The lot is within the Residential -6 (R -6) Zone and is 10,800 square feet. There is an existing single family home on the site. The tree is located on the northwest corner of the lot . City arborist, Terry Flatley, inspected the tree and noted that the tree was causing property damage to the retaining walls, stairca se, and sidewalk. Terry Flatley stated that the tree was an inappropriate species for the location, and because of the extent of the damage, he recommends removal of the tree. Staff recommends as a condition of approval that the applicant maintain a minimum of four (4) trees on th1 lot in order to comply with tree density regulations, per RMC 4-4-130C.9.d. EXPIRATION DATE: July 29, 2017 GENERAL REVIEW CRITERIA 4-4-130HS: YES 1. YES 2 . YES 3. The land clearing and tree removal will not create or contribute to landslides, accelerated soil creep, settlement and subsidence or hazards associated with strong ground motion and soil liquefaction. The land clearing and tree removal will not create or contribute to flooding, erosion, or increased turbidity, siltation or other form of pollution in a watercourse. Land clearing and tree removal will be conducted to maintain or provide visual sc reening and buffering between land uses of differing intensity and consistent with applicable landscaping and se tback provisions of the Renton Municipal Code. Land clearing and tree removal shall be conducted in a way so as to ex pose the smallest practical area of soil to erosion for the least po ssible time, consistent with an approved build-out schedule and including any necessary erosion control measures. Land clearing and tree removal shall be consistent with subsection D 2 of this Section, Restrictions for Critical Areas -General, and RMC 4-3-050-Critical Areas Regulations. Retained trees will not create or contribute to hazardous conditions as the result of blowdown, in sect or pest infestation, disea se, or other problems that may be created as a result of selectively removing trees and other vegetation from the lot. Land clearing and tree removal shall be conducted to ma x imize the preservation of any tree(s) in good health that is an outstanding specimen because of its size, form , shape, age, color, rarity, or other distinction as a community landmark. DECISION: The Nelson Tree Removal Routine Vegetation Management Permit Routine Vegetation Management Permit is Approved with Conditions*. *CONDITIONS OF APPROVAL: The appli cant shall plant a minimum of two (2) trees and maintain a minimum of four (4) trees on the lot in order to comply with tree density regulation s, per RMC 4-4-130C.9.d. SIGNATURE & DATE OF DECISION : July 29, 2016 Date Appeals of permit issuance must be filed in writing on or before 5:00 p.m . on August 12, 2016, together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Rentar WA 98057. Appeal s to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily di sco v erable prior to the original decision is found or if he finds there was misrepre sentation o f fact. Afte r review of the reconsideration request, if the approval body finds sufficient evidence to amend the o riginal decision, there will be no further exten sion ofthe appeal period. Any person w ishing to t ake further action must file a formal appeal within the 14-day appeal time frame. An extension may be granted by the Planning Division for a period of one y ear upon application by the property owner or manager. Application for such an extension mu st be made at lea st thirty (30) days in advance of the expiration of the original permit and shall include a statement of justification for the extension. It is an 86-inch diamete r giant se qu oia, loca t ed in a plante r above the street and drivewa y. This is not a very good location for a tree that gets that large in 60 years or so and is resulting in a lot of prope rty damage (retaining walls cracking/buckling, sta ircase tilting fro m roo t heaving, sidewa lk around ho use bei ng heaved, and large roots growing along h ou se fou nd ation and into nei ghboring prope rty . And, it has some poor root configurations aroun d th e base o f the tre e (girdling roots) a nd some in sec t ac tivity in the ma in trunk. Because of th e exten t of damage to prope rty this tree is causing, despite its good cond ition, I recommend pe r mission to remove . Th e owner is Mary Nelso n at 42 5-255 -6035.
