OLD BUSINESS Community Community Services Committee Chairman Reed submitted committee Services report regarding the Flood Hazard Ordinance and explained review, Committee that the ordinance is mandated by Federal regulations to insure compliance with the Federal Flood Insurance Program and will Flood Hazard accomplish: (1 ) Adopts the Federal Flood Boundary and map, insur- Ordinance ance rate map and water surface elevations established by HUD; (2) Provides ability for properties within City to obtain sub- sidized flood insurance; (3) Establishes local regulations for development . The report recommended referral to the Ways and Means Committee and adoption of the ordinance by 5/4/81 to comply with the Federal regulations and obtain benefits . R-011-81 LOCATION: 1718 Talbot Road South SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from GS-1 to SR-1 for the purpose of future short platting. SUMMARY OF Planning Department: Approval RECOMMENDATION: Hearing Examiner: Approval PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on March 10, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 17, 1981 at 9:25 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Steve Munson, Planning Department, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Vicinity Map Exhibit #3: Site Plan Map designating existing lot and potential subdivision Responding to the Examiner's inquiry regarding a statement in Section J. Environmental Assessment/Threshold Determination of the Planning Department report, which reports exemption of the subject proposal from the Threshold Determination of Environmental Significance, Roger Blaylock, Associate Planner, corrected the statement, noting that a Determination of Non-Significance was made by the E.R.C. on March 1 , 1981 , followed by expiration of the appeal period on March 15, 1981 . The Examiner requested testimony by the applicant. Responding was: Bobby A. Halsen 1718 Talbot Road S. Renton, WA 98055 Mr. Halsen supported the presentation of the Planning Department and offered no further comments. Responding to the Examiner's inquiry regarding the potential number of lots which would be allowed following subdivision of the site, Mr. Blaylock advised that only one additional pipestem lot would be feasible due to the location of the existing residence. The Examiner requested further comments in support or opposition to the proposal . Since no further comments were offered, the hearing regarding File No. R-011-81 was closed by the Examiner at 9:33 a.m. -1 1-81 Page Two FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a reclassification of approximately 37,897 square feet of property from GS-1 (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to SR-1 (Single Family Residential ; Minimum lot size '- 7500 square feet) • 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject property is located at 1718 Talbot Road South. The site was annexed into the city in May of 1956 by Ordinance No. 1547 at which time the current GS-1 zoning was automatically applied. 8. The subject property slopes downward slightly from west to east. An existing single family house and detached accessory building are located on the subject site. Lawn grass covers much of the site. Trees, shrubs and blackberry bushes are located along the perimeter of the site. 9. Single family uses, the predominant land use in the area, are located north, south and west of the subject site. The right-of-way for SR-515 is located to the east of -the site. 10. The Comprehensive Plan designates the area in which the subject site is located as' suitable for single family residential development. 11 . There is a mix of zoning classifications in the area surrounding the subject site. 1 Immediately north of the subject site is an SR-1 zone, the classification requested by the applicant. The GS-1 zone in which the subject site is located extends south and west and contains numerous parcels. Imbedded within the GS-1 zone are SR-1 zoned properties and R-1 (Single Family Residential ; Minimum lot size - 7200 square feet) zoned properties. East of the site is a large R-1 zone. 12. The Michael Baker Rezone (File No. R-416-79) reclassified property located at 2109 Talbot Road South from G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to SR-1 in late 1979. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 4-3010 which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the reclassification of the subject property. R-O l . -I Page Three 2. The subject property was automatically zoned GS-1 upon annexation. There was no consideration at that time as to whether or not the GS-1 was appropriate. The Comprehensive Plan designates the area for single family residential , and the request to reclassify the subject site to SR-1 is compatible with that designation. 3. There are a number of SR-1 districts in the vicinity of the subject site including the Baker Rezone at 2109 Talbot Road South which was approved approximately a year ago. 4. The area is almost exclusively single family in character and the SR-1 category is compatible with the surrounding zoning of SR-1 , R-1 and the remaining G and GS-1 zoning. Each of these classifications permits single family uses. 5. The SR-1 zone will allow the applicant to divide the subject lot if the applicant so chooses. The lot is about 38,000 square feet and would permit the creation of additional lots upon subdivision. The nature of the lot and the location of the existing house would limit the number of lots to about two which would not increase the relative population density in the area by any significant amount. 6. Since the request is compatible with the area and the goal of the Comprehensive Plan, the City Council should approve the requested reclassification. RECOMMENDATION: The City Council should approve the reclassification of the subject property from GS-1 to SR-1 . ORDERED THIS 18th day of March, 1981 . As of 1/80--the date of the last Comprehensive Plan--our property was zoned, previous to and still , GS-1. The- area in which we live (1718 Talbot Road) is residential (single family dwellings) . Lots developed in the last 10 years in our area have been zoned SR-1. Also, several lots developed when GS-1 was the zoning rule have submitted and obtained SR-1 zoning. An example being tract #4 of the Renton Co-operative Coal Company--the lot next to ours. This rezoning took place 6/27/75 -(from :GS-1. to SR-1) -according to the-Planning- Department- ` records-. . Also, according to the Comprehensive Plan, residential areas in Renton are recommended for SR-1 zoning. GS-1 is no longer an accepted zoning rule. We hope the council will take into consideration the facts men- tioned in this letter when considering our request for rezoning to SR-1.
