Landlord and Tenant are under contract for Ground Sublease and Facility Use Agreement dated September 28, 2020 (the "Lease") pursuant to which landlord will lease to Tenant and Tenant will lease from Landlord a building to be constructed on real property commonly known as 16022 116th Ave SE, Renton, Washington, together with all the real property on which the building is located and all improvements thereon and appurtenances thereto (the "Premises") legally described on Exhibit A attached hereto, and by this reference incorporated herein. The Lease shall commence on the date Tenant takes possession of the constructed building and will continue for a term of twenty(20)years thereafter.The Lease contains two(2)additional ten(10)- year Tenant renewal options, and one nine (9)-year renewal option which upon exercise would extend the term of the Lease to a total of forty-nine(49)years from the commencement date of the Lease. 2. Landlord leases the Premises from Renton School District No. 403 under the terms of a Ground Lease dated September 30, 2020, pursuant to which Landlord is leasing the ground for an initial term of fifty(50)years. 3. This Memorandum of Ground Sub-Lease and Facility Use Agreement is executed solely for the purpose of giving notice to the public of the existence of the Lease,the terms,and conditions of which are expressly incorporated herein by reference for all purposes as though fully set forth herein. 4. Should there be any inconsistency between the terms of this instrument and the Lease incorporated herein,the terms of said incorporated Lease shall prevail.
