PP-326-79 • (Union Circle) LOCATION: On the west side of Union Avenue N.E. between N.E. 6th and N.E. 7th Streets. • SUMMARY' OF REQUEST: Applicant requests preliminary plat approval of a nine-lot subdivision for future development of single family residences. • SUMMARY OF Planning Department: Approval with conditions. 'RECOMMENDATION: • Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT, The Planning Department preliminary report was received by the REPORT: Examiner on April 24, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field • checking the property and surrounding area, the Examiner • • conducted a public hearing on.the subject as follows: The hearing,was opened on May 1, 1979 at 9:12 a.m. in the Council Chambers of the Renton ,Municipal Building. Parties wishing to testify were affirmed by the Examiner. • It was reported' that the Hearing Examiner and the applicant had' received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. • David Clemens, Associate Planner, disclosed being acquainted with one of' the applicants, although he advised that discussion regarding the subject application had not occurred. The Examiner inquired if parties in attendance objected to proceeding with the hearing upon receipt of the information. . There was no objection. Steve Munson,• Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Preliminary Plat as Submitted • Exhibit #3: Preliminary Plat with .Staff Comments The Examiner'asked the applicant if he concurred in Exhibit #1. Mr. Ewing, consulting engineer for the project, indicated the applicant's concurrence in the report. , ' The Examiner requested testimony in support or opposition to the request. There was no' response. He then requested testimony from a representative of the Public Works Department: Responding was: Paul Lumbert • • Traffic Engineering Division • Referencing staff comments attached to Exhibit #1, the Examiner. noted that the Public Works Department had required installation of street lighting, and inquired if Other off-site improvements were required. Mr. Lumbert indicated that full off-site improvements consisting Of curbs, gutters, sidewalks, and paving were required to conform to existing similar improvements along Union Avenue 'N.E. which extend from Sunset Boulevard N.E. to ;`.. N.E. 4th Street, and the proximity of the proposed development to an elementary school and park would require improvements to separate pedestrian use from vehicular traffic. • Responding to the Examiner's inquiry regarding existing traffic volume on Union Avenue N.E. , Mr. Lumbert reported that traffic generated from the proposed development would not , substantiall impact existingtraffic on the collector arterial. The Examiner requested a final recommendation from the Planning Department representative. Mr. Munson advised that the recommendation contained in Exhibit #1 would remain as submitted. The Examiner requested further comments.. Since, there were none, the hearing on File No. PP-326-79 was closed by the Examiner at 9:25 a.m: • FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of the preliminary plat of Union Circle consisting of nine single family lots on 1.85 acres of property zoned R-1. • 2. The Planning Department report accurately sets forth the issues; applicable policies and provisions, findings of fact, and departmental recommendations in this matter, • is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton°s Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by. R.C.W.• 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and adverse comments were not expressed. 5. There 'was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the requirements of Section 4-706 (R-l) of Title IV, and Section 9-1108.23 (Subdivision Ordinance) of Title IX, Ordinance No. 1628, Code of General Ordinances. 8. Most off-site improvements exist along the property in Union Avenue N.E. (curb, gutter, and sidewalk) . Staff recommended two street lights be installed, which was agreeable to the applicant. 9. Storm water drainage and utility plans were not submitted. CONCLUSIONS: • 1. The_ proposalconforms to the Comprehensive Plan, zoning regulations and Subdivision Ordinance. - It also appears to serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . 2. Installation. of street lighting is an appropriate off-site improvement to be required. The site is adjacent to collector arterial that is contiguous to and serves an elementary school and public park. This improvement will enhance the public health, safety and welfare. 3. Detailed storm water drainage and utilities can be approved during review of the final plat. RECOMMENDATION: • Approval of. Exhibit #2, subject to: " 1. Installation of two street lights per review and approval of the Public Works Department. • 2. Submittal of detailed storm drainage and utility plans with the final plat application. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title. IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. HISTORY/BACKGROUND : The subject site is part of the original plat of the City of Renton . It was rezoned from S-1 to R-1 by Ordinance #2368 dated October 16 , 1967 . D . PHYSICAL BACKGROUND : 1 . Topography : The site is generally level except for a slight depression in the northerly portion of the property . 2 . Soils : Arents , Alderwood material , (AmC ) . Runoff is medium, erosion hazard is moderate to severe . This soil is used for urban development. 3. Vegetation : Extensive vegetation covers the site with blackberries and medium-height shrubs predominate . F . PUBLIC SERVICES : 1 . Water and Sewer : A 12" water main runs north-south on Union Avenue NE adjacent to the subject site . An 8" sanitary sewer pipe extends south into the site from NE 7th Street approximately 100 ' west of Union Avenue . Another 8" sanitary pipe is located on Union Avenue approximately 100 ' to the northeast. 2 . Fire Protection : Provided by the Renton Fire Department as per ordinance requirements . 3 . Transit : Metro Route #107 operates along Union Avenue NE adjacent to the subject site . 4. Schools : The Honeydew Elementary School is located within 1 /4 mile to the north of the subject property while McKnight Junior High School is situated within 12 miles to the northwest and Hazen High School is within 1 mile to the northeast . 5. Natural Systems : Development of the subject site will disturb soils , remove vegetation , increase storm water runoff and have an effect on traffic and noise levels in the area . Through proper development controls and procedures , however , these impacts can be mitigated . 2. Population/Employment : The proposed plat of 9 lots will increase the area population by approximately 32 persons ( 3 . 5 persons/home times 9 homes ) . 3 . Schools : The proposed subdivision will increase the school population by approximately 5 students ( . 5 student/home times 9 homes ) . These new pupils will likely be scattered throughout the grades and not significantly impact the existing services . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , a declaration of non-significance has been prepared based upon the minimal size of this plat.
