State of Washington law (RCW 35A.14.700) requires cities to conduct a special census of recently annexed areas. The purpose of the special census is to ensure proper distribution of state funds allocated to cities and towns for municipal services, such as police protection. These funds are allocated on the basis of increased population to the City. The City of Renton has hired the firm Census Services to conduct a door-to-door census of your neighborhood, pursuant to State guidelines. Soon after the annexation is effective Census Services will conduct this special census using, census enumerators. Each census enumerator will carry an official City of Renton identification badge with their name and picture on it. The census enumerators will ask you for your name and the names of others in your household. This is because the State of Washington's Office of Financial Management requires persons living in annexed households to be identified by name before they will certify the census and allocate state funds to the City. A listing of names provides a means by which state staff can � - verify the census and identify any discrepancies, such as a duplication of names. The information vou provide will be kept strictly confidential. After verification by the Office of Financial Management, all records are destroyed. Only the final city population count will be released. , . If you prefer not.to provide information through contact at the door, there are other ways you can provide this information. First, when the census enumerators come to your door, they can leave you a census form and a postage paid envelope for you to return. Second, you can take the census by phone by contacting Glenn MacGilvra, Census Director at Census Services, at 425.533.5432. Third, you can email your phone number to amathias@rentonwa.�ov and a Census Services employee will phone you. For questions about the annexation or the City of Renton, please contact the City's Planning Division at 425.430.6575. SUMMARY OF ACTION: , On July 11, 2011, City Council held a public hearing in the matter of the proposed Gaile Annexation. Following that public hearing, Council accepted the 60% petition and authorized the Administration to forward a Notice of Iritent to the King County Boundary Review Board (BRB). On September 19, 2011, the BRB issued a Closing Letter for Completed Action indicating its approval of the annexation. The next step for this proposed annexation is for Council to adopt the ordinance annexing the area to the City. The area was pre-zoned Residential Four Dwelling Units per Acre (R-4) as part of Ordinance #5561 and the Fairwood pre-zone. The R-4 zoning will become effective upon annexation. City departments conducted a review of the annexation proposals and all departments indicated that the annexations represent logical extensions of services and raised no concerns. Staff reviewed the enclosed legal description and found that it varied from the enclosed highlighted map and exhibit map. The legal description includes the SE 132nd Place right- of-way, but the maps do not. Staff recommends updating the exhibit map to show that the SE 132nd Place right-of-way is included. Additionally, staff attempts to identify islands of unincorporated road rights-of-way that may have been overlooked by the City in developing the legal description. The submitted legal description does not exclude any adjacent annexable portions of rights-of-way. King County's Soos Creek Park and Trail is within the annexation boundary. There are no Road Services Division's environmental mitigation sites, associated with past King County road projects, as identified from available GIS data. There are no King County-maintained off-road stormwater facilities within the proposed annexation bouridary, as identified from--available GIS data.- - - There are no new streets within the proposed annexation boundary that remain under maintenance-defect bonds with King County, as currently posted by the developer for the required two-year maintenance-defect period. Renton City Council adopted this annexation proposal in June 2010. The action is proposed under RCW 35A.14 via a 60% petition method of annexation. The City of Renton is seeking annexation to resolve an unincorporated island area iri order to more efficiently govern and serve the Area. The proposed annexation is also in keeping with interests by citizens in joining the City in order to participate in local government, to administer land uses under City of Renton regulations, and to receive essential public services from Renton. The Gaile Annexation site is located on the eastern side of the City of Renton. The northernmost boundary of the site is formed by property lines located south of and generally following SE 159th Place. The southern boundary of the site is formed by property lines and is located north of and generally follows SE 164th Street. The easternmost boundary is formed by property lines; this boundary is primarily located between 131St Place SE and 132°d Place SE; a portion of the eastern boundary is formed by SE 162"d Place. The westernmost boundary is formed by property lines located between 128th Avenue SE and 129th Avenue SE. The City of Renton reports that the proposed Gaile Annexation conforms to the State Growth Management Act (RCW 36.70A.) For example, the annexation is supported by RCW 36.70.20, which requires community planning goals, for urban growth, services and infrastructure, and environmental preservation. Additionally, annexation reportedly is consistent with RCW 36.70A.020 (1), encouraging development in urban areas where there are adequate public services. It is also consistent with RCW 36.70A.020 (12), calling for public services to support permitted development. The unincorporated Gaile Area is included in the "Land Use Element" of the City of Renton Comprehensive Plan. The Gaile unincorporated area is identified in the "Annexation Element" of the City of Renton Comprehensive Plan and is located within the Renton Potential Annexation Area. The proposed action is consistent with City of Renton Comprehensive Plan policies addressing annexation, including those provisions which call for inclusion of urban areas and provision of services e.g., LU-I; LU- 37.1; LU 37.5; LU-36; LU-41 and LU-42.) The proposal is reportedly also consistent with King County Comprehensive Plan/Countywide Planning Policies for annexation. For example, the Gaile Annexation is reported to address King County policies that call for contiguous orderly growth of local jurisdictions and for local services to urban areas (e.g., Comprehensive Plan: U-304, U-208, U-301, U-304.). The King County Countywide Planning Policies also establish cities as the appropriate providers of local governance and urban services (e.g., FW-13, CO-1, CO-3; LU-31, LU-32, LU-33). The City of Renton reports that the proposed Gaile annexation is consistent with the provisions of RCW 36.93 (Boundary Review Board Regulations). More specifically, RCW 36.93.180 requires that annexations be evaluated with respect to nine objectives. In this application, the City of Renton has stated that several key objectives have been identified as being potentially relevant for specific consideration. For example, City of Renton officials report that Gaile annexation would be consistent with Objective 1, which calls for the preservation of neighborhoods as this area is linked to Renton by natural/built geographic features (e.g., municipal boundaries, access routes, topography) and by social fabric (e.g., similar land uses, shared commercial centers, community gathering areas.) This annexation would also reportedly be consistent with Objective 2 which calls for the use of physical boundaries. The City of Renton borders the site at its western and southern boundaries. The remainder of the site is bordered by public rights of way and property boundaries located in Unincorporated King County. 3 , , - . --. . . �' Further, the annexation would be consistent with Objective 3, which calls for creation of logical service areas, and Objective 4 through Objective 7, which call for the achievement of reasonable boundaries for a jurisdiction. The City is seeking annexation in order that all services and land use regulations affecting this area may be efficiently coordinated by a single local government unit to the benefit of the community. Similarly, the City reports that this annexation would be consistent with Objective 8, which calls for inclusion of urban areas within municipalities. The Gaile Area has been established for annexation through the Renton Comprehensive Plan. This action is supported as well by the State Growth Management Act and the King County Comprehensive Plan. The Gaile Area is fully developed with single-family residences. As such, no new development is anticipated; however, redevelopment of some sites may occur. Both for developed and redeveloping properties in the Gaile Area, the City of Renton is prepared to provide general administrative services, review of development, and environmental protection (including evaluation and regulation of environmentally sensitive areas, storm water/flood management.) - The C-�ty of Renton wiil directly provide police service to the Gaile Area. The-City will provide fire service and emergency medical services to the Gaile Area properties via Renton Fire and Emergency Services. The City of Renton will provide the Gaile properties with utility services either directly or by contractual agreement with service providers. For example, Soos Creek Water & Sewer District currently provides water services to the Gaile Area properties and will continue to do so. Future redevelopment can also likely be served by the District, however, it may be necessary for the District to require a certificate of water availability for such development. With annexation, the City will also provide sewer services to the Gaile Area through the Soos Creek Water & Sewer District. Stormwater management will be provided in a manner consistent with the City of Renton Stormwater Manual, King County standards, and applicable State of Washington guidelines. Gaile Area residents would have access to Renton libraries, parks, and recreation facilities. Law and justice services and human services would, similarly, be provided to the citizens of the Gaile Area. Students would continue to be served by the Renton School District. City of Renton officials have conducted fiscal studies for the Gaile Area to estimate revenues and expenditures both at the time of annexation and ten years into the future. It is reported that the Gaile Area Annexation, at existing levels of development, will generate expenditures of$151,502 and revenue at$171,594. At the 10-yeaer point, the Gaile Area will generate expenditures of$189,855 and revenue at $192,723. Gaile Area property owners will assume their share of the regular taxes/fees (e.g., property taxes) and special levy rates of the City. With those revenues, and other revenues available to the jurisdiction, City officials report that there are sufficient funds to undertake the costs for governance and service to the Gaile Area in a manner equivalent to levels of service provided to citiz�ns of the existing City of Renton. BACKGROUND SUMMARY: At its April 4, 2011 public meeting, Council accepted the 10% Notice of Intent to Commence Annexation petition and authorized the circulation of a 60% Direct Petition to Annex. City of Renton departments reviewed the annexation proposal and all staff reported that the annexation represents a logical extension of their respective services and systems. There were no issues identified that would impede the annexation. A more detailed discussion of this proposed annexation and review comments are contained in the Department's April 4, 2011, Gaile Annexation 10% Notice of Intent issue paper. Revised Fiscal Analvsis At the direction of Council, Staff has been working on revising the methodology and assumptions used to analyze the fiscal impact a proposed annexation is anticipated to have on the City. Man.y revisions have been made to the analysis to try to more accurately reflect the financial impacts an annexation may have upon the City. One of the principal changes.made is to evaluate departmental costs based on what "drives" that cost. For example, the cost of an annexation area to the City for police service is driven by calls for service. Costs for street maintenance are driven by the lane miles within the area. There are also now more City divisions included in the cost analysis. For example, costs to provide human services, special events and - neighborhoods, as well as parks planning and natural resources have been added. The costs estimates are based on the 2011 budget and the official Census population figure (90,927). An effort was made to not include costs associated with staffing positions unlikely to be impacted by small incremental annexations,� e.g. supervisors, directors, , etc. The revenues for the analysis are derived from the 2011 budget assumptions specifically associated with the Benson Hill area. Finally, factors for inflation to both revenues and costs have been added. The fiscal analysis is continuing to be refined and has been circulated to departments for their review. Fiscal analysis for the Gaile annexation using the revised model is attached. _ CONCLUSION: � ' The proposed Gaile Annexation has been certified as having sufficient signatures representing at least 60% of the area's assessed value. It also has reasonable boundaries and appears to comply with Boundary Review Board objectives. Reviewing - staff raised no objections to this annexation. The proposed Gaile Annexation furthers the City's Business Plan goals and is in the general welfare and interest of the City. The Administration recommends the Council accept the 60% Direct Petition and authorize staff to forward the Notice of Intent package to the Boundary Review Board for King County. State law requires that the Council hold a public meeting with the annexation proponents within 60 days of receipt of a 10% Notice of Intent petition. The purpose of the meeting is for Council to decide whether to accept or reject the proposal and whether to require the simultaneous adoption of City zoning consistent with the Comprehensive Plan, if the proposed annexation is successful. . RECOMMENDATION: On the basis of the following analysis,the Administration recommends that Council � accept the 10% Notice of Intent petition. If Council concurs,the Administration recommends that it take the following actions (pursuant to RCW 35A.14.120): • Accept the 10% Notice of Intent to Commence Annexation petition; and . • Authorize the circulation of a 60% Direct Petition of Annex for the 43.6-acre ,area; and • Require that property owners within the proposed annexation area accept City of Renton zoning that is consistent with the City's Comprehensive Plan land use designation. � BACKGROUfVD SUMMARY: The proposed 43.6-acre Gaile Annexation is located at the southeastern portion of the City limits in the Fairwood Potential Annexation Area. The area is bordered by the existing City limits.to the west. Parcel lines comprise the northern, eastern, and southern.boundaries. However, the northern boundary is in the vicinity of Southeast Proposed Gaile Annexation 1(�. ��tice of Intent ' � Page 2 of 6 �'� � �160th Place, the eastern boundary is in the vicinity of 1315t Place Southeast, and the southern boundary is in the vicinity of Southeast 164th Street. 1. Location: The proposed 43.6-acre Gaile Annexation is bordered by the existing City limits at its north and west. � 2. Assessed value:The 2010 assessed valuation of the subject annexation site is $38,150,400. , 3. ,Natural features: The area is generally topographically level with a very small area that has greater than 25% slope. 4. Existin� land uses: There are 154 single-family residences and vacant land owned by Renton School District, King County, and City of Seattle. 5. Existin�zonin�: Existing King County zoning is R-6. This area was prezoned by the . City of Renton as part of Fairwood pre-zoning:City of Renton Ordinance#5561 prezoned the area with R-4 zoning; this zoning will become effective upon , annexation. 6. Comprehensive Plan: Renton's Comprehensive Plan designates the subject annexation site as Residential Low Density (RLD). 7. School District:The Gaile Annexation'area is in the Renton School District. 8. Public services: All responding City of Renton departments and divisions noted that the annexation represents a logical extension of their respective services and systems and presents no foreseeable problems. Specific comments follow: V1/ater Utilitv. The subject site is located within the service area of Soos Creek Water and Sewer District (SCWSD) and this would not change as a result�of annexation. A certificate of water availability from SCWSD will be required prior to the issuance of development permits within the subject area,following annexation to the City. The proposed area will not generate need for additional City employees or responsibilities for the City because it is within SCWSD. , Wastewater Utilitv. The area is served by Soos Creek Water and Sewer and annexation will not change the service provider. The area will not create a � need for staff or present additional responsibilities for the City because it is not within Renton's wastewater service area. � Parks. The Community Services department indicated that the annexation represents a logical extension of the services provided by their department., When compared with current City of Renton standards,the area has a shortfall of parks and recreation programming. Also, it was noted that the � cumulative effects of smaller scale annexations lead to the need for � . additional staff and resources. If new parks were to be developed in the future to serve the area, additional staffing and programming would be � necessary. Proposed Gaile Annexation 1( tice of Intent ' r� Page 3 of 6 v Police. The Police Department did not indicate any concerns regarding this proposed annexation. Fire. Renton Fire and Emergency Services currently provides fire and emergency services to the area under a contract with Fire District#40. No additional staff would be required as a result of the annexation. Staff did not indicate any concerns regarding this proposed annexation. Surface Water. The area is located in the Lower Cedar River drainage basin. Future development will be required to comply with the City's Surface Water � - Design Manual and the Flow Control Duration Matching Forested Site � Conditions should be applied, as well. The area consists of three plats that were constructed in 1968, 1969, and 1978 and the age of these systems will require inspections and repairs as necessary. King County IMAP's identified � three instances of flooding that were related to ground water issues. - However, no drainage, issues are attributed to system deficiencies. Upon annexation City crews would perform maintenance to the system and there may be identified a need for improvements. Although this annexation does , - not create the need for additional staff, small incremental annexations over time are will eventually create need for new staff.The area includes an _ � orphan facility that King County is in the process of inspecting and obtaining easements for. Completion of this process should be confirmed before annexation. Staff indicates the annexation is a logical extension of their services. Transportation Svstems. The Transportation Systems staff has no concerns regarding the proposed annexation. Staff indicated that additional Transportation Systems staff would not be required and that the annexation represents a logical extension of services. SE 164th Street is identified in the Renton Trails and Bicycle Master Plan as a bicycle route; it has a 36-foot roadway width with curb and gutter and sidewalks adjacent to the roadway. If this street was to be redeveloped in the future to the current City of Renton standards, it would require right-of-way acquisition. Staff noted 129t"Avenue SE, 130th Avenue SE, and SE 1615t Place SE have no sidewalks. The existing curb ramps on these streets are limited and they do not meet current ADA standards. Also,the existing street lights, most likely, do not meet current Renton standards. Energy costs associated with existing and new street lighting, and costs associated with maintenance of existing and - new traffic control signage and pavement markings that may be incurred should not be a financial burden. Staff indicated that the City would assume � ownership and responsibility for all existing and new streets in the area. Proposed Gaile Annexation 1(_ f:tice of Intent � � Page 4 of 6 �' Public Works Maintenance. The annexation does not present any problems ' for the Department and it represents a logical �extension of their services. Staff noted the surface water infrastructure was poorly installed and has not ' been maintained well, if the infrastructure were to be replaced it would represent a cost to the City. Repair work to this infrastructure may also present a cost to the City. However, the City would not assume any ownership or responsibility for any facilities within the area. Buildin�.The Building section did not indicate any concerns regarding the proposed annexation.The annexation does not present any increased need for City staff. Plannin�.The Planning section did not indicate any concerns regarding the proposed annexation and stated that the annexation represents a logical extension of their services.The annexation does not present any increased need for City staff. ANALYSIS OF THE PROPOSED ANNEXATION: ' 1. Consistencv with the Comprehensive Plan: Renton's Comprehensive Plan annexation policies support this proposed annexation.The subject site is within the City's Potential Annexation Area, is subject to development pressure that might benefit from City Development Standards, and is land that is available for urbanization under the King County Comprehensive Plan, zoning, and subdivision regulations (Policy LU-38). Additionally, as Policy LU-36 states, the City recognizes "that it has an inherent interest in future land use decisions affecting its Potential Annexation Area". • 2. Consistency with the BoundarV Review Board Oblectives: (from RCW 36.93.180) a. Preservation of natural neighborhoods and communities; The proposed annexation would cause no disruption to the larger community. b. Use of physical boundaries, including but not limited to bodies of water, highways, and/and contours; ; The subject site is bounded on its western portion by existing City limits and uses streets or parcel lines for.the other boundaries. c. Creation and preservation of logical service areas; Water and sewer service boundaries will not change as a result of this annexation.The Gaile Annexation Area is in the Renton School District. . The school district boundaries will not change,the area will remain in the Renton School District. Renton will take over police service for the 43.6- Proposed Gaile Annexation 1(�, `,tice of Intent i Page 5 of 6 � �" ' acres upon annexation; the King County Sheriff's Department currently � provides police protection to the area. Renton Fire and Emergency Services currently provide service under contract to Fire District#40. Pursuant to state law, there will be no change in the garbage service � provider for at least seven years. , d. Prevention of abnormally irregular boundaries; � This annexation does not have irregular boundaries. e. Discouragement of multiple incorporations of small cities and ' , encouragement of incorporations of cities in excess of ten thousand popu/ation in heavily populated urban areas; Not applicable. No incorporations are proposed in this area. � . f. Dissolution of inactive special purpose districts; Not applicable.There are no inactive special purpose districts here. g. Adjustment of impractical boundaries; Not applicable. . h. Incorporation as cities or towns or annexation to cities or towns of unincorporated areas which are urban in character; King County has designated this area for urban development because of its location within the Urban Growth Boundary.The County has also indicated that it wants to divest itself from providing urban services to these unincorporated urban areas by turning them over to cities as quickly as possible. Because the subject annexation site is within Renton's PAA and not in an area under consideration for incorporation, annexation is appropriate at this time. i. Protection of agricultural and rural lands which are designated for long term productive agricu/tura/and resource use by a comprehensive plan adopted by the county legislative authority. Not applicable. No portions of the proposed annexation are rural or designated for long term productive agricultural use'in the King County or � Renton Comprehensive Plans. 3. A fiscal analysis for the proposed annexation is attached.The fiscal impact analysis that is used for annexations considers costs on a per capita basis.The fiscal analysis indicates that the proposed annexation would have an initial net . negative fiscal impact of$18,366 per year. A significant contributing factor to the negative fiscal impact is the amount of roadway this proposed annexation includes. Approximately 5,882.lineal feet of roadway is esti\mated to cost approximately$13,117/year to maintain. However; it is in the City's best interest, and is the preference of•the roads division, to assume maintenance of county roadways. CONCLUSION: � The proposed Gaile Annexation is consistent with relevant County and City annexation policies, as well as most Boundary Review Board objectives for annexation. The annexation area consists of the Stafford-Hansel, Fairwood Park Division #9, & Fairwood Park - Division #10 Plats, constructed in 1968, 1969, & 1978 respectively. The age of these systems will require inspection and repairs as necessary. Drainage complaint records contained in King County's IMap system identify three instances of flooding, all deemed groundwater issues. No drainage issues are attributed to system deficiencies. 3. Does this proposed annexation represent a logical extension of services provided by your department/division? As the annexation area abuts the east City limit at 128th Avenue SE, and lies within a basin currently served by the City of Renton, it is a logical extension of services. � 4. What additional facilities or staff would be required to serve this area? Can you identify any other costs the City would incur as a result of this annexation? Upon annexation, City crews will be required to perform maintenance to the public system. Additional Capital Improvement funds may be required as system deficiencies are discovered. No ' new Surface Water Utility Engineering Section staff needed for this individual annexation, but as the City continues to annex small areas, over time, eventually new staff resource will be needed. Revenue from the 154 existing single-family residential homes within the annexation area is estimated to be$19,164 per year. 5. The annexation area has one stormwater detention facility, located in the Stafford-Hansel plat. This facility has been identified as an "orphan facility" with no determination of ownership. King County ,, is currently in the process of inspecting the facility & obtaining easements over the site parcels. Completion of this process should be confirmed prior to annexation. Need make sure King County main,tains the facility prior to completion of the annexation. 6. Would alternate boundaries create a more logical annexation for provision of City services?
