The Benson Trails subdivision project consists of a proposal to subdivide two existing parcels into 16 new residential lots. This Temporary Use Permit proposes to construct three new homes on three proposed lot locations (Lots 1, 4, and 12) in advance of the final plat approval and recording of the Benson Trails subdivision. The project site is located at 12044 SE 184' St. in Renton, Washington. The project site is composed of parcel numbers 6199600320 and 6199600282. The original project site area consists of 273,120 sf (6.27 acres). The area of the proposed lot construction totals 12,553 sf (Lot 1 = 3,405 sf, Lot 4 = 3,600 sf, and Lot 12 = 5,548 so. Currently the project site and adjacent areas are residential properties, zoned R-4. The proposed density for the new lots is 2.55 du/acre. The project site has been generally cleared in preparation for the home construction. An asphalt paved cul-de-sac and concrete curb gutter and sidewalk has already been constructed at the site. Frontage improvement construction, along SE 184' St. has also been completed for this project. Stormwater quantity and quality improvements have also already been constructed for this project. There are no additional off-site improvements proposed in conjunction with this Temporary Use Permit. The project site includes a wetland and wetland buffer area tract of 172,982 sf. The proposed construction will be located outside of the critical area buffer and the proposed buildings will maintain a minimum 15 ft building setback from the critical area tract. The location of the proposed home nearest the wetland will be a minimum of 65 ft from the nearest wetland edge. One model home has already been constructed on the property at the location of proposed Lot 13. The three new homes proposed for this Temporary Use Permit will be connected to the existing storm management system. Storm runoff from the roofs of the new homes will connect either to the constructed dispersion trench located on the home's lot, or will connect to the storm system detention vault. These storm management facilities were reviewed and approved by King County to address storm water quality and flow mitigation for the proposed project. Access to the new homes will be provided by the asphalt cul-de-sac already constructed on the project site. In conjunction with the improvements already constructed at the site, the site was cleared and graded. There is no additional clearing or significant grading proposed for the construction of the three homes. ("Owners"). Recitals The Owners own real property in the City legally described in Exhibit A, attached. The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some risk in building the model homes. In consideration of the inherent risks associated with the construction of buildings in advance of the recording of the plat, the City requires the owner to execute an indemnification agreement prior to any model home construction activities. Agreement The parties agree to the following: 1. The City authorizes the Owners to do the work as described in the Temporary Use Permit application No. once building permits have been obtained. 2. Owners understand and acknowledge that, should the model home construction not comply with the proposed lot configuration of the final plat, that no variances to development standards for either the lots or the homes may be granted as such a situation would be considered a "self-induced hardship". 5.
