The Chairman requested a status report from the Planning staff. Planner Smith reminded the Commission of their prey- sous action, noting that approval was recommended with re- otrictive covenants . Mr. Smith reviewed the recommendation of the Commission and the restrictive covenants established and also des- cribed the applicants proposed changes . Discussion followed regarding appropriateness of a Planning Commission rehearing versus a hearing to be held by the City Council . Mr. Smith , planner, pointed out the 12 acre site located on the West Valley Highway and noted significant landmarks in the vicinity . He stated that the property is adjacent to the Scarsella property to the north , and the ponding area on that site also flows onto this one . The ponding area and associated wetlands were noted. At present there are no development plans . Development of the site will require filling , at which time the Mining , Excavation and Grading Ordinance will apply. Site approval will also be required, should M-P zoning be recommended. The site is also within the jurisdiction of the Shoreline Management Act. Limit Number of Councilman Stredicke said that a year ago, the newspapers carried a Service Stations front page story asking the City to limit the number of service sta- tions in the City. They also recommended provisions for landscaping , including preservation of two percent natural area , as suggested by the Soil Conservation Service . Responding to queries of the Commission , Ross indicated that landscaping would be included in the sixty foot set- backs , that the sixty foot setback from the freeway would lend a design of consistency with adjacent properties and that the covenants would not require a sixty foot setback from Pacific Avenue , as specified by M/P zoning . He felt that a twenty foot setback from the freeway would give them a buildable area comparable to the Austin Company. Since the site is sufficiently large and adjacent proper- ties are similarly developed , the staff recommends that the property be rezoned M-P rather than the requested L-1 . Mr . Smith stated that the differences in standards between L-1 and M-P were discussed with the applicants . The Com- prehensive Land Use Plan indicates either L-1 or M-P zon- ing for the area . Seymour inquired if it would be necessary for the appli - cants to change their application , if the Commission were to recommend M-P zoning rather than L-1 . He pointed out the location of the site and prominent development in the vicinity . He noted the approximate bound- aries of the two phases on a section drawing of the proposed fill and railroad yard . The Comprehensive Land Use Plan des- ignates the area as M/P . The anticipated use as a railroad switching area would be classified as H-1 . Mr. Ericksen stated that the applicant should consider the aspect of environmental impact and indicated that it is the the staff ' s recommendation that the item be continued to allow for .this assessment . He also suggested that additional information be submitted by the applicant regarding future use of the proposed site as well as adjacent property . Slides and aerial photographs of the area were viewed . Phases one and two were indicated , and it was noted that five or six more phases are anticipated . Comments were invited from the applicant . Mr. Paul Scott , 2308 S. E . 19th , Renton , Western Director of Real Estate and Industrial Development, Milwaukee Road , pointed out exist- ing facilities and proposed development sites on the vicin- ity map . He noted that the hillside area to the east above the site is designated medium to high density use by King County. The proposed drainage channel , proposed industrial sites and Earlington Golf Course were indicated . In response to questions from the Commission , Mr . Scott stated that Milwaukee is asking only for a permit to fill at this time . The first phase is for permission to fill to the same height ( 130 ' ±) as the present railroad right-of-way .
