The proposed fence would have a maximum height of 6 feet and would encroach into the required 30 foot front yard setback. The proposed 6 foot fence would be located 25 feet from the existing paved travel lane and directly on the property line for 123 linear feet of the 264 foot frontage (See Exhibit 2). A maximum 4 foot fence is proposed on the remaining 141 feet of frontage on the south property line as well, as on the entire east property line. The applicant proposes to install permanent landscaping within the public right-of-way, along the front of the fence. Landscaping including Flowering Dogwood trees and low growing shrubs are proposed within the public right of way along the length of the 6-foot portion of fence to prevent a blank wall appearance (Exhibit 2). No city street improvements are proposed in this location at this time. Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on April 13, 2015, together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. Reconsideration; Within 14 days ofthe decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension ofthe appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Page 2 of 2 Special Fence Permit Justification: EXHIBIT 1 The following explains the use of the measures below to comply with the purpose of the Special Fence Permit at 5628 NE 23rd St. in Renton. Description of the fence area: The fence will be located 25' from the existing roadway and within the property line. The property line runs 264', the fence will be less than half of that at 123'. It will not detract from the quality of the residential environment or appear as a vast blank wall along the public roadway. The fence will enhance the overall image and appearance of the City and the quality of life for its citizens. • Permanent landscaping along the front of the fence ; There will be landscaping that improves the overall aesthetics' of the roadway and surrounding area. In addition, lower cost for the city by minimizing maintenance requirements of the 25' easement. • Quality fence material, such as cedar fencing; The fence material will be vinyl and consist of light gray wood-grain panels with white trim and post. Vinyl fencing has many environmental advantages over wood fencing. Vinyl's durability is a major environmental benefit because the longer the fence will last; the less energy and other resources are needed to replace it. A wood fence will be replaced several times over the same life span that of a vinyl fence. There is a great deal of harvesting and destruction of trees to replace a wood fence. Vinyl Fencing, on the other hand, needs only water to keep the fence looking great. Wood fences also require toxic pre-treatment, annual or semi-annual staining or painting, using chemicals that leach into the ground. In addition, wood fencing has several appearance issues over time and it cost the City time and recourses to enforce the structural and aesthetic maintenance. See the photo below of wood fencing within a couple of blocks on a major public roadway. Extremely poor appearance! The two tone color and landscaping will give is a rich and enhanced appearance. Also, this is a much shorter distance than several non-modulated fence lines in the neighborhood. • Similar design and material as other fences in the surrounding ne ighborhood; There are several areas within the City using vinyl. Here are photos on NE 4th St. in Renton, down the road from 5628 NE 23'd St property and just east of Nile . JUSTIFICATION: RMC 4-4-040.G, Special Administrative Fence Permits, provides a process to apply for a fence that is not allowed by the Section. RMC 4-4- 040.G.1.b provides this opportunity for "fences exceeding forty eight inches (48") within front yard or side yards along a street setback but not within a clear vision area." DECISION: RMC 4-4-040.D.3.c states "Side Yard Along a Street Setbacks: Fences, retaining walls or hedges shall not exceed forty two inches (42") in height within any clear vision area, as defined by RMC 4-11-030, Definitions C, and forty eight inches (48") in height elsewhere in the front yard setback. The remainder of the fence or hedge shall not exceed seventy two inches (72") in height within the side yard along a street setback. The opportunity to apply for a Special Administrative Fence Permit that would allow a fence taller than 48" within front yards or side yards along streets would not exist if the intent was to allow fences taller than 48" within the side yard along a street. Fences, hedges, and retaining walls up to 72" in height may be installed within rear and side yards along streets, excepting any portion within a front yard setback or clear vision area, if the following criteria are met: • High-quality fencing materials shall be used (e.g., cedar wood, wrought iron, etc.). (B) Shrubs: Eight (8) shrubs per five (5) linear feet. Up to fifty percent (50%) of shrubs may be deciduous: ,/ Low Shrub: Mature size under three (3) feet tall. Minimum size at planting: one (1) or two (2) gallon pot or balled and burlapped equivalent. ,/ Medium Shrub: Mature size from three (3) feet to six (6) feet tall.
