No. SA-687-72 ; site plan approval for relocation of aircraft hangar in P-1` zone; property located On Renton Airport The Chairman described the application, noting it had been con- tinued from the meeting of February 9 , 1972 , as questions had been raised concerning the proposed location of the hangar as it might relate to the Cedar River right-of-way and the Shore- line Management Act of 1971 . • The Planning Director reported that the staff had researched the matter with reference to the jurisdiction of the Airport • Board, the status of the river right-of-way as well as verifi- cation of some of the distances involved. The proposed location of the hangar partially infringes on the river right-of-way adjacent to the perimeter road along the river. It was deter- mined that all area to within five feet of the river bank has been leased by the city to the airport for airport uses . This lease will expire in 1980 . Technically, construction of hangars in this area could be allowed provided access to the river.. is not obstructed. • The Planning Director displayed a drawing showing a layout plan of the airport including long range ideas showing an additional runway for small planes . This plan was reviewed with the Airport Director regarding future development. The Airport Master Plan prepared in 1968 by Olson-Richert-Bignold is presently being updated. The Airport Director indicated concern over general security of the airport with reference to development of the river bank. Safety of children playing along the river bank was one item mentioned with regard to possibility of their wandering onto the airport proper. • It is the staff recommendation that with reference to subject item the hangar be so located as to not infringe on the Cedar River right-of-way and that landscaping be provided. Slides of the area were shown, and proposed landscaping of. the airport along Airport Way as previously presented was reviewed. Lengthy discussion followed concerning the Planning Commission' s authority in the matter of improvements contemplated for the Renton Airport. The appropriate section in the zoning ordinance, 4-710 : P-1 Public District, provides for review of non-municipal improvements as follows : "All structures (except those owned or built by federal, state or county government, school districts and like governmental units which shall comply only with applicable building codes , setbacks and minimum standards for streets) shall have plans, general specifications and uses approved by the Plan- ning Commission. The Planning Commission is charged with the responsibility of ascertaining and determining that the general design and development conform with adjacent surroundings . . . . The City Council of the City of Mercer Island , at their regular public meeting of January 24, 1972, expressed concern regarding the pro- posed Marina construction on the East shore of Lake Washington. As you no doubt are aware, the jurisdiction between the City of Renton and the, City of Mercer Island, is approximately midway in the Lake. Of particular concern to the City Council are the following : (1 ) The effect on the flow of navigation with the piers projecting into the water some 750 feet. (2) The increased water traffic and safety problems in this area that will result from the additional moorage and other related activities . (3) The increase of the noise levels that will occur on the East side of Mercer Island because of the additional watercraft. (4) The potential increase of oil and other pollutants • from the increased number of watercraft in the area. In addition, I would also draw your attention to the fact that Clarke Beach, which is opposite the proposed Marina is being developed for public use this summer, and the above concerns relate to its effectiveness. • Call if you have any questions , and please advise us of your actions. If one contemplates :a :fairlycomprehensive activity .similar to those on the West side of Lake Washington, including rental of slips , 'gasoline, and fuel service, possibly repairs and business buildings in connection therewith,' .then obviously such a proposed use would fall outside the wording _and: intent of the ';R-3 zoning. The designation on the Comprehensive Land Use Plan is medium density multi-family residential. The applicant is contending that an R-3 zone (Section 4-709A(a)'(3) permits a marina via special permit. His argument is that a' special permit allows commercial uses as clinics, professional offices and mobile home parks, and that a marina is a similar use. The departmental position is that an..R-3 zone is a residential zone. The R-3 zone permits only specific commercial uses by special permit and marinas are not included on this list. There- fore, marinas would not be allowed in R-3 zones. The applicant requested a legal opinion from you on this matter. Your comments would be appreciated. Due to the . relatively static characteristics of a private pleasure boat moorage it is compatible with almost any type of zoning, (the Puget Sound Comprehensive Study shows the ' average pleasure boat is used only 167.6 hours per year) . Marinas in other local areas are found in many , different zones including R-3. . 2. There is a definite and increasing need for marinas in this area. In 1966 there was a demand for 8,200 moorages in the Renton, Seattle, Bellevue area with only 6,700 moorages exist- , ing including Shilshole. ' A large percentage of the existing • , -marinas are subst-ndard. By 1980 the demand is expected to rise to 13,200 moorages with very little increase in existing marinas • 3. The petitioned property allows 300% utilization of existing • waterfront. The average is 1 moorage for each 3 feet of water- . ' . , front while we can get 1 moorage for each 1 foot of waterfront. ' . This is due to the over-average length of docks we can build on this piece of property. 4. The property provides an excellent buffer zone between the industrial/apartment area and the residential area. Based on the Study mentioned in (1) the average auto traffic would be about 9 cars per day. This compares very favorably with . the approximately 90 to 180 cars per day that could be generated by maximum use of the property as apartments or office buildings under R-3 zoning. 5. Construction of the marina will not substantially alter the . existing natural elements of the land. 6. The marina will provide a facility which the City of Renton does not now have and which it has a definite need for. The • . nearest marina on the East side of the Lake presently has a waiting list of up to 2 years for some lengths of boats. 7. -A marina will provide an estimated additional $1,500 to $2,500 property taxes plus the construction wages it will put into . the local economy. Mr. Jensen stated that at time of development he would provide proper access to the property; that it is not landlocked as he owns the property directly to the west which has access to Union Avenue NE, and that he owns a 15 foot easement to the south of subject prop- erty which would provide access to NE 4th Street. The Planning Director and the Planning Commission felt that in order to insure reasonable access the northerly 30 feet of subject property should be dedicated as z public right-of-way. This dedication would provide the initial land area for development of a future public street connecting to Union Avenue NE. Mr . Jensen stated he would be willing to dedicate the necessary right-of-way; however, not at this time but at a time when development plans are firm. Mr. Jensen and the Planning Com- mission, after considerable discussion, were unable to reach agreement on this point. As there were no other comments from the audience, it was MOVED BY DENZER, SECONDED BY SEYMOUR, THAT THE HEARING BE CLOSED . MOTION CARRIED. ACTION : MOVED BY MOLA , SECONDED BY SEYMOUR, THAT THE JENSEN REZONE REQUEST FROM G TO R-3 BE DENIED AS THE REQUEST IS PREMATURE, THERE IS LACK OF ADEQUATE ACCESS TO THE PROPERTY, AS WELL AS THE FACTOR OF POTENTIAL INCREASED DENSITY. MOTION CARRIED. The Chairman advised Mr. Jensen of his right of appeal to the City Council. 4. NEW PUBLIC HEARING ITEMS REZONE APPLICATION (a) WRIGHT, JAMES, AND MEYER, BORGE, ApRl. No. R-685-71; rezone from G-6000 to R-3 ; property located on west side of Ripley Lane directly south of N. 52nd St. The Chairman described the application; the Planning Director pointed out property location northerly of Baxter Pole Yard and the Ripley Lane (now known as Misty Cove) Apartments. The ap- plicants have indicated they propose development of the site in the R-3 zone as a private boat marina. It was the department' s interpretation that the proposed development would be a com- mercial use not permitted in the R-3 zone , and the applicants were so advised. However, they have seen fit to apply for the rezone. The 'R-3 zoning requested is in agreement with the Comprehensive Land Use Plan. The Planning Director showed slides of the property in question, following which the pro- posed development plan was displayed. It was noted that the land area would be used for parking with boat moorages extend- ing out onto the water. The Planning Director stated that were the use permitted in the... R-3 zone, the primary question would be the development of. ade- quate access to the area. Rezone of this particular property was requested in the past, and the matter of access was never properly resolved. The existing railroad trestle will not permit - the passage of the larger fire equipment. Railroad officials have indicated they would look with disfavor over any additional vehicular traffic in the area, either over the tracks or under the trestle, as they feel a public safety problem would result from more intensive use. Mr. James Wright of Mercer Island, one of the applicants, spoke at length on behalf of the application. He displayed his slides of subject property. Mr. Wright indicated the existing resi- dence on the property would be refurbished for use as care- taker' s quarters . The rest of the property would be, gravelled for use as parking for cars and trailers, with as much of the natural foliage as possible left intact to act as a buffer between the parking lot and adjacent properties . Audience comments in opposition to the proposed rezone were invited. Mr . Mark Robbins, 5029 Ripley Lane N. , Mrs. Thomas Buckingham, 5025 Ripley Lane N. , and Mr . George Cassidy, also of Ripley Lane N. , objected vigorously to the proposed devel- opment. Mr. Robbins stated that he and his neighbors feel a rezone of subject property would be completely out of order as there are two single family residences between subject property and the Ripley Lane Apartments and a rezone would constitute spot zoning. Mr . Cassidy stated that moorage for 250 boats in a residential area would present a danger for children swimming in the area and the noise, traffic and pollution generated would be intolerable. Mrs . Buckingham added her agreement with the arguments in opposition to the proposed rezone. Denzer stated he felt the request for rezone was not compatible with the area, that access problems exist, that opposition from adjacent property owners was valid, and that everything points to the fact that the proposed use is not permitted in the zone requested. Considerable discussion ensued concerning the proposed use in relationship to the multi-family residential zone requested, and it was felt an opinion of the City Attorney should be requested concerning permissibility of the proposed use in ' the R-3 zone. The City of Renton does not presently have a marina for the moorage of privately owned pleasure craft. A recent Pleasure Boating Study by the Puget Sound Task Force of the Pacific Northwest River Basins Commission indicates that there is a diefinite and increasing demand for private pleasure craft moorage in this area. The Survey indicates a net need for 1 ,416 additional moorage slips in the Bellevue/Renton area with 511 slips needs in the Renton area alone. The property petitioned for rezoning will provide a conveniently located moorage with easy access and ample parking. The property also allows us to gain maximum use of water front footage. The average water frontage required for one slip is 3 feet ; we can get one slip for each foot of water frontage. This is due to the large amount of available Port of Seattle property adjoining our pPoporty. We belieire this allows us to provide maximum benefit to the boating community with a minimum distur- bance to the shoreline. 2 The Pleasure Boating Study ref(erred to in (1) indicates that the demand for moorage in King County is increasing at a much greater rate than it is being met. The property peti- tioned for rezoning together with the adjoining Port of Seattle Application for Rezone (Cont) property provides a natural location for a pleasure boat moorage in the Renton area. There are an estimated 2 ,223 pleasure boats presently owned by Renton area residents of which approximately 511 are of a size requiring wet moorage. A recent telephone survey of local marinas indicated that the closest marina to the proposed development has a waiting list of nearly 2 years for small to medium size pleasure craft. 3. Minimum site development is required on the subject property. This will allow the property to retain its present natural beauty. The property will also be well suited as a bufLer zone between the industrial property to the South and the residential property to the North.
