In this same letter, you mention our November 9, 2009 appeal letter and state that we may either change or withdraw the appeal (currently scheduled for February 23). First Item: We believe the premise of the report "Item B. Project Description/Background" is incorrect. This paragraph states the Medical Park consists of Two lots with a structure on both lots. Please refer to the attached survey of the Medical Park short plat. This survey shows the short plat as Four lots, one of which is address "350". That initial premise in "Item B" resulted in "Item G. Decision" describing the "350" address as being an off -premise sign. We respectfully disagree with this conclusion and decision. We are requesting you to take a second look at the Variance Request given the attached information. Second Item: When we received the initial October 29 email from Ion Arai, Assistant Planner, we responded to the decision regarding the sign height and location. See attached letter of October 30, 2009. We are asking for your consideration in allowing our group of property owners to place our new sign at the same location relative to the curb as the current hospital sign. The hospital sign is placed at approx 19'-2" off the curb line, yet your email of yesterday indicates the Valley Medical sign would require a 15' setback from the property line (approx 23' off the curb line). This letter is to request reconsideration of the decision, on the grounds that there were misrepresentations of fact, and also that there was material evidence not readily discoverable prior to the decision. 1. 400 S. 38' Ct Is also off -premise. There is no existing multi -tenant "medical office park" as described in the report. This would imply a single contiguous property. The application is for 3721 Talbot Road S, parcel number 3023059054, owned by Seafirst Bank 1 REIS. This was the only parcel shown as affected in the application and report. There is only one building on that parcel. There is a separate parcel located across the street at 400 S. 38th Ct, parcel number 3023059110, owned by Daniel N. O'Brien, DDS. These two properties are under separate ownership, are located on opposite sides of a public road, with separate entrances. There is no indication that these two properties legally constitute a single "multi -tenant medical office park" despite the existing sign. The Decision correctly requires the removal of the "350" address because it is considered off -premise. However the facts show that 400 S. 38th Ct is also off -premise, and therefore the "400" address must also be removed from the proposed sign. (The existing sign would appear to be an improper off -premise sign for the businesses at 400 S. 38' Ct. The circumstances of its original approval are unknown, and I have no objection to the existing sign being retained.) 2. Identity of Client l Misrepresentations by Applicant. The variance request identifies the applicant as The Sign Factory and the owner as Seafirst Bank, implying that the client (the purchaser of the sign) is Seafirst Bank. However, the evidence appears to show that the actual client is Valley View Professional, the owners of parcel number 3023059111 located at 350 S. 38'" Ct. Exhibit 5 of the report consists of a drawing of the proposed sign from The Sign Factory, at the bottom of which is a tiny hard -to -read legend with the Job Name and Address shown as "Valley View Professional Offices, 360 S. 380' Court, Renton, WA". Although forced to show the "350" address in the drawing, the applicant otherwise appeared to do everything possible to hide the fact that the sign was commissioned for an off -premises client, in violation of applicable code. This is all highly suspicious. Any reconsideration or appeal by the applicant should take into consideration this apparent attempt to mislead the City. Page 2 Changes to Site After Inspection by City. In determining the "minimum variance that will accomplish the desired purpose," the City specifically took into account "the visibility issues caused by the trees" and the "screening provided by the existing vegetation" when granting the setback of 5 -feet. However, at some time after the site was inspected by City staff, and presumably unknown to the City, the trees and vegetation on the site were drastically cut back and reduced, with all vegetation and branches removed from ground level up to a height of perhaps 15-20 feet, giving a clear unobstructed view well into the side yard and the building. Therefore the 5 -foot setback Is no longer the "minimum variance that will accomplish the desired purpose". The City is urged to revisit the site to reevaluate the setback requirements in light of the new information. If a variance is indeed necessary, it does not appear that a setback any less than the existing sign's 9.5 -foot setback is warranted. The retention or removal of vegetation is at the discretion of the owner (unless otherwise prohibited by code). The variance specifically stated that "No landscaping improvements proposed." By citing the existence of obstructing vegetation in its variance request, and that no improvements were proposed, the owner effectively committed to retain that vegetation. The subsequent removal of the vegetation constitutes a misrepresentation of the original application. Also, and arguably more importantly, the report stated the vegetation affected visibility of the building, and not the visibility of the proposed sign. In terms of the affect of vegetation; the change in setback makes absolutely no difference in the visibility of the sign from the road. There are no physical features or visibility issues affecting the sign that would justify a setback any less than the existing 9.5 feet. I respectfully request the City to reconsider its decision based on the facts outlined above, and to deny both the variance request and the sign permit. The original 3 -tenant sign, and the tentatively approved two -tenant sign should be reduced to a sign appropriate for the single on - premise tenant. Any request for setback variance should be resubmitted, if desired by the owner, or at the very least the Decision should be reconsidered on the basis of the current condition of the site. Given the apparent deceptions and misrepresentations related to this application, the City should require submittal and approval of all wording on the sign, to ensure an off -premise sign is not erected. The applicant also submitted a map and photographs of similar signs within the same zoning and vicinity that have setbacks less than the permitted 15 -feet [Exhibit 3a/3b]. Staff concurs that meeting the 15 -foot setback would deprive the subject property owner of rights and privileges enjoyed by other property owners in a similar location and zoning designation. b. Staff has reviewed the applicant's proposal to reduce the setback from 15 -feet to 3 -feet has determined it would be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and the zone in which the property is situated based on the scale of the proposed sign. The proposed sign of 16 -feet in height would be one of the tallest signs north of Carr Road S and almost three times the height of the current sign of 5.5 feet. Although the proposed 16 -foot tall sign would be permitted if it adhered to the standard 15 -foot setback within the CO zoning designation, but 16 -foot height of the sign would not be in scale with the surrounding residential neighborhood. Staff recommends as a condition of approval that the sign be reduced in height to 10 -feet to reduce the scale and bulk. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that due to the proximity of other signs of similar quality, size and setback location [Exhibit 3a/3b] would be similar to the proposed sign and location, the applicant'contends that approval of the proposed setback variance would not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zoning designation. Staff concurs that the granting of the variance would not constitute a grant of special privilege inconsistent with other incidences of similar nature within the same zoning designation and vicinity, except the proposal will display "350" from 350 S 381h Court [Exhibit 4] on the sign that is not part of the medical office park development. The inclusion of the address would result in a portion of the sign be considered off -premise, which is prohibited by the sign regulations. Staff recommends as a condition of approval that the "350" portion of the display be removed from the proposed signage. d. That the approval as determined by the Planning Director is a minimum variance that will accomplish the desired purpose: The applicant contends the reduction of the side yard along a street setback from 15 feet to 3 feet would be the minimum required to locate the sign in the same view location as the similar signs within the surrounding area. Staff reviewed the variance request and concludes that 3 -foot side yard along a street setback for the proposed sign would not be the minimum required variance to enjoy the same privileges as other similar signs in vicinity. The applicant submitted photographs and approximated setbacks for seven other similar signs within the vicinity. The setbacks of the signs, referenced in Exhibit 3a/3b, range from less than 1 foot to 13 -feet. The average setback for all of the signs would be approximately 5 -feet based on the submitted information. After reviewing the photographs from Exhibit 3a/3b and the surrounding features such as vegetation, proximity to the sidewalk and street, and other items that may impede the visibility of the signs, Staff concludes that the four signs [#2, 5, 6, and 7 from Exhibit 3a/3b] with a Setback of 4 -feet or less had physical features that prevent the signs from being located further away from the property line. The existing sign most similar to the proposed sign's situation is #3 from Exhibit 3a/3b. This sign has similar visibility issues caused by the surrounding vegetation, but the surrounding physical environment does not restrict the placement of the sign as those signs from Exhibit 3a/3b with setbacks less than 4 feet. The setback for sign #3 from Exhibit 3a/3b is approximately 5 feet. F. CONCLUSIONS: 1. The subject site is located at 3721 Talbot Road S, within the Commercial Office (CO) zoning designation. 2. The side yard setback along a street requirement for the Commercial Office zoning designation is 15 -feet for buildings less than 25 -feet in height [RMC 4-2-12013]. Sign code regulations also allow ground signs of six -feet or less in height to be located within the front yard setback [RMC 4-4-100L]. The applicant requests a setback variance to allow a 16 -foot high sign, a setback of only 3 feet within the side yard along a street, when the development standards permit a 15 - foot setback. 3. Due to the location and screening of the structures within the medical office park and the presence of other signs of similar size and setback, Staff concludes that two out of four variance criteria have been met. The two variance criteria from Section E that were not met are "b." — the variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is situated and "d." - the minimum variance required to accomplish the desired purpose. The bulk and height of the proposed 16 -foot tall sign would not be in scale with the surrounding residential neighborhood. Staff recommends that the sign be reduced from the proposed 16 -feet in height to 10 -feet in order to fit the residential surroundings. The applicant submitted an inventory of similar signs within the same vicinity and zoning designation. Based on the average setback of 5 feet for the seven signs along a street is 5 -feet and on the analysis of the surrounding signs within the same zoning designation, Staff recommends that the minimum setback to meet the desired purpose of attaining a higher visibility within an area that has sight limitations caused by the surrounding vegetation would be a setback of 5 -feet. The proposed sign has three tenant addresses listed. One of these tenants is not part of the medical park complex and must be removed from the sign because off premise signs are prohibited [RMC4-4-100C.10]. G. DECISION: The Administrative Variance(s) for the East Valley Medical Sign Variance, File No. LUA09-107, V-A, is approved and is subject to the following conditions: 1. Details of the permit and variance were not available; this objection assumes the new sign will be adjacent to Talbot Rd S. in the approximate location of the existing sign. Any location on the north side of S. 38'x' Ct. is specifically objected to as being outside the affected zone shown in the Notice of Application. The variance request seeks approval to erect a 16 foot tall sign with a three-foot setback versus the required 15 feet. The basis of this objection is threefold: (1) There is no apparent valid reason for the variance, (2) The extreme height of the sign, especially when combined with the reduced setback, is inappropriate to the surrounding area, and (3) there are reasons to suspect the sign is unrelated to the address given in the Notice of Application, but is instead related to 350 S. 38t Ct.. 1. Setback Variance Not Required (a) No obstruction. There is an existing sign at 3721 Talbot Rd. S. That sign is set back approximately 9.5 feet from the sidewalk. It stands 6 feet tall, plus a slight rise in ground Ievel elevation from the sidewalk. The sign is 5 feet wide. There is adequate space to erect a replacement sign in the vicinity of the existing sign. Apparently the variance request states that existing electrical or utility installations justify the setback variance, however the only such installations that are apparent are located over 20 feet to the south of the existing sign, farther from the corner where the existing sign is located (and the logical place for the new sign), and are located close to the sidewalk. (See Figure 1.) There does not appear to be any interference in the required setback area that would require placement nearer the sidewalk. No encroachment into the prohibited setback area is necessary or justified, therefore the variance request should be denied. (b) Burden on Requester. The party requesting the variance has the burden to show significant harm in the absence of the variance. The burden is not on the public to show why it would be harmed by granting of the variance. Given the fact there is an existing, perfectly adequate sign that is set back approximately 9.5 feet from the sidewalk, there appears no valid reason a setback of a mere 3 feet is necessary, especially given the enormous height of the new Page 2 sign. It appears the applicant merely wishes to place the sign as close to the sidewalk as possible. The variance request should therefore be denied. 2. Relation to immediate Surroundings According to the sign code, "Signs should complement and characterize the environment which they serve to give their respective areas a unique and pleasing quality." (a) Separation from Nearby Commercial Zone. Although located in a commercial zone, the affected location is bounded on the north by a park -like, grass -covered lot (beyond which is a residential zone); on the east by a residential zone, and on the south by the Panther Creek watershed/ green space. The affected area is not contiguous with the dense commercial zone to the south of Panther Creek, i.e. the Valley Medical Center complex on the west side of Talbot and the dense medical/ dental commercial zone on the east side of Talbot (which ends at Panther Creek). The small, isolated commercial zone north of Panther Creek is clearly a transition zone between the dense commercial zone to the south and the residential zone to the north and east. The small existing sign at 3721 Talbot Rd. S. is the only permanent commercial sign along Talbot within approximately 125 yards. In fact, the existing sign is practically the only indication the area is a commercial zone - the actual building at that address is low-level and hidden in the trees, while the commercial building to the northwest is residential in character and fronted by park -like open space, including a picnic table. The new commercial building farther to the west, adjacent to S. 37" St., is barely visible from Talbot. S. A personal visit, or virtual visit using Google Maps street level view, will confirm this area is isolated from the VMC complex and has an open, natural character. (b) Comparison to Other Nearby Signs It is possible the applicant might justify both its sign permit application and variance request on the grounds of "fairness," citing other signs in the area. In fact, a 16' tall sign would be the tallest sign along Talbot north of Carr Road. The only signs of comparable height along Talbot are two 16' signs at the major entrances of the huge Valley Medical Center complex, both of which are well set back, the northernmost of which is opposite 5.177' St, some 170 yards from the proposed sign. These signs are appropriate for the huge VMC complex. The applicant's existing 6' sign at 3721 Talbot Rd. S. is the only sign along Talbot in the isolated zone north of the Panther Creek greenbelt. The nearest permanent commercial signs of any type are located some 125 yards to the south. One is a very small sign, 4'8" tail, associated with the dense VMC complex. The other is across the street to the east, a 6' tall sign, well set back. Farther south, directly opposite the VMC complex on the east side of Talbot, are two signs with very little setback, one 11' tall and the other 13' tall (the Lomax sign). These signs are all part of the dense medical/ commercial zone on both sides of Talbot between Carr Rd and the Panther Creek greenbelt. The proposed sign would be isolated, but as tall or taller than - and with less setback - than the VMC entrance signs. Such a tall sign would be completely out of proportion to the related business structure and inappropriate for the immediate park -like vicinity. A lighted sign would be even worse (the existing sign is not lighted). The sign permit and variance request should therefore be denied. Page 3 3. Purpose of Sign There is reason to suspect that the proposed sign is not solely related to 3721 Talbot Rd. S, or indeed related at all. That building/ business has an existing sign, in good condition, appropriate in size to the building --a huge new sign would seem an unnecessary expense given the current state of the economy. There is, however, a brand-rzew WWI sign located at the west end of S. 38`x' Ct, specifically 350 S. 38`h Ct. That new sign, and the new commercial building at that address, are difficult to see from the main road, Talbot. One can imagine without much difficulty that the owners would very much like to place a companion (identical ?)16' tall sign at the corner of Talbot and S. 38`h Ct. The sign permit and variance request should be denied for the reasons stated above, but in- any case should be denied or placed on hold until the sign's true purpose is ascertained, and is found to be compliant with applicable regulations. Summary The City of Renton has established codes and regulations for signs, covering, among other things, their size, design, esthetics, construction and placement. A sign permit has been submitted, along with a request to waive part of the code. The applicant seeks permission to replace (apparently) an existing 6 -foot tall sign with one nearly three times as tall, and place it with a setback of only three feet, versus the required 15 feet - in a leafy, park -like setting immediately adjacent to residential areas. A 16 -foot sign is far too tall and would ruin the sightlines across the vacant space between S. 38`h Ct. and S. 37" St. Such a large sign is completely out of character to the area, and there is no justification for requiring a variance to the setback requirements. Recently, the East Valley Medical Park has added a significant new medical building which will bring the medical park up to comparable standard of the immediate Valley Medical Hospital campus. The planting strip in front of the medical park is badly in need of pruning and clean up in order to provide visibility For the patients looking for the medical park and to allow proper signage. The sign proposed .in consistent. with the .type of signs that are ' existing in front of the medical campus on both sides of Talbot road. In fact, the signs near the hospital are considerably larger than those proposed for the East Valley Medical Park. As part of the improved signage there will be a significant landscape clean up and pruning of the existing landscaping. This will upgrade the'appearance for the medical park as well as enhance the appearance for the neighboring structures.
