As part of the Devil's Elbow Lift Station Project the City obtained an easement over the entirety of lot 8. Lot 8 now contains an emergency generator building for the Devil's Elbow lift station. As part of the compensation for the easement,the City also built an RV parking pad on Lot 8 and adjacent to Lot 9 for the owner. The King County Assessors office has since increased the assessment on Lot 8 due to the development. The property owner wants to sell Lot 8 to the City but retain use of the RV parking pad. The Wastewater Utility wants to purchase the lot and contacted the City Attorney to inquire about providing RV parking for the current owner. For liability purposes,the City attorney's office recommends that the City perform a lot line adjustment in lieu of granting an access easement to the owner to use the RV pad. City Clerk: South County Community Services Committee Chair Nelson presented a report regarding the Public Access Studio, AT&T funding agreement with AT&T for a South King County public access studio. The Community Services Committee recommended that Council approve the proposed offer from AT&T to provide a lump sum buyout to six South King County cities,including Renton, in the amount of$3.7 million to fund a South County public access facility. The buyout payment will fund remodeling and equipment costs and operating expenses for the facility over the next ten years, and will satisfy the obligations specified in Section 5 of the AT&T franchise agreement with the City(Ordinance No. 4412). The franchise requires AT&T to provide, equip and operate a public access studio within eight miles of City Hall by an extended deadline of January 1, 2001. Negotiations are continuing with the Renton School District regarding the use of space in Sartori School for the facility. The Committee further recommended that the AT&T buyout agreement contain the following conditions: 1)that by an extended deadline of January 30,2001, AT&T shall transfer the lump sum buyout in the amount of$3,701,942.78 directly to the board of the newly-formed non-profit organization, consisting of designees from each member city; and 2)that AT&T shall continue to fund the salary for the interim facility director until the transfer of funds has been completed and the facility is complete and operational. By meeting these conditions,AT&T will have satisfied its franchise obligation with the City of Renton for provision of a public access facility. Should State approval of the non-profit organization be delayed beyond January 30,2001,a reasonable extension for payment will be granted to AT&T. Since our building has been built, the King County Assessor's office has increased the assessed value on the property and the owner has decided he would rather sell the lot than pay property taxes for a parcel that he can't use. The property owner would like to retain ownership of the portion of Lot 8 that currently contains a 10-foot by 20-foot concrete RV parking pad. To accomplish this a lot line adjustment is needed. The City originally paid $5,000 for the utility easement. The 2000 assessed value for the land portion of the property is $24,000. The property owner has agreed to sell the lot to the City for the difference of$19,000. BACKGROUND SUMMARY: In 1999, the City replaced the old Devil's Elbow sanitary sewer lift station with a new one. All of the City's lift stations are equipped with emergency generator connections in case of power failures. However, the emergency generators need to be close to the lift station in order to make a connection. The access road for the Devil's Elbow lift station (the closed portion of NE 27th ST) is prone to falling trees and landslides during storms. This poses an access problem as well as a hazard to maintenance crews. Therefore, as part of that project, an emergency generator building was built on Lot 8 of Aloha Ranch Division 2 at 2744 NE 24th Street. This generator building contains a trailer-mounted generator that is remotely connected to the lift station and automatically starts to provide electrical power to the lift station in the event of a power failure. An added benefit to this system allows the generator to be disconnected and used on other lift stations should the need arise. October 27, 2000 Page 2 Due to steep slopes, this lot did not have enough level ground to construct a single-family residence and, therefore, was not of much use to the property owner. The City originally offered to purchase the lot. As part of the Devil's Elbow lift station project, we had anticipated purchasing the lot and, therefore, had budgeted to do so. However, since the property owner lives on the adjacent lot and utilizes Lot 8 to park his RV, he was not inclined to sell the property. The City did obtain an easement over the entirety of the lot in order to construct the generator building. This easement was purchased for $5,000, which was approximately 20% of the 1998 assessed value of$24,000. Due to the King County assessor increasing the assessed value on the property to $31,000 for 2001, the property owner would like to sell the parcel. The owner contacted the City and inquired if we were still interested in purchasing the property. The owner would like to keep the parking area for his RV and has, therefore, proposed a lot line adjustment. The lot line adjustment would transfer a 10-foot by 20-foot portion of Lot 8 to Lot 9. This area currently contains a concrete parking pad for the owner's RV.
