The appeal period for the permit ended on October 7, 2009 and no appeals were filed. The proposed fence would be similar in construction to other fences in the surrounding neighborhood. Located within the side yard along a street, the fence would be 39 feet in length and would connect to an existing fence located on the west edge of the property. The east section of fence would return approximately ten feet to the house to enclose the yard with a gate. The applicant proposes that the landscaping to be planted on the street side of the fence would be done in accordance with the approved landscape plan from the Magnussen Final Plat (LUA07-129)[Exhibit 2]. The fence would not affect any clear vision areas.
