distribution of food and toys. Upon leaving the building every night the Salvation Army shati
secure the buitding. When there is a day with no dlstribution, the Salvation Army shall secure
the prernises and shali check the security at least once every day.
5. The Salvation Anny accepts the buiiding for its use on an As Is/Where Is basis having
inspected the building and noted any issues related to its use and safety including the presence
of exposed bolts in the fioor.
6. The Salvativn A�my agrees to indemnify and hold the City and RHA harmless from
any claims, sutts or damages, including attomeys' fees, arising in any way out of or from the
Salvation Army's use of the building.This indemnity shall include any daim made under Title 51
RCW by an employee or voluntee� of the Salvation Army.This provisian has been negotiated
between the parties.

7. The Salvation Army shali (eave the premises in the same or better condition than it
found it.The bathrooms shali be thoroughly cieaned and the entire building swept and, where
necessary,mopped.
8. The Salvation Army shali carry liability insurance in the amount of$1,OQ0,000 per
occurrence and $2,OOd,000 cumulative and shafl name the City and RHA as an additianal
insured. The 5alvation Army shall aiso provide such Worker's Compensation Coverage or self
insurance as required by state law.
