The Local Agency of City of Renton desires to supplement the agreement entered into with BergerABAM Inc. and executed on 4/17/2009 and identified as Agreement No. CAG-09-077 All provisions in the basic agreement remain in effect except as expressly modified by this supplement. SECTION If SCOPE OF WORK Replace the scope of work under Supplemental Agreement No.3 with the following. This supplement provides scopes of work for eight primary tasks to be completed for this project, as shown below. The scope of work for Task 100,Start-Up Services, applies to the entire Strander Boulevard Extension project. Scopes of work for Tasks 200 to 700 apply to developing plans, specifications, and estimates of probable construction cost and time for Phase II of the Strander project from 1 October 2010 thru 15 June 2011, as described below under Task 100. Task 800 establishes an allowance for Design Construction Support Services. Brief scope of work descriptions for these tasks are shown below. More detailed descriptions for these primary tasks are provided in Exhibit A to this supplemental agreement. The scope of work shown in Exhibit A provides estimated costs for each task. It is understood that these costs are estimated costs and are not to be deemed maximum amounts for these tasks. The total agreement has an established maximum amount payable. The CONSULTANT may transfer funds between tasks and between the CONSULTANT and SUBCONULTANTS to best achieve project needs without prior approval of the City. Services during construction of Phase II,except for the allowed amount provided for Task 800, and for design of Phase III will be addressed in future supplements and are not included in this scope of work. TASK 100-START-UP SERVICES Start-up services include services authorized under two separate interim authorizations to define the configuration and costs of the Strander Boulevard project from Naches Avenue SW to West Valley Highway. These services have been performed from January 2010 thru September 2010. Start-up services include services expended on the project from March 2010 thru September 2010. During this time period,the project configuration was revised from that defined in the scope of work developed for Supplemental Agreement No.3. The project scope has been diverted back to the original intent of the project,which is to connect Oakesdale Avenue SW to West Valley Highway via a grade separated [from the Union Pacific Railroad (UPRR) and the Burlington Northern Santa Fe(BNSF)Railway tracks] four-lane arterial. A connection to the Sound Transit Tukwila Station will also be provided. Start-up services included development of a technical memorandum that defined the project configuration. This memorandum also defined interfaces with the Strander project and the companion Sound Transit Tukwila Commuter Rail Station project. These services also included an update to that technical memorandum to reflect client and other third party project III requirements. This updated technical memorandum represented a 35 percent design level City of Renton BergerABA1\1,FAPWT-09-175 Strander Boulevard Project February 2011 Phases II and III Revised Scope of Work Page 1 of 8 0 • submittal for Phase II and for Phase III of the Strander Boulevard grade separation project as described below. This technical memorandum showed the Strander project being constructed in three phases. Phase I connects Oakesdale Avenue SW to Naches Avenue SW. This at-grade section of roadway has been constructed. Phase II constructs the BNSF Bridge. A railroad shoofly and associated utility relocation and protection measures for(1) relocating fiber optic utilities with the BNSF right-of-way(ROW) and(2) protecting major utility where with the widened shoofly embankment crosses these utilities will also be constructed. Major utilities are a 60-inch-diameter pressurized Seattle Pacific Utility(SPU) waterline,two Olympic Pipeline gas lines(12-inch diameter and 14-inch diameter), and a 36-inch diameter King County Metro sanitary sewer line. This phase will also include a two-lane roadway connection from Naches Avenue SW to the Tukwila Station. This roadway connection will pass beneath the BNSF Bridge. A water quality/detention wetland and stormwater pump station will also be part of this roadway construction. Construction of the underpass requires installation of the groundwater management system to prevent flooding of Strander Boulevard roadway where the roadway elevation is below elevation of the surrounding groundwater. A 30 percent BNSF submittal was also developed to define the railroad interfaces to the Strander Boulevard project. BNSF currently has under design a third rail project that will add a third rail to the east side of their current two tracks in the project area. The project has been configured so that the shoofly embankment could provide a mutual benefit to this third rail project and to the Sound Transit Tukwila Station project. However,the current project configuration includes only the embankment construction to support the shooflies necessary to construct the BNSF Bridge over Strander Boulevard. Phase III will complete the four-lane Strander Boulevard from Naches Avenue SW to West Valley Highway. In this phase,the UPRR Bridge will be constructed. A four-lane roadway with center left-turn lane and joint use path will be constructed. A vehicle access ramp into the Tukwila Station will be constructed. Pedestrian connections will be made to the Interurban Trail and to the Tukwila Station. This phase is yet to be funded. TASK 200 - BergerABAM PROJECT ADMINISTRATION, COORDINATION,AND MANAGEMENT These services include project administration, coordination, and management attendance and preparation for project meetings with the cities of Renton and Tukwila,meetings with Sound Transit and BNSF regarding this project and interfaces with companion projects, and meetings with affected property and utility owners. Project administration,coordination, and management activities provided by SUBCONSULTANTS are included in other primary tasks. The railroad bridge includes design of the "boat" section within the footprint of the BNSF Bridge. These services also include technical assistance to the cities of Renton and Tukwila in securing the Construction and Maintenance (CM)Agreement between BNSF and the City of Tukwila. These services also include support to the City during construction contract ad,bid,and award. TASK 400-GEOTECHNCIAL ENGINEERING These services include geotechnical explorations, testing, and recommendations in forms of geotechnical design memoranda required for the project. Geotechnical memorandum will include geotechnical design recommendations for the design and construction of the BNSF bridge and associated shoring,the BNSF shoofly,BNSF shoofly bridges and associated shoring, the Strander roadway,retaining walls along the Strander Roadway, and dewatering systems for construction dewatering and for"permanent" groundwater dewatering. These services also include support to the City during construction contract ad,bid, and award. Services do not include geotechnical explorations,testing, and/or assessment of soils regarding levels of contaminants. TASK 500-CIVIL/STRUCTURAL ENGINEERING These services include civil and structural design for the roadway,roadway boat section, storm drainage,pump station,water quality and detention pond, and illumination. This design also includes staging, site preparation, and temporary erosion control for the entire project. A list of drawings that were used as a basis for this scope of work is shown in Attachment A-1 to this exhibit. This task also includes an allowance for construction verification and/or pot hole surveys. These services include development of submittals for the City of Renton,City of Tukwila, Sound Transit, and utility owners. Development of project cost estimates and of project design and/or construction schedules associated with these submittals are included in this task. These services also include support to the City during construction contract ad,bid, and award. TASK 600- RIGHT-OF-WAY ACQUISITION This task includes securing and certification of the ROW needed to construct the project as described below. ROW acquisitions include parcel or partial parcel purchases,permanent access and/or utility easements, temporary construction easements, and/or temporary access easements. Included in these services are securing title reports, development of an updated PLS base map boundary survey, development of ROW plans, obtaining property appraisals and property review appraisals, developing and boundary line adjustment(BLA)between the City of Renton and the Boeing Company for land adjacent to the east BNSF ROW boundary between Strander and the BNSF signal bungalow located along the track near the Bank of America City of Renton BergerABAiNI,FAPWT-09-175 Strander Boulevard Project February 2011 Phases II and III Revised Scope of Work Page 3 of 8 parcel, and assisting the City in securing ROW certification from the Washington State Department of Transportation(WSDOT). TASK 700-VALUE ENGINEERING STUDY Certain funding sources require that projects with high capital costs be subject to a Value Engineering(VE) Study. This study will involve a three-day study by a panel of experienced engineers and a cost estimator under the tutelage of a VE facilitator. This study and panel will focus on ways of achieving project objectives at a reduced cost. Members of the CONSULTANT project design team will not be panel members. These VE services are included in this task. TASK 800 - DESIGN CONSTRUCTION SUPPORT SERVICES(CSS) This task provides an allowance(allowed amount) for design CSSs. These services include efforts of project SUBCONSULTANTS. Therefore, this proposal assumes that some rework of the PS&E documents will be done following receipt of City of Renton BergerABAiII,FAPWT-09-175 Strander Boulevard Project February 2011 Phases H and III Revised Scope of Work Page 5 of 8 0 this additional information. This rework could be done as revisions to the PS&E documents prior to being issued for bid or as an addendum during bidding. The effective date for this Supplemental Agreement is 1 October 2010. The following SUBCONSULTANTS are added to the table shown in the revision to Paragraph 1,Hourly Rates,of Exhibit D-3 as follows. CONSULTANT DIRECT SALARY COST MULTIPLIER HDR Engineering, Inc. 2.823 OAC Services, Inc. 3.112 BCE Engineers, Inc. 3.050 RH2 Engineering, Inc. 3.175 Authorization up to a maximum amount of$2,114,900 is granted for this scope of work. This amount does not include the$100,000 management reserve fund (MRF). That MRF is available for use on this scope of work. Prior authorizations against this scope of work include the following. • $19,900 authorized under the initial agreement and Supplement No. 1 • $200,000 authorized on 19 March 2010 against Supplement No. 3 • $300,000 authorized on 8 July 2010 against Supplement No. 3 • $359,100 authorized on 19 November 2010 against Supplement No. 3 • $270,000 authorized on 5 January 2011 against Supplement No.3 • $771,114 authorized on 16 February 2011 against Supplement No. 3 It is also agreed that the CONSULTANT may transfer funds between Tasks 200 and 700 and between the CONSULTANT and SUBCONSULTANTS to best achieve project needs without prior approval of the City. Any transfer of funds from those shown in Exhibits E and G to this Supplemental Agreement will be provided to the City in writing. It is also recognized by both parties that efforts to provide services under Task 800,Design Construciton Support Services(CSS) to this supplemental agreement,is an allowed amount and can vary considerably from this allowed amount. CONSULTANT will monitor total costs expended under Task 800 and will notify the City when costs for Task 800 have reached 75 percent of the allowed amount for Task 800. At that time. CONSULTANT will provide the City with an estimated amount to complete the work for Task 800. If CONSULTANT's costs for the remaining work under Task 800 are estimated to be higher than the allowed for amount in this supplement,the remaining work above the allowed amount will not be performed without prior written authorization from the City,which shall not be unreasonably withheld. CONSULTANT shall have no obligation under this agreement to provide services for Task 800 where the cost would exceed the authorized allowed for amount. The project configuration shown in the Technical Memorandum,Updated 35 Percent Design, Configuration and Design Standards for the Strander Boulevard Extension Project for the Cities of Renton and Tukwila, dated 11 October 2010, is used as the basis for this scope of work with the following modifications. a. The Sound Transit Tukwila Station will remain in its current location along the BNSF tracks. This location is north of the location shown in the 35 percent Technical Memorandum. b. The BNSF embankment will only be widened to construct the shoofly. C. Two temporary bridges will be used to protect utilities over the Metro Sewer and the BP Fuel Pipelines. d. No bridges will be used to protect the SPU waterline. e. The Phase H roadway will be constructed,including a "permanent" underdrain system connected to the stormwater pump station. A boat, as shown in the above technical memorandum,will not be utilized. f. The Phase H two-lane Strander will extend approximately 50 feet north of the southern Sound Transit property line. 2. The project will be bid using cumulative alternates bidding in accordance with the WSDOT GSP. a. The base bid will include the BNSF Bridge and associated shoring, the shoofly, the shoofly Metro Sewer and BP Fuel Lines temporary utility protection bridge, fiber optic relocation and a lump sum item for construction access. b. Alternate 1 will include the two-lane Strander Boulevard roadway into the Sound Transit Tukwila Station,the four associated walls, associated roadway excavation the pump station, storm drainage,the pond,lighting, and an additive or deductive item for construction access to the base bid construction access lump sum bid item. C. Alternate 2 will include the emergency generator for the pump station. Right-of-way(ROW)sought for the project includes the following. ■ Develop a boundary line adjustment(BLA)that exchanges property between the City of Renton and the Boeing Company along the east side of the BNSF ROW between Strander and the signal bungalow. ■ Tax Parcel Number 0886700090-Acquire southwest section about 100 feet east-west and 10 feet north-south from The Boeing Company. This section will be part of a BLA o Tax Parcel Number 2523049087-Purchase a south section of about 12,600 square feet from Sound Transit ■ Tax Parcel Number 2523049006-Acquire entire parcel from the City of Tukwila ■ Tax Parcel Number 0886700300-Acquire a permanent access easement along the southernmost 20 feet of this property from the Boeing Company for BNSF access to their signal bungalow. This property transfer will be part of the BLA e Secure long-term construction easements to allow the long-term installation of tiebacks into Boeing Parcel Number 0886700270 and Sound Transit Parcel Number 2523049087 3. Temporary construction easements and temporary construction access easements will be sought from up to 20 parcels, in addition to those identified above from The Boeing Company,City of Seattle,Sound Transit, City of Tukwila, and the City of Renton. 4. Traffic studies are excluded. 5. The City will be securing environmental clearances and permits. CONSULTANT support in these efforts will include creation of exhibits,project descriptions, and calculations 6. CONSULTANT or any of its subconsultants are not responsible for schedules beyond their direct control. 7. CONSULTANT or any of its subconsultants will work to produce a design that BNSF, Sound Transit, and/or utility owners will accept. 8. CONSULTANT or any of its subconsultants do not ensure that property owners will accept offers extended. 9. CONSULTANT or any of its subconsultants will produce a design that will be acceptable to BNSF. Where key understandings and/or assumptions are listed as being understood between CONSULTANT and their subconsultant to this scope of work,it is understood that these same key understandings exist between the AGENCY and CONSULTANT. Task 205 - Design to Budget CONSULTANT will coordinate with CITY to continually update the available funds for construction and modify the elements and design of the project to result in a bid likely to fit within the available funds. The railroad bridge includes design of the "boat" section within the footprint of the BNSF Bridge. These services also include technical assistance to the cities of Renton and Tukwila in securing the Construction and Maintenance(CM)Agreement between BNSF and the City of Tukwila. A more detailed scope of work for this task follows. The following key assumptions were followed during development of the proposed estimate of effort for this work: • SUBCONSULTANT will design and prepare drawings for the railroad bridge structure and roadway base slab for the 82-foot-wide structure depicted in the 30 percent plan submittal. SUBCONSULTANT assumes no responsibility for the adjacent permanent retaining walls or roadway slab outside of these limits. • SUBCONSULTANT will design and prepare drawings for the temporary shoring to construct the aforementioned bridge as depicted in the 30 percent plan submittal. SUBCONSULTANT will not design temporary shoring to construct the adjacent permanent retaining walls or roadway slab outside of these limits. SUBCONSULTANT has assumed that the temporary retaining walls will be sheet pile with tiebacks, and has not accounted for other wall styles in the estimate of effort. • SUBCONSULTANT will design and prepare drawings for the temporary shoring at three utility bridge locations. It is assumed that this temporary shoring will be similar to the temporary shoring required to construct the railroad bridge. SUBCONSULTANT has assumed that this temporary retaining wall will be sheet pile with tiebacks, and has not accounted for other wall styles in the estimate of effort. • All geotechnical input will be provided by Shannon&Wilson. • Flagging protection or permit fees of any kind have not been included in the estimate of effort. • The project schedule is contingent upon timely reviews by all reviewing parties. SUBCONSULTANT is not responsible for delays caused by long review periods. • SUBCONSULTANT assumes that the bridge concept and key components presented in the 30 percent plan submittal will remain the bridge configuration moving forward. The current scope of services and estimate of effort does not include significant changes in any structural component or layout of the bridge,shoring,or tracks. • SUBCONSULTANT makes no warranty or assurance that BNSF will approve the project concept for construction. Sixty-foot-deep observation wells used for the dewatering pumping test will be installed in three borings. S&W's proposed tasks are as follows. 1. Meet with the project team to review project effort and select optimum location for dewatering pumping test well to maximize potential for use in final dewatering system. 2. Retain a drilling subcontractor for well construction, test pumping, and trench excavation. 3. Clearing to provide drill rig access to the BNSF ROW would be accomplished using a skid steer with a brush cutting ttachment. Cleared vegetation would be left on the g g cities of Renton and Tukwila ROW,immediately east and west of the BNSF ROW, respectively. 4. Monitor construction of a 24-to 30-inch-diameter pumping well with a 12-inch-diameter casing and screen,located to serve as a dewatering well during construction. 5. Monitor construction of 6-to 8-inch-diameter observation wells with 2-inch-diameter casings and screens. 6. A BNSF flagger may be required for up to about eight days during brush clearing at MW 1 MW-3 and PW-1 and durin g drillin g at all four wells. 7. Obtain soil samples from pumping and observation wells at approximately 5-foot intervals for characterizing subsurface conditions. 8. Take soil samples from the bottom of the infiltration trench. 9. Perform sieve analyses on nine samples to develop grain size distribution curves upon which to base test pumping rates and estimate permeabilities at individual well locations. 10. Upon completion of the work,complete wells with security enclosures to allow use during construction. This task includes a 4-hour pretest pumping scenario,a 24-hour pumping test, a 24-hour recovery test, and a 24-hour infiltration test. S&W's scope of work includes the following effort. 1. Install transducers and data loggers in all the wells and the infiltration pit. 2. Monitor installation and operation of the test pumping equipment and test discharge rates. 3. Conduct a pre-pumping test to confirm the long-term pumping rate for the 24 hour dewatering pumping test. Assumption that groundwater can be discharged on site for tests. 4. Monitor the pumping and recovery tests, and manually check groundwater drawdown and recovery. Toward the end of the pumping test, collect groundwater samples from the discharge and conduct biological reaction tests(i.e.,iron,hydrogen sulfide,nitrate, and slymeTM test for slime) to determine potential for well plugging during construction dewatering. S&W will also analyze the discharge for common organic and mineralogic parameters(i.e.,phosphate, zinc, arsenic,total hydrocarbons, and volatile organic compounds) that might impact discharge to storm or wastewater sewers in the event on-site recharge is not feasible. Refine Dewatering Parameters Under this task, S&W will refine the controlling factors influencing dewatering flows and impacts. Their proposed scope is as follows. 1. Analyze the pumping test data to determine transmissivity, storativity, permeability/hydraulic conductivity, and radius of influence. 2. Develop a revised conceptual dewatering model for the proposed unshored excavation and shoring system alternatives, assuming groundwater will be lowered to 3 feet below the proposed excavation. 3. Meet with the project team to confirm dewatering requirements (i.e., dewatered area, perimeter, depth, etc.)prior to our analyses. Refine Estimate of Dewatering and Recharge Flows Under this task, S&W will recalculate potential construction dewatering flows based on a probable range of hydraulic conductivities based on the pumping test data using analytical and/or computer models(i.e.,MODFLOW, Excel Interference,etc.)for the conceptual dewatering model developed in Task 3. We will also evaluate the potential for dewatering discharge disposal and estimate the size of the infiltration pond necessary to accommodate long-term dewatering. S&W's proposed tasks are as follows. 1. Recommend dewatering approaches suitable for construction and provide an outline of basic system elements(i.e.,conceptual well design,potential well yields,well/wellpoint spacing,etc. 2. Meet with the project team to discuss the recommended approach and general construction and shoring approaches. 3. Develop costs for dewatering system installation and operation. 4. Tailor owner/engineer's standard dewatering specifications for inclusion in contract documents. Schedule for Preliminary Dewatering Evaluation 1. Prepare draft preliminary dewatering evaluation report four weeks from notice to proceed. 2. Meet with project team to discuss findings and recommendation presented in the draft preliminary dewatering report. 3. Prepare final draft preliminary dewatering evaluation two weeks after receipt of comments on draft preliminary dewatering evaluation report. Schedule for Final Dewatering Evaluation 1. Assume three weeks to obtain access/right-of-entry permits. Begin field explorations within two weeks of obtaining entry permits. 2. Depending on the availability of the driller,S&W anticipates approximately three weeks will be needed to complete the well drilling and dewatering pumping tests. 3. Perform analyses and submit draft final dewatering report within three to four weeks of completion of the pumping and infiltration tests. 4. Submit final reports within two weeks of receipt of the City of Renton and project team comments. Based on the above schedule,S&W anticipates approximately a total of 12 to 15 weeks for completing the project. Deliverable(s) ® Geotechnical design report updates(memorandum)with results from additional geotechnical explorations and dewatering pump tests Scope of Work BergerABAM/FAPWT-09-175 Strander Boulevard Extension February 2011 City of Renton Exhibit A Page 16 i Total Task 415 Cost= 7 $ 9,759.00 Task 420 - Excavate,Observe, Pump Down,and Partially Backfill Infiltration Trench An excavator capable of digging to 20 feet below grade will be mobilized to the site. A loader will also be mobilized to support soil stockpiling and soil backfilling. Up to about 250 linear feet of temporary construction fencing will be supplied, as needed,if the excavations are to remain open overnight. A trash pump capable of removing about 100 gallons per minute from the trench bottom will be supplied. The trench will be excavated to a maximum of about 20 feet deep,about 3 to 8 feet wide, and about 100 feet long. The trash pump will be used to control groundwater inflow to the excavation;S&W assumes that the discharge can be placed on the ground nearby, without the need for a settling tank or permits. Upon completing the trench excavation and discharge rate monitoring,fencing will be installed around the trench. We anticipate that the trench will be backfilled and bucket-compacted,probably on the following day, to a depth of about 3 feet,when the fencing will be removed. The trench will later be used for infiltration of the pumping test discharge water. Excess spoils will be left on site. In particular, the control surveys conducted for this project included datum control surveys, premarks for aerial photogrammetry, ground control for topographic completion surveys and control surveys for road and railroad ROWS, and for parcel boundary calculations. Datum control surveys were based on the Washington State Plane Coordinate System(WSPCS),North Zone (NAD 83/91)for horizontal datum, and for elevations,the North American Vertical Datum (NAVD 88). Based on field located monumentation,between August, 2003 and January, 2004,base maps retracing street and railroad ROW and parcel boundaries were computed to "survey level accuracy." Since that time, land use actions have altered 2003 computed boundaries,most notably,that area lying southerly of Southwest 27th Street and the new western terminus of Southwest 27th Street where the new Strander alignment will tie in and the potential north-south swaths where the shooflies may occur.
