HomeMy WebLinkAboutLUA71-676 tDECLARATION OF RESTRICTIVE COVENANTS WHEREAS, Tino Cugini and EmmakCugini, his wife, are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: PARCEL A: The West 265 feet of the WZ of the NE4 of the NW4 of Section 16 , Township 23N, Range 5E, W.M. , lying northerly of 3rd Ave. N. Extension (also known as NE 3rd St. Extension) , less SE 128th St. (also known as N. 4th St. ) , subject to transmission line easement, less coal and mineral rights; = CD PARCEL B: Beginning at the northeast corner of the NW4 of n the NW4 of said Section 16; thence west along the northerly line thereof 315 . 66 feet; thence south 108 ' 26" west to the northerly line of 3rd Ave. N. Extension (also known as NE 3rd St. Extension) ; thence easterly along said northerly margin to the east line of said subdivision; thence north along the east line thereof to the true point of beginning; less transmission line right-of-way; less county road; less a 30 foot strip to the City of Renton adjacent the northerly line of the transmission line right-of-way. WHEREAS , the owners of said described property desire to impose the following restrictive covenants running with the land as to use, present and future, of the above described real property; NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors , heirs and assigns, as follows : SETBACKS No buildings or structures shall be permitted or located within twenty (20) feet of the north, south and east property lines . LANDSCAPING The first ten (10) feet adjacent to the north and the first five (5) feet adjacent to the east and south property lines shall be appropriately land- scaped and maintained continuously in a neat and clean manner except for designated pedestrian and vehicular accessways. The remainder of the setback area not required to be landscaped may be utilized for off-street parking purposes as provided by the laws and ordinances of the City of Renton. SCREENING The outside storage of building materials , construc- tion equipment, supplies and containers shall be permitted within the described property provided Declaration of Restrictive Covenants Tino C. and Emma Cugini - Page 2 such storage area is screened from all adjacent property lines by a wall or view-obscuring fence or by appropriate landscaping, or a combination of both fence and landscaping. Screening shall be continuously maintained in an attractive and neat manner. Building, landscaping and screening plans shall be submitted and subject to approval CD of the City of Renton Planning Department prior [NJ to the issuance of permits for the development of CD the described property. The aforesaid restrictive covenants shall be null and void if the above described property is not zoned by the City of Renton for commercial use effective on or before January 1, 1972 . Any violation or breach of any of these restrictive covenants may be enforced by proper legal procedures in the Superior Court of King County by either the City of Renton or any property owners ad- joining subject property who are adversely affected by said breach. NE, extended southerly The Chairman described the rezone application and noted that Commission members were familiar with the property having recently completed a review of a requested Comprehensive Land Use Plan change for subject area. The Assistant Planning Director pointed out property location and advised the Commission that slides of all properties on the agenda were available if the Commission wished to review them again. The applicant is requesting B-1 zoning for the property as described. The applicant also owns the property directly to the west which is presently zoned B-1. The requested rezone is in agreement with the Comprehensive Land Use Plano The applicant, Mr. Cugini, has executed restrictive covenants for the entire property covered by the recent Comprehensive Land Use Plan change (from high density multi-family residential to commercial) , including subject property as well as area to the west presently zoned B-1 and a small area south of that to the power line easement presently zoned L-1. The covenants require a twenty foot setback for structures from the north, south and east property lines. Landscaping will be required on the first ten feet adjacent to the north and the first five feet adjacent to the east and south property lines . Any out- side storage of materials will be screened. Restrictive covenants for setbacks, landscaping and screening have been executed by the property owner covering subject property as well as his adjoining property to the west presently zoned B-l. Scholes asked if the covenants made any reference to light and noise control. The Planning Director replied that the coven- ants pertained only to setbacks, landscaping and screening. The Planning Director was requested to furnish a copy of the executed restrictive covenants to each Commission member. (b) KAMPE CONSTRUCTION CO. , Appl.
