CRITICAL AREA: Buffer of unnamed tributary to Rolling Hills Creek
PROPOSAL DESCRIPTION: Temporary location of a 21,000 gallon self-contained
Baker tank (40' long x 8.5' wide) on an existing graveled service road associated with an
electric transmission line. The tank would be installed on top of an existing culvert crossing of
Rolling Hills Creek, outside of Washington State Department of Transportation (WSDOT) right-
of-way. The tank would be plumbed to accept stormwater from the 1-405 right -of way where
roadway widening and retaining wall construction will occur from July through December
2010. Piping and/or flexible hoses would be placed on the ground to connect the tank to
existing sewer or stormwater manholes.
An electric pump set with a double -walled fuel tank will pull stormwater to the tank with
gravity discharge. No fuel will be stored in the stream buffer. Maintenance access will be
provided via a pedestrian trail. No soil disturbance or vegetation removal is proposed.
Security fencing will be placed in front of the tank or at the parking lot access point for
security.

EXEMPTION JUSTIFICATION: Pursuant to RMC 4-3-050C.7.a.iii Activities in Criticol
Area Buffer, of the Critical Areas Regulations an exemption is hereby granted:
iii. Stormwater Conveyance in Buffer: Necessary conveyance systems including stormwater
dispersion outfall systems designed to minimize impacts to the buffer and critical area, where
the site topography requires their location within the buffer to allow hydraulic function, provided
the standard buffer zone area associated with the critical area classification is retained pursuant
to subsection L or M6c of this Section, and is sited to reduce impacts between the critical area
and surrounding activities. (Ord. 5526, 2-1-2010)
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-0500.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal
law or regulation.
2. The activity will be conducted using best management practices as specified by industry
standards or applicable Federal agencies or scientific principles if submitted plans are
followed and the conditions of approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if
submitted plans are followed and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in
accordance with this exemption, the site will be revegetated with native vegetation as
required as a condition of approval for this exemption.
5. All removed trees shall be retained as large woody debris in the stream/buffer and
wetland/buffer corridors, where feasible.
DECISION: An exemption from the critical areas regulations is approved for the temporary
placement of the 21,000 gallon Baker tank in the buffer of the unnamed tributary of Rolling
Hills Creek for the time period July— December 2010.

Dear Ms. Henning:
On behalf of 1-405 Corridor Design -Builders, we request a Letter of Exemption from the City
of Renton to temporarily locate a stormwater collection tank on an existing utility access
road in a Type 3 stream buffer (Figure 1). The proposed activity is for management of
construction stormwater for WSDOT's 1-40511-5 to SR 169 Stage 2 Widening and SR 515
Interchange Project. Our need for stormwater collection is to comply with Washington
Department of Ecology's NPDES Construction Stormwater Discharge Permit #WAR -
006736. Our purpose for using the tank is to temporarily collect and detain nonhazardous
stormwater prior to discharge to the sanitary sewer or storm drain system. We understand
that a Letter of Exemption is required prior to initiation of activities, pursuant to Renton
Municipal Code 4-3-050 (Critical Areas Regulations) C.4.i-v.

Proposed Activity
We propose to temporarily park a 40 -foot -long, 8.5 -foot -wide self-contained 21,000 -gallon
Baker tank on an existing gravel and soil powerline access road. The Baker tank will be
trailered to the site via Triton Tower One's asphalt parking lot, and placed across the
existing culvert crossing of Rolling Hills Creek, outside of WSDOT right-of-way. The tank
will be plumbed to receive stormwater from the 1-405 right-of-way where roadway widening
and retaining wall construction will occur during July -December 2010- Piping or flexible
hose will be laid on the ground surface, and connect the tank to existing sewer or water
system manholes. An electric pump set with a double -walled fuel tank will pull stormwater
to the tank, with gravity discharge. No fuel will be stored in the stream buffer. Pedestrian
maintenance access to the tank during use will be limited to water quality monitoring and
checking the pump. No soil disturbance, woody vegetation removal, or noticeable grass
mowing will occur. No erosion or sediment control measures will be installed because no
soil disturbance will occur. Temporary chainlink fencing will be placed in front of the tank or
at the parking lot access point for security.
Specific Critical Area Affected
The critical area buffer is associated with an unnamed tributary to Rolling Hills Creek
(Stream 09.RH-2.6).' The short tributary is a City of Renton Class 32 open channel
between 1-405 and the Triton Tower One parking lot, on Parcel #7231600542 at T23N, R5E,
Section 19 NE. The property is managed by JSH Properties Inc. (Attn: Jennifer A.
Bell, 425.917.3400). The tributary flows through a short culvert before joining Rolling Hills
Creek, which eventually outlets to Springbrook Creek. The unnamed tributary has little in -
stream structure and narrow stream buffers comprised of immature deciduous trees,
shrubs, and non-native Himalayan blackberry and reed canarygrass. No anadromous fish
species are reported to occur in Rolling Hills Creek or its unnamed tributary-, however, DNR
has designated it as Type F.

Mitigation Plan
Proposed exempt activities will be mitigated as follows:
• Self-contained water collection system
• Existing access road
• No soil disturbance
• No vegetation removal
• No hazardous materials storage
• Six month duration
Pertinent Information
Applicable Regulations
The activity is not known to be prohibited by any other regulation. Activities will not disturb
jurisdictional waters or wetlands or special status species.3
Best Management Practices
The activity will be conducted using WSDOT best management practices (BMPs) for
highway construction. In particular, BMPs will rely on the WSDOT-approved, project -
specific Stormwater Pollution Prevention Plan, which is based on the WSDOT Highway
Runoff Manual.
Impact Minimization
Impacts will be minimized by parking a self-contained Baker tank at the existing powerline
access road. No buffer vegetation will be removed and no soil will be disturbed. Hazardous
materials will not be stored in the buffer.
Revegetation
No existing buffer vegetation will be cut or mowed, except for minor grass cutting to permit
pedestrian access to the Baker tank's ladder. Existing grasses are expected to remain in
place or reestablish naturally. We do not expect to replace or reestablish existing buffer
vegetation. In the unlikely event that existing grasses become trampled and die, we will
seed the trampled areas with the native grass seed mix used on the 1-405 Renton Stage 2
project, at the appropriate time of year.
Hazardous Material
Stormwater collected in the Banker tank is non -hazardous, and will be discharged to the
sanitary sewer if turbidity precludes discharge to the storm drain_ We will run an electric
pump to avoid the need to refuel or store fuel for a diesel pump.
