The modification is requested for site renovation of outdoor areas associated with the Renton Place III office building. Summary of Requested Modifications: 1. Replace existing concrete and asphalt paving at the building entries with new concrete paving. 2. Construct a new employee concrete patio. 3. Install new site furniture including table and chair units,a smoking canopy,benches and trash receptacles. 4. Remove and replace plant materials at building entrances. 5. Relocate the existing dumpster approximately 50-feet to the east, and enclose with an 8- foot tall slatted chain link fence. The Site Plan regulations define minor adjustments or modifications to an approved site plan as changes which do not involve more than a 10% increase in area or scale of the development, which do not have a significantly greater impact on the environment and facilities,and which do not change the boundaries of the originally approved plan (RMC 4-9-200.H.). The proposed revisions appear to comply with the applicable development standards of the Commercial Office(CO)Zone(RMC 4-2-120B), and the Parking, Loading, and Driveway Regulations(RMC 4-4-080). It has been determined that the revised proposed would not involve more than a 10% increase in area or scale of the development, and would not result in any significant environmental impacts above those analyzed under the previous development review. Decision The proposed modification to the site plan review is approved as a minor modification. This determination will be final unless a written appeal of the administrative determination is filed with the City's Hearing Examiner within 14 days of the date of this letter. The City was not aware that The Callison Partnership did not have the right to utilize this area for recreational purposes. Therefore, a new site plan must be submitted as a revision to the building permit application showing the 9,000+ square feet of recreational area outside of the area occupied by the power substation. Since there is enough on-site parking and it will not substantially impact the site plan approval, the ERC has determined that the item will not be referred back to the Hearing Examiner. This administrative decision of the Environmental Review Committee can be appealed to the Hearing Examiner for a period of two weeks from the date of the decision of Wednesday, June 4, 1986. Therefore, the appeal date will expire at 5 p.m. on Wednesday. June 18, 1986. SUMMARY OF REQUEST: Approval to construct an office building known as III Renton Place, consisting of 131,000 square feet, together with an associated parking lot of 660 parking stalls. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval. Hearing Examiner Decision: Approved, subject to approval of Rezone R-016-86 by City Council. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on April 29, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 6, 1986, at 9:40 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Revised Site Plan dated April 23, 1986. Exhibit #3 - Photograph of III Renton Place. Exhibit #4 - Letter dated April 23, 1986 establishing Transportation Management Plan. Exhibit #5 - Letter dated April 30, 1986 from Metro to Ron Nelson. Exhibit #6 - By reference. Rezone file for Callison Partnership, Ltd. R-016-86. A review of this proposal was presented by Roger Blaylock, Zoning Administrator. He referred to Exhibit #2 stating the property is 8.55 acres, designated as commercial, and is to be the future home of an office building to be called Three Renton Place. The 7 story building will be identical to the One and Two Renton Place buildings on adjacent sites. Access will be from Grady Way at the northwest corner of the site as well as the southeast corner of the site adjacent to the Puget Power Substation. The accesses are limited to right-in and right-out turns. As a mitigation for Two Renton Place a traffic signal was required at Talbot and Lake which will further accommodate the traffic to be generated from this proposal. Upon further review Mr. Blaylock advised the applicant will participate in storm water drainage improvements for the area; recreational facilities have been relocated adjacent to the Puget Power Substation site as shown on Exhibit #2; and a pedestrian corridor has been established between Two and Three Renton Place. Mr. Blaylock stated the applicant has reached a transportation agreement with Metro as referenced in Exhibit Nos. 4 and 5. The Callison Partnership, SA-032-86 May 14, 1986 Page 2 Initially the proposed parking lot was of concern as it was felt the pedestrian and vehicle movement was not properly separated: perimeter landscaping was reviewed along with the proposed access in the northwest corner of the site. It is felt the intent of the site plan ordinance has been met with the modifications to pedestrian circulation, on-site recreation, perimeter landscaping, circulation and access. It was pointed out the driveways within the subject site are in need of improvement. The only area of expressed concern was the proposed recreational area of 9000 sq. ft. which the City feels should be increased to 10,500 sq. ft., thereby eliminating 3 parking spaces on either end. Mr. Blaylock closed with a recommendation of approval with six conditions set out in the staff report. Calling for testimony in support of this application from the applicant or their representative, responding was: Tom Goeltz 1501 - 4th Avenue 2600 Century Square Seattle, Washington, 98101-1688 Mr. Goeltz clarified the exhibits as presented and requested that the Rezone file to cover this property also be made a part of the permanent record. This was accomplished by the entering of Exhibit #6. Mr. Goeltz continued stating the condition regarding the timing of the drainage requirement imposed by ERC does not mean the physical improvements must be in place prior to occupancy, but instead referred to the applicant entering into an agreement commiting them to fund their fair share of the improvements. A traffic analysis by CH2M Hill was referred to regarding traffic mitigation measures specifically shown on page 17. He said with the mitigating measures it is felt the traffic generated by this project will be adequately addressed, as well as the improvements to the area, enabling them to provide an increased level of service. Mr. Goeltz said the applicant will be requesting a Latecomers Agreement from the City Council for the extra lanes to be added on Talbot as well as some of the intersection improvements that are not adjacent to the site but seem to provide a system-wide benefit. He then introduced the architect for the project. Testifying was: Richard King, Architect 1423 - 3rd Avenue Seattle, Wa. 98101 Mr. King referred to traffic circulation and said it is his understanding there is also a channelized left-turn lane into the project on the northwest corner of the site, not just a right turn-in and out as had previously been stated by staff. They do not intend to revise the configuration of that street at this time as it is not a condition to do so by the City. He addressed the area proposed for on-site recreation stating they have provided on-site. and within the other buildings of the associated project, amenities such as 30,000 sq. ft. park, shower facilities and approximately 4600 sq. ft. of food service area. Mr. King said in Two as well as Three Renton Place there will be a provision allowed for the tenant to provide more shower facilities within the building. The anticipated tenant of the new building is Boeing Computer Services. He feels with the 2300 sq. ft. of food service provided in One and Two Renton Place, along with 9,000 sq. ft. of on-site recreational areas including tables, benches, etc., this would seem to exceed the 10,500 sq. ft. the City requested. He requested that the applicant be permitted to determine, at the building permit process, whether or not the tenant desires to have recreational services. Mr. King stated additional parking has been provided as they anticipate a high need due to the type of occupants that will be using the building. He requested approval of this proposal, with the original 9000 sq. ft. requirement for on-site recreational services. In closing, Mr. King advised the signage to be used will be office-park type, no higher than approximately 10 ft. He had no further comments. The Examiner called for further testimony in support of or in opposition to this proposal. There was no one wishing to speak. Gary Norris, Traffic Engineer for the City of Renton, requested clarification of the two letters referred to in Exhibit Nos. 4 and 5 as pertains to traffic improvements. He stated the ERC reviewed and set forth recommendations and he has had no further information from the developer as to what he will be providing. Mr. Goeltz clarified stating on Page 17 of the CH2M Hill report were referenced mitigation measures that would tie in with the ERC requirements. Mr. Goeltz closed with a request for an expedient determination by the Hearing Examiner. There being no one else wishing to testify, the hearing was declared closed at 10:15 A.M. The Callison Partnership, • SA-032-86 May 14, 1986 Page 3 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, The Callison Partnership, Ltd., has requested approval of a Site Plan for an approximately 131,000 sq ft office building on approximately 8.55 acres of property. 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at the southwest corner of South Grady Way and Talbot Road South. 7. The site was annexed into the City by the adoption of Ordinance 1547 in June, 1956. An application to reclassify the site and adjoining southerly acreage to B-1 (Business/Commercial) is pending. The portion of the site zoned G-1 (General: Single Family Residential: Minimum lot size - 35,000 sq ft) automatically received that designation with the adoption of the original zoning for the City. The H-1 (Heavy Industry) district at one time had been zoned an equivalent to single family. It was zoned H-1 by the adoption of Ordinance 1741 enacted in March, 1959. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial uses, but does not mandate such development without consideration of other policies of the plan. 9. The site is irregular in shape although almost rectangular. The northeastern and northern property line is described by the intersection of Grady Way and Talbot Road S. In addition, a small square segment at the southeast corner of the site, along the Talbot Rd frontage, is utilized by a Puget Power Substation. 10. The zoning around the site is a mix of H-1 and G-1, the site's current zoning, north and west of the site. An L-1 (Light Industry) district is just northwest of the site. The Puget Power Substation is zoned B-1. 11. The site is at the extreme eastern end of the Renton Village (Ernst/Pay N Save) Shopping Center. Two Renton Place, a companion building, is under construction just south of the subject site and One Renton Place is located southwest of the site. 12. Immediately west of the site is the shopping center and a gas station. The Evergreen Building, a movie theater and the Sheraton Renton Inn are also located on this large block. I-405 is located south of the subject site. 13. The proposed B-1 zoning would permit an office building of the type proposed for the subject site. The applicant proposes construction of Three Renton Place on the subject site. It would be a complement to Two Renton Place, now under construction, and One Renton Place, a completed office building. The building will be 7 stories in height and will match the exterior treatment of Two Renton Place. Concrete bands will be intermixed with rows of windows of clear glass. 14. In response to the staff and ERC analysis the applicant provided modified plans. As now proposed, the project will contain the approximately 131,000 sq. ft. building, parking for 657 cars. bike racks, on-site recreation, perimeter and internal landscaping and connecting pedestrian links tying the subject development to the other 'Renton Place' developments. • The Callison Partnership, SA-032-86 May 14, 1986 Page 4 15. More specifically, a perimeter of trees and lawn will parallel the street frontage along Grady and Talbot. The trees will be offset from the street to avoid view blockage, and particularly near the intersection they will be moved toward the interior of the site providing a location for signage. The tree/landscape theme will be continued along the southern edge of the site between the proposed project and its neighboring Two Renton Place. Similar treatment will be provided on the interior of the site. 16. The applicant will provide landscaped pedestrian corridors through and around the parking areas. This will permit access between the various buildings, from the buildings to the recreation areas, and to the street on walkways somewhat separated from vehicular traffic. 17. The applicant has provided an outdoor recreation area adjacent to the Puget Power Substation rather than one surrounded on all sides by parking stalls. The area will be approximately 9,000 sq ft. Indoor showers and food service will be left to the discretion of the tenants, although similar facilities have been provided for the adjoining development. 18. Driveways to Grady and Talbot will be limited to right in/right out only. Aisle alignment will be consistent with Two Renton Place to provide a link to S. Renton Village Place and its controlled access to Talbot Road. The existing access immediately west of the site, between the site and the gasoline service station, will be maintained in its current state. 19. The Municipality of Metropolitan Seattle has entered into an agreement with the applicant to ensure a cooperative information effort to alert and encourage public mass transit, active enlistment for ride sharing/car pools, bike racks, signed reserved parking for car/van pools, and pedestrian corridors to promote easy access to the Metro Park and Ride lot north of the subject site. 20. The applicant has agreed to participate in and make extensive drainage improvements. The applicant will participate to the extent of $50,000 to $60,000 to fund area wide drainage improvements to include new and expanded culverts under I-405. An agreement in principle has been worked out between the applicant and the Public Works Department. 21. Traffic mitigation measures include the right-in access indicated above as well as modifications to the Lake/Grady Way intersection - two lane configuration northbound, permitting left lane left only turns, and right lane left turns, through movement and right turns: the Grady/Shattuck intersection would receive a new controller, and the three lane configuration northbound with similar turning and through movements enhanced by an additional lane. The leg of the Grady/Talbot intersection north to S. 7th would receive an additional lane. Renton Village Place would be improved. The applicant reserved the right to request Latecomer Agreements for some of these improvements. 22. In designing the parking lots, staff has permitted the applicant to take advantage of the adopted but not yet effective modifications of the Parking and Loading Ordinance. These permit more compact stalls and base required parking on lowered floor area ratios. The parking meets the intent of these provisions. CONCLUSIONS 1. The proposed project appears to serve the public use and interest. The applicant has made extensive modifications to satisfy both staff and the ERC in areas of traffic, landscaping and site amenities. 2. The site will be extensively landscaped both along the site's perimeter public road frontages and lot line, but also interior to the site and throughout the parking areas. Pedestrian links will be discreet from the parking areas and will also be landscaped. 3. The applicant will provide improved access to the site by improving access to the entire block at intersections west of the site. Grady/Lake and Grady/Shattuck, east of the site. Grady/Talbot, and south of the site, Talbot/Renton Village Place. Driveways will be limited to right- in/right-out to avoid turning conflicts on the major arterials adjacent to the site. • • The Callison Partnership, SA-032-86 May 14, 1986 Page 5 4. The design of the site has been tied to the complementary One and Two Renton Place projects to provide an office park-type atmosphere when the site's B-1 zoning did not require such amenities. 5. The project appears well designed, and it appears that traffic conditions will not deteriorate substantially with the combined traffic improvements and the cooperative efforts of the applicant and Metro. 6. The proposal appears to be one of the better designed projects, and since it is located at a major focal point it will be seen by many persons passing through the City. 7. The recreational space provided appears sufficient and will be sufficient if coupled with additional indoor amenities such as the food service area and showers for active recreationalists. 8. Therefore, subject to approval of the pending Rezone, the Site Plan is approved. DECISION The Site Plan is approved subject to approval of the rezone of the subject site by the City Council. The Metro agreement shall be an explicit condition of approval. The ERC conditions are incorporated by reference. ORDERED THIS 14th day of May, 1986. 440, FRED J. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. They also agree to install a second 42-inch minimum diameter pipe between the recently constructed concrete system, which has its western-most manhole just north of I Renton Place and the open ditch on the southwestern edge of the property. The ditch cross-section will be changed to match the projected increase in flow rates and volumes. c. None of the driveways are to be left-hand turns. They will be right-in and right-out only. The applicant will do the intersection at Lake and Grady Way, assuming 100 percent responsibility for this intersection including channelization plus a new controller. d. Modification of channelization of Grady Way and Shattuck and require new controller. This will provide additional movements out of the parking lot. e. Grady Way and Talbot will; need an additional southbound lane from South Seventh Street to Grady Way and a new third lane to the most southerly entrance by the substation. It will include revisions to the channelization and a new controller. The City would be willing to give them a latecomers agreement on this. f. Cooperate in the park-and-ride transit program. g. All of the above items are to be completed prior to occupancy. 4. The effect of the Environmental Review Committee's decision significantly modifies the site plan as originally presented. The conditions imposed by the ERC mitigate severe adverse environmental impacts of (1) on-site pedestrian circulation, (2) on-site recreation, (3) on-site and off-site storm water drainage, and (4) on- and off-site traffic improvements. 5. The City of Renton has recently adopted regulations governing site plan approvals. Ordinance No. 3981 became effective on April 17, 1986. The application that was received on April 15 was not vested under the old site plan approval criteria since the underlying zoning had not been established. The rezoning request from H-1, Heavy Industrial, and G-1, General Use, to B-1, Business Use, is still pending as part of the general application for construction. Section 4-738(D) establishes site plan review criteria. These criteria fall into the following categories: • General criteria. • Mitigation of impacts to surrounding properties and uses. • Mitigation of impacts of a proposed site plan to the site. • Circulation and access. • Signage. The following analysis shows that the site plan is appropriate with some modifications. 6. In analyzing the criteria enumerated under Ordinance No. 3981, the Building and Zoning staff will analyze only those portions that appear to be critical issues and/or problems. In general, the proposal complies with (1) the intent of the Comprehensive Plan designation of Commercial, (2) with the intent of the proposed zoning reclassification request to B-I, Business Use, and (3) with the proposed requirements of the Parking and Loading Ordinance. The Parking and Loading Ordinance is specifically referenced. The Building and Zoning Department is having applicants design parking areas to those criteria because by the time that actual building permits would be issued the ordinance will be in effect. The first reading has already been conducted by the City Council with second readings scheduled for Monday, April 28th, with an anticipated effective date of approximately June 2nd. 7. The specific areas where the Building and Zoning Department believes that the applicant has not met the detailed intent of the site plan ordinance are as follows: PRELIMINARY REPORT T THE HEARING EXAMINER THE CALLISON PARTNERSHIP, LTD., FILE NO. SA-032-86 MAY 6, 1986 PAGE 4 • On-site pedestrian circulation. • On-site recreation. • Perimeter landscaping. • Access at the northwest corner of the subject site. • Roof mounted equipment. Each of the following items are discussed in the analysis referencing specific site plan criteria that would apply. A. ON-SITE PEDESTRIAN CIRCULATION Section 4-738(D)(2)(a): Mitigation of undesired impacts of proposed structure and site layouts that could impair the use or enjoyment or potential use of surrounding uses and structures and of the community. Section 4-738(D)(2)(c): Provision of a desirable transition and link between uses to the street, utility, walkway, and trail systems in the surrounding area by the arrangement of landscaping, fencing and/or other buffering techniques in order to prevent conflicts and to promote coordination and planned benefit from, and access to, such elements. Section 4-738(D)(4)(f): Promotion of the safety and efficiency of the internal circulation system, including the location. design and dimensions of vehicular and pedestrian access points, drives, parking, turnarounds, walkways, bicycle ways, and emergency access ways. Section 4-738(D)(4)(g): Separation of loading and delivery areas from parking and pedestrian areas. Section 4-738(D)(4)(i): Provision for safe and attractive pedestrian connections between parking areas, buildings, public sidewalks, and adajcent properties. The site plan presented by the applicant does not provide any pedestrian links between the public rights-of-way, parking areas, recreational areas, or adjacent buildings. The plan introduces pedestrians throughout the parking lot and creates hazardous situations. The Environmental Review Committee felt that this was a significant adverse impact and required that specific pedestrian corridors to be created between both Two Renton Place and Three Renton Place and from Three Renton Place northward to South Grady Way to allow access to the South Renton Metro Park-and-Ride facility which is located on the north side of South Grady Way. B. ON-SITE RECREATION Section 4-738(D)(1)(h): Mitigation of noise, odors, and other harmful or unhealthy conditions. Section 4-738(D)(2)(a): Mitigation of undesirable impacts of proposed structures and site layouts that could impair the use or enjoyment or potential use of surrounding uses and structures and of the community. Section 4-738(D)(2)(c): Provision of desirable transition and linkage between uses and to the street, utility, walkway, and trail system in the surrounding area by the arrangement of landscaping, fencing, and/or buffering techniques, in order to prevent conflicts and to promote coordination and plan benefit from, and access to, such elements. Section 4-738(D)(2)(e): Effective location, design and screening of parking and service areas in order to promote efficient function of such facilities, to provide integrated facilities between uses when beneficial, to promote "campus-like" or "park-like" layouts in appropriate zones, and to prevent unnecessary repetition and conflict between uses or service areas or facilities. •PRELIMINARY REPORT 1 :i HE HEARING EXAMINER THE CALLISON PARTNERSHIP, LTD., FILE NO. SA-032-86 MAY 6, 1986 PAGE 5 Section 4-738(D)(3)(a): Building placement and spacing to provide for privacy and noise reduction: orientation to views and vistas and to site amenities, to sunlight and prevailing winds, and to pedestrian and vehicle needs. On-site recreation is not specifically required in the B-1, Business Use. zone: however. the Environmental Review Committee's position is that when a major employment center is being proposed on-site recreation should be addressed. Three Renton Place will generate in excess of 800 employees. and they will have on-site recreational needs during the day. The ERC specifically required that the proposed recreational area which was to be located south and west of Three Renton Place (across approximately 350 feet of parking lot) was an unacceptable location and did not benefit either the on-site users or the general public. In fact. the site plan proposes recreational area adjacent to the service areas for the major shopping center including a grocery store. Dumpsters, truck noise, and access all prompted the Environmental Review Committee to require the relocation of the recreational area to be centrally located between Three Renton Place and Two Renton Place along the*apside of the Puget Power substation site. C. PERIMETER LANDSCAPING Section 4-738(D)(1)(b): Conformance with existing land use regulations. Specific review of the proposed B-1, Business Use, zone shows that the landscaping proposed around the perimeter of the site adjacent to South Grady Way and Talbot Road South do not meet the minimum width requirements of 10 feet. The landscaping should be adjusted and the location of trees should be specifically looked at in light of sight clearance problems. Because of the magnitude of the subject site. street trees should be encouraged. but limited in cases where they create a safety problem. The landscape theme that was established for Two Renton Place should be continued to make the three buildings appear to be cohesive office park development. D. CIRCULATION AND ACCESS Section 4-738(D)(4)(al: Provision of adequate safe vehicular access to and from all properties. Section 4-738(D)(4)(f): Promotion of the safety and efficiency of the internal circulation system, including the location. design. and dimensions of vehicular and pedestrian access points. drives, parking. turnarounds, walkways. bikeways and emergency access ways. The access proposed at the northwestern corner of the subject site actually is a shared access between the Renton Village Shopping Center and the proposed Three Renton Place. As the design is presented. there is a tremendous amount of user confusion at this entry. This area should be redesigned with an approximate loss of 10 parking spaces to allow a clear separation of the parking lot from the access and the ability to queue in the access way instead of in the parking lot. The real problem is that the access is a back entrance to the Renton Village Shopping Center providing both service and a point where people skirt around the controlled access point at Shattuck on South Grady Way. Redesign would separate and improve the safety and efficiency of this access without compromising the general intent of the site plan. E. ROOF MOUNTED EQUIPMENT Section 4-738(D)(2)(g): Provision of effective screening from public streets and residential uses of all permitted outdoor storage areas (except auto and truck sales), for service mounted utility equipment, for roof top equipment, and for all refuse and garbage containers, in order to promote a "campus-like" or "park-like" setting where appropriate and to preserve the effect end intent of screening or buffering otherwise required by the Zoning Code. SA-032-86 MAY 6, 1986 PAGE 6 Roof top equipment has never been considered a major problem in any of the previous land use decisions of the City of Renton except where we have residential areas looking down on top of such equipment (Denny's Restaurant site/N.E. 44th Street). The architecture and style of a building can be dramatically modified by the type of screening imposed for roof top equipment. The site plan ordinance is not intended to provide a subjective evaluation of the architecture of a building. However, common sense should be used in making sure that the roof top equipment is adequately screened and does not create an intrusion of noise or vision into any adjacent residential areas or adjacent public rights-of-way. The proposed elevation appears to de-emphasize the extent of the roof mounted equipment. The elevations show quite clearly the intensity and height of the necessary equipment. The applicant, in fact. has provided one of the better examples of screening of roof top equipment within the City. The Building and Zoning Department only wishes to bring this to the attention of the Hearing Examiner because we believe it is important in continuing the underlying theme and intent of the Zoning Code and Comprehensive Plan. 8. The site plan as presented appears to require major adjustments in the location of the on-site recreation. pedestrian corridors. access at the northwest corner of the site, and general parking layout. The site plan would not work if the present Parking and Loading Ordinance standards were imposed upon the review. However, since the building will not be occupied until the new provisions go into effect, it is reasonable to design the building according to the new standards. This allows more flexibility on this site and allows the creation of a larger recreational area and the pedestrian corridor. 9. In general. the proposal meets the intent of the Comprehensive Plan, its policies, and the specific dimensional requirements of the Zoning Code and Parking and Loading Ordinance with revisions. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site plan request by the Callison Partnership, Ltd., file number SA-032-86, be approved subject to the following conditions: 1. Approval of the City Council of the rezone application, file number R-016-86. 2. Revision of the site plan per ERC decision for pedestrian circulation. 3. SA-032-86/ECF-014-86 LOCATED ON THE SOUTHWEST CORNER OF SOUTH GRADY WAY AND TALBOT ROAD SOUTH The Environmental Review Committee (ERC) has analyzed the information submitted by The Callison Partnership for site approval including rezone approval to allow future "III Renton Place" office building and zoning compliance with two existing buildings. The Environmental Review Committee finds the following facts to be true of the pro- posed project: 1. The applicant has provided specific mitigation measures set forth in the "III Renton Place Office Building Traffic Analysis" performed by CH2M HILL, dated February 19, 1986 (page 17) and attached to the Environmental Check- list as attachment 11. 2. Applicant has written a letter (see attached) stating that Renton Village, in order to mitigate the drainage impacts of their proposed III Renton Place office building, is prepared to enter into a concomitant agreement with the City to assist in the funding of an additional storm water pipe system. 3. The applicant will provide detailed site plan prior to Site Plan Approval going to the Hearing Examiner. Therefore, the Environmental Review Committee (ERC) , under their substantive authority (Section 4-2822(D) ) , recommends to the decision maker, the Hearing Examiner, that the application for site plan approval and rezone to allow the construction of one building totaling 131,000 square feet of office space located at the southwest corner of South Grady Way and Talbot Road South is subject to the following conditions: 1. The applicant will expand and move the location of the on-site recreation area from the southwest corner of the site next to the Puget Power sub- station. This will enable them to eliminate the small recreation area originally planned in front of III Renton Place. Also, a pedestrian corridor to be installed between II Renton Place and III Renton Place which will also service the outdoor recreation area. The corridor needs to extend from one end to the crosswalk on Grady Way. 2. Assist in the funding of an additional storm water pipe system. This system would start on the southwest corner of the property and pass under I-405 and east of S.R. 167.. Applicant will provide between fifty and sixty thousand dollars to be used for this project, assuming it can be accomplished within the next five years. They also agree to install a second 42" minimum diameter pipe between the recently constructed con- crete system, which has its western most manhole just north of One Renton Place, and the open ditch on the southwestern edge of the property. The ditch cross section will be changed to match the projected increase in flow rates and volumes. (letter attached) 3. None of the driveways are to be left hand turns. They will be right in and right out only. Applicant will do the intersection at Lake and Grady Way, assuming 100o responsibility for this intersection including channel- ization plus a new controller. 4. Modification of channelization at Grady Way and Shattuck and require new • controller. These will provide additional movements out of the parking lot. 5. Grady Way and Talbot will need an additional southbound lane from 7th Street to Grady Way and a new third lane to the most southerly entrance by the substation. The actions included in the attached TMP, if actually implemented by the developer and monitored by the City and Metro, have the potential to reduce single occupant vehicle commuting to the project site. While the developer does not agree to transit pass or carpool/vanpool subsidies as part of the TMP, the commit- ment to promote transit and ridesharing among employers and employees, appoint an Employee Transportation Coordinator, provide HOV priority parking, encourage flex-time, and survey and monitor employee commute patterns are key elements of a comprehensive transportation management program. We would like to have the attached TMP for Three Renton Place made part of the formal record. To this end, we plan to request the Hearing Examiner to condition site plan approval for the project to include the TMP. In addition, in your letter you have raised concerns regarding the level of service adjacent to the site, specifically at the Renton Village Place-Talbot intersection. This intersection is having improvements made to it in conjunction with the construc- tion of Two Renton Place by adding a three-way lighted signal and coordinator which is being installed at this time and will be in place and operational prior to the occupancy of Two Renton Place. In addition, we have attached a copy of the full CH2M Hill Traffic Analysis Report prepared for Three Renton Place which shows the mitigating measures taken by us for this development. These mitigating measures are significant and broad range in that they deal with intersections both immediately adjacent to the site and intersections remote from the site down both Talbot and Grady. We feel that these measures have been taken and are in response to the city' s concerns related to level of service in the area and meet or exceed the impacts projected associated with this project. By raising these questions with respect to this development and this development site plan approval review, you have alerted us to a concern which we share, and we are placing our bike racks such that the adjacent development to the South of Two Renton Place can utilize the same facility. In addition, the trans- portation management plan which is attached will be put into place for that project as well. Condition 6 states: 6 . Cooperate in the park and ride transit program. Metro staff believe this condition, as stated, would not bind the developer to take any actions to mitigate traffic impacts of the development. For one thing, the word "cooperate" does not obligate the developer to initiate any action on his own. Secondly, the S. Renton Park & Ride lot has been completed for many years; aside from promotions among employees, there is no program related to this lot in which we would wish to have the developer participate. Therefore, we are very confused as to what the ERC intended with this condition. According to the traffic analysis conducted by Renton City staff, Renton Village Place/Talbot is projected to operate at LOS E. Actions to reduce traffic generation through transit and ride- sharing are recommended as a necessary mitigation measure. Metro would like to see Condition #6 modified in either of two ways: 1) Given the size of the project, it would be appropriate to require the developer to submit a Transportation Management Plan designed to reduce single-occupant vehicle trips by 20% from the jurisdiction average as established in the year the approval is granted (See attached example of a TMP) . • Letter to Mr. Nelson April 23 , 1986 Page Two 2 ) Require the developer to undertake specific actions to promote alternatives to single-occupant vehicles, including: A. Post transit/ridesharing information and distribute to existing and new employees . B. Distribute ridematch applications annually. C. Provide secure bicycle parking. D. The Environmental Review Committee finds the following facts to be true of the pro- posed project: ' 1. The applicant has provided specific mitigation measures set forth in the "III Renton Place Office Building Traffic Analysis" performed by CH2M HILL, dated February. 19, 1986 (page 17) and attached to the Environmental Check- list as attachment 11. 2. Applicant has written a letter (see attached) stating that Renton Village, in order to mitigate the drainage impacts of their proposed III Renton Place office building, is prepared to enter into a concomitant agreement with the City to assist in the funding of an additional storm water pipe system. 3. The applicant will provide detailed site plan prior to Site Plan Approval going to the Hearing Examiner. Therefore, the Environmental Review Committee (ERC) , under their substantive authority fr (Section 4-2822 (D) ) , recommends to the decision maker, the Hearing Examiner, that the application for site plan approval and rezone to allow the construction of one building totaling 131.,000 square feet of office space located at the southwest corner of South Grady Way and Talbot Road South is subject to the following conditions: 6 Fred J. Kaufman April 17, 1986 Page 2 1. The applicant will expand and move the location of the on-site recreation area from the southwest corner of the site next to the Puget Power sub- station. This will enable them to eliminate the small recreation area originally planned in front of III Renton Place. Also, a pedestrian corridor to be installed between II Renton Place and III Renton Place which will also service the outdoor recreation area. The corridor needs to extend from one end to the crosswalk on Grady Way. 2. Assist in the funding of an additional storm water pipe system. This system would start on the southwest corner of the property and pass under I-405 and east of S.R. 167. Applicant will provide between fifty and sixty thousand dollars to be used for this project, assuming it can be accomplished within the next five years. They also agree to install a second 42" minimum diameter pipe between the recently constructed con- crete system, which has its western most manhole just north of One Renton Place, and the open ditch on the southwestern edge of the property. The ditch cross section will be changed to match the projected increase in flow rates and volumes. (letter attached) 3. None of the driveways are to be left hand turns. They will be right in and right out only. Applicant will do the intersection at Lake and Grady Way, assuming 100% responsibility for this intersection including channel- ization plus a new controller. 4. Modification of channelization at Grady Way and Shattuck and require new controller. These will provide additional movements out of the parking lot. 5. Grady Way and Talbot will need an additional southbound lane from 7th Street to Grady Way and a new third lane to the most southerly entrance by the substation. Will include revisions to the channelization and a new con- troller. The City would be willing to give them- a latecomers agreement on this. 6. Cooperate in the park and ride transit program. 7. All of the above items are to be completed prior to occupancy. Therefore, the above conditions are necessary as a minimum for the preservation of the welfare and safety of the general public and a minimum to mitigate the adverse environmental impacts of the proposal. Kaufman April 17, 1986 Page 3 Under Section 4-2822 (D) , the decision maker must accept these conditions as binding upon his ultimate dicision unless he identifies in writing a substantial error in fact or conclusion by the Environmental Review Committee. The decision maker then has the option of asking the ERC for reconsideration or revising the conditions. The applicant also has the ability to request reconsideration of these conditions from the ERC or appeal these conditions directly to the Hearing Examiner under authority granted in Section 4-2823(A) (1) (a) within 14 days of the date that the DNS is final. Therefore, the appeal date would be Friday, May 2, 1986 at 5 p.m. Appeals must be submitted in the form prescribed by both the Environmental Ordinance of the City of Renton and the Hearing Examiner Ordinance, Section 4-3011(B) . Renton Village, in order to mitigate the drainage impacts of our proposed III Renton Place Office Building, is prepared to enter into a concomitant agreement with the City to assist in the funding of an additional storm water pipe system. This system would start on the southwest corner of our property and pass under I-405, eventually terminating in the wetlands directly South of I-405 and East of S.R. 167. We agree to provide, when actually required, between fifty and sixty thousand dollars to be used for this project, assuming it can be accomplished within the next five years. In addition, and in order to complete the storm drainage system through our 55 acre tract, we agree to install a second 42" minimum diameter pipe between the recently constructed concrete system, which has its western-most manhole just North of One Renton Place, and the open ditch on the southwestern edge of our property. R-016-86 LOCATED ON THE SOUTHWEST CORNER OF SOUTH GRADY WAY AND TALBOT ROAD SOUTH The Environmental Review Committee (ERC) has analyzed the information submitted by the Callison Partnership, Ltd., to rezone 15.44 acres from H-1, Heavy Industrial, to B-1, Business Use, to allow the future construction of "III Renton Place." Based upon the environmental information submitted with the application, the Environmental Review Committee has issued a declaration of non-significance for the rezone only. They have found that the information is insufficient in the areas of storm water drainage, traffic generation, and on-site recreation to release the environmental declaration for the proposed building. The Environmental Review Committee, therefore, conditions the declaration of non-significance for the rezone subject to the condition that the rules and regulations governing the State Environmental Policy Act of 1981 are still applicable for the individual site plan review. The ERC also wishes to inform the Hearing Examiner and the applicant that the City's new site plan approval process will most probably be applicable to the subject site because the rezone application presently being reviewed could not possibly be completed prior to the anticipated enactment date of the site plan ordinance. Therefore, all parties should be aware that a separate site plan approval will most probably be required. Under Section 4-2822(D), the decision maker must accept these conditions as binding upon his ultimate decision unless he identifies in writing a substantial error in fact or conclusion by the Environmental Review Committee. The decision maker then has the option of asking the Environmental Review Committee for reconsideration for revising the recommended conditions. Fred J. The Environmental Review Committee finds the following facts to be true of the pro- posed project: 1. The applicant has provided specific mitigation measures set forth in the "III Renton Place Office Building Traffic Analysis" performed by CH2M HILL, dated February 19, 1986 (page 17) and attached to the Environmental Check- list as attachment 11. 2. Applicant has written a letter (see attached) stating that Renton Village, in order to mitigate the drainage impacts of their proposed III Renton Place office building, is prepared to enter into a concomitant agreement with the City to assist in the funding of an additional storm water pipe system. 3. The applicant will provide detailed site plan prior to Site Plan Approval going to the Hearing Examiner. Therefore, the Environmental Review Committee (ERC) , under their substantive authority (Section 4-2822(D) ) , recommends to the decision maker, the Hearing Examiner, that the application for site plan approval and rezone to allow the construction of one building totaling 131,.000 square feet of office space located at the southwest corner of South Grady Way and Talbot Road South is subject to the following conditions: = Fred J. Kaufman April 17, 1986 Page 2 1. The applicant will expand and move the location of the on-site recreation area from the southwest corner of the site next to the Puget Power sub- station. This will enable them to eliminate the small recreation area originally planned in front of III Renton Place. Also, a pedestrian corridor to be installed between II Renton Place and III Renton Place which will also service the outdoor recreation area. The corridor needs to extend from one end to the crosswalk on Grady Way. 2. Assist in the funding of an additional storm water pipe system. This system would start on the southwest corner of the property and pass under I-405 and east of S.R. 167.• Applicant will provide between fifty and sixty thousand dollars to be used for this project, assuming it can be accomplished within the next five years. They also agree to install a second 42" minimum diameter pipe between the recently constructed con- crete system, which has its western most manhole just north of One Renton Place, and the open ditch on the southwestern edge of the property. The ditch cross_ .section will be changed to match the projected increase in flow rates and volumes. (letter attached) 3. None of the driveways are to be left hand turns. They will be right in and right out only. Applicant will do the intersection at Lake and Grady• Way, assuming 100% responsibility for this intersection including channel- ization plus a new controller. 4. Modification of channelization at Grady Way and Shattuck and require new controller. These will provide additional movements out of the parking lot. 5. Grady Way and Talbot will need an additional southbound lane from 7th Street to Grady. Way and a new third lane to the most southerly entrance by the substation. Will include revisions to the channelization and a new con- troller. The City would be willing to give them- a latecomers agreement on this. 6. Cooperate in the park and ride transit program. 7. All of the above items are to be completed prior to occupancy. Therefore, the above conditions are necessary as a minimum for the preservation of the welfare and safety of the general public and a minimum to mitigate the adverse environmental impacts of the proposal. Kaufman April 17, 1986 Page 3 Under Section 4-2822 (D) , the decision maker must accept these conditions as binding upon his ultimate dicision unless he identifies in writing a substantial error in fact or conclusion by the Environmental Review Committee. The decision maker then has the option of asking the ERC for reconsideration or revising the conditions. The applicant also has the ability to request reconsideration of these conditions from the ERC or appeal these conditions directly to the Hearing Examiner under authority granted in Section 4-2823(A) (1) (a) within 14 days of the date that the DNS is final.
