He also asked for a briefing on action taken previously relating to the Citizens Service Corp . site . Scholes asked who has jurisdiction over land as far as the shores of Lake Washington are concerned , Shoreline Management or zoning . Mola requested information as to what was previously approved for Wiechmann Enterprises . Responding to a request by the Chairman , Mr. Magstadt stated he would attempt to get a legal opinion as to whether a devel - oper ' s plan can be tied to the property at the time of request for rezone . COMMITTEE REPORTS The• Chairman called for committee reports on special items , as follows : ( 1 ) GLACIER PARK CO . ; Appl . No . R-757-74 ; Rezone from G to M-P (Community Services and Zoning - Request to report back April 10 , 1974 ) Scholes , chairman of the Community Services Committee , reported that they had met jointly with the Zoning Com- mittee , had discussed various aspects of the request , including environmental protection , shoreline management , fill and the recommended moratorium far rezones and fills in the Valley . They were unable to come up with a defini - tive answer. Planner Smith stated that the applicant has formally submitted a letter reducing his application on the rezone to include parcel one of the property . Ross , chairman of the Zoning Committee , reported that the question of limits of the application also prevented them from arriving at a decision . It was indicated that the committees are continuing to work on the problem . (2 ) CBD PARKING Chairman Ross of the Zoning Committee presented the Com- mittee ' s proposed ordinance amending Section 4-2208 of the Parking and Loading Ordinance relating to parking exemptions to the Commission . He referred the members to their " Parking Exemption District Rationale" report . He indicated the recommendation was the result of study with the Downtown Merchants Association and the staff . The April 1974 administrative meeting of the Renton Planning Commission was called to order at 8 : 05 p .m. by Chairman Tee- garden . ROLL TALL was taken by Secretary Wik . All members re- sponded present with the exception of Scholes (arrived at 8 : 15 p .m. ) and Seymour (arrived at 8 : 10 p .m. ) . 2 . APPROVAL OF MINUTES : The Chairman called for additions or corrections to the minutes of the meeting of March 27 , 1974 . Commissioner Ross requested that the record be amended to reflect his comments as follows : 4/ REGARDING THE GLACIER PARK COMPANY REZONE REQUEST FROM G TO M-P FOR PROPERTY LOCATED ON THE EAST SIDE OF WEST VALLEY HIGHWAY AT THE INTERSECTION WITH STRANDER BOULEVARD, ROSS REQUESTED THAT THE RECORD INDICATE THAT THE PUBLIC WORKS DEPARTMENT COMPREHEN- SIVE PLAN OF STREETS AND ARTERIALS IN THE AREA BE PROVIDED. (4) , VALLEY DEVELOPMENT , inasmuch as Chester Jahns of the Soil Conservation Service had been invited to make a presenta- tion regarding land use and drainage proposals in the Green River Valley. It was MOVED BY MOLA, SECONDED BY SCHOLES , THAT THE AGENDA BE MODI- FIED TO HEAR THE REPORT BY MR. JAHNS OF THE SOIL CONSERVATION SERVICE. MOTION CARRIED UNANIMOUSLY . 3- VALLEY DEVELOPMENT - GREEN RIVER WATERSHED PLAN Chester Jahns , Soil Conservation Service Assistant Project Engineer on the Green River Watershed Plan , presented \maps of their proposed drainage system for the Green River Valley . Said plan was adopted in 1966 and is presently in the environ- mental stage . The project area is 16 ,000 acres , of which 110 acres are designated as "mitigated wetlands . " Of the eight designated areas , three are located in Renton as follows : one along the east side of the Valley freeway ; one situated in Orillia ; and one located east of the West Valley Highway. Estimated cost of work in the total Valley is $28 ,000 ,000 . Mr. Jahns discussed the location and capability of planned channels and the types of wetlands found in this area . He listed the following five points to be accepted by local jur- isdictions before the project is begun : 1 . Acquisition of wetlands . 2 . COMMISSION MEMBERS ABSENT: None CITY STAFF PRESENT: Gordon Y. The April 1974 public hearing meeting of the Renton Planning Commission was called to order at 8:00 p .m. by Chairman Tee- garden . 1 - ROLL CALL was taken by Secretary Wik. All members re- ported present with the exception of Ross , who had prev- iously reported he would be arriving late . (Ross arrived at 8:45 p.m. ) Noting the long agenda , the Chairman requested that Commis- sioners and audience make their comments as brief as possible . He then introduced continued public hearing items for con- sideration . 2. CONTINUED PUBLIC HEARING ITEMS : REZONE: A, GLACIER PARK CO . , Appl . No. R-757-74 ; rezone from G to M/P; property located on east side of West Valley Highway at intersection with Strander Blvd. The Chairman asked for a presentation from the Planning Director. Mr. Ericksen pointed out the two parcels on the vicinity map which were originally requested for re- zoning , noting that Richard Vincent , Project Manager, Glacier Park Co. , has submitted a letter formally with- drawing parcel #2 from the application and offering par- cel #1 for consideration in its entirety. Mr. Ericksen advised that four letters supporting the rezone had been received . The Zoning Committee ' s report , recommend- ing approval , was read by the Planning Director. It was noted that the staff recommended approval with the under- standing that the 2% natural area requested by the Soil Conservation Service be incorporated in the site devel - opment plans subject to Planning Commission approval . Scholes , Chairman of the Community Services Committee , reported that his committee was in favor of the re- quested rezoning and any surface fill and excavation required but recommended that street right-of-way be dedicated for the extension of Strander Boulevard . Discussion followed regarding the advisability of a right-of-way requirement at this time . ACTION: MOVED BY HUMBLE, SECONDED BY MOLA, THAT APPROVAL OF PAR— CEL #2 FROM G TO N—P BE RECOMMENDED TO THE CITY COUNCIL AS IT AGREES WITH THE COMPREHENSIVE LAND USE PLAN WITH THE UNDERSTANDING THAT TEE 2% NATURAL AREA WILL BE INCOR— PORATED INTO THE SITE DEVELOPMENT PLANS. MOTION CARRIED • UNANIMOUSLY. Renton Planning Commission Meeting April 24 , 1974 Page Two SPECIAL PERMIT: B. PETERSON , ROGER; WITSOE , STAN ; Appl . No . SP-754-74 ; spe- cial permit to construct nine duplex buildings in R-2 zone ; property located at N . E . 8th Street between Harring- ton and Jefferson N . E . The Chairman requested a brief status report from the Planning Director. Mr. Ericksen displayed elevations of the proposed nine two-story duplexes and noted that their height is. 212 • feet from average ground level . He pointed out thetr loca- tion on the vicinity map and stated that adjacent properties were single family residences and some duplex units . Mr. Ericksen and Commissioner Scholes , Chairman of the Commun- ity Services Committee , reported that the Committee had met with the applicants and area residents . Items discussed in- cluded landscaping , screening , setting aside of open space , grading to reduce building heights , and placement of build- ings . The resulting revised plan , indicating use of existing and proposed fencing to screen the development from adjacent properties , was described by the Planning Director. Mr. Erick- sen noted that setbacks of structures on N . E . 8th Street vary between 14 and 24 feet and is acceptable to the staff. Mr. Ericksen brought the Commission ' s attention to a copy ;of restrictive covenants pertaining to Fairwood Terrace that were filed in 1958 and run with the land until 1983 and nOted requirements for a twenty-five foot rear yard setback and mini - mum lot size of 7500 square feet . Mr. Ericksen stated that they had not had an opportunity to review the restrictive cov- enants with the City Attorney. Discussion followed regarding the possible effect of the covenants on the application . The Chairman invited comment from the audience . Mrs . Doris Reed , 801 Jefferson N . E. , Renton , submitted a list of twenty- eight names of neighbors who protested the development . She stated they object to the number of units , the excess traffic on N . E. 8th Street , distance from the property lines , and height of the buildings . She also questioned what this would do to property values , and if the plan was in the best inter- est of the surrounding area . ACTION: MOVED BY HUMBLE, SECONDED BY SCHOLES, TO CONTINUE THE HEARING FOR THE PURPOSE OF INVESTIGATING THE ALLEGED RESTRICTIVE COVE- NANTS ON THE LAND. MOTION CARRIED, ROSS ABSTAINING. Mr. Peterson then asked for a "yes " or "no" vote , stating he felt a decision could be rendered subject to determining the legality of the restrictive covenants . Discussion fol - lowed. Therefore , it was established that the Commission would meet with the Council Community Services Committee Wednesday , April 17 , at 8 : 00 p . m. The recording secretary would advise the Commission of the meeting place . C. P.A. W. CONFERENCE ' - JUNE 6 , 7 , 8 , 1974 The Chairman called for anyone wishing to attend the P . A. W. Spokane Conference . Mr. Magstadt stated that funds were available for three members to attend . ACTION: MOVED BY WIK, SECONDED BY MOLA , THAT COMMISSIONERS GIBSON, SCHOLES AND SEYMOUR BE AUTHORIZED AS REPRESENTATIVES OF THIS COMMISSION AT THE SPOKANE PLANNING ASSOCIATIONS OF WASHINGTON CONFERENCE JUNE 6, 7 AND 8 . MOTION CARRIED UNANIMOUSLY. - Ross requested that the staff make necessary reservations for him, and he would attend at his own expense . D. SEATTLE AUDUBON SOCIETY REQUEST The Chairman read a letter from Leonard Steiner , Conserva- tion Chairman , Seattle Audubon Society , requesting that the Renton Planning Commission open public hearings on a reevaluation of the Renton Comprehensive Land Use Plan in consideration of legislation of the State Environmental Policy Act and the Shorelines Management Act. ACTION: MOVED BY ROSS, SECONDED BY SEYMOUR, THAT THIS MATTER BE REFERRED TO THE COMPREHENSIVE PLAN COMMITTEE TO DETERMINE WHETHER ANY ACTION SHOULD BE TAKEN PREVIOUS TO THE REGULAR CONSIDERATION OF CHANGES IN THE COMPREHENSIVE LAND USE PLAN IN OCTOBER AND REPORT BACK AT THE MAY ADMINISTRATIVE MEETING. The property , site of Tony Go ' s Restaurant, was indicated by Mr. Smith . The applicant proposes to expand his busi- ness and parking into three lots now occupied by duplex dwellings . These lots are presently zoned R-2 ; the Com- prehensive Land Use Plan designates the area for medium density, multi -family residential use . Discussion followed regarding the conflict between the existing B-1 use and the proposed commercial use with the Comprehensive Plan . It was noted that a change in the Comprehensive Land Use Plan may be in order. The Commission may also consider the extension of the present use or use of B-P (Business Park- ing) zoning and the imposition of restrictive covenants for site development. C. ' SCARSELLA BROS . , INC . ; Appl . No . R-759-74 ; rezone from G to M P ; property located approximately 1200 ' north of S. W. rd on West Valley Highway. The location of the 5 . 8 acre site , situated east of the West Valley Highway at S . W. 43rd and west of the Milwaukee/ Burlington Railroads was reviewed. It was noted that the site is generally surrounded by G zoning , but there are parcels zoned M/P , H- 1 and B-1 in the vicinity. The property includes a large pond which is a habitat for numerous water- fowl . Responding to an inquiry by Commissioner Scholes , Mr. Erick- sen stated that the Commission recommendation to the City Council for a one year moratorium on rezones in the Green River Valley is presently being studied by the Council Com- munity Services Committee . It was also noted that the site comes under the ,jurisdiction of the Shoreline Management Act , inasmuch as it lies within 200 feet of the Green River. Provisions of the Mining , Excavation and Grading Ordinance relate, to the site development, including the erection of an office building and construction repair shop and outside stor- age area , as some filling of the site will be required. The proposed rezone is in agreement with the Comprehensive Land Use Plan . At this time , slides and aerial photographs of the proposed rezones were shown by the Planning Director.
