The gross and net lot areas for each lot shall be provided at the time of formal land use application. Building Standards -The R-8 zone allows a maximum building coverage of 35% of the lot area or 2,500 square feet, whichever is greater for lots over 5,000 square feet in size. Lots under 5,000 square feet in size are permitted a maximum building coverage of 50% of the lot area. Building height is restricted to 30 feet and 2-stories. Detached accessory structures must remain below a height of 15 feet and one-story or can be up to 30 feet and 2 stories if the use of the structure is animal husbandry related. The gross floor area must be less than that of the primary structure. Accessory structures are also included in building lot coverage calculations. The proposal's compliance with the building standards would be verified at the time of building permit review. Setbacks -Setbacks are the minimum required distance between the building footprint and the property line and any private access easement. The required setbacks in the R-8 zone are 15 feet in front for the primary structure and 20 feet in front for the attached garage, 20 feet in the rear, 5 feet on interior side yards, and 15 feet on side yards along streets (including access easements) for the primary structure and 20 feet on side yards along streets (including access easements) for the attached garage. It appears that the existing residence on proposed Lot 1 would not comply with the required 20-foot rear yard setback requirements, however as the rear yard is a previously existing situation, compliance with the rear yard setback requirements is not required. The setbacks for the proposed residences would be reviewed at the time to building permit review. It appears that the proposed lots would have adequate area for the construction of residences outside of the required setback areas. Access/Parking: The proposal is to access the proposed lots through a 20-foot wide private access easement off of Union Avenue NE. Each lot is required to accommodate off street parking for a minimum of two vehicles. Private driveways may serve a maximum of two lots and must have a minimum easement width of 20 feet with 12 feet of paving. Addresses of lots along private streets are to be visible from the public street by provision of a sign stating all house numbers, and the sign is to be located at the iptersection of the private street and the public street. Half street improvements (curb, gutter and 6-foot wide sidewalk) along the site's Union Avenue NE frontage will be required for the short plat if not already in place. The applicant may elect to ask the Planning/Building/Public Works Administrator to pay a fee in lieu of installing the off site street improvements. Driveway Grades: The maximum driveway slopes cannot exceed 15%, provided that driveways exceeding 8% are to provide slotted drains at the lower end of the driveway. If the grade exceeds 15%, a variance from the Planning/Building/Public Works Administrator is required. Landscaping and Open Space: For plats abutting non-arterial public streets, the minimum off-site landscaping is a five (5 ft.) wide irrigated or drought resistant landscape strip provided that if there is additional undeveloped right-of-way in excess of 5 ft., this also must be landscaped. For plats abutting principal, minor or collector arterials, the width increases to 10 ft. unless otherwise determined by the reviewing official during the subdivision process. A minimum of 5 feet of landscaping shall be required along the site's Union Avenue NE street frontage. The existing landscaping for the existing residence may be counted towards the project's landscaping requirements. Tree requirements for plats include at least two (2) trees of a City approved species with a minimum caliper of 1 Yz inches per tree must be planted in the front yard or planting strip of every lot prior to building occupancy. A conceptual landscape plan must be provided with the formal land use application as prepared by a registered Landscape Architect, a certified nurseryman or other certified professional. The plan shall show the minimum 5-foot landscaping strip along the street frontages provided if additional undeveloped right-of-way is present additional right-of-way shall be required and two trees within the front yards or planting strips of each lot. The tree retention plan must show preservation of at least 25% of significant trees [those with a minimum diameter of 8" (evergreen) or 12" {deciduous) when measured four feet above grade], and indicate how proposed building footprints will be sited to accommodate preservation of significant trees that will be retained. The following species are exempted from the retention requirements outside of critical areas: All Populus species including cottonwood (Populus trichocarpa), quaking aspen (Populus tremuloides), lombardy poplar (Populus nigra "ltalica"), etc. All Alnus species which includes red alder (Alnus oregona), black alder (Alnus glutinosa), white alder {Alnus rhombifolia), etc. Salix species which includes weeping willow (Salix babylonica), etc., unless along a stream bank and away from paved areas. • All Platanus species which include London plane tree (Platanus acerifolia), American sycamore, buttonwood (Platanus occidentalis), etc. Environmental Review: Short plats four lots or less that do not have any critical areas as defined by the City of Renton's Municipal Code (RMC4-3-050) are exempt from the Environmental Review process. Permit Requirements: Short plats of four or less lots with a Setback Variance are processed administratively within an estimated time frame of 6 to 8 weeks for preliminary approval. The application fee is $1,000 with Y, off subsequent applications. The fee for the Administrative Setback Variance would be $50 (1/2 off $100 full fee). The applicant will be required to install a public information sign on the property. Detailed information regarding the land use application submittal is provided in the attached handouts. Once preliminary approval is received, the applicant must complete the required improvements and satisfy any conditions of the preliminary approval before the plat can be recorded. The newly created lots may be sold only after the short plat has been recorded. For your use, I have attached a copy of the short plat recording process to be completed after preliminary short plat approval. Fees: In addition to the applicable building and construction permit fees, the following mitigation fees would be required prior to the recording of the plat (the project will be credited for the existing home). • A Transportation Mitigation Fee based on $75.00 per each new average daily trip attributable to the project; and, • A Fire Mitigation Fee based on $488.00 per new single-family residence. A handout listing all of the City's Development related fees in attached for your review. Expiration: Upon preliminary short plat approval, the preliminary short plat approval is valid for two years with a possible one-year extension. Consistency with the Comprehensive Plan: The proposed development would be located within the Residential Single Family (RSF) Comprehensive Plan Land Use designation. The following proposed policies are applicable to the proposal: Land Use Element Objective LU-FF: Encourage re-investment and rehabilitation of existing housing, and development of new residential plats resulting in quality neighborhoods that: 1. Are planned at urban densities and implement Growth Management targets, 2. Promote expansion and use of public transportation; and 3. Make more efficient use of urban services and infrastructure. Policy LU-147. Net development densities should fall within a range of 4.0 to 8.0 dwelling units per acre in Residential Single Family neighborhoods. A minimum lot size of 5,000 square feet should be allowed on in-fill parcels of less than one acre (43,560 sq. ft.) in single-family designations. Allow a reduction on lot size to 4,500 square feet on parcels greater than one acre to create an incentive for aggregation of land. The minimum lot size is not intended to set the standard for density in the designation, but to provide flexibility in subdivision/plat design and facilitate development within the allowed density range. Policy LU-149. Lot size should exclude private sidewalks, easements, private road, and driveway easements, except alley easements. Policy LU-150, Required setbacks should exclude public or private legal access areas, established through or to a lot, and parking areas. Policy LU-152. Single-family lot size, lot width, setbacks, and impervious surface should be sufficient to allow private open space, landscaping to provide buffers/privacy without extensive fencing, and sufficient area for maintenance activities. Policy LU-154. Interpret development standards to support new plats and infill project designs incorporating street locations, lot configurations, and building envelopes that address privacy and quality of life for existing residents. Community Design Element Policy CD-12. Infill development, defined as new short plats of nine or fewer lots, should be encouraged in order to add variety, updated housing stock, and new vitality to neighborhoods. The following policies are advisory and are intended to inform the applicant of the City Council's desired outcome for infill development. Code implementing these policies is on the department's work program and may be adopted prior to formal review of projects now at the pre-application stage. Policy CD-13. Infill development should be reflective of the existing character of established neighborhoods even when designed using different architectural styles, and/or responding to more urban setbacks, height or lot requirements. Infill development should draw on elements of existing development such as placement of structures, vegetation, and location of entries and walkways, to reflect the site planning and scale of existing areas. I Policy CD-14. Architecture of new structures in established areas should be visually compatible with other structures on the site and with adjacent development. Visual compatibility should be evaluated using the following criteria: a. Where there are differences in height (e.g., new two-store development adjacent to single- story structures), the architecture of the new structure should include details and elements of design such as window treatment, roof type, entries, or porches that reduce the visual mass of the structure. b. Garages, whether attached or detached, should be constructed using the same pattern of development established in the vicinity. c. The proJect tax number is I 02305-9243 and the address is 902 Union Avenue N.E., Renton, Washington. The site currently has an existing home, which is proposed to be on Lot I of the short plat. There is also an existing outbuilding (garage), which is to remain. The site is relatively flat, however, the grades are from the northwest to the southeast comer of the project. The elevation drop from the northwest comer is approximately 4 feet. The site is covered with landscaping shrubs and lawn areas with existing deciduous and evergreen trees. These trees have been located on the proposed short plat map. Proposed Use: The site is zoned R-8 in accordance with the City of Renton Zoning Code and we are proposing a two-lot short plat. Lot 1 will be approximately 13,947 square feet and Lot 2 will be approximately 5,214 square feet. The proposed access will be directly from the existing driveway curb drop on Union Avenue N.E. to serve both the existing house and the future home on Lot 2. The proposed project will require short plat approval, SEPA threshold determination, construction plan approval (water, sewer, and storm drainage), and a Right-of-Way Use Permit for construction in Union Avenue N.E. The project soil is Alderwood gravelly sandy loam, and existing drainage is from the northwest to the southeast of the property. Proposed Improvements/Mitigation: Currently, the site gains access to Union Avenue N.E., which is fully improved with curb, gutter, and sidewalk; therefore, there will be no requirement for new public road improvements but to serve the existing home and future Lot 2, a 20-foot-wide private access easement/driveway will be required. This access will be paved for fire/emergency vehicle access. The construction cost estimate for this project is unknown at this time and will be determined upon short plat approval requirements. We anticipate that there will be minimal excavation/grading on the site other than what is needed for utilities. We are proposing to remove five trees as part of this project. We have highlighted this on the attached site plan. These trees will be removed as part of the future construction of the home on proposed Lot 2. All other trees arc to remain. Response: We anticipate that during construction the hours of operation would be from 8:00 a.m. to 8:00 p.m. Monday through Friday. Saturday work may be required and will be coordinated with the City of Renton inspectors. • Proposed hauling/transportation routes. Response: Access to the site for hauling of materials would be from Union Avenue N.E. to N.E. 12th Street. • Measures lo be implemented to minimize dust, traffic, and transportation impacts, erosion, mud, noise, and other noxious characteristics. Response: During construction we will utilize water trucks to minimize dust during construction. With respect to traffic and transportation impacts, the City of Renton requires a fee to be paid for final plat for transportation impacts. The preliminary short plat map indicates all the existing trees, which include mature fir trees along the south property line and several ornamental trees within the front yard of proposed Lot I. For your review, please see the attached photo indicating recently planted flowering deciduous trees along the border of the existing driveway and wood trellis. Furthermore, there are quite a number of large mature rhododendron trees. Therefore, it is our opinion that Lot l does not need or warrant additional landscaping. However, because of the grade and future construction of a new home on Lot 2, we are proposing the builder to provide two evergreen trees (1 \/, caliper) as part of the building permit. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). RECONSIDERATION. Within 14 days of the effective date of the decision, any party may request that a decision on a short plat be reopened by the Administrator. The Administrator may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the Administrator finds insufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the following appeal timeframe. APPEAL. This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on October 13, 2006. Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton City Clerk's Office, (425) 430-6510. Appeals must be filed in writing, together with the required $75.00 application fee, to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98055. EXPIRATION DATE: The Short Plat approval will expire two (2) years from the date of approval. An extension may be requested pursuant to RMC section 4-7-080.M. City of Renton P/B/PW Department Administrative Land Use Action 902 UNION (TAYLOR) SHORT PLAT REPORT AND DECISION DATED September 29, 2006 ADVISORY NOTES TO APPLICANT LUA06-090, SHPL-A Page 10 of 10 The following notes are supplemental Information provided in conjunction with the administrative land use action. Because these notes are provided as information only, they are not subject to the appeal process for the land use actions. Planning 1. Commercial, multi-family, new single family and other nonresidential construction activities shall be restricted to the hours between 7:00 a.m. and 8:00 p.m .. Monday through Friday. Work on Saturdays shall be restricted to the hours between 9:00 a.m. and 8:00 p.m. No work shall be permitted on Sundays. 2. Two ornamental trees, a minimum caliper of 1-1/2 inches (deciduous) or 6-8 feet in height (conifer), shall be planted or retained within the 15-foot front yard setback area for the proposed new lot. Fire 1. All plats are required by City code to provide a fire hydrant with a minimum fire flow requirement of 1,000 GPM within 300 feet of any proposed single-family structure. This distance is measured along a travel route. If the proposed single-family structures exceed 3,600 sq. ft., the minimum fire flow increases to 1,500 GPM and requires two hydrants within 300 feet of the structures. Additional fire hydrants may be required as a part of this project to meet this criterion. The fire hydrants must meet all current City of Renton standards. 2. A Fire Mitigation Fee, based on $488.00 per new single-family lot, with credit given for the existing single-family residence, is required in order to mitigate the proposal's potential impacts to the City emergency services. The fee is estimated at $488.00 and shall be paid prior to recording the final plat. 3. Street addresses shall be visible from a public street. Plan Review-Storm/Surface Water 1. A Surface Water System Development Charge of $759.00 per single-family lot is payable prior to final plat recording. Plan Review -Streets 1. A transportation Mitigation Fee based on $75.00 per new average daily trip attributed to the project will be required. One new lot (credit is given for the existing residence) is expected to generate approximately 9.57 new average weekday trips. The fee for the proposed short plat is estimated at $717.75 ($75.00 x 9.57 trips = $717. 75) and is due prior to recording the final plat. 2. All new electrical, phone and cable services and lines must be undergrounded. The construction of these franchise utilities must be inspected and approved by a City of Renton public works inspector prior to recording the plat. 3. Any damage incurred to the street, curbs, gutters, or sidewalks by this project must be repaired. Plan Review-Water 1 . This project will be required to provide domestic water service lines from the main to serve the new lot prior to recording the final plat. The existing water service line and meter may need to be relocated to meet current code. 2. A Water System Development Charge based on a rate of $1,956.00 per new single-family lot is required prior to short plat recording. Plan Review -Sewer 1. This site is located in the East Renton Interceptor Special Assessment District (SAD 0002). These fees are $316.80 per new connection. These fees shall be paid prior to issuance of the construction permit. 2. Sewer System Development Charges (SDC) are $1,017.00 per new unit. These fees are collected at the time a construction permit is issued and prior to recording the final plat. 3. Minimum slope for side sewers shall be 2%. Dual side sewers are not allowed. The existing side sewer may need to be relocated to better serve the short plat and new building foundations. 4. This project is not required to install a sanitary sewer main. The conceptual utility plan needs to be modified to reflect this (delete the sewer main from the project plans). 5. The applicant is responsible for securing the necessary easements to serve this short plat with sanitary sewer. Plan Review -General 1. All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a licensed Civil Engineer. 2. Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvements is 5% of the first $100,000 of the estimated construction costs; 4% of anything over $100,000, but less than $200,000, and 3% of anything over $200,000. Half of the fee must be paid upon application for building and construction permits, and the remainder when the construction permit is issued. A Fire Mitigation Fee, based on $488.00 per new single-family lot, with credit given for the existing single- family residence, is recommended in order to mitigate the proposal's potential impacts to City emergency services. The fee is estimated at $488.00 and is payable prior to the recording of the final plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per single-family residential dwelling. Based on the student generation factor, the proposed short plat could result in a single new student (0.44 X 1 lots = 0.44 rounded to 1) to the local schools. Renton School District has indicated it can accommodate additional students generated by this proposal at Highlands Elementary School, McKnight Middle School, and Hazen High School. Surface Water: The storm drainage plan for this 2 lot short plat shall determine if detention is required under the 1990 King County Surface Water Drainage Manual. If per the 1990 Manual the engineer of record determines that detention is required then the engineer shall use the 2005 Manual for sizing the detention facility. The new lots will be required to provide conveyance to address the storm water runoff from the individual lots. The conceptual utility storm drainage plan is under review at this time. The proposed short plat is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, a Transportation Mitigation Fee based on $75.00 per new average daily trip attributed to the project. One new lot (credit given for the existing residence) is expected to generate approximately 9.57 new average weekday trips. The fee for the proposed short plat is estimated at $717.75 ($75.00 x 9.57 trips= $717.75) and is payable prior to the recording of the short plat. Blocks: The proposed Short Plat does not create new blocks. Lot Standards: The size, shape, orientation, and arrangement of the proposed lots must comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. The minimum lot size permitted in the R-8 zone is 5,000 square feet for lots smaller than 0.5 acre prior to subdivision. The lot sizes would be Lot 1 (existing house) at 13,9476 square feet and Lot 2 at 5,214 square feet. Both lots meet the minimum size requirement. The lots appear to contain adequate buildable areas for the construction of suitable single-family residences when taking setbacks and lot coverage requirements into consideration. These requirements will be reviewed at the time of building permit application for the new houses. The R-8 zone requires a minimum lot width of 50 feet for interior lots and a minimum lot depth of 65 feet. The lots would meet the lot width and depth requirements, although Lot 2 would have its front yard on the north side of the lot in order to meet minimum lot depth requirements. The proposed lots would be compatible with other existing lots in this area. The lots are rectangular in shape and aligned in an urban pattern that is consistent with other lots in the immediate vicinity, as well as generally with the city as a whole. d) Reasonableness of Proposed Boundaries Access: All lots in a short plat must have access to a public street. Lot 1 would continue to front off Union Ave NE and Lot 2 would have access by means of a new access easement across Lot 1 from Union Ave NE. The new access easement would be aligned with the existing driveway location to avoid a new driveway curb cut. See "Police and Fire" section below. A condition of the plat shall be that a maintenance agreement be recorded assigning responsibility for maintenance of the private access easement. Topography: The site slopes very gradually from northwest to southeast at an average grade of approximately 1 percent. Relationship to Existing Uses: The properties north and east of the site are single-family residences and are zoned Residential -8 Dwelling Units per Acre on the City's zoning map. The proposal would result in development at density comparable to existing development in the area. Kiwanis Park, a 9-acre city-owned public park, is located adjacent to the site on the west side of Union Ave NE. The Church of the Nazarene occupies a 4.5 acre site abutting on the south side of the property. There are no confiicts anticipated between the two residential lots and other uses in the area. e) Availability and Impact on Public Services (Timeliness) Police and Fire: Police and Fire Prevention Bureau staffs indicate that sufficient resources exist to furnish services to the proposed development. The access easement must have a 20 foot minimum paved width. Dead end roadways over 150 feet in length are required to have an approved turnaround. The current site plan does not show an approved turnaround. A condition of the short plat approval shall be that a revised access easement plan be submitted to the Fire Prevention Bureau for approval. Policy LU-149. Lot size should exclude private sidewalks, easements, private road, and driveway easements, except alley easements. Lot areas do not include the access easement. Objective CD-K: Site plans for new development projects for all uses, including residential subdivisions, should include landscape plans. A landscape plan is required as a condition of plat approval. Policy CD-45. Existing mature vegetation and distinctive trees should be retained and protected in developments. Trees and vegetation would be removed from the new lot. However, all pervious areas, except rear yards, are required to be landscaped and additional trees, both replacement trees and other required trees, will be planted, as per City of Renton code. This would compensate for the loss of vegetation to a certain extent. Policy CD-53. Landscape plans for proposed development projects should include public entryways, street rights-of-way, storm-water detention ponds, and all common areas. A landscape plan is required indicating that pervious areas of both lots, would be landscaped. b) Compliance with the Underlying Zoning Designation The subject site is designated Residential -8 Dwelling Units per Net Acre (R-8) on the City of Renton Zoning Map. The R-8 zone is intended for single-family residential development that would add to the city's mix of residential styles including detached dwellings on small lots. The zone is intended to implement the Residential Single Family Comprehensive Plan land use designation. Development should be promoted in the zone that provides opportunities for detached single-family dwellings, ensures high-quality infill development, and maintains the single-family character of existing, established neighborhoods. The maximum density allowed in the R-8 zone is 8 dwelling units per net acre, there is no minimum density requirement on properties smaller than 0.5 acre prior to subdivision. Net density is calculated after the deduction from the gross acreage of the site of environmentally critical areas, areas intended for public right-of-way (with the exception of alleys), and private access easements. In this case, the applicant has a gross site area of 19,161 square feet, with no critical areas. A 3,528 sf private access easement was subtracted, so the resulting net density of the short plat would be 5.5 dwelling units per acre (2 / 0.36 = 5.5 du/ac), which is within the density range allowed in the R-8 zone. There are five significant or "protected" trees on the site, so replacement by 2 trees will be required. This replacement requirement is in addition to other required landscaping. Renton Municipal Code also requires two (2) new trees per lot. Landscaping along the frontage of Union Ave NE and of all pervious areas of the residential lots will also be required (RMC 4-4-070). Existing landscaping along Union and on Lot 1 may be suitable to meet some of the landscaping requirements. Staff recommends the required landscape plan indicate existing landscaping to remain as well as replacement and new proposed landscaping. c) Compliance with Subdivision Regulations Streets: No improvements to Union Ave NE have will be required as part of the requested subdivision. This is within the density range of between 4 and 8 dwelling units per net acre for the R-8 zone, although development on property that is less than 0.5 acre in size prior to subdivision is not required to meet the minimum density requirement. Access to the new lot would be provided from a new private access easement off Union Ave NE. The access easement would serve as a shared driveway for both Lots 1 and 2. The site is essentially level, with a slope of approximately 1 percent from northwest to southeast. There are no known critical areas or environmental issues of concern associated with the property. There are 5 "protected" trees on Lot 2 that would be removed. Replacement of these trees is required by interpretation of Renton Municipal Code. Staff recommends that a landscape plan be submitted indicating proposed location, size, and type of replacement trees. Required landscaping, including two trees to be located on the new lot, shall also be indicated on the landscape plan. 2. Environmental Review Except when localed on lands covered by water or with sensitive areas, short plats are exempt from SEPA Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Staff Review Comments Representatives from various City departments have reviewed the application materials to identify and address issues raised by the proposed development. Consistency with Short Plat Criteria Approval of a short plat is based on an evaluation using the following short plat criteria: a) Compliance with the Comprehensive Plan Designation Purpose Statement: Lands in the Residential Single Family Designation are intended to be used for quality residential detached development organized into neighborhoods at urban densities. It is intended that larger subdivision, infill development, and rehabilitation of existing housing be carefully designed to enhance and improve the quality of single-family living environments. Policies in this section are to be considered together with the policies in the Regional Growth, Residential Growth Strategy section of the Land Use Element, the Community Design Element, and the Housing Element. Policies are implemented with Residential 8 zoning. The proposed plat is consistent with the following Comprehensive Plan objectives and policies for Residential Single Family land use designation.
