HomeMy WebLinkAboutAdden 1 LAG-11-004, Adden #1-12 City of � s•� LEASE ADDENDUM NUMBER ONE I4�' THIS ADDENDUM to LAG-11-004 is made as of the day of ��C , 2012, between the CITY OF RENTON, a non-charter code city organized under RCW 35A and State of Washington Municipal Corporation, hereinafter referred to as "CITY", and Birthday Dreams, a nonprofit corporation hereinafter referred to as "Lessee," hereinafter collectively referred to as the "Parties". The CITY and LEESEE agree to addend LAG-11-004, attached as Exhibit One, entered into on July 15tH, 2011 as set forth below. Additional Leased Space. Lessee will lease portions of the second floor in the subject property at 1119 Bronson Way N., Renton, WA, as shown on the attached Exhibit Two. 1. Term: This Addendum will run concurrent with the existing lease, including any renewals that may be made in the future. 2. Payments: Lessee will continue to pay the original monthly payment of six hundred dollars ($600.00) plus excise tax of seventy-seven dollars and fifty cents ($77.50) and pay an additional monthly rent payment of two hundred dollars ($200.00) plus excise tax of twenty- five dollars and eighty-four cents ($25.84), for a total of for a total of eight hundred dollars ($800.00) and excise tax of one hundred three dollars and thirty-four cents ($103.34). The excise tax will be exempted if the Lessee has a non-profit excise tax exemption certificate from the Department of Revenue in force. 3. Monthly Lease Payment Adiustment: The additional rent amount indicated in Section 3 will also be subject to the CPI adjustment described in Section 3(B) of LAG-11-004. 4. Use Restrictions: Lessee accepts: a. The space is to be used only for storage; office and work areas are not allowed. b. The floor shall not be loaded above 75 pounds per square foot. c. Access to closets shall not be blocked. d. Closets without mechanical equipment may be used for storage; closets with mechanical equipment may not. e. Conditions prescribed by the City Fire Marshall shall be maintained at all times and with no exceptions. Limited Liability: Lessee understands and accepts that the only access to the second floor is by a stairway. The City affirms that the stairway has been examined by City Building Officials who judged the stairway to be in compliance with governing codes and regulations and in good condition. The Lessee accepts that the City will not be liable for accidents or personal damages that occur on or about this stairway except in the case of gross negligence on the City's part. Lessee will be responsible to immediately report any safety or maintenance issues with the stairway and agrees not to use the stairway from the point of report until the City has restored the stairway to a safe condition. 6. Cleanliness: The City shall not provide janitorial services to this portion of the leased space. The Lessee will keep this entire area clean and free of litter and debris. No organic materials will be kept on site longer than 24 hours. The space will be broom clean upon return to the City. Any damage by the Lessee or the Lessee's employees, agents, or volunteers to the floor, window(s), walls, doors, fixtures or signage will be repaired by the Lessee at the Lessee's sole expense. Lessee's failure to fully and completely comply with this requirement shall result in the Lessee having to pay the CITY the cost of the clean up and an additional $300.00 for litter and debris and an additional $300.00 for each item damaged. 7. Employment: The Lessee, or any employee, or any sub-lessee of the Lessee is not an employee of the City of Renton. All other terms and conditions of LAG-11-004 not specifically amended shall prevail and shall remain in effect. This Agreement is entered into as of the day and year written above.
