Box 84608 Lincoln NE 68501 4608 RE: A09-001: Request for a Shoreline Exemption for BNSF bridge replacement project Dear Mr. Strahrn: The City of Tukwila has reviewed your request for an exemption from a Shoreline Substantial Development Permit for the proposal to replace the existing Burlington Northern Santa Fe (BNSF) Bridge 9.71 that spans the old Black River channel a right bank tributary to the Green River. BACKGROUND: The existing bridge is an I I span, 173 ft long Ballast Deck Trestle bridge and is structurally deficient and needs to be replaced. The proposal is to replace it with a 7 span 204 ft long Prestressed Concrete Double Cell Box Girder bridge. The bridge is proposed to be replaced using on -track equipment with no equipment within the Black River channel. An on -track crane will drive the new h -piles through the existing bridge and set the concrete caps. Then the existing timber bridge will be removed and the new concrete spans will be placed on top of the concrete caps. An on -track backhoe will excavate approximately 400 cubic yards between the existing abutments and the proposed abutments. Existing timber will be cut off at or below the existing ground line. SEPA EXEMPTION: You had indicated that the project is exempt from State Environmental Policy Act (SEPA) under WAC 197-11-800 (3), "Repair, remodeling and maintenance activities: The following activities shall be categorically exempt: The repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt (examples include repair or replacement of piling, ramps, floats, or mooring buoys, or minor repair, alteration, or maintenance of docks). The following maintenance activities shall not be considered exempt under this subsection: (a) Dredging; (b) Reconstruction/maintenance of groins and similar shoreline protection structures; or (c) Replacement of utility cables that must be buried under the surface of the bedlands. Upon review of the proposed project and WAC 197-11-500(3) it was determined that replacement of the bridge including the replacement of pilings over the River is categorically exempt. SHORELINE EXEMPTION: After a review of the application materials, we concur that the proposed project qualifies for a Shoreline Exemption under WAC 173-27-040(2) (b), "Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment"_ OTHER PERMITS: This exemption from the permit process does not relieve you of the requirement to comply with the Shoreline Management Act, local Shoreline Master Program or sediment control Best Management Practices. All construction shall be consistent with the policies of Chapter 90.58 RCW and Tukwila's Shoreline Master Program. In order to show compliance with Tukwila's Shoreline Management Act, restoration of the disturbed area shall include planting of native plants. The planting plan shall be reviewed as part of the Public Works (PW) construction permit. PW permit application is available online at htt://www.ci.tukwila.wa.us/dc&q s/PublicWorksPermitA lication. df. The fee shall be $250 plus s of cut). Additional fees will be determined based on the construction cost grading volume (cubic yard estimate. The fee estimate worksheet is available at htt://ww-w./)ulletins/A02. df Please note that there may be other permits required from various state and federal agencies including but not limited to Hydraulic Project Approval (HPA) from Washington State Department of Fish and Wildlife; and Aquatic Crossing Permit from Department of Natural Resources. It is possible that BNSF may already have an Aquatic Crossing Permit however the proposed work may trigger an update and/or amendment to the existing permit. You can contact Taylor Kaech at 360-802-7050 for further information regarding Aquatic Crossing Permit. Also, you should contact Washington State Department of Ecology and US Army Corps of Engineers for any permit requirements from them. Additionally, you should contact Muckleshoot and the Duwamish Indian Tribe to address any concerns they may have regarding impacts to archaeological resources. Tukwila Municipal Code TMC 18.50.110 lists city code requirements that apply if excavations are planned into historically native soils in an area of archaeological potential. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment; Construction or repair of protec#ive bulkhead for single-family residence. Construction of the normal protective bulkhead common to single-family residences. A "normal protective" bulkhead includes those structural and nonstructural developments installed at or near, and parallel to, the ordinary high water mark for the sole purpose of protecting an existing single-family residence and appurtenant structures from loss or damage by erosion. A normal protective bulkhead is not exempt if constructed for the purpose of creating dry land_ When a vertical or near vertical wall is being constructed or reconstructed, not more than one cubic yard of fill per one foot of wall may be used as backfill. When an existing bulkhead is being repaired by construction of a vertical wall fronting the existing wall, it shall be constructed no further waterward of the existing bulkhead than is necessary for construction of new footings. When a bulkhead has deteriorated such that an ordinary high water mark has been established by the presence and action of water landward of the bulkhead then the replacement bulkhead must be located at or near the actual ordinary high water mark. Beach nourishment and bioengineered erosion control projects may be considered a normal protective bulkhead when any structural elements are consistent with the above requirements and when the project has been approved by the department of fish and wildlife. An "emergency" is an unanticipated and imminent threat to public health, safety, or the environment which requires;mmediate action within a time too short to allow full compliance with this chapter. Emergency construction does not include development of new permanent protective structures where none previously existed. Where new protective structures are deemed by the administrator to be the appropriate means to address the emergency situation, upon abatement of the emergency situation the new structure shall be removed or any permit which would have been required, absent an emergency, pursuant to chapter 90.58 RCW, these regulations, or the local master program, obtained_ All emergency construction shall be consistent with the policies of chapter 90.58 RCW and the local master program. A feedlot shall be an enclosure orfacility used or capable of being used for feeding livestock hay, grain, silage, or other livestock feed, but shall not include land for growing crops or vegetation for livestock feeding and/or grazing, nor shall it include normal livestock wintering operations; 6 Construction or modification authorized by Coast Guard or desi nated authority. Construction or modification, by or under the authority of the Coast Guard or a designated port management authority, of navigational aids such as channel markers and anchor buoys; 7 Construction of a single-family residence for use by owner or owner's family- Construction amilyConstruction on shorelands by an owner, lessee or contract purchaser of a single-family residence for their own use or for the use of their family, which residence does not exceed a height of thirty-five feet above average grade level and which meets all requirements of the state agency or local government having jurisdiction thereof. "Single-family residence" means a detached dwelling designed for and occupied by one family including those structures and developments within a contiguous ownership which are a normal appurtenance. An "appurtenance" is necessarily connected to the use and enjoyment of a single-family residence and is located landward of the ordinary high water mark and the perimeter of a wetland. On a statewide basis, normal appurtenances include a garage; deck; driveway; utilities; fences; installation of a septic tank and drainfield and grading which does not exceed two hundred fifty cubic yards and which does not involve placement of fill in any wetland or waterward of the ordinary high water mark. Local circumstances may dictate additional interpretations of normal appurtenances which shall be set forth and regulated within the applicable master program. Construction authorized under this exemption shall be located landward of the ordinary high water mark; a Construction of a private dock for non-commercial use by property owner(s). Construction of a dock, including a community dock, designed for pleasure craft only, for the private noncommercial use of the owners, lessee, or contract purchaser of a single-family and multiple -family residences. This exception applies if either; (i) In salt waters, the fair market value of the dock does not exceed two thousand five hundred dollars; or (ii) In fresh waters, the fair market value of the dock does not exceed ten thousand dollars. However, if subsequent construction having a fair market value exceeding two thousand five hundred dollars occurs within five years of completion of the prior construction, the subsequent construction shall be considered a substantial development for the purpose of this chapter. No fee may be charged for accepting and processing requests for exemption for watershed restoration projects as used in this section_ (i) "Watershed restoration project" means a public or private project authorized by the sponsor of a watershed restoration plan that implements the plan or a part of the plan and consists of one or more of the following activifies: (A) A project that involves less than ten miles of streamreach, in which less than twenty-five cubic yards of sand, gravel, or soil is removed, imported, disturbed or discharged, and in which no existing vegetation is removed except as minimally necessary to facilitate additional plantings; (B) A project for the restoration of an eroded or unstable stream bank that empioys the principles of bioengineering, including limited use of rock as a stabilization only at the toe of the bank, and with primary emphasis on using native vegetation to control the erosive forces of flowing water, or (C) A project primarily designed to improve fish and wildlife habitat, remove or reduce impediments to migration of fish, or enhance the fishery resource available for use by all of the citizens of the state, provided that any structure, other than a bridge or culvert or instream habitat enhancement structure associated with the project, is less than two hundred square feet in floor area and is located above the ordinary high water mark of the stream. (ii) "Watershed restoration plan" means a plan, developed or sponsored by the department of fish and wildlife, the department of ecology, the department of natural resources, the department of transportation, a federally recognized Indian tribe acting within and pursuant to its authority, a city, a county, or a conservation district that provides a general program and implementation measures or actions for the preservation, restoration, re- creation, or enhancement of the natural resources, character, and ecology of a stream, stream segment, drainage area, or watershed for which agency and public review has been conducted pursuant to chapter 43.21 C RCW, the State Environmental Policy Act; 15 Projects intended to improve fish or wildlife _habitat_ or fish passage. A public or private project, the primary purpose of which is to improve fish or wildlife habitat or fish passage, when all of the following apply: (i) The project has been approved in writing by the department of fish and wildlife as necessary for the improvement of the habitat or passage and appropriately designed and sited to accomplish the intended purpose; (ii) The project has received hydraulic project approval by the department of fish and wildlife pursuant to chapter 75.20 RCW; and (iii) The local government has determined that the project is consistent with the local shoreline master program. C-0ocuments and SettingslctalleylLocal 5ettings9emporary Internet FileslContent.Outlook%F5BUTOVSIsme.doc - 6 - 03/0! 0 Project Narrative • Project name, size and location of site BNSF Bridge 9.71, L.S. 51 Proposed bridge will be 204 feet long, existing is 173 feet long 47°28'27.51"N latitude/122'14'59.86"W longitude (SE'/4 of Section 14, T23N, R4E) • Brief description of proposed work The purpose of the project is to replace the existing structurally deficient bridge, which is an 11 -span, 173 -ft long, Ballast Deck Pile Trestle Bridge, with 7 (5 @ 27'-10" and 2 @ 31'-10") spans of Prestressed Concrete Box Girders for a total bridge length of 204 ft. The replacement bridge is 31 ft longer than the existing bridge and was analyzed based on BNSF's intent to replace the Mainline Track 3 Bridge only, the other bridge, under mainlines 1 and 2, will remain in place. The proposed bridge will be centered over the existing bridge with the longest span (31'-10") over the channel.
