Contract Change: Revise Drawings Numbers 23,27 through 30,and 35. A lump sum amount of$24,922.31 is proposed for this continuation of Change Order#15,to compensate for the additional work to complete this change.This lump sum amount includes labor, materials and equipment and applicable markups. In reviewing the materials attached to your letter, the Engineer has suggested what he considers to be an equitable adjustment in spite of a lack of adequate supporting documentation as follows: 1. In Exhibit A you seek compensation for 38 hours of regular time and 5.5 hours of overtime. These hours were estimated and not tracked as required for force account work and not supported by the IDR's. Time for review of change order plans are considered overhead and not allowable. 2. In Exhibit B you seek compensation for 30 hours of the three man crew and 32 hours for the Grade Engineer that operated the Trimble Total Station. We paid 32 hours for the Trimble Total Station and 10 hours for the three man crew. In addition we agree to pay 32 hours for the Grade Engineer and 20 hours for the three man crew. For flagger(Group 3) hours, compensation for 10 hours is proposed to match the description of work which describes 10 hours for flagging, instead of the 17 hours previously granted. $4,773.33* 3. In Exhibit B you seek compensation for 20 additional days of Traffic Control Supervisor. We agree to pay a lump sum cost based on a prorated number of working days. $10,500 4. In Exhibit C you seek compensation per Transportation Systems Inc. letter No. 237-037 for permanent signing labor. We agree to pay for 8 hours of labor. $577.52* 5. In Exhibit C you seek compensation per Transportation Systems Inc. letter No. 237-037 for the cost of steel plates used in the gas line conflict. We agree to pay for 5 days of rental. $471.29 6. There was no supporting documentation for the materials. We agree to pay for the 32 hours of labor. $2,310.08* We have spent some time trying to evaluate your continued request for extended overhead for the 20 additional working days. The work performed during that time was either by force account that included the required markup that covers all costs associated with the work or by unit prices that include overhead. The Engineer finds the request for extended overhead not allowable. It is our desire to fairly pay ICON Materials for all the work performed under this contract and its change orders. However we cannot pay for claims that are not justified or have no documentation. On May 31,2013 ICON Materials responded in Letter 022 acknowledging receipt of the change order and notifying the City that ICON Materials does wish to challenge the accuracy of the costs provided in the change order. Below and attached you will find our list of inaccuracies and supporting documentation. In Exhibit A of Change Order 18,the City is paying one hour per day for Christine DeYoung and Jason Betzer for site maintenance for the period of 7/5/12—7/13/12. The estimate sheet(City Exhibit A)states, "This estimate based off certified payrolls and Inspector Daily Reports." If certified payrolls had actually been used, they would have shown that Christine and Jason actually worked 38 regular hours and 5.5 overtime hours the week of July 9, 2012. The certified payrolls also show that Christine's time on 7/5/13 was 4.5 hours and 7/6/13 was 4 hours. ICON only billed for 40 straight hours for the week of 7/9/12. If the City would like to pay the straight time and overtime based off of the certified payrolls, ICON will agree to that. On June 29,2012 and July 10, 2012, ICON Materials and the City met at the City of Renton to discuss the inaccurate and conflicting change order plans that had been distributed to ICON in various unacceptable methods. It was agreed upon at these meetings that the change order plans were not complete and that KPG should never have transmitted them to the contractor in that condition. It was also agreed to in these meetings that ICON personnel would work diligently during the shutdown to review the plans and find and report all errors to the City who would also work diligently to fix the errors. This was all in attempt to minimize the down time and impacts to the project caused by the change order. ICON followed through with the agreement and spent the entire week of 7/9/12 finding mistakes and planning for the work. Some of the several mistakes(including luminaires in the roadway)and questions are attached in Exhibit A. They include the list we brought to our meeting on 7/10/12 and RFI No. 00014 and No. 00015. The City is also conveniently forgetting that ICON went back to work on the project on July 16,2012 without the final revisions to the Highlands to Landing change order plans and without our electrician able to work until all of the electrical revision mistakes were corrected and reissued. This change order was supposed to compensate for those impacts. ICON held up our end of the verbal agreement between Bob Hanson and Tim Davis to help mitigate the impacts of KPG's inaccurate, error filled and late change order plans and the City is not compensating ICON for turning the project into a design-build. ICON stands firm and requests payment again on the amount billed for Standby Costs & Review of CO Plans (Week of 7/9/12)attached again in Exhibit A. In Exhibit B of Change Order 18, the City does pay for most of the costs that ICON has billed for. However, it appears that the City made two mistakes in their review. For the 32 hours of survey billed, the City paid 32 hours for the Trimble Total Station, but no hours were paid for the Grade Engineer operating the Trimble. ICON also billed for 30 hours of a 3 man crew. The City only paid for 10 hours of the 3 man crew even though the notes on the estimate sheet (City Exhibit B) in the Description of Work box state, "30 hours for 3-man crew." The City also didn't pay for 20 extra days of the TCS lump sum bid item. This bid item is based on there being 80 working days of contract time which has been significantly increased and is well above the percentage required to qualify for an adjustment in price. If these mistakes are corrected, ICON will agree to Exhibit B of the change order. For Exhibit C of Change Order 18, see Transportation System's attached letter in response to the revisions made by the City. Regarding extended overhead,the contract allows for equitable adjustment of additional costs and time incurred as a result of changes and delays that are not the fault of the contractor. Clearly ICON is not at fault for the changes and delays caused by the inaccurate and conflicting change order plans issued by the City that are the subject of this change order. Including this change order, 62 working days have been added to the original contract time of 80 working days. In addition to increasing our cost to perform the work associated with these changes,the additional time has caused ICON's cost to administer this contract to increase significantly. Accordingly,we are seeking reimbursement for the 20 additional days of overhead caused by this change order. We previously provided a detailed cost breakdown of these costs which was denied on account of ICON not providing documentation. We have asked the City to be specific as to what further documentation is required, but have yet to be provided with this information. The City is aware that ICON incurred additional costs for the items listed and therefore we find it unreasonable that they would deny reimbursement of these costs when ICON has done nothing wrong to cause the changes that have so significantly increased the time of the contract. There is no other means or avenue available to us to recover these costs other than to identify the extended overhead items as we have done and provided detailed cost information as documentation. The overhead cost included in our bid for this project was calculated according to there being 80 working days of contract time to complete the work. Now that the contract time has been almost doubled, the City has to recognize that this has caused our overhead costs to increase as well the bid items affected by this change and provide an equitable adjustment for both. There are several issues with the City review that we are not in agreement on with Exhibit C. First of all,the City has added permanent signage to the contract,and only wants to pay for the added material. There is labor associated with the installation that needs to be paid for to install the added materials. We had an additional 8 hours to install these signs and posts. We request to be compensated for this added work. Second,the steel plate costs are what they are. We have submitted the invoice for the cost of the material and service. That is a fixed cost with our supplier. We have to pay the tax one way or another. This total should be$942.58. Thirdly,the additional night work request is for the added aiming,installations, and other work associated with the change that will have to be done at night. There is a premium cost to perform this work at night. That is why we added this in. The additional traffic signal items will have impacts to our work and creates added night work for the crew. This needs to be compensated for. Fourth,the demobilization and remobilization is an item that is directly attributable to the contract. If we have to demobilization due to the fact our materials have changed and is caused by the agency, then the mere fact of removing equipment,materials and cleanup of the site needs to be compensated for. It's a direct cost to us that we would not anticipate incurring. Then to remobilize,we have to get our equipment on site,materials on site from storage,and familiarize our crew with the work again. We are in general agreement with the quantities and the pricing is supported by the backup information provided. There are a few conduit and conductor quantities that don't match with our estimate of additional work based on plan quantities as identified on the attached .pdf. These don't affect the overall cost significantly and we recognize that the plan conduit routing is schematic and will not match exactly what was actually installed,but wanted to point out the discrepancies. It may be that their quantities include the RapidRide changes as well, but we don't have any information on the scope of those changes. However,collectively,there seems to be a disagreement with the City of Renton as to whether or not we are entitled to additional compensation for additional time and the cost of that additional time it requires to complete the project for the City of Renton. I would like to respond to the City of Renton letter dated 12-18-12,relating to the Highlands to Landing Change Order Pricing ICONN letter 15. In regards to item#1,(signal base#2),we were only paid for a portion of the day on force account. The fact is we had two days of delay on this base due to an obstruction that was unforeseen,but,we were only paid for a portion of the time on force account. Had we been able to drill the foundation in one day,we would have been able to move to another base,but,we were unable to proceed due to the unforeseen obstruction. This is shown in letter 237-019 and in the attached force account sheets. As the force account documentation shows,we were only being paid for a portion of the day we were impacted,not the full day or for the two days the obstruction actually caused. Additionally,myself and another project manager came out to the project,but,the inspector did not want to agree to my time or my project manager time spent on assisting the field even though we assisted in planning on how to remove the obstruction and how to proceed. This is also shown on the force account documents. The additional backup information detailing our itemized costs,we have included those,and have attached them again for reference for this change order. As for the additional electrical permit cost,once the change order is executed,we would need to extend the electrical permit to cover the cost of the additional work. Along with the changes,we added in a few of the conflicts we have ran into during the phase 1A portion of the project. This change makes several revisions to the project,such as new pedestrian poles and foundations, conduit revisions, and signal gear additions. There will be additional time required to construct the traffic signal portion of the project with this change,as well as more time coordinating the changes in materials with our suppliers. For instance,we had to work closely with our supplier on the Polara Push Button System. This system is more involved and takes more time managing the proper programming for each push button. Attached is our lump sum cost breakdown excluding additional overhead costs is set at$69,857.77,which includes use taxes on materials only. We are requesting additional days be added to the contract to cover the additional time required to make the revisions in the amount of 20 days. This will cover the additional time to manage procurement,and then installation. In addition to this change request,we seek an equitable adjustment to the contract to cover the additional office overhead expenses needed to manage the project from researching the changes to coordinating the additional material needed to complete the change. Signal Base#2 had a large obstruction in the base of the foundation at approximately 9 feet deep. We lost time while trying to remove the obstruction and ultimately had to excavate and pull out the obstruction. This caused our production to slow down and impacted our ability to complete the base on schedule. The obstruction was an old bollard that had been dumped in the area. 2. Luminaire base 21 had a gas line conflict,which caused a delay of two days for installation until it was determined where to move it. There was added conduit to the road crossing at Lake Washington Boulevard the night of the crossing with this change that we were unaware of,thus we ran out of conduit that night,and had to complete the road crossing at a later date due to the shortage of conduit. This added another day for us to complete the NW corner conduit system and tie it together to F line change and original contract drawings. 5. Additional management time to work with suppliers on material changes and submittal drawings. Specifically,had to determine the Polara Push Buttons style and programming. During the Friday June 29th,2012 meeting in your office, ICON and Bob Hansen agreed that discussion and further direction is necessary in order for ICON to be able to proceed with the work on the project. Bob also indicated that this direction and discussion would continue on Monday July 2, 2012 to make decision(s)as to how to proceed with the revised plans,rework and payment methods for the changes to the work that has been and continues to occur in Phases 1A and lB.
