PROJECT DESCRIPTION/BACKGROUND: The property located at 19654 104th Avenue SE (APN 5672000050) is developed with a 2,140 square foot single family residence on an 11,760 square foot parcel. The existing house -was built in 1965 at which time the subject property was under the jurisdiction of King County. The interior setback at that time was 5 feet. The house was constructed with a south side yard setback of 5 feet. In March 2008 the property was annexed to the City of Renton and was zoned Residential — 1 dwelling unit per acre (R-1). The required side yard setback in the R-1 Zone is 15 feet. Currently, the applicant uses an uncovered area on the existing driveway for vehicle parking. The variance request is for a two -car, 576 square foot attached garage which would be in alignment with the south side of the existing house with a side yard setback of 5 feet. The proposed garage would extend 24 feet into the existing driveway from the front of the house. The applicant has indicated that 30 feet of the driveway would remain between the front of the proposed garage and the front property line (Exhibit 4). C. EXHIBITS: The following exhibits were entered into the record: Exhibit 1: Project file (yellow file) containing project application, staff and public comments, and application materials. FINDINGS: Having reviewed the written record in the matter, the City now makes and enters the following: 1. Background/Zoning: The subject site is located at 19654104th Avenue SE (Exhibit 2). The existing house was built in 1965 with a south side yard setback under King County jurisdiction. The property was annexed to the City of Renton in March 2008 at which time it included in the Residential —1 dwelling unit per acre (R-1) zone (Exhibit 3). The applicant requested approval of an administrative variance from RMC 4-2-110A for a side yard setback of 5 feet to construct an attached garage which would be in alignment with the 5 -foot south side yard setback of the existing house. RMC 4-2-110A specifies that side yard setbacks in the R-1 zone shall be 15 feet. Germann Garage Variance Rpt.doc City of Renton Department of Commur. Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance request. The applicant's site plan and other drawings are provided as Exhibits 3 through 6. -3. Existing Land Use: North -- single-family residences (R-1 zoning); South — single-family residences (R-1 zoning); East — single-family residences (it -1 zoning); and West —single-family residences (R-1 zoning). 4. Topography: The lot slopes gently upward from west to east. S. Lot and Building Size: The total area of the lot is 11,760 square feet and the building (including the proposed 576 square garage) would be 2,716 square feet. Including the proposed garage lot coverage would be approximately 23°x. 6. Public Comment: Comments were received from one neighboring property owner and that letter is included as Exhibit 7. The letter included requests for clarification on where the proposed garage would be located on the subject property, the distance from the front of the proposed garage to the street, and how the proposed garage might affect future improvements to 104th Avenue SE. E. CONSISTENCY WITH VARIANCE CRITERIA: Section 4-9-250B.5.o lists 4 criteria that the Reviewing Official is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Reviewing Official shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners In the vicinity and under Identical zone classification: The applicant contends that special circumstances apply to the subject site as a result of annexation to the City of Renton in March 2008. The existing house was built in 1965 when the property was under the jurisdiction of King County and in conformance with County Code requirements. The property was assigned City of Renton zoning upon annexation making the existing 5 -foot south side yard setback nonconforming under the City's zoning regulations. The current zoning is Residential —1 dwelling unit per acre (R-1). While the proposed garage would be closer to the south side yard property line than is required, it would be built in alignment with the existing house which has a south side yard setback of 5 feet. Staff concurs with the applicant that special circumstances apply to the subject property in that the 5 -foot south side yard setback was established under and conformed to King County codes. While approval of the variance would allow the proposed garage to be closer to the south side property line than is currently allowed, it would be in alignment with the 5 -foot south side yard setback of the existing house. Placing the proposed attached garage elsewhere on the property would not be feasible due to the existing configuration of the existing house Germann Garage Variance Rpt.doc City of Renton Department of Commur, Economic Development ninistrative Variance Report & Decision GERMANN GARAGE VARIANCE LUA11-014, V-A Report of May 16, 2011 Page 4 of 7 and would impose an undue hardship on the applicant. Furthermore, the 30 -foot front yard setback would be maintained. b. That the granting of the variance will not be materially detrimental to the public welfare or Injurious to the property or Improvements in the vicinity and zone in which subject property Is situated: The applicant contends that the proposed garage would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is situated. The south side of the existing house is located 5 feet from the property line and the proposed garage would be constructed in alignment with the south side of the house. The applicant also contends that approximately 70% of properties in the vicinity have garages which are closer to the side property line than the current 15 -foot standard. These garages were constructed prior to annexation into the City of Renton. A review of the aerial photo of the surrounding neighborhood indicates that many houses have been constructed with attached garages which are closer than 15 feet to their side yard property lines. The proposed garage does not pose any sight distance issues or interference with 104 1h Avenue SE. Because other properties in the vicinity have garages developed in a manner similar to the subject request and that compliance with other R-1 development standards would be met, staff concurs with the applicant that the proposal would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone. In order to make the proposed garage addition more aesthetically pleasing and a neighborhood asset, staff recommends as a condition of approval that the garage be constructed with two single -car garage doors. Each of the doors shall include a horizontal line of windows. Staff further recommends that the garage design be indicated on revised elevation drawings which shall be submitted to the Planning Division Plan Reviewer for review and approval prior to issuance of building permits. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that the proposed garage would not constitute a grant of special privilege because approximately 70% of the houses in the vicinity have attached garages which are closer to the side property line than the currently required 15 feet. Many houses in the vicinity of the subject property have attached garages which are closer than 15 feet to their side yard property lines. The existing house was legally established in conformance with King County codes including a south side yard setback of 5 feet. Therefore, staff believes that approval of the proposed garage attached to the south portion of the existing house in alignment with its 5 -foot side yard setback while maintaining the required 30 - foot front yard setback does not constitute a grant of special privilege. d. That the approval as determined by the Reviewing Official is a minimum variance that will accomplish the desired purpose: The applicant contends that the request for a south side yard setback of 5 feet is the minimum variance needed to accomplish the goal of constructing an attached garage. The requested variance for a 5 -foot south side yard setback is the minimum variance that would accomplish the applicant's desired purpose of constructing an attached garage. Increasing the south side yard setback would not allow the construction of a two -car garage. F. CONCLUSIONS: 1. Zoning: The proposal would meet the development standards of the R-1 Zone with the exception of the south side yard setback for the proposed attached garage for which the variance is being sought. The south side yard setback of the existing house was made legally nonconforming as a result of annexation into the City of Renton as an R-1 zoned property. 2. Administrative Variance: The applicant's proposal for a 5 -foot south side yard setback for the construction of an attached garage meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4-9-2506.5: (a) The applicant suffers an undue hardship and the variance is necessary because of special circumstances that apply to the property; (b) The granting of the variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the surrounding area; (c) The approval is not a grant of special privilege; and, (d) The approval of the variance is the minimum to accomplish the desired purpose. 3. Existing Surrounding Land Uses: The proposal will not result in changes to existing land uses which are single-family residential. Many houses in the surrounding area are developed with attached garages which are closer than 15 feet to their side yard property lines. As shown in Exhibit 2 many of these are located 5 feet from their side property lines. 4. Topography: The project will not impact any steep slopes or result in extensive grading. 5. Building Proposal: The proposal would result in the construction of an attached garage which would match the south side yard setback of 5 feet for the existing house and would be compatible with attached garages in the surrounding neighborhood. A condition of approval requiring that the applicant construct the proposed garage addition with two single -car garage doors would yield a more aesthetically pleasing structure which would be a neighborhood asset. 6. Recommendation: Staff recommends approval with a condition of the requested variance from RMC 4-20-110A to allow a south side yard setback of 5 feet which is less than the 15 feet within the R-1 Zone as presented in Exhibit 4. DECISION The Administrative Variance for the Germann Garage Variance, File No. LUA11-014, V-A, is approved subject to the following condition. 1. The applicant shall construct the garage addition with two single -car garage doors. Each of the doors shall include a horizontal line of windows. The applicant shall indicate the garage design on revised elevation drawings which shall be submitted to the Planning Division Plan Reviewer for review and approval prior to issuance of building permits. LAND USE ACTION APPEALS, REQUEST FOR RECONSIDERATION, & EXPIRATION The administrative land use decision will become final if the decision is not appealed within 14 days of the effective date of decision. APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on May 31, 2011. An appeal of the decision must be filed within the 14 -day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall — 7th Floor, (425) 430-6510. Appeals must be filed in writing, together with the required fee to the Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. RECONSIDERATION: Within 14 days of the effective date of decision, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14 -day appeal time frame. EXPIRATION: The variance(s) approval will expire two (2) years from the date of decision. A one (1) year extension may be requested pursuant to RMC 4-9-250B.17. THE APPEARANCE OF FAIRNESS DOCTRINE: Provides that no ex parte (private one-on-one) communications may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing through the Hearing Examiner. All communications are public record and this permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence in writing. Any violation of this doctrine could result in the invalidation of the appeal by the Court. I am concerned that this protrusion into the street will (1) block the north view of the home directly south of this residence, (2).force visitors to park in the street, instead of the driveway, and (3), will this eliminate any possibility that in the future the open ditch will be eliminated, and a sidewalk run along the east side of 104th? It consists of an addition of a 576 square foot (2424) two car garage to an existing single family residence occupied by the owner, Patricia Germann and her family. The garage would be aligned with the south side of the existing home. The home currently does not have a garage, merely a parking pad in front of the house. The home, built in 1965, currently has 2,140 square feet of living space on a 11,760 square foot lot and was built with a five foot side yard setback on the south side, conforming to regulations at that time. This area, originally part of unincorporated King County, was annexed by the City of Renton in 2008 and zoned R-1 which requires a 15 foot side yard setback. This variance is needed to be able to construct the garage aligned with the south side of the existing home. The site slopes gently to the street. Current slope and drainage conditions will not be affected by the project. No wetlands or bodies of water are nearby. Also, access with not be changed as the garage will replace the current parking pad. Beyond this variance, no land use permissions or permits are proposed nor are any off-site improvements planned. No trees are to be removed and no export or import of soil is planned. A small amount of leveling gravel may be used under the garage slab. The only temporary structure will be a portable toilet for use of the workers during the construction. City of Renton Planning Division APR - 4 'LU11 RECEIVED Justification for the Variance Request — Germann Garage Patricia Germann's home at 19654 --104' Ave 5E, like most of the homes in her neighborhood, was built while the area was still a part of unincorporated King County. it was built with a five yard setback from the south property line, similar to many homes in the neighborhood and conforming to regulations at the time. When the City of Renton annexed the area in 2008 it was designated an R-1 zone which mandates a 15 foot side yard setback minimum. Compliance with this setback when adding a garage to the home would create an architecturally discordant appearance since it would block a considerable portion of the front entry and living room window area. This would create the appearance of something that was'tacked on' rather than being a part of the whole and would be at odds with the pleasant overall character of the neighborhood. Almost all of the homes in the area, all in the R-1 zone, were either built with garages or added them over the years prior to the annexation. Roughly 70% of these garages are closer to the side property line than the current 15 foot standard. Without this variance Patricia Germann would be unable to enjoy a right and privilege enjoyed by a considerable majority of her neighbors.
