Per City Code, the applicant shall apply for the obtainment of an Additional Animals Permit [RMC 4-9-100] to allow for the extra animals beyond those permitted by the Code. The Code permits 3 household pets, 3 small lot domestic, and 2 large lot domestic animals without an Additional Animals Permit if lot size requirements are met. The facilities for the animals would be located within the southwest portion of the property behind the primary residence. There is a perimeter fence around the entire enclosure. The animal facilities include an existing 512 square foot outbuilding, a chicken house which is a 60 square foot covered area enclosed by chicken wire, a 100 square foot covered stall for the goats, a 180 square foot roofed structure for protection of the animals during inclement weather, a 380 square foot pole and tarp enclosure for the caged rabbits, and a 2,400 square foot open area for the goats and chickens to roam for exercise. DECISION CRITERIA COMMENTS: [the bullet number below corresponds to the Decision Criteria number above] 1. Two comment letters were received concerning the impact of the animals on the neighborhood. The major complaint stated in the letters was odor. A neighbor to the southwest commented that they kept their windows closed to avoid the odor. One letter suggested that an outdoor compost pile was compounding the odor problem. Allergens from the animals were cited as a health concern. Other concerns expressed were loose chickens causing damage to landscaping, the animals attracting predators such as coyotes and raccoons, and diminished property values due to the animals' odor. During the site inspection, the Animal Control officer noticed a slight farm smell in the air from the animals. 2. The Animal Control officer noted a complaint from a neighbor of chickens getting loose and odor on hot days. 3. The goats are classified as Large Lot Domestic Animals. The minimum lot requirement for permitting Large Lot Domestic Animals is 43,560 square feet. The goats are not permitted because they do not meet the minimum lot requirements and would be required to be removed. The Animal Control Inspection reports that the animals are well taken care of and approved the inspection. 4. No, the goats are classified as Large Lot Domestic Animals by the City of Renton. The minimum lot requirement for permitting Large Lot Domestic Animals is 43,560 square feet. The goats are not permitted because the lot does not meet the minimum lot requirements. These goats were purchased when the subject property resided within unincorporated King County. The applicant submitted information detailing purchase of 2 goats and 25 chickens in March of 2007. The applicant would have to show sufficient documentation· that the animals were legally established within unincorporated King County to allow the animals to be classified legal non-conforming by the City. 5. The comment letters suggests that the odor from the compost pile added to the smell coming from the animals. The Animal Control Report states that there are adequate provision made for the removal of animal waste and food waste so that the area is kept free from infestation of rodents obnoxious or foul odors are prevented. 6. The subject property is located within the Residential-8 (R-8) zoning designation. The minimum lot size for this zoning designation is 5,000 square feet for parcels 1 acre in size or less. The subject parcel is 15,142 square feet, which is more than 3 times the required lot size for this zoning designation. The total area dedicated to the animals is approximately 3,600 square feet in size with approximately 1,200 square feet contain in covered structures and approximately 2,400 square feet of outdoor free roam area. There is adequate space to allow the animals to live in a healthy environment, but the types of animals (goats, rabbits, and chickens) are not suitable for the R-8 zoning · designation in the numbers that the applicant is proposing. The intent of the R-8 zoning design is to create opportunities for new single family residential neighborhoods and to facilitate high-quality infill development that promotes reinvestment in existing single family neighborhoods. The applicant's proposal best fits a zoning designation that serves as a transition between rural designations and higher density zones such as the Residential-4 (R-4) zoning designation. 7. The applicant did not provide copy of an adopted farm management plan based on the King County Conservation District's Farm Conservation and Practice Standards. 9. The shelter for the rabbits is located within 10 feet of the east property line. All animal shelters shall be located at least 10 from any property line [RMC 4-4-0lOG.l]. The open run area for the animals is located south of the primary residence and the animal shelters in between the east and west property lines. The east property line fence is not an adequate barrier. Photographs of chickens wandering outside the ani_mals' enclosure were provided within the comment letters. The same comment letter describing the chickens' destructive behavior to the surrounding properties' landscaping. 11. The Animal Control Inspection report approves the condition in which the animals are kept, but the odor and loose chickens have proven to be a nuisance to the neighbors, especially the neighbor to the southeast, who have difficulties with the odor and allergens produced by the animals which restricts them froin enjoying the use of their property. CONCLUSION: Although Animal Control approved the inspection of the animals' living conditions, the animals' impacts and intensity of use on the surrounding neighborhood are detrimental to the neighbors' welfare. The neighbors' concerns are detailed within the submitted comment letters. The concerns include issues with odor, allergens, loose animals, noise, property damage, and reduction in property value due to the odor. Because of the impact on the surrounding neighborhood, Staff recommends that the number of outdoor animals be reduced to the permitted number allowed by City Code. The 1 dog and 3 birds do not impact the surrounding neighborhood, and are not mentioned as concerning the neighbors in a negative way; therefore staff recommends that the indoor animals be permitted to remain on the subject property. The application also does not meet the General Standards for .Keeping Animals. Shelter locations and animal pens shall be located a minimum of 10 feet from any property line. The rabbit enclosure appears to be within ten feet of the southeast property line. Also, City Code requires that all animals shall be kept and maintained in a manner which confines their movement and activity to the premises of the owner. During a Staff visit, a Staff member took a picture of one of the applicant's chickens on top of the perimeter fence, and outside of the property. Also a neighbor submitted photographs of loose chickens in the immediate neighborhood. The perimeter has shown to be unable to confine the chickens to the property. Staff recommends that the applicant rebuild/repair the perimeter fence to a height of 6 feet to adequately confine the chickens on the property. DECISION: The Holliday Additional Animals Permit is partially approved subject to the following conditions: 1. The goats are not permitted and shall be removed from the property. The applicant has 60 days to remove the animals from the property from the date of this decision. 2. The applicant shall rebuild/repair the perimeter fence to a minimum height of 6 feet in order to adequately confine the animals to the applicant's property. The applicant shall schedule an inspection of the property with City of Renton Code Compliance by calling the Code Compliance Hotline [425-430-7373] within 90 days to verify that all of the conditions have been met. Renton, Washington 98055 253-217-1501 To: Renton City Planning Board In the Fall of 2006 at age 61, I was a distributor of framed art to furniture stores in Washington State. Unfortunate for me, retirement came early because of the sale of business by my wholesale supplier in Coeur d' Alene, Idaho. Not being eligible for Social Security for yet more than a year, I decided to begin raising rabbits as a table fare and as a supplemental income. Concurrently to raise chickens for eggs and table fare, we undertook to develop the 4000 or so square feet of overgrown land at the South end of our property. At the time it had been overgrown primarily by Himalayan blackberries and of no use to us for recreation, agriculture or animal husbandry. Most of my searching for and success in acquiring breeding stock rabbits transpired via Craigslist contacts and subsequent purchases. Not being able to find the breed I sought West of the Cascades, namely New Zealand and California rabbits, I was able to make contact with three breeders in the Spokane area during the Winter of 2007. Unlike horses or cattle which require "bills of sale" and other certifications, my transactions with individuals for rabbits was for cash, and a hand shake. Similarly via Craigslist, I had acquired a pick-up load of cages to house them. Nutritionally, rabbits are very healthy. The breeds I raise are ready for table in 10 to 12 weeks. Rabbits will not make me a fortune. Using the same vehicle, Craigslist, I have been able to provide pets to individuals, often children in families, pets to 4H individuals, breeding stock to individuals interested in raising rabbits, and occasionally sell at the Enumclaw Livestock Auction on Saturdays. • Laureen M. I. This property and the animals at 19405-104th Avenue S.E. is located just 35 feet from our house at 19409-I04th Avenue S.E. Therefore we smell all the objectional and obnoxious fumes coming from the animals and chickens waste products. 2. The stench from the rabbits is so bad we are limited in the use of our property, house and yard. We can't open our windows to get fresh air because the animal odors come into our house. We can't enjoy social events or eating outdoors because of the smell. During the hot summer weather the strong smell of urine made us sick. Our visitors As soon as they leave their cars they complain about the smell. 3. Goats and rabbits create serious allergens. There is no grassy or vegatation area just barren ground. 6. WHERE'S THE HUMANITY? 67 rabbits cooped up in crowded cages sitting in Their waste. Their shelter a open tent with easy accessibility by rats and other Predators. Since the arrival of the rabbits we've seen coyotes, several raccoons and Rats in our yard next to the rabbit tent. 7. WHERE'S THE HUMANITY? The chickens are not kept in a manner that confines Their movement., We've seen the chickens upon the streets where they could get Killed. We strongly object to any FOR-PROFIT VENTURE as this is a residential area In the City of Renton. There are two families occupying the residence at l 9405- l 04th Avenue S.E. Their parking area is filled with a large camper, boat and traveler, another very large trailer, truck and several cars. Our point and concern is businesses create more traffic, noise and safety issues and our property will become a parking lot. It has already occurred. 9. Having a smelly farm business in our community will devalueate our property and Make it very difficult to sell our homes. To: IonArai Re: Holliday Additional Animals Permit/LUA09-121, AAP Please do not allow any more animals than the city ordinance normally allows! I am concerned about the effects of this furm on such a small lot, especially by the health hazards that are already present because of the animals that are housed on the Holliday property. I have seen a coyote twice from my window, heading toward the furm, drawn by the chickens. But if there are no chickens outside for them to eat, they will eat just as happily any small cat or dog that may come by. And Priscilla Witters, in the house next door to the southeast, has seen 5 raccoons crossing her yard to get to the Holliday farm, and several rats which were never there before the animals came. Priscilla and her husband, who is hattling cancer, are elderly and have suffered a lot from the terrible smell coming from the property. She has asthma and is allergic to rabbit fur. Furthermore, their house is right next door to the farm. As the Witters' house is at the bottom of a high ridge on their south, there is very little air circulation to move out the fumes from the area, as the prevailing winds come from the southwest. This summer was particularly had for them and for the Willmore's (to the west of the farm) because of the stifling heat magnifying the offensive odor. Both of these families have had to leave their windows closed all summer because the smell was worse than the heat. I could smell it when I have gone to the mailboxes near the farm to get my mai~ and it is dreadful. Come and smell it for yourself if you can. Maria told me that they keep the manure from the animals and compost it for their garden. So it is not just the fresh daily manure, but the rotting stuff that may be making things worse. At first there were two goats, but Maria told me that they got rid of the billy goat because it was mean. The result was the nanny goat bleating all day long because it was lonely, until a kid was born. There have been up to 4 goats there at the same time. Maria leaves the chickens out during the day to roam the neighborhood, which presents another problem: chickens are very destructive to flower beds, as they scratch for their food to turn up worms and seeds. Another problem is the terrible noise that the newly mature young roosters make. All day long, starting at 4:30am this spring there were 5 new roosters crowing all day, waking the neighbors even with the windows shut. Finally, how could the Witters hope to sell their property so as to move, with such an undesirable situation present nearly in their front yard? Old sick folks should not have so much to worry about. I have tried to the best of my ability to submit the required site plan drawing. I have also included a description page defining the areas by number with their function. I have include a 'bird's-eye' view of the property to give you an idea of the layout of the land as well as a blow up of the king county map with the property dimensions. The driveways are visible as well as the streets. We have no sidewalks in the area. The area that we use to house the goats and chickens was a pre-existing building. We built the pole and tarp construction for the rabbit housing. We have had our small farm since 2006 after my husband retired. He keeps the rabbits for hobby and extra income . The number of adult rabbits are 18, and the additional number are young ones ear marked for sale at the Enumclaw Auction, or to private parties for pets and 4H purposes. Our twenty eight chickens are for eggs. We do not have any roosters, just hens. They supply ourselves and our extended family, three daughters, sons in laws and 6 grandchildren with healthy fresh eggs. Each chicken has a name, courtesy of the grandchildren. The two goats supply our family with milk and milk products and keep the blackberries which grow in the neighboring property at a distance from our fence line. The entire fenced area of our property before we had the goats was covered with blackberries and we were not able to keep them under control. The more we trimmed them the better they grew! The use of this portion of our property was lost to us due to the overgrowth. By permission of the neighboring property owner we cleared a 25' by 85' area on his property that the goats browse in and keep the vegetation managed. They are also fed grains and hay. Everyday, I hand pick manure from the chicken and goat areas and place it into empty feed sacks that are removed from the enclosure and disposed of or placed into our garden bed and rototilled into the earth. There is very little smell from the animals as we keep .. ' ·-· them very clean and well cared for. The rabbit area is routinely cleaned as well, but not on a daily basis. When we had the animal control agent respond due to a complaint of 'odor' it was shortly after the hottest part of the summer and we had been misting the rabbits with water to keep them cool. The additional water along with the abnormally high temperatures, I believe, was composting the hay along with rabbit droppings under the rabbit cages and creating an 'odor' which is not normally present. Our very small dog lives most of his life inside or on a leash when outdoors. The birds are caged inside as well. Please feel free to call me if you have further questions. This portion of his property is not flat but more like a shallow canyon with a year round drainage going down the middle that encourages blackberries to grow profusely. No one maintains this area.
