APPLICANT: B. I. Nicoli FILE NO. PP-327-79 E-341-79 LOCATION: South side of North 40th Street between Lake Washington Blvd. North and Park Avenue North. SUMMARY OF REQUEST: Applicant seeks approval of a. seven-lot subdivision for future development of single family residences, and an exception to the Subdivision Ordinance to allow two pipestem lots. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on April 25, 1979 and a subsequent addendum was received on May 4, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 1, 1979 at 9:10 a.m. in the Council Chambers of the Renton Municipal Building. David Clemens, Associate Planner, advised that subsequent to legal publication of the hearing date, the necessity of submitting a request for exception to the Subdivision Ordinance to allow pipestem lots within the plat was determined, and he recommended continuance of the hearing for a one-week period to allow review and preparation of an addendum to the Planning Department report. The Examiner subsequently continued the hearing to May 8, 1979 at 9:00 a.m. CONTINUANCE: The hearing was opened on May 8, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report and the subsequent addendum, and the reports were entered into the record as Exhibits #1 and 2, respectively. David Clemens, Associate Planner, advised that the application had recently been amended by the applicant to combine proposed Lots 1, 2 and the pipestem roadway located east of Lot 2 into one parcel to be developed at a future date. Mr. Clemens entered the following additional exhibits into the record: Exhibit #3: Letter to Planning Department from applicant, dated April 27, 1979, request for exception to allow pipestem lots Exhibit #4: Letter to Planning Department from applicant, dated May 7, 1979, plat revision request for development of Lots 3 through 8 only Exhibit #5: Preliminary Plat as submitted Exhibit #6: Preliminary Plat with staff comments Exhibit #7: Revised Preliminary Plat and Vicinity Map • with staff comments Mr. Clemens also advised receipt of a statutory warranty deed, dated October 5, 1969, which serves to fulfill a real estate contract dated October 28, 1962 and establishes location of an easement east of Lot 2. The deed was entered into the record as follows: Exhibit #8: Statutory Warranty Deed PP-327-79 Page Two Mr. Clemens indicated the applicant's amended request would require an exception to the Subdivision Ordinance to allow pipestem configuration of Lots 4 and 8. He noted that because inclusion of Lots 1 and 2 is required in the plat, a requirement by the Utility Division for water main extension on Lake Washington Boulevard North must apply. He corrected an error in Utility Division comments attached to Exhibit #1 which state that a substandard two-inch water main in Park Avenue North must be replaced and advised that a six-inch water main currently existing will provide satisfactory service to the plat. Mr. Clemens indicated that review had occurred regarding the possibility of requirement of a cul-de-sac access configuration located south of the proposed plat extending from Park Avenue North, but it had been determined that the required amount of lot area would reduce potential development of the lots and no substantial evidence of improved access was apparent. Referencing Section M.3 of Exhibit #1, Mr. Clemens deleted reference to resolution of the driveway designation as per Engineering Division comments due to the previous revision in the plat•.configuration. He also recommended approval of the request for exception to allow two pipestem lots for provision of access to interior lots since detriment to public health, safety and welfare was not evident. The Examiner asked the applicant if she concurred in the Planning Department recommendation. Responding was: Mrs. Bruno Nicoli 3404 Burnett Avenue N. Renton, WA 98055 Mrs. Nicoli indicated concurrence in the recommendation as well as agreement to provide an additional fire hydrant and street lighting if determined necessary to supplement existing facilities. She also advised the existence of a large retention system on the corner of Park Avenue North and North 40th Street. The Examiner requested testimony in support or opposition to the application. There was no response. The Examiner then requested confirmation that Tract A and the easement to Tract A from North 40th Street are not included in the proposal as defined in Exhibit #8. Hr. Clemens reviewed the plat configuration designated on Exhibit #7, and noted that the easement granted in purchase of the property is part of Lots 1 and 2 and not proposed for development at this time, and Tract A is a separate parcel created prior to adoption of the Subdivision Ordinance. The Examiner requested testimony from a representative of the Public Works Department. Responding was: Paul Lumbert Traffic Engineering Division The Examiner advised that because the Subdivision Ordinance does not specifically require Dff-site improvements, justification for those improvements required by the Public Works Department must be provided on the basis of public health, safety and welfare. Mr. Lumbert indicated the departmental opinion that the requirement is necessary to provide curb, gutter, sidewalk and paving which are lacking in many areas in the Kennydale community, is well as improve drainage which is currently accommodated by open ditches. He also idvised that full off-site improvements have recently been required in conjunction with development on North 38th Street, and improvements will protect pedestrian and traffic safety to the Kennydale Beach Park located one-quarter mile south of the proposal as well is improve the collector roadway system connecting North 40th Street and Park Avenue North to the major arterial of Lake Washington Boulevard North. Mr. Lumbert advised that ;onditions of approval of previous applications on Lake Washington Boulevard North have included installation of complete off-site improvements. The Examiner inquired if ?edestrian and traffic problems have existed in the area. Mr. Lumbert advised receipt )f requests from residents for crosswalks, traffic control devices, and sidewalks for safety purposes. Responding to Mr. Lumbert's statement regarding existence of open ditches, Mrs. Nicoli idvised that open ditches do not exist on North 40th Street or Park Avenue North, and ?roperties are served by culverts with catch basins. She indicated concern with the -2ity's policy regarding sidewalk requirements due to a recent change in public attitude that such amenities encourage crime and door-to-door solicitation, although she did not )ppose the requirement for the subject plat. Since there were none, the hearing on File No. ?P-327-79 and E-341-79 was closed by the Examiner at 9:42 a.m. PP-321-79 Page Three FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: . 1. The request is for approval of the preliminary plat of Nicoli Addition consisting of seven single family lots in a G-7200 zone and an exception for two pipestem lots. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and significant adverse comments were not expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, and Section 9-1108.23 (Subdivision Ordinance - minimum standards for residential design) of Title IX, Ordinance No. 1628, Code of General Ordinances; except for Lots 4 and 8 which are pipestem lots conforming to Section 9-1108.23.F. (3) . 8. The staff recommended that off-site improvements of curbs, gutters, sidewalks, paving, street lighting, and storm drainage be provided along North 40th Street, Park Avenue North, and Lake Washington Boulevard. That these improvements do not presently exist along these streets in this vicinity was contested by the applicant who stated that street lighting exists in the area and storm drainage facilities exist in Park Avenue North and North 40th Street. Staff testified that traffic and pedestrian problems exist in this area, and that one-quarter mile southerly along Lake Washington Boulevarc is a beach park. North 40th Street and Park Avenue North are designated as collector streets and Lake Washington Boulevard is a major arterial. 9. An exception for two pipestem lots (Lots 4 and 8) was requested. The property has approximately 200 feet. of frontage along North 40th Street and 410 feet of frontage along Park Avenue North. Exhibit #6 shows that part of the interior of the property was divided in 1962 (Exhibit #8) prior to purchase (Tract A) with an easement to Park Avenue North. Staff's review of the alternative plat configurations concluded that a dedicated street along the southerly portion of the property to avoid the pipestem lots would not be advantageous or reasonable in terms of overall traffic circulation and development potential. 10. Per Exhibit #4 the applicant combined Lots 1 and 2 into a single lot to reduce the total number of lots to seven. CONCLUSIONS: 1. The proposal conforms to the goals and objectives of the Comprehensive Plan, zoning regulations and appears to serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . 2. With the exception of two pipestem lots the proposal conforms to the Subdivision Ordinance. 3. Pipestem configurations for Lots 4 and 8 should be approved. The property is narrow and of a "panhandle" shape (with subtraction in 1962 of Tract A) , presenting great difficulty in dividing the property and complying with the Subdivision Ordinance (Section 9-1109.1.A) . Perhaps the most direct method of precluding the necessity for pipestems is dedication of one-half of a public road along the southerly property line. But staff has found this alternative to not benefit the proposal or other adjoining properties. This alternative may substantially reduce the number of lots available for subdivision (Section 9-1109.1.A) . Pipestem configurations have been approved in the past in the general area (e.'g. Exhibit #6 along the north side of North 38th Street) (Section 9-1109.1.B) . Injury or detriment to the public or other properties was not demonstrated (Section 9-1109.1.C) . PP-327-79 Page Four The weight of testimony appears to favor installation of off-site improvements of curbs, gutters, sidewalks and street lighting. Uncertainty exists regarding what storm sewer facilities are available. Traffic and pedestrian problems and particularly the major arterial status of Lake Washington Boulevard seem to support staff's contention that the public health, safety and welfare will be served by requiring off-site improvements along the abutting streets. Additional study by the Public Works Department appears necessary concerning storm sewer systems in the area to conclusively conclude that this off-site improvement should be required as well. . It was suggested by the applicant that the city study the use of rolled curbs/edges and deletion of sidewalks due to alleged experience in other jurisdictions of a direct correlation of vandalism and burglaries with standard curb, gutter and sidewalk. Within the recent past the Council has considered rolled curbs, but this suggestion should be submitted by the applicant if desired to the City Council for further consideration. RECOMMENDATION: Approval of Exhibit #5 subject to: 1. Combining of Lots 1 and 2 into a single lot and revising the rest of the plat accordingly. 2. Installation of off-site improvements of curbs, gutters, sidewalks, street lighting and paving along Lake Washington Boulevard, North 40th Street and Park Avenue North. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. The applicant seeks approval of lots 4 and 8 of this plat and access to the adjoining property through the means of of pipestem lot access . The applicant ' s letter of April 27 , 1979 , describes the proposal . 2 . Lots 4 and 8 are interior portions of the applicant ' s property. Due to the relative depth as compared to the street frontage , these areas cannot be served by the existing exterior street pattern . Development of a public street along the south property line would require inclusion of properties of the adjoining owner to the south . Construction of even a minimum ( 50 foot width ) public street would appear to reduce the development potential of both the subject property and the adjoining property . The loss ,of usable lot area appears to be more than offset by any gain provided by access to interior areas . No adverse impact upon the public health , safety or welfare is evident. 3 . The proposed pipestem arrangement for the Tract A to the south ( discussed in L . 3' of the previous report) will replace a current easement for access required at the time of sale of the property to the applicant . If Tract A is included in the plat , the pipestem request is appropriate and may be considered on its merits . However, the applicant has stated that the owner of Tract A will not allow the area to be con- sidered as a part of the plat , and that the access roadway which currently exists should be considered a separate lot. Staff has requested , but not received , copies of the appli - cant ' s deed in order to confirm the status of this existing access . • We have discussed with the City Attorney the method for appro- val at the access to Tract A , if Tract A is not included in the plat , and the access is not a separate lot of record. Under these conditions, the proposed 20 foot access to Tract A must be considered a separate lot of the plat and a variance for lot area must be granted by the Board of Adjustment , and an exception for lot width approved by the Hearing Examiner. 4 . The proposed plat meets all zoning ordinance requirements concerning minimum lot size (7200 square feet ) and dimensions . However , the west 289 ' of Tract #88 of C . D .
