Phase I includes the construction of a 12,741 square-foot addition on the south side of the existing facility and Phase II includes the construction of a 8,125 square-foot addition on the west side. In addition the applicant is proposing: the relocation/replacement of a drainage pond with a new detention vault; a lO-foot high fence along the southwest property line, which exceeds the height limits prescribed in code, screening the use; associated landscaping and parking. The 4.73 acre site is located on the south side of SW 34th Street between Oakesdale Ave SW and Lind Ave SW. The site is zoned Light Industrial (lL) and is in the Employment Area-Valley (EAV) Comprehensive Plan land use designation and overlay. Access would continue to be gained via 2 curbs located on SW 34th Street. The stream is confined within a relatively straight channel within in the City limits. Vegetation mostly consists of grasses with scattered shrubs. Grading, the redesign of paved areas and construction of a new detention vault is proposed within 200 feet of the of the stream's ordinary high water mark. The proposal would have no additional long term negative effects on water and land vegetation, water life and other wildlife as the existing site is fully developed. In addition the applicant is providing additional vegetation along the property line that is adjacent to the stream. The water quality treatment system for the proposed storm system will include an oil/water separator spill control manhole combined with a wet vault sized to exceed the 2005 DOE Manual. Hydrants dedicated for the Fire Department connection shall require them to be within 50 feet of the FOe. Hydrant spacing shall also be in accordance with Chapter 4 of the Renton City Ordinance. 3. Fire apparatus access roadways are required to be within 150 feet of all portions of the building exterior. Roadways shall be a minimum of 20 feet wide on a surface capable of sustaining the weight of a fire apparatus. The turning radius shall be 45 feet to the outside and 25 feet to the inside. 4. The fire sprinkler systems proposed for phase one and two shall be designed to adequately suppress High Piled Combustible and Plastic commodity storage. Separate plans and permits are required for the installation of a fire sprinkler system. 5. The fire sprinkler riser rooms for the phase one and two projects shall be accessible through a dedicated exterior door. The Sprinkler Riser Room shall be located with heat and lighting. 6. A Fire Alarm and Monitoring system shall be required. Separate plans and permits are required for the installation of a fire alarm and monitoring system. The requirements for the Fire Alarm system shall also include the existing building. 7. All additions shall require compliance with all High Pile Storage requirements set forth in Chapter 23 of the 2006 International Fire Code and, National Fire Protection Association Standard 13, High Pile Storage requirements. 8. High piled combustible and plastic storage piles shall be separated by 5-foot aisle ways and all other requirements noted in Chapter 23 of the 2006 International Fire Code and National Fire Protection Association Standard 13. 9. Handling and storage of high piled combustible fibers shall require that it be conducted as in accordance Chapter 29 of the 2006 International Fire code. Specifically the handling and storage of combustible fibers requires the use of an approved dust collection and exhaust system. 10. Overhead utility and power lines should not be located within the fire department aerial apparatus access roadways. Public Services 1-Utilities a. Water: There is a lO-inch water main looped around the building. There is also an 8-inch fire line, a 2-inch domestic meter and a 2-inch irrigation meter serving the main building. b, Sewer: There is a 6-inch side sewer connection to the existing building. c. Sur'face/Storm Water: There is a storm drainage pond and conveyance system on site. 2. Streets: Improvements are installed along the frontage of the site. 3. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Earth Impacts: There are approximately 4.08 acres of impervious surface on the site under existing conditions which is proposed to remain the same. The site is nearly level with slopes of two percent or less. Approximately 400 cubic yards of cut and 2,500 cubic yards of fill material is being proposed in order to prepare the site for construction and the relocation of the stormwater facility. Following development, impervious surface coverage will remain the same at approximately 85 percent. Mitigation Measures: No mitigation recommended. Nexus: Not applicable. 2. Water a. Wetland, Streams, Lakes Impacts: The project site is located adjacent to Springbrook Creek, a Class 1 stream. The stream is confined within a relatively straight channel within the City limits. Vegetation mostly consists of grasses with scattered shrubS. Grading. the redesign of paved areas and construction of a new detention vault is proposed within 200 feet of the of the stream's ordinary high water mark. The proposal would have no additional long term negative effects on water and land vegetation, water life and other wildlife as the existing site is fully developed. In addition the applicant is providing additional vegetation along the property line that is adjacent to the stream. Staff is recommending the applicant provide a temporary erosion control plan that complies with the Department of Ecology's (DOE) Erosion and Sediment Control Requirements as outlined in Volume II of the most recent edition of the Storm water Management Manual. Water quality is a significant concern for this project due to the land use. The applicant has provided preliminary plans for water quality which attempt to address this concern. The wet pond volume required in 1995, when the facility was originally constructed, was 6,970 cubic yards. However, the applicant is proposing 17,280 cubic yards of volume within the proposed vault. The water quality treatment system for the proposed storm system will include an oil/water separator spill (ontrol manhole combined with a wet vault sized to exceed the 2005 DOE Manual. The proposed water quality treatment system exceeds the treatment originally designed and constructed for the site. Additions are being proposed in order to enclose storage areas that are currently outdoors. The expansions would prevent recycling materials from being windblown and potentially entering Springbrook Creek. Mitigation Measures: No mitigation recommended. Nexus: Not applicable. b. Storm Water Impacts: The project site is located within the Black River sub-basin of the Duwamish-Green River Drainage Basin. Stormwater runoff from the site currently discharges into the existing detention pond and bioswale at the south end of the site. The applicant is proposing to remove the existing storm water pond and bioswale and install an underground storm detention/water quality vault along the southwest end of the site. The existing on site conveyance system would be modified slightly in order to route the existing runoff into the new detention/water quality vault. As the existing site is fully developed the applicant is required to replace the original required detention volumes provided in the pond, within the proposed vault. The detention volumes were originally calculated based on the Santa Barbara Urban Hydrograph (SBUH) methodology. The calculations for the proposed detention vault volumes were based on this methodology with consideration given to the slightly changed site conditions; specifically updates to the model and the depth of the proposed vault. There were no measurable changes in flow durations from existing conditions since there is no proposed change in the effective impervious area. The water quality volume provided for the proposed system exceeds the volume required under the 2005 DOE manual. The site will utilize the same outfall pipe that is being used under existing conditions. The outfall discharges into Springbrook Creek and there would be very little change in flow rates from the project site under proposed conditions. Staff recommends that a temporary erosion control plan be submitted that complies with the Department of Ecology's Erosion and Sediment Control Requirements as outline in Volume II of the most recent edition of the Stormwater Management Manual. The plan must be approved by the Deve[opment Services Division prior to issuance of the building permit. The recently revised FEMA Flood Insurance Rate Map show the subject site within the general location of the 100-year floodp[ain. The applicant submitted an assessment, prepared by Talesaea Consultants, Inc. on July 1, 2009, with regards to the Nationa[ Marine Fisheries Service's Biologica[ Opinion. According to the assessment the proposed expansion areas are sited at elevations above the revised 100-year floodp[ain with portions of the expanded vehicular pavement and the stormwater detelltion vault occurring within the floodp[ain. The proposal is consistent with the development gUidelines provided in the biological opinion, in that there will be no decrease in stormwater retention, no increase in flooding potential; and fish habitat will not be damaged or destroyed. Mitigation Measures: The applicant shall be required to provide Temporary Erosion and Sediment Control Plan (TESCP) designed pursuant to the Department of Eco[ogy's Erosion and Sediment Control Requirements outlined in Volume [[ of the most recent Department of Ecology Stormwater Management Manual. This condition shall be subject to the review and approval of the Development Services Division prior to the issuance of building permits. Nexus: SEPA Environmental Regulations, Department of Ecology Stormwater Management Manual 3. Transportation Impacts: The project would be accessed, by means of existing curb cuts, from SW 34th Street. No street improvements would be required for this project. No new trips would be generated by the proposed building additions since the additional space will be product storage and maneuvering. There is no Transportation Mitigation Fee required. Mitigation Measures: No mitigation recommended. Nexus: Not applicable. 4. Fire & Police Impacts: The Fire Prevention Bureau and the Police Department have indicated they have the ability to provide service to the project provided required improvements are made and a Fire Impact Fee is assessed. The fee, at $0.52 per net square foot of new building area, has been estimated to be $10,850.00. Fire sprinklers are required for the proposal. Separate plans and permits are required for the installation of a fire sprinkler system that adequately suppresses High Piled Combustible and Plastic commodity storage. A fire alarm and monitoring system, for the existing facility as well as the proposed additions, is also required. The additions require compliance with all High Pile Storage requirements set forth in Chapter 23 of the 2006 International Fire Code and, National Fire Protection Association Standard 13, High Pile Storage requirements. High piled combustible and plastic storage piles shall be separated by five-foot aisle ways and all other requirements noted in Chapter 23 of the 2006 International Fire Code and National Fire Protection Association Standard 13. Handling and storage of high piled combustible fibers shall require that it be conducted as in accordance Chapter 29 of the 2006 International Fire code. Specifically the handling and storage of combustible fibers requires the use of an approved dust collection and exhaust system. Currently there are five hydrants within the 150 to 300 foot range to the exterior of the front entrance. There appear to be adequate hydrants to serve the site. However, the hydrant shown east of the addition located on the eastern fa~ade of the existing building is required to be relocated further east as a condition of building permit approval. Mitigation Measures: The applicant shall pay a Fire Mitigation Fee, prior to issuance of the building permit. PART THREE: ADMINISTRATIVE SITE DEVELOPMENT PLAN REVIEW This decision on the administrative land use action is made concurrently with the environmental determination. A. Staff Review Comments Representatives from various City departments have reviewed the application materials to identify and address site plan issues from the proposed development. These camments are contained in the official file, and the appropriate recommendations have been incorparoted into this report. B. Consistency with Site Development Plan Review Criteria The Site Development Plan Review Criteria set forth in Section 4-9-200 of the Renton Municipal Code forms the basis of the Site Plan Review, as follows: 1. Conformance with the Comprehensive Plan, its elements and poliCies The Comprehensive Plan Land Use Map designation for the project property is Employment Area - Valley (EAV). The purpose of EAV is to provide for a mix of employment-based uses, including commercial, office and industrial development to support the economic development of the City of Renton. Recycling Collection and Processing facilities are allowed in the IL zone as long as operations are conducted within an enclosed structure. In order to ensure operations are conducted within an enclosed structure staff recommends, as a condition of approval, that all recyclable materials be stored inside of a structure at all times. b. The proposed facility would be required to provide 247 square feet of recyclable deposit areas and 497 square feet of refuse deposit area. Square footages for deposit areas were not provided on the site plan provided. Staff recommends, as a condition of approval, the applicant submit a revised site plan depicting adequate square footage for the refuse and recycling deposit area. The revised site plan shall be submitted to and approved by the Current Planning Project Manager prior to final occupancy. c. Parking/Circulation: The parking regulations require a specific number of off-street parking stalls be provided based on the amount of square footage dedicated to certain uses. The parking conforms to the minimum requirements for drive aisle and parking stall dimensions and the provision of ADA accessible parking stalls. Within the proposed surface parking lot 25 square feet of landscaping, per parking space, would be required. Based on the proposal no more than 62 surface parking stalls would be provided, a minimum of 1,550 square feet of landscaping would be required within the surface parking areas. The submitted landscape analysis indicates that a total of 26,531 square feet of landscaping would be provided on the interior and perimeter of the site which would mitigate impacts to adjacent properties caused by parking. 3. Mitigation of impacts ta surrounding properties ond uses; City staff does not anticipate any adverse impacts on surrounding properties and uses as long as the conditions of approval are complied with. All parcels immediately surrounding the subject property are zoned Light Industrial (IL) with the exception of Springbrook Creek to the west, which is zoned Resource Conservation (RC). Surrounding uses include office buildings, warehousing and distribution facilities. An existing surface parking area is located along the east side of the building with 48 parking stalls. The applicant is proposing a new surface parking area on the west side of the building in the amount of 14 stalls. Concerns have been raised related to adequacy of parking on site for employees. The proposed additions are not anticipated to generate additional trips as the proposed additions will be used for product storage and maneuvering. The additional 14 spaces being proposed will be able to provide parking for existing employees. The applicant is proposing two additions to the facility in order to enclose those recycled materials that have been historically stored outdoors. Several comments and complaints have been received from Site Plan and ERC City of Renton Deportment of Community 0, "'conomic Development SMURFIT RECYCLING EXPANSIO Report of August 3, 2009 Environmental R~v:ew Committee & Adminis1ralive Site plan Report LUA09-063, SA-A, ECF, SM Page 9 of 14 adjacent property owners about recycled materials escaping the Smurfit site and being windblown onto their properties. In order to decrease the probability of litter being windblown onto adjacent properties and into the Creek; staff recommends as a condition of approval the applicant be required to provide and impose a new litter management plan/program for their own employees and for truckers bringing in recycled materials. A copy of this plan shall be submitted to and approved by the Current Planning Project Manager prior to building or utility construction permit approval whichever comes first. In addition the adjacent property owners have raised concerns related to the aesthetic impact of the recycled materials that have been historically stored outdoors. As a result the applicant is proposing a ten-foot chain link fence with slats along the southwest property line. RMC 4-4-040 limits the height of fences for industrial and commercial uses to eight feet. Staff recommends as a condition of approval that a 8-foot high, black coated chain link fence with black slats; be installed along the southwest property line prior to building or utility construction permit approval whichever comes first. According to code, parking lot lighting fixtures are to be non-glare and mounted no more than 25 feet above the ground. This is to help minimize the impact onto abutting properties and on-site building. 4. Mitigation of impacts of the proposed site plan to the site; The existing building is located in the center of the site setback approximately 35 feet from SW 34th Street. The 12,741 square foot addition would be located on the southern fa~ade while the 8,125 square foot addition would be located on the northern portion of the western fa~ade. The applicant has limited the height of the proposed additions to 34 feet and 6 inches in order to match the height of the existing structure thereby not creating additional impacts due to height. The 82,311 square foot footprint on the 4.73 acre site results in a building lot coverage of 40 percent. The exterior of the additions will be comprised mostly of concrete panels and roll-up loading doors with sheet metal coping to match the existing structure. The scale and bulk of the facility would be virtually unchanged as viewed from south as the proposed addition on the southern fa~ade would maintain the same sight lines as the existing building. The scale and bulk of the facility will increase, as viewed from the north, east and west. However, the proposal exceeds all setbacks required by code thereby mitigating the additions' impacts on neighboring uses in terms of scale and bulk. The scale, height and bulk of the proposed additions are appropriate for the site and would be architecturally compatible with the existing faCility. There is existing landscaping around the perimeter of the site. Most notably is a large landscape area on the southern portion of the site that of which most vegetation is proposed for removal in order to create maneuvering space for vehicles and construct a new water detention vault. The vegetation which will be removed primarily consists of invasive weeds and tall brush that has grown up around and within the pond over the years from lack of maintenance. This landscape area was created as part of the original site plan in order to comply with the wildlife habitat requirement. As the there is no longer a requirement for the wildlife habitat the applicant will not be required to relocate the landscaped area elsewhere on site. However, the use of landscaping on the southern portion of the site to buffer the recycling facility is important due to topography. Vegetation would enhance screening of the facility from those properties to the south that are slightly elevated above the site. The applicant is proposing the planting of four black pine trees, five cypress trees and rock rose shrubs along the southwest property line; while retaining 10 deciduous trees along the southeast property line. All existing landscaping along the western property line (abutting Springbrook Creek). eastern property line and the frontage of the site are proposed to remain. Additional landscaping is also being proposed within the new parking area. 5. The proposed enclosing of recyclable materials on site should help to conserve area wide property values. 6. Safety and efficiency of vehicle and pedestrian circulation; Access would continue to be gained via two curbs located on SW 34th Street. Vehicle circulation would be improved on the interior of the site as a result of the proposal. The site development would include 14 additional parking stalls within the surface lot, which complies with the parking requirements for the proposed use. Comments have been received related to truck traffic, generated by the facility, along SW 34'h Street. However, no additional long term impacts would be generated by the proposal as the additions would be used for product storage and maneuvering. 7. Provision of adequate light and glare; The applicant is not proposing changes to the lighting plan for the site. The existing building and proposed additions are designed appropriately to allow adequate light and air circulation to the building and the site. The design of the building will not result in excessive shading of the property. In addition, there is ample area surrounding the building to provide for normal airflow. 8. Mitigation of noise, odors and other harmful or unhealthy conditions; The proposed additions are not anticipated to generate harmful or unhealthy conditions. There would continue to be noise, odor and traffic impacts that are normally associated with an industrial development 9. Availability of public services and facilities to accommodate the proposed use; Fire and Police Department staff have indicated that existing facilities are adequate to accommodate the subject proposal, subject to the applicant's payment of the necessary impact fees. As imposed by the Environmental Review Committee, the applicant will be required to pay a Fire Mitigation Fee prior to the issuance of building permits. The site is served by the City of Renton for all utilities. There is a lO-inch water main looped around the building. There is also an 8-inch fire line, a 2-inch domestic meter and a 2-inch irrigation meter serving the main building. There is a 6-inch side sewer connection to the existing building. 10. Prevention of neighborhood deterioration and blight; The site and existing use are industrial and would continue to operate in the same manner. The proposal is not expected to cause neighborhood deterioration and/or blight. As long as conditions of approval are met, the additions would be compatible with the existing facility. C. Findings Having reviewed the written record in the matter, the City now enters the following: 1. Request: The Applicant has requested Administrative Site Plan Approval, Environmental Review and a Shoreline Substantial Development Permit for the Smurfit Recycling Facility Expansion, LUA 09-063, SA- A, ECF, SM. 2. Environmental Review: The City's Environmental Review Committee (ERC) has reviewed the proposal and issued a Determination of Non-Significance-Mitigated (DNS-M) and imposed two mitigation measures. 3. Site Plan Review: The applicant's Site Plan Review application complies with the requirements for information necessary for site plan review. The applicant's plans are attached to this report. 4. Comprehensive Plan: The subject site is designated Employment Area Valley (EAV) which permits industrial development. The subject project complies with the policies and codes of the City of Renton, provided all advisory notes and conditions of approval contained in this Report and Decision are complied with. 2. The subject project complies with the Employment Area Valley Comprehensive Plan designation and the Light Industrial zoning designation. 3. The City's Environmental Review Committee (ERC) has reviewed the proposal and issued a determination of non-significance-mitigated (DNS-M) and imposed two mitigation measures. 4. The subject project complies with the City of Renton Shoreline Master Program, provided all advisory notes and conditions of approval contained in Shoreline Substantial Development Permit are complied with (Exhibit 8). E. Decision The proposed site plan for Smurfit Recycling Expansion, File No. LUA09-063, ECF, SA-A, SM is approved subject to the following conditions: 1. All recyclable materials shall be stored inside of a structure at all times. 2. The applicant shall submit a revised site plan depicting adequate square footage for the refuse and recycling deposit area. RMC section 4-4-030.e.2Iimits haul hours between 8:30 am to 3:30 pm, Monday through Friday unless otherwise approved by the Development Services Division. The Development Services Division reserves the right to rescind the approved extended haul hours at any time if complaints are received. 2. Within thirty (30) days of completion of grading work, the applicant shall hydroseed or plant an appropriate ground cover over any portion of the site that is graded or cleared of vegetation and where no further construction work will occur within ninety (90) days. Alternative measures such as mulch, sodding, or plastic covering as specified in the current King County Surface Water Management Design Manual as adopted by the City of Renton may be proposed between the dates of November 1st and March 31st of each year. The Development Services Division's approval of this work is required prior to final inspection and approval of the permit. Water: 1. Due to the location of the new building (Phase I), the lO-inch water main will need to be relocated and rerouted. A new water main easement will also be required. The relocation and easement has been shown on the plans, however this work will be done at a later date. 2. Why did the applicant's consultants choose to use the Santa Barbara Urban Hydrograph methodology to size the detention and water quality facilities? This model has known limitations as discussed in Ecology's Stormwater Management Manual for Western Washington, Volume 2, pages 2-3 and 2-4. By using the SBUH method and not a continuous simulation model, the proposed project will likely lead to an undersized vault and increased discharge of pollutants to Springbrook Creek. In addition, the facility may lead to increases in flow durations over pre-developed conditions that could adversely affect juvenile salmonids in Springbrook Creek because Springbrook Creek is not in a pre-developed condition and lacks off channel habitats for rearing salmonids. 3. Per the Stormwater report, it appears that the new detention vault will need to be larger to meet detention and water quality treatment requirements based on changes to the stormwater requirements. Previously, the project discharged to a biofiltration swale per the 1995 Technical Information Report. However, the site plan drawings do not show a biofiltration swale. Does this swale exist and if so, will it be increased to meet stormwater requirements? 4. What level of treatment will be used for the stormwater? The project should be treating its stormwater using enhanced methods including an oil and water separator to maximize treatment and minimize pollutant loading to Springbrook Creek. 5. Will any work need to be completed at the stormwater outfall? If so, what work will be completed? 6. The environmental checklist notes that vegetation around the existing pond will be removed? Where exactly is this vegetation that will be removed? How much vegetation will be removed? What species of vegetation will be removed? Is any mitigation proposed for the removal of this vegetation? These building are located directly across the street from Smurfit. Smurfit provides a needed service to our community and we support their planned expansion provided that two main areas of concern are adequately addressed. The first concern is with waste paper that is wind-blown from Smurfit onto our property and into the creek. This is a regular occurrence in anything but a calm wind. Smurfit workers oilen will patrol the exterior and ~ick up some of the garbage that has landed on our property. However, our members along 34' often spend countless hours cleaning waste paper from the grass and landscaping beds. We are asking that Smurfit take the necessary steps to control the waste material on their grounds and prevent this material from consistently fouling our landscaping areas. This can easily be accomplished. Some suggestions include: Closing the gates on windy days Run sweepers in the yard on an ongoing basis Adjust the fencing at the entrance to catch more of the trash before it can blowout The second concern is with trucks waiting to enter the Smurfit plant. These trucks park in a traffic lane, sometimes blocking the view for vehicles exiting our property. We have been told by the City to call 911 when this happens, but the response is almost always too slow. This expansion may exacerbate a dangerous situation and we expect the City to protect its citizens by addressing this with Smurfit. We have every confidence that our concerns can be addressed in a reasonable manner that should not necessitate delays in the completion of this expansion. There is an 8-inch fire line, a 2-inch domestic meter and a 2-inch irrigation meter serving the main building. See City as-built drawing W-2228. Preliminary fire flow demand for the new expansion is estimated to be 4,250 gpm. Available fire flow from the lO-inch looped main is 4,250 gpm. SEWER There is a 6-inch side sewer connection to the existing building. STORM There is a storm drainage pond and conveyance system on site. Constructed in 1995, the outfall from the site discharges into Springbrook Creek. The existing pond and conveyance system on the site was designed to the 1990 King County Surface Water Manual. STREETS Improvements are installed along the frontage. CODE REQUIREMENTS WATER 1. Due to the location of the new building (Phase I), the lO-inch water main will need to be relocated and rerouted. A new water main easement will also be required. The relocation and easement has been shown on the plans, however this work will be done at a later date. 2. Water system development fees will apply if applicant adds a new water meter or increases the size ofthe existing domestic, fire line, or irrigation meter. SANITARY SEWER 1. Some suggestions include: Closing the gates on windy days Run sweepers in the yard on an ongoing basis Adjust the fencing at the entrance to catch more of the trash before it can blowout The second concern is with trucks waiting to enter the Smurfit plant. These trucks park in a traffic lane, sometimes blocking the view for vehicles exiting our property. We have been told by the City to call 911 when this happens, but the response is almost always too slow. This expansion may exacerbate a dangerous situation and we expect the City to protect its citizens by addressing this with Smurfit. Grading to redesign paved areas and construction of new detention vault will occur within 200 feet of Springbrook Creek. 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected. I ndicate the sou rce of fill material. No fill or dredge material will be placed in Springbrook Creek. 4) Will the proposal require surface water withdrawals or diversions? Give general description, purpose, and approximate quantities if known. No. 5) Does the proposal lie within a 1 ~O-year flood plain? If so, note location on the site plan. No. The site is not within the IOO-year flood plain based on the current adapted FEMA Flood Plain maps. The site is located on current King County FIRM Map Panel 53033C0978, dated May 16, 1995. However, based on the Draft King County Flood Plain maps, portions of the site are located within the 100-year floodplain. Copies of the current and proposed flood plain maps are enclosed. 6) Does the proposal involve any discharges of waste materials to surface waters? If so, describe the type of waste and anticipated volume of discharge. No waste materials will be discharged to surface waters. 13182.004.doc - 5 - 02/08 b. Specifically, the City requested a revision to the SEPA checklist to indicate that the project is located within a 1 OO-year floodplain and that an assessment be made of the project with regards to the National Marine Fisheries Service's Biological Opinion (BO) 22 September 2008 paper. We understand the project will improve an existing facility within a site that has been previously developed to the property limits with buildings, pavement, stromwater management areas, and other infrastructure. Three questions within the SEPA checklist relate to the BO. These are questions: (1) 3.a.5, which deals with the location of the project in relation to 100-year floodplains; (2) 5.a, which asks which animals (birds, mammals, and fish) have been observed or are known to be on or in the vicinity of the project site; and (3) 5.b, which asks if any threatened or endangered species are known to be on or in the vicinity of the site. This letter contains the results of our assessment of the proposed project in consideration of the BO and provides general responses to these three SEPA checklist questions. Remaining SEPA review issues should be addressed by the information provided herein to describe the limits and elevation of the revised 1 OO-year floodplain for the project, the water typing of Springbrook Creek, and the acknowledgment of federally-listed species of anadromous fish within Springbrook Creek. SEPA Checklist Question 3.a.5 It is apparent from review of available GIS maps and other resource information that Springbrook Creek is a stream that has been significantly modified by urban development of the Kent Valley area, including the City of Renton. The stream is confined within a relatively straight channel (no natural meanders or ability to migrate) through most of the Renton area. Development around Springbrook Creek is often up to the top of the bank providing no natural riparian buffer area. Vegetation along the stream channel through the Renton area is mostly grass with scattered shrubs in some areas through Renton. Springbrook Creek is identified on resource information as supporting anadromous fish. WDFW indicates that the stream additionally supports fall Chinook and winter steel head. The findings of this published information justify rating Springbrook Creek as a Class 1 stream within the City of Renton. or Type F stream as defined under the WAC. The FEMA Flood Insurance Rate Map (FIRM) for the Renton area containing the proposed project indicates that the project is outside of the mapped 1 DO-year flood areas. However, this map was created in 1995 and we understand that recently revised FEMA flood data puts the project within the general location of the 1 DO-year floodplain for Springbrook Creek. We understand the proposed expansion will be completed in two phases. Phase 1 involves a building addition on the south side of the existing structure. The previously constructed stormwater detention facility located on the south side of the property will be replaced with a stormwater vault system. The proposed stormwater vault will utilize the same discharge pipe and outfall of the existing stormwater detention facility. Pursuant to City requirements and standards, we understand the new stormwater vault system will provide equivalent stormwater quality and quantity functions compared to the existing stormwater system. The stormwater vault will be buried and the area above used as additional parking and vehicular circulation. Phase 2 involves the construction of a second building addition at the northwest comer of the existing structure. No additional impervious surfaces or changes to existing stormwater retention and release are planned for this phase. Proposed building expansion areas are sited at elevations that are understood to be above the revised 1 DO-year flood elevation, based on information provided to us by Barghausen Engineers, Inc. However, portions of the expanded vehicular pavement and the stormwater detention vault may occur within the floodplain of Springbrook Creek. This action is consistent with the development guidelines provided in the BO, in that there will be no decrease in stormwater retention, no increase in flooding potential, and that fish habitat will not be damaged or destroyed. It is conceivable that the existing conditions (open stormwater detention and water quality treatment) may constitute a potential fish stranding area during extreme flood events. The proposed stormwater detention vaults will eliminate the potential for this problem and could be considered by the City to be a natural resource/habitat conservation or preservation measure. It is also understood that the new building expansions will decrease the existing paved area that is accessible by vehicles. eliminating some pollutant generating surfaces. Stormwater runoff from rooftops and vehicular areas will be diverted to the proposed stormwater detention vault for treatment and controlled release. It is understood that all other wastewater will be discharged to the sanitary sewer system for the site, as it is presently. The current usage of the site is paper recycling. Aerial photographs reviewed from King County iMap indicate that some paper materials are being stored outside along the west and southwest property boundaries. SEPA Checklist Question 5.a. Under this section, salmon have been determined by WDFW to occur within Springbrook Creek in the vicinity of the project. Salmon should be circled on the SEPA checklist. SEPA Checklist Question 5.b. The salmon identified as present in Section 5.a. may include coho, steelhead, and fall-run Chinook (as identified on published resource information). All of these species are currently federally listed as threatened or endangered under the Endangered Species Act and/or protected under EFH (Magnuson Act). Springbrook Creek occurs directly adjacent to the project area; though, due to the apparent lack of specific habitat characteristics it is unlikely that this reach of Springbrook Creek provides spawning for any of these species. We trust that the information presented here is sufficient for your current needs to facilitate the SEPA review for this project by the City of Renton. FIRE FLOW; The preliminary fire flow for the entire building of79,825 square feet, of type !II B construction and that will be fire sprinklered, shall have a required fire flow of 4,250 gallons per minute for 4 hours. HYDRANT SPACING; Commercial Spacing -The primary hydrant shall be located within 150 feet to the front of the structure, with all other hydrants being located within 300 feet to the front of the structure. The fire sprinkler systems proposed for phase one and two shall be designed to adequately suppress High Piled Combustible and Plastic commodity storage. 6. SPRINKLER RISER ROOM ACCESS: The fire sprinkler riser rooms for the phase one and two projects shall be accessible through a dedicated exterior door. The Sprinkler Riser Room shall be located with heat and lighting. 7. FIRE ALARM REQUIREMENTS: A Fire Almn and Monitoring system shall be required. The pre-application packet indicates that the proposal is to eliminate the open detention Pond and bioswale located on the south end of the site and replace with an underground wet/detention vault. In addition the appl.icant would be requesting a two-phase expansion of the existing building. The first phase would include the construction of an 11,700 square foot covered warehouse storage area expansion. The second phase includes an 8,125 square feet expansion of the warehouse/storage area constructed oftiit-up walls. Current Use: The property currently contains an existing 62,000 square foot structure used as a materials recovery facility. Zoning: The subject site is located within the Light Industrial (IL) zoning designation on the City's Zoning Map. The site is also located within the Employment Area Valley overlay. Recycling centers are a pennitted land use within the IL zone. However, as a condition of the original approval, for the construction of the recycling facility (LUA95-033 SA, ECF), the storage of recyclable materials is limited to the interior of the building and no outside storage of recyclable materials is allowed. Elevations were not included in the pre-application materials; therefore it could not be detennined whether the proposed expansions could be used for storage. Development Standards: The project would be subject to RMC 4-2-130A, "Development Standards for Industrial Zoning Designations" effective at the time of complete application (noted as "IL standards" herein). A copy of these standards is included herewith. Parking -Off-street parking, loading areas, and driveways for the entire site shall meet the requirements of RMC 4-4-080, "Parking, Loading and Driveway Regulations" (enclosed) if the new paved area will be used as a parking lot or any new buildings or structures are erected. The site is currently developed with the recycling facility and is located on the south side of S.W. 34th Street, approximately 400-feet west of Lind Avenue S.W. and Springbrook Creek is lying adjacent to the site on the western boundary. Access to the site is via one driveway along S.W. 34th Street. The proposed project will construct a phased expansion to the existing 61,445 square foot building. Phase I of the project will construct a 12,741 square foot addition to the southern side of the building and Phase II of the project will construct an 8,125 square foot additional to the western side of the building. Additional parking and asphalt pavement areas will be constructed in Phase I along with new landscaping and relocation of the existing stonnwater facility. Stonnwater runoff from the site currently discharges into the existing detention pond and bioswale at the south end of the site. The proposal will relocate the pond to an underground detention/water quality vault to be located in the same area. Approximately 400 cubic yards of cut and 2,500 cubic yards of fill material is anticipated for the grading activities, stonn pond relocation and detention vault construction. The current zoning of the site is IL-Light Industrial and the recycling facility is a permitted use within that Zone. No outdoor storage of any materials is proposed. Springbrook Creek is located adjacent to the site to the west. Construction activities will be located within approximately 70-feet of the ordinary high water mark of the creek.
