Mead City Clerk FROM: Gerard M , Shellan SUBJECT: Charles B. Guy - Rezone - Restrictive Covenants Dear Del : Thank you for your Memo of today regarding the above matter. As we understand your communication you have now been advised by the Public Works Director that the legal descriptions as contained in the Declaration of Restrictive Covenants and the Rezone Ordi:a.nce are incorrect. We have therefore prepared a new set of Ordinances enclosed herewith leaving the legal description blank with the request that you have the appropriate Department fill in the correct description. Please be advised that according to the City file the description, as formally contained in the ordinance is the one appearing in the application for rezone and other documents and also undoubtedly used by the Planning Department in preparing the "Declaration of Restrictive Covenants" . As you know , we do not prepare descriptions of property which is the responsibility of the Engineering Department and the property owner who petitions . Frankly , I do not know whether the incorrect descriptions may invalidate the whole proceedings and we would therefore suggest that both the Planning and Engineering Departments get together to resolve this issue . If the error is very minor and does not affect the proceedings , then we probably should leave it alone . Since the Restrictive Covenants are usually prepared by the Planning Department and • not our office , the proper procedure probably should be for the Engineering Department to prepare and/or verify the legal description first before the matter is processed in any way. We are therefore returning this whole file to you and simply request that confirmed copies be returned to our office after this matter has been corrected. We remain Very truly yours , Gerard M. As we understand your communication you have now been advised by the Public Works Director that the legal descriptions as contained in the Declaration of Restrictive Covenants and the Rezone Ordnance are incorrect. We have therefore prepared a new set of Ordinances enclosed herewith leaving the legal description blank with the request that you have the appropriate Department fill in the correct aescription. Please be advised that according to the City file the descriptions as formally contained in the ordinance is the one appearing in the application for rezone and other documents and also undoubtedly used by the Planning Department in preparing the "Declaration of Restrictive Covenants" . As you know, we do not prepare descriptions of property which is the responsibility of the Engineering Department and the property owner who petitions . Frankly , I do not know whether the incorrect descriptions may invalidate the whole proceedings and we would therefore suggest that both the Planning and Engineering Departments get together to resolve this issue. If the error is very minor and does not affect the proceedings , then we probably should leave it alone. Since the Restrictive Covenants are usually prepared by the Planning Department and not our office , the proper procedure probably should be for the Engineering Department to prepare and/or verify the legal description first before the matter is processed in any way. R-'(35-73 Pursuant to your memo concerning timliness of procedures regarding the Guy rezone, on l410/7j the Planning Commission rezone recommendation went to the City Council and was referred that' date to the Legislation -Committee for Oruinance. 1411/73 • we forwarded our file to }our office which included Declaration of Restrictive Covenant document apparently prepared by the Planning Department. On l4/13 you returned the file and a proposed ordinance advising that the covenant document required indication as to whether Mr. Guy was married and if so wife's signature was required along with any mortgagee signatures as might be involved. On l4/13/7j we forwarded the documents to Planning for correction as to the covenant and for checking of the legal description, copy also going to the Public Works Department with request for check of the legal. Alter some delay in acquiring signatures the document was returned to us on 1/. /'(4 but without proper notary certification for additional signatures. That date we returned same to Planning for completion and and it came back to us on January 4 and we thought it was ready for recording. Guy Dear Del : We are handing you herewith original and one copy of a proposed Rezoning ordinance in the above matter. ,Would you please have the Engineering and Planning Departments verify the legal description. We notice that the original of the "Declaration of Restrictive Covenants" is only signed by Mr. Guy. If Mr. Guy is married , then this document should likewise be executed by his spouse since the husband alone can not validly impose these restrictions without his wife' s signature. If on the other hand he is a single man, the Declaration should so indicate. Likewise , as we hav explained in the past , if there is any mortgagee involved/Eris property, that party should likewise approve and execute these covenants since they are an encumbrance on the property. We would also appreciate it if the Planning Department from now on would forward to us a copy of the estrictive Covenants before it is submitted to the City Counc so as to give us an opportunity to pass on its legality. The initial rezone request was granted by the Plan- ning Commission on June 27 , 1973. The restrictive cove- nants , which were an important aspect of the rezone , were to be signed before the approval could take effect ., This was delayed for some time , ultimately resulting in a re- quest for the Commission to re-examine their original decision . The re-examination request was suddenly dropped and the covenants signed and submitted by Mr. Guy. As a re- ' sult of this , the Commission could then take their origi - nal approval and make a favorable recommendation to the City Council Unfortunately, the Planning Commission was unable to attain a quorum for two consecutive meetings due to some rather unusual circumstances . (A quorum is needed to carry on any Commission business legally. ) The Planning Commission finally recommended referral to the City Council at their November 28 meeting . This will be submitted to the Council at their December 10 meet- ing . The actual ordinance which changes the zoning classi - fication would take effect after final Council approval and publication and after the restrictive covenants have been filed with the County . In reviewing the covenants , the applicant indicated his concern regarding landscaping , parking and loading re- quirements , including on-site paving and drainage . Said items are under the Public Works Department and not under the jurisdiction of the Planning Department or Planning Commission . Mr. Ericksen reviewed the request , including a descrip- tion of the property , its location and proposed use . He noted that the applicant wishes to retain existing struc- tures on the property for storage purposes . The Compre- hensive Plan indicates L- 1 or M-P in this area . The Chairman called for comments from the applicant . Mr. Glenn Guy , 10948 S . E . 284th , Renton , questioned the 10 ' landscaping strip and 20 ' setback . He stated he Renton Planning Commission Meeting October 10 , 1973 Minutes - Page 2 feels the fence should be placed on the property line and the beautification placed outside of it on public rights-of-way . The Planning Director advised that the setback was for structures or buildings , and any landscaping must be on private property in accordance with City ordinances . A 5 ' strip is required by ordinance at this time . The additional 5 ' were requested by the Commission to pro- vide continuity with adjacent property and was initi - ally agreed to by the applicant. Mr. Glenn Guy asked if the landscaping could be placed inside the fencing , and indicated it would be more suited to recreational vehicle parking . He stated that ,planting of pyramidal -shaped evergreen trees were ten- tatively planned. He said that he was in agreement with the 20 ' setback for buildings but wished to know the location of the fence . Discussion ensued regarding the appropriate procedure to follow in this situation . I expressed the fact that blacktop or similar permanent surfacing was required by ordinance . I also informed him he would have to concern himself with proper drainage of the site. The sign and two buildings he proposes to use would have to be approved by the Build- ing Department . I reviewed our landscape suggestions due to the absence of a detailed landscape plan from the ap- plicant. I also informed him that the Planning Commission had granted the rezone with the understanding that certain restrictive covenants would be signed and filed . This has not been done to date , thus delaying approval . I told him that if he wished to get a clarification on this matter , he could request another hearing . We would pre- sent his request at the 9-12-73 administrative meeting so that the Commission could decide on what date they could review the situation . He indicated that he wanted to proceed in this fashion . However, the only apparent item of discontent is the blacktopping requirement which is not an item of the restrictive covenants . Chairman Teegarden presented the application and the Plan- ning Director reviewed the request , noted that it involves approximately 7/10 of an acre and is presently undeveloped . The proposed• use is for storage of travel trailers and other recreational vehicles . The request for L-1 zoning is in conformance with the Comprehensive Plan , with the exception that the Plan indicates L-1 or M-P . He noted the Commission in previous actions has specified development control and landscape requirements . Mr . Ericksen , in referring to the staff report , noted staff has indicated that there are some requirements with refer- ence to on-site improvements , permanent surfacing , a drain- age system and certain requirements for off-street parking . The storage in the proposed zone also requires screening of the fencing , and staff feels there should be some sign controls . Staff is recommending approval of the rezone subject to the conditions listed in the staff report , and is recommending the use of restrictive covenants to define development controls in lieu of the same type of require- ments in the L-1 zone . The Planning Director stated the subject property abuts property owned by Mr. Lotto on which there are restric- tive covenants regarding setbacks and landscaping . Mr. Magstadt , the Assistant Planning Director , read through { these covenants . Mr. Ericksen stated the Planning Depart- ment is recommending an 8-foot high screening fence and landscaping to tie in with the Lotto property , as well as the requirement that no buildings or structures will be permitted within 20 feet of any public right-of-way or easement. Chairman Teegarden then detailed what the staff is recommending , and the, applicant stated that there was no problem.
