We have been conducting additional title search and working with our legal counsel. It appears that it will be necessary to obtain a new easement from the neighboring land owners order to satisfy your requirement. This file was assigned to me for completion in early February 2009 and that is when I noticed that supporting documents are needed to confirm legal access to the new lots. Therefore I made an attempt to bring it to your attention as soon as possible. We regret that the easement issue regarding this project was not fully addressed earlier. However, it is important that this issue be resolved prior to the preliminary approval ofthis short subdivision, thus preventing delay during the final review and recording of the lots. Fram what was discussed at .our meeting, it appears that there cauld be same benefits ta apply under Rentan's cade vs. King Caunty.'Hawever, there are a cauple .of key issues that questians that I hape yau can help me with naw. 1. Raad Width: In my past research inta the City's regulatians, it was my understanding the raad serving the plat needs ta be wider than the prapased 30' width allawed under Caunty regulatians. If this is true, what is the requirement and wauld a variance be needed? Please camment. 2. Plat Recording: Will the City require that all plat impravements be made priar ta recarding .of the plat? With a sufficient band in place, the Caunty will allaw the plat ta be recarding priar ta completing the improvements. We discussed this at the meeting and Jennifer wasn't sure .of the answer. Points discussed were: o In order to proceed with processing the project under King County regulations approximately 48 hours of work by the City of Renton would be necessary. Such work would be billed at $140/hour. Approximately 48 hours of work are estimated which would ~otal $6,720.00 (16 hours for Development Services and 32 hours for Planning). o King County accepted the project as a short plat. KC interprets State Subdivision statutes differently than the City of Renton and does not count tracts in the total number of lots. There are 9 residential lots and 4 tracts proposed as part of the project. The City of Renton considers this as a 13-lot project and, therefore, it is a preliminary plat. o In the City of Renton all preliminary plats require a public hearing before the Hearing Examiner. o Even though the proposed project site contains a wetland buffer area, KC did not require environmental {SEPAl review. This proposed project requires SEPA review within the City of Renton. In order to proceed with processing an Environmental Checklist must be submitted. o An updated Preliminary Drainage Report (TIR) is necessary (detention/retention will be a requirement). o A geotechnical report will be required. Gary Watts said that he has a geotech report. o Updated Soos Creek Certificates of Water and Sewer Availability will be required. o It was suggested to Gary Watts that he may want to refile the proposed project as an application for a preliminary plat using the City of Renton regulations and procedures. The filing fee for a preliminary plat application is $4,000.00 and the environmental review fee is $1,000.00 for a total of $5,000.00 plus a 3% Technology Surcharge Fee. The timeframe for processing the preliminary plat and environmental review would be approximately 10 to 12 weeks. o It appears that there may be enough net area on the proposed project site to accommodate 9 residential lots in City of Renton R-8 zoning. A density worksheet was provided to Gary Watts in order to calculate net project density. o While KC requirements do not preclude development of 9-lots on a private street, City of Renton regulations do not allow that number of lots on private street. Therefore, public street dedication would be required and would involve street improvements to the complete streets requirements. o Fire Department access must also be taken into account. o Gary Watts mentioned that use/development of the access easement on the east side of the subject site is problematic since those property owners have not granted development rights. This issue must be resolved whether the proposed project proceeds using KC or City of Renton' regulations .. o It was suggested that Gary Watts may want to prepare drawings which would more closely reflect City of Renton regulations in order to apply for a pre-application meeting. Such drawings do not have to be engineered drawings. The existing gravel road access is in private road easements. A thirty-foot public road easement extends from Illth Place SE to the northwest comer of the proposed short plat. However, several wetlands within the easement area block any road connection. To the west of the public easement is a tract owned by King CoWlty as access to a pond. The tract also is encumbered with private access easements and the easement holders will not permit a road within the tract. 3. The existing private gravel road will be improved to a KCRS minor acceIIS road classification.
