Early emphasis will be given to completing that part of the work most desired by the City of per site plan discussions, such as painting, and West and South covered walkways and metal roofing to match adjacent structures. The agreement between Bob and I call for me providing funding of $7,000 to provide for purchase of materials and commencement of work. This would provide for approximately one third of total work to be completed. Bob Hepworth after inspection by you or other designated City personnel would request release of additional $7500 to continue the work. There would be a second inspection and subsequent release of the balance of $7500 held by the City. Upon completion of work there would be a final inspection and release of occupancy permit holds. Mr. Erickson, I am working on the premise that this procedure meets your approval , if there is a problem or suggestion, please call me immediately; otherwise I will presume that we are commencing construction right after the first of the ear. Although, I realize that from a physical point of view work has not commenced since the building permit was issued, progress is in fact being made. This progress comes in three areas; 1 ) the attorneys representing Penelope's and Shannon's Village are finally completing- the construction agreement spelling out who is responsible for what and when, 2) I am working on the closing of a real estate transaction, the proceeds from which the balance of funds needed to finance the project (including the money the City holds) can be drawn, and 3) passage of the holiday season which is a large part of Penelope's annual business will allow the Hepworths the opportunity to devote the time required to complete the work. I am committed to our agreement and for my part will perform as per that agreement. We intend to commence the work right after the first of the year and it is my understanding that the work will be finished soon thereafter. Your recommendation of putting the $15,000 in an escrow account is fine with me providing we can work out the details of payment with Hepworth. In so much as progress is in fact being made, and commitments have been made, I ask that you allow Express Wok (Suite A, 1630 Duvall Ave N.E.) to open when their improvement work is completed approximately A LONE "D" COMPANY, INC., DEVELOPMENT 5919 119TH AVE. S.E. BELLEVUE, WASHINGTON 98006 • 746-5656 December 8th. Even with their opening, we still have four spaces to lease representing 18% of the total center. This creates a negative cash flow, an unacceptable marketing situation and a good situation for you to assure that the work is completed as I have pledged my every efforts to see that it is. As I mentioned to you on the phone, it is important that the City and Shannon's Village continue to work toward our common goal . For your support, I will make sure that commitments are kept and that the City will not be left holding an empty bag. I will be contacting you soon with hope of setting up a meeting between you, I, and Hepworth to discuss the workable application of your escrow idea. Thank You. Sincerely, C. You indicate that you conducted a meeting attended by tenants, landlord, and respective legal counsels which resulted in a compromise agreed to by all. You stated that you now need additional time to resubmit plans to the City for approval and to commence the work. Your request is both valid and acceptable, therefore, I hereby grant a 30 day extension of your temporary occupancy permit. Said extension will commence on September 5, 1990 and expire on October 5, 1990. A word of caution - please make sure that the plans are approved by the City, the required permit issued, and the work completed within this 30 day period granted by the extension. Washineton 98055 - T16-'7f l CITY OF RENTON MEMORANDUM DATE: August 8, 1990 TO: File SA-025-89, Shannon's Village FRO : on Erickson, AICP oning Administrator SUBJECT: Meeting August 8, 1990, with Kelly O'Neil re: Bldg"F" I met this morning with Kelly O'Neil and William Witt, his architect, to discuss further design modifications that Kelly was requesting. Because of the fact that he saw the arcade/porch on the west and south side of the building as tenant improvements which were to be done by the Hepworths, he wants to delete these and have the blue metal mansard roof supported directly off the roof of the existing building. He also wants to delete the extension of the mansard roof to the east by the garden/greenhouse area because of cost constraints. I told Mr. Kelly and Mr. Witt that I would support the revisions they were talking about, but noted that the revised roof would have to have returns on the north side (as seen from Duvall) and on the east side of the building to create a transition back (as seen from the south) to the existing roof line. It was also agreed that a pedimented gate/arch would continue to be provided on the west facade, although it would be brought out four or five feet from the building face to create greater contrasts. A fair amount of discussion resolved around the pedimented gate/arch on the south side of the building and its placement. Whereas it was agreed that this element could be freestanding, Kelly initially felt that it should be located in the center of the south wall or even deleted. Bill Witt and I felt that it was an important visual element that helped break up the southern facade as well as provided thematic continuity to Building "F", with the rest of the shopping center to the south. Once it was decided to keep this feature (I noted that actually two gateways had been indicated at one time and the drawings reviewed and approved by the Hearing Examiner always showed one!), our discussion focused on its placement on the site. Bill Witt and I felt that it should be sited to the east of the existing building to help screen any eventual enclosure that the Hepworths might propose around their garden area. It was agreed to site it far enough to the east that it could serve as a gate or entranceway into the "greenhouse" area, if the Hepworths so chose. Such a location would also ensure that it would be visible from the south. We agreed that it need not be physically connected to the mansard roof of the"F" Building, but rather, could be free-standing. Another issue discussed had to do with the materials that the pedimented gateways would be constructed of. Whereas Larry Springer and I had talked about possibly stucco, to match the split face block used on Building"C", Bill Witt and Kelly O'Neil felt that the four inch horizontal cedar siding used on the bank would be just appropriate, given the relatively small areas and the cost of"getting someone out to stucco them." I agreed to the use of the cedar siding material for the pedimented gates, if it matched wood used elsewhere in the shopping center. The last issue pertained to landscaping. I requested that since the porch in front of the building was to be deleted, that permanent landscaping be installed. Bill Witt thought Mrs. Hepworth might want to display plants in this area, but I said we had no guarantee on her tenancy and that without the arcade, we would like to see larger, permanent evergreen shrubs, such as rhodys, in this area. In closing the meeting, I asked that revised drawings, pursuant to today's meeting, be drawn up as soon as possible so that I could review them before they were submitted for building review. I reiterated to Kelly O'Neil the importance of getting this work completed so that their final occupancy permits could be issued. ` CITY OF RENTON MEMORANDUM DATE: August 6, 1990 TO: Files CFROM: Don Erickson,AICP Principal Planner SUBJECT: Penelope's Flower Shop Building Site Plan Improvements I met this afternoon with Kelly O'Neil to discuss the drawings that had been submitted for my review by the Hepworths on August 3, 1990. Kelly was very concerned about who was going to pay for what and noted that although the City had a bond for $15,000, he thought the improvements shown would exceed this amount. He stated that Ms. Hepworth was given $7,500 by him for building improvements and he expected this to be used for the types of improvements shown in the drawing. He called my attention to the fact that an earlier drawing Ms. Hepworth had prepared did show a lattice roof line similar to a mansard and also showed an arcade with columns. He also felt that the decorative applique was excessive and agreed with me that it was inappropriate on the pedimented gateways. I explained to Mr. O'Neil that, in my opinion, the mansard treatment did not, in this case, need to be carried around the whole building but rather,.the Duvall facade and the southern facade with a return on the east and north sides for transition. I explained that this should reduce costs as well. Mr. O'Neil stated that their temporary occupancy for the shopping center was going to expire in early September and he wondered if the City would allow full occupancy if they were showing progress in resolving the design issues with Building 'F'. I stated in no uncertain terms to Kelly that, in my opinion, the City would not allow full occupancy, that this issue had already gone on for a number of months and eaten up a large amount of staff time already. I said that as a minimum, I thought the City would expect him to have had prepared, and submitted, building plans for the modifications as well as extended his surety device for$15,000 if the City were even going to extend the temporary occupancy permit. Mr. O'Neil said he would do what he could to get the building plans ready for submittal. CITY OF RENTON MEMORANDUM DATE: August 6, 1990 TO: Files FRO Don Erickson,AICP Principal Planner SUBJECT: Meeting with Penelope Hepworth,August 3, 1990 I met on Friday, August 3, 1990, with Penelope Hepworth and her husband to discuss revisions to the building they apparently lease from Kelly O'Neil. The Hepworths brought in a plan that showed the changes they would like to see to the building to make it consistent with the Hearing Examiner's recommendations. They submitted two sets of drawings. One set showed the revised roof line with a blue metal mansard roof to match that of the other buildings in the center,as well as pediment style gateways at the center of the west facade of the building, as well as along the south facade and at the east elevation of the building at the entrance into the garden area. This last decorative pediment archway was not required by the City. The second set of drawings showed decorative elements overlaying the superstructure of the building and gateways shown in the first set of drawings. Extensive gingerbread applique was shown over the decorative gateways and at the tops of the columns. In addition, a decorative railing was provided around the arcade area. Penelope explained that an eight foot step was required and the railing was to help control access and prevent people from stumbling. After discussing the changes, I made it known to the Hepworths that the City felt good about the revised roof line with the mansard roof and pedimented gateways. I noted that it was nice to see this feature carried over to the back of the building, but noted that this was not required by the City or Hearing Examiner. Staff also noted that the decorative applique on these gateways was inappropriate and should be deleted. I indicated that the decorative brackets at the top of the columns was probably alright, if they could be easily removed, and suggested that the fence railing sections would likely also be acceptable, depending on color and removability. Penelope stated that she thought the changes I was requesting were reasonable and noted that she now understood the difference between shopping center architecture and tenant improvements. I requested copies of the materials that the Hepworths had brought to the meeting and noted that I would try to set up a meeting with Kelly O'Neil for the first part of the week of August 6th. Since we have already done this twice, and the applicants are not willing to accept even the revised elements even though a $10,000.00 bond or surety was posted for this purpose, I believe the applicant should either go back through the Site Plan Review process before the Hearing Examiner or consider seeking a variance from the requirements based upon hardship, and the fact that the existing house does not easily lend itself to revision. In either case, procedure would be to take the project back before the Hearing Examiner for resolution. I think the Examiner would be more supportive of the changes if he thought there was, indeed, a unique hardship that had not been brought up at hearing. I would like to discuss this further with you on Monday. Thanks. If the owner does not complete the project and obtain a permanent occupancy permit as required then it will be necessary to vacate all tenants from the subject building until said work is completed and a permanent occupancy permit issued. The City Planning staff is currently working with the owner to accomplish compliance. However, in the event the work is not completed, the tenant vacation will become a reality. CITY 3F RENTON Community Development Department Earl Clymer, Mayor Kenneth E.Nyberg,Director PLANNING DIVISION June 12, 1990 CITY OF RENTON JUN 1 2 1990 RECEIVED Mark A. Erhart Davis Wright Tremaine 2600 Century Square 1501 Fourth Avenue Seattle, Washington 98101-1688 RE: Proposed Exterior Remodel--Penelope's Country Flower Shop, 1702 Duvall Avenue NE Dear Mr. Erhart: This letter is sent in response to your inquiry of.May 31, 1990, concerning the process necessary for obtaining City approval of the above-referenced remodeling project. Since the exterior design of the building currently leased by Penelope' s Country Flower Shop was approved by the City' s Site Plan Review Committee in conjunction with the Shannon' s Village site plan approval (City file number SA-ECF-025-89) , any new construction/remodeling must be done in accordance with the approved site plan(s) unless an amended site plan approval application is submitted to and approved by the City. Section 4-31-33 (f) of the City of Renton Municipal Code requires that adjustments to an approved site plan be done only through an amended application which must be processed in the same manner as the originally approved site plan. This would require taking the entire Shannon' s Village shopping center back to the Site Plan Review Committee. Additionally, restrictive covenants (enclosed) reaffirming these restrictions were also placed as conditions of the development's approval. Condition #2 of these covenants states that the site must be developed in accordance with the approved 1989 plan, including the " . . . architectural integration of Buildings "A" and "F" (the building presently occupied by Penelope' s County Flower Shop) into the site plan for the development as a whole so as to be thematically compatible with Buildings "B" and Building "D" . . . " . 200 Mill Avenue South - Renton. Washington 9Ro55 Mr. Mark A. Erhart June 12 , 1990 Page 2 Because of the these conditions--and the City' s Comprehensive Plan policy (Urban Design, Land Development B8.) which encourages development that is harmonious in intensity and architectural design within a district--it would seem unlikely that the revisions proposed by Penelope' s would be approved by the Site Plan Review Committee since it would not be harmonious in architectural design with the rest of the commercial complex. However, should you desire to apply for site plan approval we will do all we can to expedite your application. If you have questions regarding this letter or would like more information regarding the site plan approval process, please feel free to contact me or Laureen Nicolay at 235- 2550. Your cash bond.of $15,000.00 is being held as security to guarantee the completion of the remaining portions of the project. In order to obtain the permanent certificate of occupancy, the following options are available to you: 1. Complete the exterior remodel of the flower shop as originally submitted and approved. 2. Obtain Planning Division approval for minor modifications of the flower shop remodel plans. 3. Apply to the Hearing Examiner for a modification to your site plan which would allow the flower shop to remain as it is. Chair Guttmann advised the even though the applicant is required to accomplish improvements under the development plan, the neighbors would not be impacted unless a local improvement district for the entire area was formed. Motion: Moved by PARNESS, seconded by NYBERG, that based on the following reasons there is no justification which would negate those requirements mandated by law or City policy and procedure: a) improvements were the subject of considerable discussion which included appeals through the Hearing Examiner and City Council; b) there no technical reasons which would substantiate not installing curb, gutter and sidewalks; d) there are schools in the neighborhood and concern/interest has been expressed about providing a safer sidewalk system for the children; and, e) while we recognize installation of improvements might engender concerns in the neighbors, it does not directly impact them. MOTION CARRIED Note: The applicant returned toward the end of the meeting and advise Board members that this decision would prevent her from recording the Short Plat. Due to the fact that she had not mentioned, nor included the information about recording the short plat in the application, the matter was re-reviewed and it was moved by PARNESS, seconded by NYBERG, to approve a temporary deferral of the off-site improvements to coincide with the construction; and, that occupancy of the building will not be allowed until all improvements are installed. Based on the fact that the improvements being deferred are standard and do not require detailed analysis, and the fact that occupancy is being withheld until improvements are constructed, the standard requirement for detailed plans prior to issuance of occupancy can be waived conditioned upon a report being submitted by the applicant outlining the estimated costs for installing improvements. The estimate would then be approved by the Public Works staff and the bond amount set; and, within the required 30-day time frame. MOTION CARRIED On-Off Site Improvement Deferral Extension Request. Shannon's Villaee Business Park. Sunset Hwy. and Duvall St. (current 60 day deferral expiring July 24. 1989) Expectation: Applicant requests additional 30 days in which to complete the improvements. Facts: Staff suggested that the applicant would need more than the 30 days to complete the installation of improvements. Ken Nyberg substantiated this opinion, as he had recently visited the site. Motion: Moved by NYBERG, seconded by PARNESS, to grant a 60-day extension, until September 26, 1989, to the existing on/off site improvement deferral. MOTION CARRIED Sewer Improvement Deferral Expires 811/89. Renton Plaza I. 1400 Talbot Rd. (Work unfinished). Facts: Paul Lumbert informed the Board members that the deferral expires August 15th; and, once again, the sewer improvement construction has not commenced. • RESTR ICT IVE C0VEOWQb•Ici2r #0296 D for. For example, the proposed development is consistent with Urban Design Goals calling for development to be allowed only where it can be shown to be compatible with future uses in the vicinity (III.A. 1) . It is consistent with Commercial Goals, such as: 1) promoting attractive, convenient, viable systems of commercial facilities (V) ; 2) planned clusters of commercial development should be encouraged to improve access (V.A. 3) ; 3) Commercial areas should be located .SitP Plan Review Commi to Report and Decision June 1, 1989 Page 3 and designed to minimize travel and congestion and to promote safety (V.A. 4) ; 4) sufficient access, circulation, walkways and off-street parking and loading should be provided by commercial developments (V.A. 5) ; 5) commercial areas should be compatible with adjacent land uses (V.A.7) ; 6) various uses within a commercial area should be compatible with each other (V.A. 10) ; 7) joint parking facilities should be encouraged (V.A. 11) ; and 8) individual stores in an area should follow a common design and landscape theme (V.A. 12) . Finally, the proposed development generally conforms to the Northeast Area Commercial Development Objective B. 1. which states that commercial uses developed . . . along Sunset Boulevard N.E. should be oriented within shopping centers or other sizeable complexes. Although not a part of a major shopping center, this development does appear to satisfy this goal which is intended to discourage the development of strip commercial areas. b. Conformance with existing land use regulations: The design modifications as suggested by the proponent and/or as recommended by staff in conjunction with land use/environmental review -- including the architectural incorporation of Buildings "A" and "F" with all of the other structures on the site, the screening of all outdoor (including rooftop) equipment, the improvements to landscaping, to lighting and to pedestrian linkages -- conform to Section 4-711 of the Zoning Ordinance. The proposed clock tower and three drive-through bank service lanes -- the major structural additions to the originally proposed complex -- comply with the B-1 zoning regulations (Section 4-711) with respect to permitted uses, as well as development standards, including lot coverage, height of the proposed structures, and building setbacks. With these proposed design modifications to the previously approved site plan for Shannon's Village, and the proposed additions (clock tower and drive- through windows) , the development will continue to comply with Zoning Ordinance requirements for parking and loading (Section 4-2204) and for landscaping (Section 4-744) . c. Mitigation of impacts to surrounding properties and uses; Potential impacts to the surrounding environment and to neighboring land uses have been identified by staff in the areas of aesthetics, traffic circulation, noise, light and glare, and air quality. 1) Aesthetics The applicant, working with staff, has endeavored to make the proposed commercial development -- both the initially approved retail/service center and the new structures/design modifications presently under consideration (See Finding 1. ) -- one which is compatible in design and scale with surrounding existing commercial and residential developments. Site Plan Review Commit- a Report and Decision June 1, 1989 Page 4 As one example, the proposed clock tower will serve as a focal point and will effectively identify the shopping center. The proposed drive-through lanes will be well-separated from nearby developments and will be screened from those parcels by structures and by landscaping. Additionally, the common design themes, proposed in the revised plans now under consideration -- including architectural integration of Buildings "A" and "F", addition of a greenhouse to Building "F" to the thematic design concept, improved lighting, landscaping and pedestrian access routes -- will provide an attractive view from neighboring properties and for vehicles travelling along adjacent corridors. 2) Traffic Circulation Off-site traffic impacts are evaluated below in Section "F - Safety and Efficiency of Vehicle and Pedestrian Circulation" . 3) Light and Glare This impact is evaluated below in Section "G - Provision of Adequate Light and Air" . 4) Noise/Air Quality These impacts are evaluated below in Section "H - Mitigation of Noise, Odors, and Other Harmful or Unhealthy Conditions" . d. Mitigation of impacts of the proposed site plan to the site; Potential impacts to the site have been identified by staff with respect to aesthetics, traffic circulation, noise, light and glare, and air quality. 1) Aesthetics The site plan as proposed by the applicant,. and/or as modified by staff, provides an integrated design theme and a pleasant, efficient environment for consumers and employees. Structures throughout the development -- including the four (4) buildings (and the clock tower) and three drive-through service windows -- are to be constructed (or existing structures improved) to have attractive, durable exterior facades. Buildings "A" and "F" will be modified to be integrated with other structures on the site. A greenhouse will be added to Building "F" . Individual units will be linked through pedestrian pathways (raised sidewalks and crosswalks) . The night deposit window will be located and improved so that it is readily visible and well-illuminated to protect user safety. Open areas and landscaping will be designed to improve the appearance of the site and to provide on-site amenities for consumers and employees (e.g. seating areas, view corridors) . 2) Traffic Circulation On-site traffic impacts are evaluated below in Section "F - Safety and Efficiency of Vehicle and Pedestrian Circulation" . !///' Site Plan Review Commit e Report and Decision June 1, 1989 Page 5 3) Light and Glare This impact is evaluated below in Section "G - Provision of Adequate Light and Air" . • 4) Noise/Air Quality These impacts is evaluated below in Section "H - Mitigation of Noise, Odors, and Other Harmful or Unhealthy Conditions" . e. Conservation of area-wide property values; The proposed modifications to this new commercial complex are not expected to have a negative impact on property values in the area since these modifications are designed to: 1) improve the attractiveness and efficiency of the complex; and 2) be compatible with uses on neighboring properties. f. Safety and efficiency of vehicle and pedestrian circulation; 1) Off-site Based upon ITE Reports, staff anticipates that the three proposed drive-through windows will generate approximately 160 daily vehicle trip ends. Impacts to adjacent rights-of-way (Duvall Avenue and Sunset Boulevard) are anticipated to be addressed by the ingress/egress plan and the on-site flow plan adopted in conjunction with the City's approval of the basic commercial development. That plan was designed to promote safe, efficient flow of traffic to the site via two driveways along Duvall Avenue. Signage/lighting which have been proposed by the applicant and/or recommended by the City (See Finding #2 Environmental Review) are also intended to enhance traffic circulation, thereby reducing the likelihood of queueing to access the site or conflicts between entering and exiting traffic (vehicle-vehicle and/or pedestrian-vehicle) . 2) On-site Applicant proposals and City recommendations for access and circulation routes on the site are also designed to protect pedestrian safety and to enhance vehicle circulation. Proposals/recommendations are made for: a) provision of queueing space for 21 cars in the bank drive-through window access corridors; b) provision of parking and loading areas on-site which are adequate to serve consumers and which are coordinated in a manner which is compatible with on-site circulation routes; c) pedestrian linkage (raised sidewalks, crosswalks) between structures and between the site and adjacent rights-of-way; d) signage and pedestrian-scaled exterior pole lighting to identify/illuminate structures, vehicle travel routes, parking areas, pedestrian pathways, and other on-site amenities (e.g. seating areas) . g. Provision of adequate light and air; The proposed revised development, in combination with Shannon's Village as previously approved, has been designed and sited so that structures are generally well-separated from one another and from neighboring Site Plan Review Commis e Report and Decision June 1, 1989 Page 6 sites to allow good exposure to natural light and to reduce shadow impacts. Exterior pedestrian-scaled pole lighting is planned to supplement natural light so that the site is fully illuminated in order to mitigate aesthetic impacts as well as to protect personal safety and property. Similarly, design and location of structures and open spaces generally protects air circulation on-site (see Section "h" below for further discussion of air quality) . h. Mitigation of noise, odors and other harmful or unhealthy conditions; 1) Construction Construction activity with respect to the entire development -- including the now proposed clock tower and drive-through windows and proposed design revisions (architectural integrity of all structures, improvements to landscaping, illumination and pedestrian linkage) -- will generate some additional dust and debris. Mitigation measures recommended in conjunction with the initial site plan review (1987, SA 031-87) are sufficient to address impacts from these proposed improvements. 2) Operation The proposed modifications to Shannon's Village (e.g. design integration of Buildings "A" and "F" , addition of the greenhouse to Building "F" , improved landscaping, pedestrian linkage, lighting, outdoor seating) are not anticipated to generate noise or to be harmful in any way. - Similarly, the newly proposed clock tower is not anticipated to generate noise, odors or other harmful conditions. It is located well-away from the right-of- way, and, as such, should not distract vehicle operators on adjacent rights-of-way. The drive-through windows will provide a total of 21 queueing spaces for vehicles. If used to capacity, noise impacts from running vehicle engines and air emissions would be likely to occur. Staff do not anticipate that noise from these drive through window queues will be greater than sound produced from vehicles travelling on-site, on adjacent Duvall Avenue or Sunset Boulevard, nor will the Noise Ordinance be violated. The location of structures (other than the bank) away from the drive-through windows should serve to further mitigate sound. Similarly, anticipated air emissions (automobile exhaust, etc. ) is not anticipated to be significantly greater than those emissions occurring from other vehicles traveling on or near the site. PSAPCA does not consider the potential emissions to be sufficiently significant in quantity or quality to require a permit for these drive-through service windows. The proposed night deposit window will be located, constructed and improved in a way which provides the access, light and ready visibility necessary to protect user safety. No other harmful or unhealthy conditions are anticipated. • 410 iepc L JV Y i n 1 $ = Axt$, RI 7 ;r 3 • F a J @ u C N, 0 Aa SIi-. Availability of public services and facilities to accommodate the proposed use; and The site is adequately served by existing public services and utilities. Neither the Police Department nor the Fire Prevention Bureau has indicated that the proposed facility would place a major burden on their respective services, if code provisions (e.g. signage) are met. The Police Department has approved the night deposit window. The Utilities Engineer reports that no changes to utilities are necessary as a result of the proposed project modifications. Existing roadways are sufficient to meet increased traffic anticipated to be generated by the drive-through windows. j . Prevention of neighborhood deterioration and blight. The proposed facility is expected to have a positive impact on surrounding properties and on the local area as a whole by providing improved service uses which are conveniently located with respect to two major arterials and to nearby residences. Further, the improvement of the existing structures (coordination of exterior materials, screening of equipment) should enhance both the site and the area and possibly act as a catalyst for new development and/or other redevelopment efforts in the area. Conclusions: 1. The subject proposal generally complies with the policies and codes of the City of Renton. 2 . Specific issues raised by various City departments and focused on were: a. Aesthetics b. Noise, light and glare. c. Traffic d. Air quality 3 . The proposal complies with the Comprehensive Plan designation for Commercial Use. Decision: The revised site plan (May 3, 1989) for Shannon's Village, file no. ECF; SA-025-89, is subject to the following conditions: 1. That a restrictive covenant be placed on the property requiring site plan approval for any addition to or exterior remodeling of the subject site, based upon: a) the existing dense level of development upon the site; b) the proximity of residential development; c) the existing and anticipated heavy utilization of adjacent roadways; and 4) the anticipated limited capacity of sanitary sewers to handle new developments. 2 . That the applicant provide a written statement confirming agreement to develop the site in accord with approved plans (May 3 , 1989) , including: a) architectural integration of Building "A" and "F" into. the site plan for the development as-a-whole (including roof-top equipment screening) so as to be thematically compatible with Building "B" and Building "D" ; b) a Site Plan Review Commit, _-e Report and Decision June 1, 1989 Page 8 greenhouse adjacent to Building "F" ; c) on-site outdoor seating, d) on-site exterior pole lighting, to pedestrian scale, for illumination and safety; e) on- site pedestrian linkage; and f) on-site signage to protect safety and efficiency of travel. 3 . That the applicant provide a landscaping plan which provides for increased size, quantity and diversity of plantings throughout the site, with particular attention to the area immediately to the south of Building "F" . Plantings on the west side of the bank adjacent to the Night Deposit Window will need to be designed so that safety of window users is protected. The plan shall be subject to the approval of the City's Landscape Planner. For the purpose of these decisions, the term "should" and "shall" are to be considered mandatory and the term "may" is considered discretionary. Notes to Applicant: An applicant complying with these provisions and willing to hold the City harmless for any expense or damages incurred for work begun prior to the exhaustion of the 14-day appeal period and/or for work which may consequently be stopped by an appeal or work required to be altered or returned to its preconstruction state, may begin construction activities with the issuance of the proper permits. File Numbers ECF; SA-025-89 Dear Mr. Witt: This letter is to inform you that the Environmental Review Committee completed their review of the environmental impacts of the above referenced project. The Committee on May 3, 1989 decided that your project may be issued a Determination of Non-Significance- Mitigated with the following conditions: 1. That the applicant install a luminaire along Duvall Avenue at the northern property line of the site in order to provide lighting to mitigate traffic impacts and ensure safer travel for pedestrians and vehicles, subject to specifications established by the Traffic Engineer. Note: At the time of site plan review, staff will recommend the following, subject to City approval: • a) A restrictive covenant be placed on the property requiring site plan approval for any addition to or exterior remodeling of the subject site, based upon: a) the existing dense level of development upon the site; b) the proximity of residential development; c) the existing and anticipated heavy utilization of adjacent roadways; and d) the anticipated limited capacity of sanitary sewers to handle new developments. 200 Mill Avenue South - Renton, Washington 98055 - (206)235-2550 • William E. Witt Shannon's Village May 4, 1989 Page 2 b) Confirmation that the applicant will develop the site in accord with approved plans for: a) architectural integration of Building "A" and "F" into the site plan for the development as-a-whole (including roof-top equipment screening); b) landscaping the area immediately to the south of Building "F" and the west side of the bank adjacent to the Night Deposit Window; and c) for on-site exterior pole lighting, to pedestrian scale, for illumination and safety; and d) on-site signage to protect safety and efficiency of travel. Because the Environmental Review Committee imposed specific mitigation measures rather than issue a Determination of Significance, there is a required fifteen (15) day comment period during which comments are solicited from various agencies, jurisdictions or individuals who may have an interest in the Committee's decision. The required 14 day appeal period will run concurrently with the comment period. Appeals shall be filed with the Renton Hearing Examiner, Municipal Building, 200 Mill Avenue South, Renton, WA 98055, within the fifteen (15) day comment/appeal period. All appeals must be accompanied by a non-refundable $75.00 filing fee. The comment/appeal period will end May 23, 1989. Following the end of the comment/appeal period, the City will finalize it's Determination, unless comments received require a reevaluation. In addition, by the end of the comment/appeal period, we should be able to establish a tentative date for completion of administrative site plan review or a tentative public hearing date before the Hearing Examiner, should a public hearing be necessary. This memo outlines those concerns. CASH MACHINE/NIGHT DEPOSIT: The bank is situated such that the main entrance is on the west side of the property line, boarding Duvall Road. While this road faces traffic and is conducive to visual observation, it is unsafe for people arriving at this bank to use the bank machine, or night deposit. Customers will have to park their vehicles in the south lot and then walk around the building to use the cash machine. This is a dangerous location for the cash machine and night deposit. LOITERING: The branch is located with several other businesses in such a manner that it allows for loitering, making the bank an easy mark for robbery. Observation of suspiciuos individuals will also be nearly impossible with the location of the bank in a mixed business complex. TRAFFIC FLOW: The design of the drive-up windows and parking availability indicate that the parking lot will have a great deal of through traffic, this is a major cause of traffic accidents in parking lots. With these concerns in mind, I feel this bank has the potential for having a major impact on police services. MA Building and Zoning Department 1989 /0 Revised Administrative Site Plan Approval for: SHANNON'S VILLAGE Renton,Wa. 3-10-89 We have been required to submit an application for a revised Site Plan Approval including a new environmental checklist for the Shannon's Village project. The current status of the project is as follows: Building "A" is complete and occupied(except upper level)by dental offices. Building "D" Retail Mall (Buildings C, D, E on original plan)Currently under construction. Building "B" Permit application submitted 12-88; comments received 2-89 indicated"major change of building "B"into a bank with drive through windows will require an ammended Administrative Site Plan approval. (Ref SA-031-87)( i) The changes to the project since the original site plan approval have been minimal. The buildings are of the same general size, configuration , and materials. The changes are outlined here: 1. Building "B", now with Seafirst Bank as main floor tenant will have 3 drive up lanes instead of the one on the initial approval. We are providing 7 backup spaces per lane instead of ' the 5 required in the zoning code. The driveup is hidden from the street view, and if there should be overflow beyond the backup provided it would be on site rather than causing congestion on Sunset or Duvall. 2. We have added a clock tower as a focal point to the site and to help unite the buildings. It is in front of the retail mall which acts as a backdrop to the site, and centers approx. between buildings "A" and "B". This clock tower, with planter, trellis, and benches, and the stair towers • of"A" and "B" facing each other should unite and enhance the project. 3. The architectural detailing of the buildings has been,we feel, enhanced, since the original approval. The materials are the same - Split face masonry, cedar siding, metal roofing and trim, with the exception of the retail mall where stucco will be used in lieu of wood siding for the wall areas other than the masonry. (This was to respond to comments from the fire Marshall's office.) Some colors will be the same on all buildings, the blue metal roofing for example, but there will be some differences between the buildings as well. 219 FIRST AVE.S. • SUITE NO.210 SEATTLE,WA 98104 (206)682-1180 • • We have been requested to submit a revised environmental checklist as well. It is located midway between Renton and Bellevue in a rapidly growing upper middle class bedroom community. The project consists of four separate buildings arranged on a well-landscaped site with excellent street access, visibility, and parking. It is designed to accommodate a variety of community businesses such as medical/dental clinic, beauty shop, flower shop, dry cleaning, real estate office and pet store. Three of the buildings are to be newly constructed with contemporary architectural appearance. One of the buildings is to be remodeled from its current use as a dental clinic to meet the new flower and gift shop tenant's image. The buildings are masonry with cedar timber trim. • The primary marketing area supporting this development has experienced a population increase of over 84% in the past ten years, and an increase of over 64% is expected in the next ten years. The project site is a 98,000 s.f. flat, cleared parcel on the corner of Sunset Blvd. and Duvall Avenue -- the two busiest business oriented arterials linking the community to Bellevue and Renton. The project is scheduled for phased construction. This loan application is to cover the cost of all site development and improvements ; the construction of the first two buildings, A 8 B, and the remodeling of the existing Building F. Phase 2 will complete the last buildings when they have been substantially pre-leased. • • CUfLD:NG/ZOn11NIG DEPT. • nArr 1 tr nr'rngnrn innr • . A. Background A. 11. The proposed project consist of four buildings for retail and professional offices to be known as Shannon's Village. Shannon Village will be located on 2.26 acres within the City of Renton. This development will contain 20.200 square feet of office and retail store. Off street parking will be provided at 1 parking space for every 200 square feet of usable space. Shannon's Village will be served by the City of Renton sewer and water system. An on—site storm drainage system will be provided. Access to the Site will be via Duvall Ave. NE and NE Sunset Highway. A.12. The 2.26 Acre Site is located east of Duvall Ave. NE and north of NE Sunset Blvd. B. Air 2.a. Construction activities will cause a temporary increase in suspended particulates. 1979 date for suspended particulates from Puget Sound Air Pollution Control Agency indicates the annual geometric means for monitoring stations near the Site (SE District Health Center, Renton WA. ) were 43 micrograms per cubic Meter. This figure is below State and Regional Standards of 60 ug/m. 2.c. During construction, suspended particulate levels may be reduced by the watering and hydroseeding of exposed soils. The increase of CO emission. 3. Water b. Ground b. l. Approximately 72 percent of the (2.26 acres) site will be converted to impermeable surfaces (roofs, parking, driveways, sidewalks) will reduce the amount of exposed soils and natural vegetation. This will reduce the amount of water discharged into the ground. c. Water Runoff c.l. The increase of impervious surfaces will result in increase of surface water runoffs. The developer will comply with City of Renton Storm and Drainage ordinances which require that storm water runoff generated after construction, do not exceed the peak rate of runoff prior to development. Storm water runoff will be collected into underground storage facilities and released into it's natural outlets at a rate equal to peak rate of predeveloped condition. c.2. As is common each development, surface quality will be reduced as urban pollutants (oil, grease, lawn fertilizer) enter surface and ground water more frequently after development. c.3. To alleviate the impact of increasing storm water flows, a permanent detention facilities will be constructed to control runoffs from the Site. Oil/grease separators will be installed to reduce the amount of pollutions j,scharging into ground and downstream area. Temporary erosion/sedimentation controls will be employed during construction to intercept all potential silt laden runoff prior to discharging into stream areas. 4. Plants 4.b. Majority of the Site is bare ground and short grass except for the northeast portion there exist evergreen fir trees and certain underground cover and shrubs. Construction activities will disturb most of the project area and inevitably result in the removal of the trees and natural vegetation. 4.d. The entire Site will be generously landscaped. Plants material include large caliper maple, large caliper evergreen groundcover, and sod lawn. Native groundcover and shrubs are emphasized in the landscape plan. 5. Animals 5.d. The development of this Site may result in some habitat and displacement of some animals. As the Site is landscaped certain bird species may utilize the Site. 14. Transportation 14.f. ITE Technical Committee project 30 to 35 Average Vehicle trips per day (VDT) per 1000 Gross square Feet of lease Area (G.S.F. ) for shopping Centers under 50.000 G.S.F. The area to be leased when the entire project is completed is 21 ,800 (G.S.F. ). The peak hours for such development will occur between 7-9 Am and 4-6 PM, during the weekdays and all day during Saturdays. Week Day - AM 29.6 X 21.8 = 645 VTD PM 31.0 X 21.8 = 676 VTD Weak End - AM 37.7 X 21.8 = 833 VTD (Saturday) • • • 15. Public Services 15.a. Fire Protection The proposed project will be served by the City of Renton Fire Department. First response to a call from the Site would be from station #12. Station #12 is equipped by Medic One Facilities. Police Protection Police services will be provided by the Renton Police Department and will be dispatched by the Valley Com. 16. Utilities Power & Telephone are available to the Site from adjacent roads serving the Site. Puget Sound Power and Light Company will provide services to the Site. Telephone service to the project Site would be provided by Pacific Northwest Bell. A water system will be provided by the developer for the ` Site. The system will be built according to the City of Renton Public Works Department specifications. Public Works will be responsible for the review and approval of final water system design. Gravity sewer service exists on the Site. The system will be extended to serve the entire property. Public Works will be responsible for the review and approval of final sewer plans. A storm water drainage system, including detention facilities, will be constructed as required by City of Renton. Detention facilities will be in the form of oversize pipes. Storage provided will be for a 10 year design storm, and the release rate will be restricted to that of a 10-year storm. • • 1 . r ' +-A + -•.. y,;r oLT`, (,0.t:cj- :p-i.., ..T. bL:Jl:fir,Z.0 i .iEG\ / - „"'l::.s:-e y,.,. -- +Yi'...L•,a..:_ >''`•1/ /Pr..2 (-!/mT' 4 gL(7af. :G+lLe2 `S.P_, __` - ,,_,._.. .Zi• c-_. .._,•..,-`••:ice`"IJ-. An environmental impact statement (EIS) must be prepared for allproposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide Information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. Instructions for Applicants: - This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly. with the most precise information known, or give the best description you can. You must answer each question accurately and carefully. to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply." Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmental agencies can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impacts. Use of Checklist for Nonproject Proposals: (Please Type or Print Legibly) Complete this checklist for nonproject proposals, even though questions may be answered "does not apply." IN ADDITION, complete the SUPPLEMENTAL SHEET FOR NONPROJECT ACTIONS (part D). For nonproject actions (actions involving decisions on policies. plans and programs), the references in the checklist to the words "project," "applicant." and "property or site" should be read as "proposal," "proposer." and "affected geographic area," respectively. Instructions for Applicants: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. Use of Checklist for Nonproiect Proposals: (Please Type or Print Legibly) Complete this checklist for nonproject proposals, even though questions may be answered "does not apply." IN ADDITION, complete the SUPPLEMENTAL SHEET FOR NONPROJECT ACTIONS (part D). For nonproject actions (actions involving decisions on policies, plans and programs), the references in the checklist to the words "project," "applicant," and "property or site" should be read as "proposal," "proposer," and "affected geographic area." respectively.
