We offer the following comments for your consideration in the planning for this project: 1. Previously Required Off--Site Improvements at Lake Avenue and Rainier Avenue. The proposal described in your pre-application inquiry does not include any off-site improvements to Lake Avenue; however, please note that Condition 6 of the 1989 approval required the applicant to make off-site improvements to both Lake and Rainier Avenues. Resolution of this issue of code required off-site improvements will have to be accomplished prior to the issuance any new Site Plan Approvals and/or Building Permits. This requirement is also reiterated in comments from the Plan Review Section (see attached memo from Neil Watts). 2. Compliance with Conditions of 1989 Site Plan Approval. Since Taco Time was previously issued Site Plan Approval on October 13, 1989 [File No. SA-054-89], your new application should include narrative addressing compliance with the eight conditions,imposed as part of the Site Plan Approval. It appears from looking at the current site conditions that little if any of the previously required landscaping was installed. For example, the 1989 Site Plan Approval's Condition No. 5. called for outdoor eating and seating in landscaped areas either north of the drive-thru land or on the east side of the site. If this area was installed per the 1989 decision, it should be shown on your existing and proposed site plans. If the area was not installed, than it will have to be completed prior to issuance of any new Site Plan Approval. 3. Comments on Site Plan Proposal. • Landscaping. Although Taco Time recently completed an upgrade of the building's exterior materials, the site improvements, such as landscaping, fall far short of site development standards established by the City through its Site Plan Approval Ordinance. My review comments are based on the assumption that the only work being proposed is the construction of the 434 sf addition shown on the plan. No additional pavement area is being added at this time. No new driveway/curb cuts are being requested. No additional sewer or storm drainage improvements shall be required for this proposed addition. A TIR will not be required for this small incremental addition of impervious surface. No sewer or drainage SUCC fees or permit fees will be triggered by this addition. Provided that the Fire Department does not require additional fire protection coverage, such as a new sprinkler system or an additional hydrant, no new water service improvements, SUCC fees or permit fees will be required. If a new meter is required for irrigation purposes, or an existing meter is upsized to provide sufficient water flow to the site, then permit fees will be required, and the water SUCC fee of$0.126/sf will be triggered. No additional building permits of any type should be issued for this site until the construction permit for the original building permit is obtained. LOCATION: South Second Street/Rainier Ave. South SUMMARY OF REQUEST: The applicant is requesting site plan approval for: 1) addition of a new parking area (15 spaces) and improvements to an existing parking area (Phase I) ; and 2) revisions to the existing structure and drive through lane (Phase II) . COMMITTEE REVIEW: The Committee review was conducted after receiving written comment from all divisions of the Public Works Department, all divisions of the Community Development Department, and the Fire, Police, and Parks Departments. The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting, and publication and other documentation pertinent to this request. Exhibit No. 2 Site plan (received July 7, 1989) . Exhibit No. 3 Landscape plan (received May 17, 1989) . Exhibit No. 4 Building elevation plans. FINDINGS, CONCLUSIONS, AND DECISION Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, Accord, Inc. ,, has requested site plan approval for: 1) addition of a new parking area and improvements to an existing parking plan (Phase I) ; and 2) revisions to the existing structure and drive through lane (Phase II) . Phase I includes an additional parking lot (15 spaces) at the south side of the existing restaurant and modifications to the existing parking area at the east side of the property (14 spaces) to meet Parking/Loading Ordinance requirements (for stall size, maneuvering area, etc. ) . (Note: This eastern parking area was developed without site plan review) . • 2 . The applicant's file containing the application, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. ' Site Plan Review Committee Report and Decision October 13, 1989 Page 2 3 . Environmental review was undertaken for this site at the time of development of Taco Time. No significant impacts were identified at the time of initial development; identified likely impacts were required to be mitigated in conjunction with the initial development (e.g. traffic, noise, aesthetics) . The proposed activities -- the addition of 15 new parking spaces and the remodeling of 14 existing spaces, the restaurant and the drive through lane -- are exempt from SEPA review (197-11-305) , as determined by review of an environmental checklist submitted by the applicant for the proposed projects. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject proposal is consistent with the Comprehensive Plan designation of Commercial Use. 6. The proposed new parking area conforms to standards established in the Parking and Loading Ordinance (4-2204) ; the proposed improvements to the existing parking lot are intended to, and do satisfy Parking Loading Ordinance requirements, as well. 7. The landscaping plan proposed does not fully conform to requirements established by the Landscaping Ordinance (4- 744) , the Commercial Zone Ordinance (4-711) , and the Site Plan Review Ordinance (4-738) . Staff recommendations for modifications will enable conformance with those regulations (See Sections 10.b. - d. of this report) . 8. The subject site was annexed into the City in 1948 by the adoption of Ordinance No. 1320. The site was zoned for Business Use (B-1) when zoning was initiated for the City of Renton in 1953 . 9. Commercial uses surround the subject site. 10. SITE PLAN APPROVAL CRITERIA Section 4-738 (D, 1) lists ten criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: General Criteria a. Conformance with the Comprehensive Plan, its elements and policies; The proposed projects, including additions, improvements and revisions, are permitted under the Commercial designation for this property on the Comprehensive Plan Land Use Map. Similarly, the development conforms with Comprehensive Plan Goals, Objectives and Policies. b. Conformance with existing land use regulations; The proposed modifications to the structure, drive-through lane and parking area generally conform to applicable Zoning Ordinance criteria (e.g. setbacks, dimensions, lot coverage) and other regulations. • Site Plan Review Committee Report and Decision October 13, 1989 Page 3 Staff has recommended some modifications to the project in order to more effectively comply with Landscaping Ordinance and Site Plan Review requirements to develop an attractive, functional site, including upgraded landscaping, outdoor amenities for customers, and improved pedestrian linkage. Additionally, off-site street improvements (sidewalks, curbs, gutters, paving, lighting, etc. ) will be required, pursuant to Section 4-103 of the Uniform Building Code. c. Mitigation of impact to surrounding properties and uses; Potential impacts to the surrounding environment and to neighboring land uses have been identified by staff in the areas of aesthetics, traffic circulation, and public services. Redesign of the restaurant, the drive through lane and the parking area is planned to enable more effective, efficient use of the facility, thereby reducing off-site impacts such as noise, light and glare. Additionally, in order to reduce aesthetic impacts, traffic impacts and public service impacts to the neighboring developments and roadways, staff will recommend that the applicant provide: a) an expanded and upgraded landscaping plan; b) improved pedestrian linkage; and c) off-site improvements, such as sidewalks, curbs and gutters along Lake Avenue. d. Mitigation of impacts of the proposed site plan to the site; Potential impacts to the subject property have been identified by staff in the areas of aesthetics and traffic (vehicle and pedestrian) circulation. Again, applicant proposals and staff recommendations have been made to improve the ambience of the Taco Time development. For example, relocation of the drive through lane and the parking area is planned to enable more efficient use of the facility. Also, in order to reduce aesthetic impacts, and (pedestrian and vehicle) traffic impacts on the site, staff will recommend that the applicant provide: a) an expanded and upgraded landscaping plan; b) outdoor dining areas (picnic tables and benches) for restaurant customers and staff; and c) improved pedestrian linkage to and through the site. e. Conservation of area-wide property values; The proposed modifications to this new commercial complex are not expected to have a negative impact on property values in the area since these actions are designed to: 1) improve the attractiveness and efficiency of the complex; and 2) be compatible with similar uses on neighboring properties. Safety and efficiency of vehicle and pedestrian circulation; The applicant's proposed redesign of vehicle access and on- site circulation plan (parking, drive through, etc. ) is considered adequate to meet requirements for safe, efficient vehicular travel. The on-site pedestrian linkage plan will require improvement to enable safe travel to and from the restaurant and parking areas -- suggested improvements will include an increased number of access routes which are well-marked. Required off-site improvements (curbs and sidewalks and streetlighting) -- particularly along Lake Avenue -- should similarly serve to provide for safer pedestrian travel. g. Provision of adequate light and air; The proposed revised development has been designed and sited so that the structure is generally well-separated from neighboring sites to allow good exposure to natural light and to reduce shadow impacts. Exterior lighting is planned/recommended to supplement natural light so that the site is fully illuminated in order to mitigate aesthetic impacts as well as to protect personal safety and property. h. Mitigation of noise, odors, and other harmful or unhealthy conditions; 1) Construction Construction activity will generate some noise, dust and debris. Standard mitigation measures recommended in conjunction with this site plan review -- e.g. erosion control, designated operating hours, etc. -- are believed sufficient to address these temporary impacts. 2) Operations The proposed modifications to Taco Time (e.g. improved circulation, landscaping, pedestrian linkage, drive through lane, lighting, outdoor seating) are anticipated to achieve some reduction of noise, light and traffic impacts. i. Availability of public services and facilities to accommodate the proposed use; and The site is generally adequately served by existing public services and utilities. Neither the Police Department nor the Fire Prevention Bureau has indicated that their proposed facility would place a major burden on their respective services, if Code provisions (e.g. signage) are met -- indeed the improvements should facilitate better emergency services because circulation on the site will be more efficient. The Utilities Engineer reports that no changes to utilities are necessary as a result of the proposed project modifications. Existing roadways can accommodate additional traffic, however, off-site improvements will be required on Lake Avenue (e.g. curbs, gutters) , since the Public Works Department intends to develop this corridor into a public right-of-way in the near future. (Note: Applicant may endeavor to obtain a deferral for these improvements, with an appropriate bond) . I have several questions about this project. 1) Second page of the blueprints indicate "possible new wall if this part of exist. building is removed." Is this narrow strip to be removed or not? I would strongly support of the removal of such. 2) The landscape illustration does not indicate the addition to the building as proposed in phase II,yet,it is along the south portion of the building that there are several large trees. What is the proposed plan for these trees? 3) The proposed parking along the south end of the lot and around the east edge of the property raises the potential for head on collisions. This driveway needs to be painted and signed appropriately to help reduce this risk. 4) The project description indicates an"adjustment of the existing drive through lane to improve the vehicular routing pattern,"yet there is no indication of such on the plans. O P The State Environmental Policy Act (SEPA), Chapter 43.21C., RCW, requires all governmental agencies to consider the environmental impacts of a proposal before making decisions. Although the State Environmental Policy Act does specify certain categorical exemptions, these.can, in some cases, be modified by local agencies if there.is a likelihood of probable significant adverse impacts from an otherwise categorically exempt project. Although the SEPA rules do not generally require environmental documentation when a project'is categorically exempt, many smaller projects are, in fact, a part of a larger whole which is not exempt. Also, under recent guidelines issued by the Washington State Department of Ecology, it is recommended that agencies reviewing projects show that SEPA was considered. This would be consistent with a 1980 State Court of Appeals decision which held that agencies should consider likely environmental effects before applying the SEPA categorical exemptions.
