A request for a two year extension to the agreement allowing the temporary Renton Municipal Court building in its current location, 2. Project Justification/Reason for Extension. The request is for an extension of two years from the date of expiration of the original three year period of approval granted by the Site Plan Committee in December of 1988. The condition of the site plan approval allowed the temporary courthouse for a period of three years with a possible two year extension. 3. Environmental Review A Determinaition of Non-Significance was issued for the subject proposal on November 23, 1988 FINDINGS, CONCLUSIONS & DECISION Having reviewed the written record in the matter, the City now makes and enters the following: D. Findings 1) Request: The Applicant, City of Renton, has requested Extension of the Previous Site Plan approval to allow the temporary Renton Municipal Court building in its current location. 2) Environmental Review: The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3) Site Plan Review: The applicant's site plan application complies with the requirements for information for site plan review. The applicant's site plan and other project drawings are in the offical project file. 4) Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation of Mixed Use-City Core. 5) Zoning: The site plan as presented, complies with the zoning requirements and development standards of the P-I zoning designation. ADMINISTRATIVE DETERMINATION AND DECISION 1. Administrative Code Determination on Expiration of Previous Site Plan Approval Zoning Code Section 4-31-9 contained in the Interim Zoning Code dated June 7, 1993 (Effective Section Date of Code July 18, 1993) Subject Renton Municipal Court Building Agreement - Request for a 2-year extension. Background • In 1988, the Site Plan Review Committee gave permission to place a 4,570 square foot temporary structure to serve as a courthouse on the Municipal Campus parking lot. The site plan for the temporary structure was approved subject to three conditions, one of which allowed the courthouse for a period of three (3) years from the date of occupancy with a possibility of a two (2) year extension. Justification • The original three (3) year term has expired. A two (2) year extension has been requested through August 20, 1995. An extension is necessary to maintain courtroom facilities until permanent facilities are available. Determination 1) The two (2) year extension for the temporary courthouse is approved through August 20, 1995. Appeals The Appeal Period on this Determination shall run concurrently with the appeal period of the Administrative Land Use Action. REQUESTS FOR RECONSIDERATION must be filed in writing on or before April 5, 1994. Any aggrieved person feeling that the decision of the Site Plan Review Committee is based on erroneous procedure,errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior meeting, may make a written request to the Zoning Administrator for review by the Site Plan Committee within fourteen (14) days of the decision. This request shall set forth the specific errors relied upon by such appellant, and the Committee may, after review of the record, take further action as it deems proper. If an appeal is made to the Hearing Examiner, requests for reconsideration will be forwarded to that office for consideration at the same time as the appeal. AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 4-8(B)(1), which requires that such appeals be filed directly with the Hearing Examiner. Appeals must be made in writing before 5 p.m. on Appeal 5, 1994. Any appeal must be accompanied by a$75.00 fee and other specific requirements. The Committee review was conducted after receiving written comment from all divisions of the Public Works Department, all divisions of the Community Development Department, and the Fire, Police, and Parks Departments. The following exhibits were entered into the record: Exhibit No. 1 Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. FINDINGS, CONCLUSIONS, AND DECISION Having reviewed the written record in the matter, the Site Plan Review Committee now makes and enters the following: Findings: 1. The applicant, the City of Renton, has requested site plan approval to allow for the construction of a temporary structure having two floors with a total of 4, 570 square feet (2,285 square feet each floor) to serve as a courthouse with attendant offices. 2 . The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43 .21C, 1971 as amended) , a determination of non-significance (DNS) was issued for the subject proposal on November 23, 1988, with the following conditions: a. That the applicant must complete the construction and receive all necessary approvals for utilization of a proposed municipal parking lot due west of the Renton Municipal Building complex prior to receiving a Certificate of Occupancy for the proposed temporary courthouse/office structure. b. That the applicant provide a plan which depicts all connections to utility service systems/lines, subject to approval by the Public Works Department. c. That the applicant provide a plan for provision of pedestrian amenities between Mill Avenue and Main Avenue in conjunction with the installation of the courthouse annex and the off-site parking area, to increase safety and efficiency of operations of the entire Renton Municipal Complex. Note: Staff recommends that the applicant enter into an agreement with the City to limit the life of the proposed Courthouse Annex to a period of three (3) years, with a possibility of a two (2) year extension (since the applicant has indicated that the temporary building will be removed in five (5) years) , to ensure that this structure is indeed a temporary one, to be replaced with a permanent structure at the earliest feasible date. 4. Plans for the proposal have been review by all City departments affected by the impact of this proposal. 5. The subject proposal is consistent with the Comprehensive Plan designation of Public/Quasi-Public 6. The site plan as presented, will provide sufficient parking to comply with the Parking and Loading Ordinance of the City of Renton by the construction of a new parking lot to be located on the east side of Main Avenue South between South 2nd Street and South 3rd Street. 7. The subject site is part of the City' s original townsite incorporated in 1901. The site was zoned B-1, Business Use with the adoption of the first zoning map in 1953 . 8. Land use surrounding the subject site is the civic center and park to the north (City Hall & Liberty Park) , the fire station and Renton historical museum to the west, residential to the south on Renton Hill and industrial to the east. 9. The applicant's site plan complies with the requirements for information for site plan review. ' Site Plan Review Commi e Report and Decision - Date Page 3 10. SITE PLAN APPROVAL CRITERIA Section 4-738 (D, 1) lists ten criteria that the Hearing Examiner is asked to consider along with all other relevant information in making a decision on a Site Plan Approval application. These include the following: General Criteria a. Conformance with the Comprehensive Plan, its elements and policies; The land use designation of the Comprehensive Plan for this site is "Public/Quasi-Public" which allows governmental buildings such as the Municipal Court House. b. Conformance with existing land use regulations; The subject proposal is consistent with the zoning designation of the property of B-1, Business Use. A building height of 25 feet is proposed for the structure which is well below the 95 feet height limit of this zone. A 10 foot building setback is required along South Houser Way and 58 feet is being .provided. The building along with the existing municipal building is well below the maximum 65% lot coverage of this zone. Finally, the new building will displace 11 parking stalls and the new building will require an additional 23 parking stalls for a total of 34 parking stalls that will be required. The new parking lot proposed along Main Avenue South will add 47 parking stalls to the City Hall complex. c. Mitigation of impact to surrounding properties and uses; The municipal building is located to the north of the proposed courthouse and to the west is the Parks Department Annex, Fire Station and Renton Historical Museum, all which are compatible with the courthouse building. The residential to the south and the industrial to the east is separated from the site by interstate 405 and while not highly noticed, will be able to be viewed from the higher residences of the Renton Hill neighborhood. Existing landscaping around the perimeter of the site and relocated trees adjacent the planter by the courthouse will soften the visual appearance of the building. d. Mitigation of impacts to surrounding properties and uses; The subject site was landscaped in 1968 with the completion of the Municipal Building. Twenty years of growth has provided a beautiful campus of maturing ornamental trees, shrubs and groundcover. The location chosen, is one that is the least disruptive to the existing parking of the complex but will reduce substantially, one of the larger , landscaped islands of the complex. Four of the existing large red oak trees will be removed from - Site Plan Review Commie e Report and Decision Date Page 4 this location, but three of them will be replanted around the outside planters that will surround the courthouse building. With the relocated trees and new shrubs and groundcover that is proposed to be added, the impact should be minimal to the surrounding uses and view from upon Renton Hill. e. Conservation of area-wide property values; The subject development will have minimal impacts on the area-wide property values. f. Safety and efficiency of "vehicle and pedestrian circulation; Condition No. 3 of the environmental mitigation measures issued for this project has asked for the provision of pedestrian amenities with this project and the future parking lot that will follow to "increase safety and efficiency of operations of the entire Renton Municipal Complex" . The site plan has also illustrated that pedestrian walkways will be provided on both the east and west sides of the building along with four exits (which will also be accessible for the handicapped) . The building location should not pose a safety problem with either motorist or pedestrians and will not change the flow of traffic. g. Provision of adequate light and air; Windows on the courtroom building are to be provided, on both the east and west elevations of both floors and should provide the users of the structure adequate sunlight and air. h. Mitigation of noise, odors, and other harmful or unhealthy conditions; The subject proposal will not result in any adverse noise, odors or other harmful conditions. i. Availability of public services and facilities to accommodate the proposed use; and The subject property is adequate serviced with public services such as water, sewer and electricity. j . Prevention of neighborhood deterioration and blight. The project is a temporary use and is not expected to result in any long term impacts on the surrounding uses which will result in neighborhood deterioration and blight. Conclusions: 1. The subject proposal generally complies with the policies and codes of the City of Renton. 2. Specific issues raised by various City departments and focused on were: a. Permanent parking must be in place before the new courthouse can be occupied. Site Plan Review Commil e Report and Decision Date Page 5 b. Mitigation of aesthetic impacts. c. Possible adverse impacts with parking. d. Developing a signing plan designating different uses for parking (ie: carpools, handicap, motorcycle/bicycle, visitor, etc. ) . 3 . The proposal complies with the Comprehensive Plan designation of Public/Quasi-Public. 4 . The proposal does comply with the zoning designation of B-1, Business Use, on the property. 5. Eleven existing parking stalls will be lost because of the courthouse building as well as some of the existing City Hall landscaping, but its location in this area of the complex minimizes the loss and still allows the current vehicular circulation of the complex to continue. 6. The courthouse will also require approximately 23 new parking stalls in addition to making up for the lost parking stalls mentioned above. A separate site plan approval application (file: SA-112-88) has been requested to permit for this new and required parking on a nearby lot on South Main Street. This new lot is expected to provide parking for 47 vehicles. Decision: The site plant for the temporary courthouse, file no.SA-099- 88 is approved subject to the following conditions: 1. Compliance with the conditions imposed by the Environmental Review Committee, File No. ECF-099-88. 2 . The temporary courthouse shall be allowed for a period of three (3) years from the date of occupancy with a possibility of a two (2) year extenetion for good cause shown. In no case shall the temporary courthouse be permitted beyond five (5) years. 3 . When the courhouse is vacated or the time period for its use is terminated, the courthouse shall be removed from premises of the site and that area shall be restored to its original condition of parking and landscaping. For the purpose of these decisions, the term "should" and "shall" are to be considered mandatory and the term "may" is considered discretionary. Notes to Applicant: An applicant complying with these provisions and willing to hold the City harmless for any expense or damages incurred for work begun prior to the exhaustion of the 14-day appeal period and/or for work which may consequently be stopped by an appeal or work required to be altered or returned to its preconstruction state, may begin construction activities with the issuance of the proper permits. 1 Report and Decision Date Page 6 ORDERED this 29th day of December, 1988 . on behalf of the Site Plan Review Committee. /1/( L Donald K. The Washington Department of Fisheries ' primary concerns are related to storm water run-off . The introduction of pollutants such as oils, heavy metals, phosphates, etc. constitutes one of the more serious impacts to urban area streams and rivers . These pollutants enter the rivers and streams through storm run-off systems . Most run-off system designs consist of underground pipes leading to either underground detention vaults or detention ponds designed to prevent downstream flooding. Unfortunately, even with oil/water separators, these systems concentrate pollutants, then discharge them to the receiving waters . Therefore, some means to remove typical urban-related pollutants is necessary in addition to the standard oil/water separators . This can be accomplished by designing shallow grass-lined swales leading to open detention ponds large enough to establish vegetation within them. It is that vegetation, acting in concert with the grass-lined swales, which create a bio-filter . An Hydraulic Project Approval will be required for any work within the ordinary high water mark of state waters .
