See the attached letter in Red below The Boeing Company has temporarily delayed the start of the project to address these concerns. We met this morning to develop the following mitigation plan. 1. Boeing has invited the Audubon Society and United States Department of Agriculture to perform third party nesting inspections. 2. Boeing will review the nesting inspection and forward the information to the city of Renton and the concerned citizen. 1 3. It has come to my attention April 6 from some who work in the Boeing Long acres (Oakes dale Ave) building of the intent to cut 30+ columnar Maple trees (permit LUAI l 008) and replace them with Japanese or other maples starting April 9 -through mid May. 1 have cc'd Matt Mega from the Audubon Society. His input below reflects my concern, and the concerns expressed by some people who work in that building with regard to the timing of this permit. Nest-building has already started. They can sec activity in the trees near their windows. "Nesting season early March through late July is the critical time not to remove trees. Tree cutters during this time are supposed to ensure there are no nesting birds present. The removal of a nest with young or eggs is technically against Federal Law (the international migratory bird treaty act).11 In light of this information, I am requesting you amend or suspend the approved permit until nesting season is over, and bring this to Boeing's attention. I have little confidence their hired "arborist11 wilJ see any nesting birds, since they are contracted to remove said trees. We have been in contact with the Boeing Company and they are planning on completing the following to mitigate for the nesting season. 1. Boeing has invited the Audubon Society and United State Department of Agriculture to perform a third party nesting inspection. 2. Boeing will review the nesting inspection and forward the information to the City of Renton and Mr. Brittain. 3. Boeing will mark any trees and delay the removal of those trees with migratory bird nests until after the nesting season. The City has accepted the above mitigation plan to reduce impacts to migratory birds during the nesting season. Furthermore, the U.S. Department of Agriculture performed the third party inspection today, pursuant to an e-mail from Boeing (attached). The results of Aaron Loukes inspection indicated that there was no visual evidence of bird nesting. The U.S. Department of Agriculture gave Boeing the approval to remove the trees as approved by the Routine Vegetation Management Permit City file number LUAll-008. Adjacent to the North parking lot of the 25-20 Building at the Boeing Companies Longacres Park Development The 25-20 is the current BCAG headquarters Boeing proposes to remove and replace 34 Columnar Maple Trees (5o ft and higher) with new Red leave Japanese Maple Trees 8-10 ft (25ft mature) Existing trees are blocking Boeing Sign and view of entrance. This is first phase of the BCAG Customer experience route improvement project. The 2nd phase is in interior of the 25-20. Boeing will apply for any applicable permits on that phase as scope is developed. The Size of the property 153.8 acres The current use of the site is office and engineering support for Boeing Commercial Airlines as well as the BCAG executive complex and customer area. There is no near term future development at the proposed site. Tree being removed are being replaced 1 for 1, no net loss of trees in the existing parcel No Special site features in the project area Tree§existing in the parcels are 26 each Deador, and 8 Catsura, 12 Vine Maples No work is to be performed in a 'Native Growth Protection Easement' or tract The work area is flat with no slope There is no landslide potential The fill is organic mulch with no grade, distributed evenly.
