The northern, eastern, and southern boundaries are coterminous with existing City limits. The northern boundary is in proximity of Northeast 16th Street (if extended),the eastern boundary is in proximity of Mount Baker Place Northeast (if extended), and the � southern boundary abuts Southeast Renton Issaquah Road. The western boundary is a parcel line that lies west of Lyons Avenue Northeast. � The area is currently designated with the King County Comprehensive Plan designation of Urban � Residential Medium 4- 12 du/acre and is zoned with R-4 zoning, allowing four dwelling units per gross F acre. The City of Renton Comprehensive Plan designation for the area is Residential Low Density � (RLD). As shown on the map below, R-4 zoning, which allows four dwelling units per net acre, is proposed for the entire proposed annexation area. � � State law requires two public hearings in the matter of zoning annexation areas, the first public hearing � for the proposed zoning of this annexation area was held on March 12, 2012. Following that public hearing, Council accepted the 60% petition and authorized the Administration ta forward a Notice of Intent to the King County Boundary Review Board (BRB). On May 16, 2012, the BRB issued a Closing Letter for Completed Action indicating its approval of the � annexation. The next step in the annexation of this area is for Council to hold a second public � hearing in the matter of zoning. Following that public hearing, the Council may adopt the ordinance � annexing the Windstone V area and the ordinance establishing zoning. City departments conducted a review of the annexation proposal and all departments indicated that the annexation represents a � logical extension of their services and raised no concerns. The action is � proposed under RCW 35A.14 via a 60% petition method of annexation. � The City of Renton is seeking a Waiver from the Boundary Review Board for the Windstone V Area � Annexation pursuant to RCW 35A.14.220 based upon the fact that the Windstone V Area property is less than 10 acres in size and less than $2 million in value. � i c The City of Renton is seeking annexation in order to more efficiently govern and serve the Area. The � proposed annexation is also in keeping with interests by citizens in joining the City in order to participate � in local government, to administer land uses under City of Renton regulations, and to receive essential � public services from Renton. , � The Windstone V Annexation site is located on the eastern side of the City of Renton. For example, the annexation is supported by RCW 36.70.20, which � requires community planning goals, for urban growth, services and infrastructure, and environmental preservation. Additionally, annexation reportedly is consistent with RCW 36.70A.020 (1), encouraging development in urban areas where there are adequate public services. It is also consistent with � RCW 36.70A.020 (12), calling for public services to support permitted development. q 6 The unincorporated Windstone V Area is included in the "Land Use Element" of the City of Renton $ Comprehensive Plan. The Windstone V unincorporated area is identified in the "Annexation Element" of ; the City of Renton Comprehensive Plan and is located within the Renton Potential Annexation Area. The ` ! proposed action is consistent with City of Renton Comprehensive Plan policies addressing annexation, including those provisions which call for inclusion of urban areas and provision of services e.g., LU-I; LU- 37.1; LU 37.5; LU-36; LU-41 and LU-42.) ' � The proposal is reportedly also consistent with King County Comprehensive Plan/Countywide Planning , Policies for annexation. For example, the Windstone V Annexation is reported to address King County policies that call for contiguous orderly growth of local jurisdictions and for local services to urban areas (e.g., Comprehensive Plan: U-304, U-208, U-301, U-304.). The King County Countywide Planning Policies also establish cities as the appropriate providers of local governance and urban services (e.g., FW-13, CO-1, CO-3; LU-31, LU-32, LU-33). � The City of Renton reports that the proposed Windstone V annexation is consistent with the provisions of RCW 36.93 (Boundary Review Board Regulations). More specifically, RCW 36.93.180 requires that � annexations be evaluated with respect to nine objectives. In this application, the City of Renton has stated that several key objectives have been identified as being potentially relevant for specific � consideration. � � For example, City of Renton officials report that Windstone V annexation would be consistent with � Objective 1, which calls for the preservation of neighborhoods as this area is linked to Renton by � natural/built geographic features (e.g., municipal boundaries, access routes, topography) and by social � fabric(e.g., similar land uses, shared commercial centers, community gathering areas.) � � This annexation would also reportedly be consistent with Objective 2 which calls for the use of physical � boundaries. The City of Renton borders the site at its northern, eastern and southern boundaries. The � western boundary of the site is bordered by property boundaries located in Unincorporated King County. These unincorporated properties are all located within the City of Renton's Potential Annexation Area. � � � E 3 � t 4 � � � � s � � `� : < � z ` ,�% � Further, the annexation would be consistent with Objective 3, which cails for creation of logical service � areas, and Objective 4 through Objective 7, which cail for the achievement of reasonable boundaries for a � ° jurisdiction. The City is seeking annexation in order to provide practical and regular boundaries so that ail � services and land use regulations affecting this area may be efficiently coordinated by a single local ; government unit to the benefit of the community. ' Similarly, the City reports that this annexation would be consistent with Objective 8, which calls for ' inclusion of urban areas within municipalities. The Windstone V Area has been established for � annexation through the Renton Comprehensive Plan. This action is supported as well by the State � Growth Management Act and the King County Comprehensive Plan. � The Windstone V Area is developed with four single-family residences. Available vacant land is ; estimated to develop within the next 10 years to add approximately eight new dwelling units. Both for � developed and developing properties in the Windstone V Area, the City of Renton is prepared to provide � general administrative services, review of development, and environmental protection (including � evaluation and regulation of environmentally sensitive areas, storm water/flood management.) .3 The City of Renton will directly provide police service to the Windstone V Area. The City will provide fire � service and emergency medical services to the Windstone V Area properties via Renton Fire and ; � Emergency Services. The City of Renton Police Department will protect the community. � The City of Renton will provide the Windstone V properties with utility services either directly or by � contractual agreement with service providers. For example, King County Water District No. 90 currently provides water services to the Windstone V Area properties and will continue to do so for both existing 6 _ and new development. � With annexation, the City will also provide sewer services to the Windstone V Area. Stormwater ` � management will be provided in a manner that is consistent with the City of Renton Stormwater Manual, � � King County standards and applicable State of Washington guidelines. '° i Windstone V Area residents will have access to Renton libraries, parks, and recreation facilities. Law and ; justice services and human services would, similarly, be provided to the citizens of the Windstone V Area. x Students would continue to be served by the Issaquah School District. � City of Renton officials have conducted fiscal studies for the Windstone V Area to estimate revenues and , expenditures both at the time of annexation and ten years into the future. It is reported that the I a Windstone V Area Annexation, at existing levels of development, will generate expenditures of $3,843. ; � and revenue at $5,034.00. At the 10-year point, the Windstone V Area is anticipated to generate expenditures of $15,107. and revenue at $16,881.00. Thus, at annexation the City would recognize an i annual revenue gain of $1,191.00. At 2022, with anticipated new development, the City estimates � � annual revenues would exceed expenditures by approximately$1,774. ' " The City is prepared to govern and serve the VVindstone V Area at annexation and into future years. } Windstone V Area property owners will assume their share of the regular taxes/fees(e.g., property taxes) �, � and special levy rates of the City. City of Renton departments reviewed the annexation proposal and all staff � reported that the annexation represents a logical extension of their respective services � and systems. There were no issues identified that would impede the annexation. A more detailed discussion of this proposed annexation and review comments are contained in the Department's January 9, 2012, Windstone V Annexation 10% Notice of ; Intent issue paper. � On January 25, 2012, the petitioner submitted the 60% Direct Petition to Annex. That � petition was certified as sufficient, with signatures of property owners representing at � least 60% of the taxable value of the annexation area, by King County on January 31, � 2012. � 3 � �i f F � Rich Zwicker,Council Presid� ` Page 2 of 2 � � y February 27,2012 ZOnin� This area has not been pre-zoned and therefore needs to be zoned with City of Renton zoning prior to annexing. The Comprehensive Plan Land Use Map designation for the annexation area is Residential Low Density (RLD). There are three zones that implement this designation: RC - Resource Conservation (one dwelling unit per 10 net acres), R-1 - Residential One Dwelling Unit (one dwelling unit per net acre), and R-4 - Residential Four Dwelling Units (four dwelling units per net acre). Staff recommends zoning the area with R-4 zoning. I I The City's Comprehensive Plan policies (LU 151 and LU-153) call for (and within the RLD j designation to be zoned R-4 where there are not significant environmental constraints. ; Land that has significant environmental constraints is identified as land where: � • a significant percentage of the gross area is critical areas, � • developable areas are separated by pervasive critical areas, $ • sensitive areas are located where if developed development would be non- � contiguous, or � � • variances or modifications would be required to develop at the allowed density � on the land remaining after application of the required buffers. � None of these conditions apply to the area being considered in this zoning � recommendation. Greene/s Stream, a Class IV waterway is located along the eastern � boundary of the area, which is coterminous with a parcel line. The stream does not � encumber a significant percentage of the site. It does not separate developable areas � and is not located so as to result in non-contiguous development because of the streams ; location along a parcel line or properties owned by different parties. Also, the stream � and its associated buffers are not significant enough to require variances or � modifications to develop at an R-4 density on the remaining land. � Revised Fiscal Analvsis � � At the direction of Council, Staff has been using a revised fiscal analysis. This fiscal � analysis uses methodology and assumptions that try to more accurately reflect the � financial impacts an annexation may have upon the City. One of the principal changes � made is to evaluate departmental costs based on what "drives" that cost. For example, � the cost of an annexation area to the City for police service is driven by calls for service. � Costs for street maintenance are driven by the lane miles within the area. There are � also now more City divisions included in the cost analysis. For example, costs to provide human services, special events and neighborhoods, as well as parks planning and � natural resources have been added. The costs estimates are based on the 2011 budget � and the official 2010 Census population figure (90,927). An effort was made to not � include costs associated with staffing positions unlikely to be impacted by small ` incremental annexations, e.g. supervisors, directors, etc. The revenues for the analysis � are derived from the 2011 budget assumptions specifically associated with the Benson � Hill area. The proposed Windstone V Annexation furthers the City's Business Plan goals and is in the general welfare and interest of the City. Location: The Windstone V Annexation area is located south of Northeast 16th Street if � extended, west but not abutting 148th Avenue Southeast, north Northeast Sunset a Boulevard, and east of Jericho Avenue Northeast if extended. � 2. Assessed value: The 2011 assessed valuation for the subject annexation site is $1,059,000. � � 3. Natural features: The site is generally level with the highpoint at the western portion of the � area. The topography then descends to the east with no steep slopes present. Greenes i Stream, a Class IV waterway is present at the eastern boundary of the area. � � 4. Existin� land uses: Existing development is residential and vacant land. There are an � estimated 4 single-family homes and the estimated existing population is 11 people. There � are 2.9-acres of vacant land. 5. Comprehensive Plan: Renton's Comprehensive Plan designates the subject annexation site as Residential Low Density(RLD). � � 6. Existin� zonin�: The existing King County zoning is R-4, allowing four dwelling units per � gross acre. The area was pre-zoned R-5 as part of the May Valley Prezone in 1997, � Ordinance #4667. However, the R-5 zone is no longer in use in the City of Renton. The � zoning classification that most closely matches the density allowed in the former R-5 is R-4. � The area is designated Residential Low Density (RLD) on the City's Comprehensive Plan Land � Use Map. There are three zones that implement the RLD designation: Resource � Conservation (1 dwelling unit per 10 acres), Residential One Dwelling Unit per Acre (R-1), �• and Residential Four Dwelling Units per Acre (R-4). As part of this annexation process, the � City will hold two public hearings in the matter of zoning for the area. � �. 7. The annexation site is located within the Renton Sewer Service Area. The � area is relatively underdeveloped and it is expected that, if sewer lines were to be � extended in the future, the costs would be incurred by a developer. This drainage basin has been identified as having significant erosion, water ' E quality, and habitat problems due to urbanization. The site contains Greenes Creek, a � tributary stream to May Creek. Staff noted that any future applications for $ development in the City will need to comply with the City adopted Surface Water Design � Manual (2009 King County Surface Water Design Manual and City amendments RMC 4- 6-030) and that the flow control standard to be applied to new construction in the area is the Flow Control Duration standard matching Forested Site Conditions. Staff noted � that King County records indicate one drainage complaint was (odged in 1996 for SR900 � runoff. The area contains no infrastructure on site and no ditch along the north side of � SR900. Runoff is conveyed via sheet flow to the seasonal stream channel. A culvert � carrying discharge from the south side of SR900 discharges to the stream as well. Staff � stated that the annexation is a logical extension of their services. There is no � infrastructure or right of way to maintain currently within the area. � Parks. King County's May Creek Park is located approximately 400 feet east of the � annexation area. It is 54.27 acres in size and has walking trails. The City of Renton owns Kiwanis Park located approximately 1.1 mile southwest of the annexation area. The a park has an activity building, ball fields, a basketball court, playground equipment, � restrooms, and tennis courts. Community Services staff indicated that in the long-term � the 4.3-acre potential annexation area and the larger area should be served with a � neighborhood park which would require land acquisition. Staff indicated that the � annexation represents a logical extension of their services. Also, there would be no City � � assumption of responsibility for facility maintenance. � � a Fire. Eastside Fire and Rescue currently serves the area. Upon annexation, Renton Fire � and Emergency Services will provide fire and emergency services to the area. Staff � indicated that the annexation represents a logical extension of their services and would � not require additional facilities or staff to serve. � �Police. It is estimated that the area would have 3.8 calls for service per year at current � development and 11.3 at full development. � � Transportation. The reviewing staff noted that the area does not have curb, gutter, � sidewalk, and street lighting along NE Sunset Boulevard (SR900). The City does not have � plans for street improvements here, but Washington State Department of � Transportation (WSDOT) has identified the need to improve State Route 900 by � widening the road and installing curb, gutter, sidewalks, and street lighting, which would � require some acquisition of right-of-way by WSDOT. A timeline for these proposed � improvements has not been developed. The costs associated with the identified � improvements of SR 900 would be paid for by WSDOT or possibly future development. � The annexation would not require any additional transportation systems staff. The proposed Windstone V Annexation Area is � located in a portion of the City where it is required that physical addresses be changed � to the City of Renton addressing system upon annexation, therefore households will have their physical address changed when the annexation becomes effective. � � 8. Fiscal Impact Analvsis � � A fiscal analysis for the proposed annexation is attached.The fiscal impact analysis that � is used for annexations considers costs on a per capita basis.The fiscal analysis indicates € that to the operating budget the proposed annexation would have an initial net positive � , fiscal impact of 3,120 per year. Over a 10-year buildout period if the area developed 4 with an additional eight new dwelling units, it is estimated that the fiscal impact to the ¢ operating budget would become positive at$7,480 per year. The analysis for the impact � to the capital and enterprise funds is that at current levels the area would have a � positive fiscal impact of$659. If the area fully developed to its estimated residential � capacity, over the next 10-years,the fiscal impact would be positive $5,466. � � ANALYSIS OF THE PROPOSED ANNEXATION: � 1.
