MINUTE APPROVAL Motion by Trimm, Second Shane to adopt minutes up to adjournment. Motion, failed. MOVED BY THORPE, SECOND PERRY TO APPROVE MINUTES OF JULY 24, 1978 AS PREPARED AND MAILED. CARRIED. Councilmen Shane and Trimm did not vote on the motion. MOVED BY STREDICKE, SECOND PERRY TO REAFFIRM ACTION ADOPTING ORDINANCE 3234, RESOLUTIONS 2201, 2202, 2203, 2204, AND APPROVAL OF VOUCHERS JULY 24, 1978. Roll Call : Aye - Clymer, Perry, Thorpe, Stredicke, Shinpoch; No - Shane, Trimm. 5 Ayes, 2 No's. MOTION CARRIED. Councilman Shane noted for the record if anyone brings suit for this being illegal , they can pay for it. ' AUDIENCE COMMENT Proposed Extension John Reed, 613 Smithers Ave. So. , inquired regarding SR 515 routes and SR 515 studies. Being advised of meeting on August 10. (See schedule of committee meetings. ) Mr.. Warren Gonnason, Public Works Director, . explained the State Highway Dept. will make corridor studies to determine a specific route for such a project including public parti- cipation. Glen Garrett, 1006 So. 30th Court, requested to be notified of the State Highway Dept. corridor studies. ' Latecomer Sewer Dave Biggar, President Kennydale Community Club, 2525 Aberdeen Ave. NE, Line Connections inquired re installation of sewers of Highgate Plat ; and explained request in Highgate for reconsideration being denied. Councilman Perry explained appeal process and dead line of August 18 and that questions have been referred to Planning and Development Committee and all parties of record will be notified of Committee meeting. William D. Johnson, PO Box 201., made suggestions of possible alternatives re Highgate sewer system. Jim Eisler, 1912 NE 20th, inquired how the city determines-a health hazard requiring sewer installation and procedure of committee meetings ; being advised of King County Health Dept. determination. City Attorney, Larry Warren, explained that the council can not prejudge an issue. Mr. Eisler then questioned for the record if he would be required to pay for any of the improvements being made by a developer across the street. Councilman Stredicke requested the record show Mr. Gonnason explained that the developer will pay for all improvements associated with the plat in a normal situation unless there are circumstances that the city might parti- cipate in some general improvements to benefit the entire area. Individual property owner would not be involved unless there is curb, gutter, or sidewalk directly in front of his property. In this case, he will not be affected. Mary Moore, 515 Tobin, noted new developments allow for new homes for young people who can help bare tax burden. Also that some people in the area favor sewers. Michael Bonski , 1908 NE 20th, inquired of reconsideration-appeal process to hearing examiner. k Renton City Council 8/7/78 Page 2 Audience Comment - Cont. Director PUBLIC HEARING Vacation- This being the date set and proper notices having been posted, published Portion of and mailed, Mayor Delaurenti _opened the public hearing to consider So. 7th St. closure of a portion of South 7th Street, petitioned by Puget Sound Power and Light Co. Councilman Trimm left the Council chambers due to conflict of interest. Letter from Washington Natural Gas was read requesting the City to defer action on the So. th St. vacation petition, as they are in the process of obtaining an easement from the petitioner to cover existing gas facilities in the area. Letter read from Warren Gonnason, Chairman Board of Public Works, stating present and future city street circulation does not require this portion of So. 7th St. with the exception of the Westerly portion of Burnett Ave. So. , a 30 foot easement for utilities is required, appraisal of the property is $2.00 per sq. foot, and some agreement I should be required between Milmanco, and Puget Power for access to Milmanco, as otherwise it is landlocked. Councilman Perry questioned. the city's position if vacation were to, be granted and property was to become landlocked. City Attorney noted that the normal rule is 1 that city can not vacate a piece of property and leave it landlocked. Thomas Cook, owner. of Milmanco, noted' construction of original building done in proper city form by city. Standards noting request 1 for temporary street vacation had been denied. Mr. Cook questioned ' ownership of the street and noted negotiations with Puget Power regarding property being considered for vacation. Mr. Cook noted ' he was aware of possible landlock. Councilman Clymer suggested Mr. Cook consult with an attorney re value of property if it becomes, landlocked and the possibility of Puget Power selling property. - Councilman Perry explained that council is dealing with the street vacation only-not any special consessions, such as donating or proving right-of-way of property. Councilman Stredicke questioned • position of building to property boundaries. Public Works Director Gonnason noted that there are not set back requirements. *MOVED BY PERRY, SECOND SHANE TO CONTINUE HEARING FOR ONE WEEK. Councilwoman Thorpe noted possible health hazard or safety problem in re to fire protection in that area ; also that the committee reviewing keep in mind the extension of SR 515 in relation to this street vacation. +'. and the development of Burnett Ave. *MOTION CARRIED. So. 27th St. Transportation Committee Chairwoman Shinpoch presented report recommend- Victoria Park ing to Council that So. 27th St. (in Victoria Park) NOT be opened to SR .515. Meritorious Presentation by the Mayor of a meritorius service award to Harold Service Award O'Hara for recognition of courage and good judgement displayed in the rescue of Bruce Wehrer from the Cedar River. MINUTE APPROVAL MOVED BY CLYMER, SECOND PERRY TO APPROVE MINUTES OF. JULY 17, 1978 AS PREPARED AND MAILED. CARRIED. AUDIENCE COMMENT Balloon Ordinance Mr. Don Chalners, General. Manager, Renton Sound Ford, residences 4441 155th Ave. SE Bellevue, stated that he had been notified by the Renton Police Department to remove balloons from business premises-being in code violation; contending their use is vital business promotion and community service. After discussion of Renton Building and Sign Codes and business operation, Council advised that Ordinances provide for permits therefor, to be secured from Building Department. Tent also questioned. Latecomer Sewer Mr. Michael Bonski , 1908 NE 20th, inquired as to public access to Line Connection information regarding department decisions, public rebuttal re final in Highgate decisions, and availability of minutes of the July 11th Hearing Examiner public hearing. Mr. Gordon Ericksen, Planning Director, noted the information is available for review in the Planning Dept. Mr. Bonski was advised that the minutes are available shortly after the Hearing Examiner's file is closed and decision rendered, timing outlined, for recommendation, appeal etc. James L. Isler, 1912 NE 20th, questioned whether T's were going to be installed at time of construc- tion of the Highgate sewer line, who is paying for them, to whom the payments will be made, how much time allowed to make payments; Also, if they can request designation of where sewer line enters property. Policy discussion of last week was recalled where hook up not required unless there is a health hazard. Mr. Gonnason advised this is a preliminary Plat with no specific design for the line as yet, however there will be a developer extension; the hook up requirements referred to the legal department for review; charges and payment over period of years were outlined, owner provides for own connection to house and place of entry. Mr. Ericksen noted that developer would pay for the initial improvements. *MOVED BY STREDICKE, SECOND SHINPOCH TO REFER QUESTIONS AND COMMENTS TO PLANNING AND DEVELOPMENT COMMITTEE FROM THIS WEEK AND LAST FOR REPORT BACK ALONG WITH ATTORNEY'S RECOMMENDATION. Substitute motion by Thorpe that city policy regarding connections of sewer lines other than LID be referred to Planning & Development Committee. Motion lost. Requested that City Clerk furnish list of questions asked this week and last to committee. *CARRIED. Renton City. Council 7/24/78 Page 2 Public Hearing PUBLIC HEARINGS 0 Alley vacation Letter from Warren Gonnason, Chairman Board of Public Works, was between Burnett & read recommending that proposed alley vacation be granted with the Williams Aves. So. conditions that utility easement be retained over the entire right- at S. 2nd St. of-way, and alley be extended out to either Williams Ave. S. or (McLendon & Cugini )Burnett Ave. S. for fire access. Property value ranges from $2.00 to $3.75 per square foot. Roland Smith representing Cugini and McLendon, 4151 134th SE, Bellevue, stated intent of vacation was to change egress of doors to comply with city and state code,- and remodel interior to improve check out facilities. Councilwoman Thorpe questioned if remodeling required compliance with parking and loading ordinance and landscaping requirements of ordinance. Gonnason stated if improvement is 1/3 less than value of building or less than $10,000.00 not required. Councilwoman Thorpe urged plans include enhancements of property due to City improvements along Second. Mr. Smith noted they are willing and pleased to conform;advising of plans to improve appearance of the property and , building. Councilman Shane questioned why was City asking for fees when using petitioners property. Mr. Gonnason noted state law allowing city,when vacating alley or street in the city,to charge ' a fee up to 2 of appraised value of the property at the time of vacation, which could be -0- to a maximum of z the assessed value. Councilman Perry questioned why a utility easement was necessary with no present utilities and if there are proposed utilities at this time. Mr. Smith stated that yes there were proposed utilities for the area. Councilwoman Thorpe questioned what the present zoning is and if the fire department had reviewed. Mr. Gonnason noted B-1 zoning and the fire department had reviewed and were satisfied. MOVED BY STREDICKE, SECOND PERRY HEARING BE CLOSED. CARRIED. *MOVED BY STREDICKE, SECOND PERRYTHE VACATION BE GRANTED PROVIDING THAT WESTERLY CONNECTION FROM THE SEWER MAIN OR NORTH PROPERTY LINE TO BURNETT BE PLACED IN EFFECT SO THAT ATTORNEY AND HEATING SUPPLY COMPANY CAN GAIN ACCESS AND FIRE DEPARTMENT ACCESS. ALSO. 2 ASSESSED VALUE BE CHARGED LESS THAT PROPERTY, WHICH , IS USED FOR THE CONTINUATION OF THAT ALLEY. Moved by Trimm, Second ; Shane to table matter until it is determined they will dedicate right-of-way to the city. Chair declared motion lost. Roll Call : Aye-Trimm, Shane, Thorpe;, No-Clymer, Shinpoch, Stredicke, Perry. 3 Aye' s, 4 no' s . Motion failed. *ORIGINAL. MOTION CARRIED. Extension Mr. Warren Gonnason explained route of SR 515 extension. SR 515 Grady Way to FAI 405 at the North Renton Interchange and possible alternatives. Mrs. Kay Stricker, 507 Smithers Ave. So. questioned previous plans to take out homes along Smithers and put in an overpass. Mr. Gonnason explained that there is no specific plan, except for the possible connection from Grady Way to South 7th as it comes into Smithers so that westerly property lines come into alignment, and if it were to be extended northerly on Smithers and additional widening is to be accomplished - the easterly row of houses on the eastside of Smithers would be in the path of that right-of-way, but all plans are strictly preliminary. Mrs. Stricker questioned if any funds have been obtained. Mr. Gonnason noted that no funds have been appropriated. Councilman Stredicke questioned possibility of Burnett Ave. instead of Smithers Ave. Mr. Gonnason said that it had not been seriously considered as an alternative. Councilman Perry noted that the city ; now owns the property on Burnett and there is plenty of right-of-way without interferring with any of the residences. Mike Creegan, 531 Smithers Ave. So. , stated that the highway can be left on Main St. so no one would be affected. Tom Park, 440 Smithers Ave. So. , questioned how the plan could not affect them and what the hearing was to accomplish if there are no definite plans. Mayor answered the decision will not be final for some time and that more public hearings will he held, this hearing was just to get public input and for placement on the state six year street plan. Dennis Stremick, 2532 Smithers Ave. So. , urged that because of the opposition in Victoria Park for SR 515 that the council take into consideration the residents of the area involved ,changes hard to make once encased in concrete.
