Whereas the Grantor of said described property desires to impose the following restrictive covenants running with the land as to use, present and future, of the above described real property. NOW, THEREFORE, the aforesaid Grantor hereby establishes, grants and imposes restrictions and covenants running with the land hereto attached described with respect to the use by the undersigned, his successors, heirs, and assigns as follows: Installation and Approval of Construction Improvements Prior to Buildin� Permit(s): Grantor hereby agrees and covenants that Grantor, its successors, heirs and assigns, including those who may acquire merely a partial interest in the subject property, shall construct and must receive final construction approval from the City of Renton (the "City") for the on and offsite improvements shown on the approved construction drawings on file with the City under reference number 3980. Private underground stormwater detention facility located on Lot 4 of the Short Plat that for storm water detention for all five lots within the Short Plat. 3. Sixteen foot wide asphalt access roadway on Lot 4 of the Short Plat to provide the required maintenance access for the underground stormwater detention facility. 4. A 12-inch diameter 966 lineal foot storm drainage main extension within 114tn Avenue SE and SE 162"d Street including roadway restoration meeting the City of Renton Trench Restoration Standards. 5. A four foot wide asphalt paved shoulder along SE 16nd Street from the east property line of Lot 1 of the Short Plat to the intersection of 116t'' Avenue SE and SE 162"a Street. 6. An 8-inch diameter 143 lineal foot sanitary sewer main extension within SE 162"a Street including roadway asphalt overlay including sanitary sewer stubs to the lots within the Short Plat. 7. Water services to each of the lots within the Short Plat. NO BUILDING PERMIT APPLICATIONS WILL BE ACCEPTED, AND NO BUILDING PERMITS WILL BE ISSUED, BY THE CITY FOR ANY LOT ASSOCIATED WITH THE SHORT PLAT UNTIL ALL ON AND OFF SITE IMPROVEMENTS SHOWN WITHIN THE CONSTRUCTION PLANS REFERENCED ABOVE HAVE RECEIVED FINAL CONSTRUCTION APPROVAL FROM THE CITY OF RENTON. Duration: These covenants shall run with the land. If the City issues final construction approval of the Required Construction Improvements the covenants herein shall terminate without necessity of further documentation. Any violation or breach of these restrictive covenants may be enforced by proper legal procedures in the Superior Court of King County by either the City or any property owners adjoining subject property who are adversely affected by said breach. ALL PRESENT AND FUTURE OWNERS OF LOTS WITHIN THE SHORT PLAT ARE SUBJECT TO THE OBLIGATIONS IMPOSED BY THESE COVENANTS UNTIL THE COVENANTS TERMINATE.
