The site is approximately 21,720 square feet and is currently occupied by a single family house. A protected slope is located near the northeast corner of site (See Exhibit 2), however the proposed tree removal will not be located within the identified protected slope. The applicant proposes to remove three of the trees do to root rot and weak/hazardous tree limbs. The applicant stated that the tree limbs are breaking off and falling on the property and street. These three trees are located in a stand of five fir trees. According to Renton Municipal Code, Section 4-4-130C9a., the applicant can remove up to three trees within a twelve month period, without a permit. However, the applicant states, and staff agrees, that if three of the trees located in the stand of five trees are removed, the remaining two trees will be exposed to wind. The wind exposure could compromise the integrity of the trees and increase their hazard potential by creating situations where the trees would be susceptible to blow down. After removal of the five fir trees, the applicant proposes to immediately replant with shrubs and grass. The project will be scheduled immediately after City of Renton approval. November 18, 2015 GENERAL REVIEW CRITERIA 4-4-130H4: NO 1. The land clearing and tree removal will not create or contribute to landslides, accelerated soil creep, settlement and subsidence or hazards associated with strong ground motion and soil liquefaction. Comments: While the subject site is located within Erosion Hazard Area, it is not anticipated that the removal of the subject Douglas Fir trees would contribute to hazards associated with strong ground motion and soil liquefaction. The land clearing and tree removal will not create or contribute to flooding, erosion, or increased turbidity, siltation or other form of pollution in a watercourse. Comments: The subject site is not located within an identified Flood Hazard Area or near a stream or wetland. It is not anticipated that the removal of the subject Douglas Fir trees would contribute to flooding, erosion, or increased turbidity siltation. Will the land clearing and tree removal be conducted to maintain or provide visual screening and buffering between land uses of differing intensity and consistent with applicable landscaping and setback provisions of the Renton Municipal Code? Comments: Not applicable. Can the land clearing and tree removal be conducted in a way so as to expose the smallest practical area of soil to erosion for the least possible time, consistent with an approved build-out schedule and including any necessary erosion control measures? Comments: The applicant is proposing to remove five Douglas Fir trees on the northwest corner ofthe parcel. A small portion ofthe site on the southern border is identified as Erosion Hazard Area. The proposed location oftree removal is not within the identified Erosion Hazard Area and would not contribute to hazards associated with erosion. After removal of the five fir trees, the applicant proposes to immediately replant with shrubs and grass, which will ensure that the smallest practical area of soil will be exposed to erosion for the least possible time. In addition, by removing all five trees, rather than the allowed three trees, the applicant is avoiding potential hazards from wind-compromised trees. Land clearing and tree removal shall be consistent with subsection D2 ofthis Section, Restrictions for Critical Areas -General, and RMC 4-3-050-Critical Areas Regulations. Comments: A protect slope is located on the site, however the proposed tree removal will not be located within the identified protected slope. See seismic and flood hazards above in subsections a. and b. respectively. No other Critical Areas are located on site. The retained trees will not create or contribute to hazardous conditions as the result of blow-down, insect or pest infestation, disease, or other problems that may be created as a result of selectively removing trees and other vegetation from the lot (s). Comments: The purpose of the applicant's proposal is to remove all five trees in the identified stand of trees, rather than the code allowed three trees, in order to prevent wind exposure, blow-down, or other problems that may be created by selectively removing trees. Will the land clearing and tree removal being conducted maximize the preservation of any tree(s) in good health that is an outstanding specimen because of its size, form, shape, age, color, rarity, or other distinction as a community landmark? Comments: Not applicable, no specimen trees are located on site. Some ofthe proposed trees to be removed are estimated to be over one hundred years old, however three of the trees are hazardous. The applicant is proposing to remove all five trees in this group, rather than the code allowed three trees, in order to prevent wind exposure, blow-down, or other problems that may be created by selectively removing trees. DECISION: The 2616 Union Ave NE RVMP Routine Vegetation Management Permit is Approved. SIGNATURE & DATE OF DECISION : November 18, 2014 Jennifer He,;;;ing, Planning Dir~ Date Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on December 02, 2014, together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, ifthe approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Expiration: The Routine Vegetation Management Permit shall be valid for one year from the date of issuance. An extension may be granted by the Planning Division for a period of one year upon application by the property owner or manager. Application for such an extension must be made at least thirty {30) days in advance of the expiration of the original permit and shall include a statement of justification for the extension. You will need to delineate the protected slope on the site plan.
