Currently a Religious Institution use is permitted as a Conditional Use Permit granted by the Hearing Examiner. There is currently a proposal to re-evaluate which permits would be necessary for religious institutions to operate in the City's commercial zoning designations. Given the similarity of the former and proposed uses and the fact that there are no physical improvements necessary; the City finds that a Temporary Use Permit is justified in this circumstance. Additionally the applicant will need to comply with the new terms and conditions for religious institutions after the sunset date of the Temporary Use Permit. The following comments on development and permitting issues are based on the pre -application submittals made to the City of Renton by the applicant and the codes in effect on the date of review. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision -makers (e.g., Hearing Examiner, Community & Economic Development Administrator, Public Works Administrator, Planning Director, Development Services Director, and City Council). The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for $50.00 plus tax, from the Finance Division on the first floor of City Hall or online at www.rentonwa.gov Project Proposal: The subject property is located on the northeast corner of S 3`d St and Shattuck Ave S at 300 S 3'd St. The project site totals 18,166 square feet in area and is zoned Center Downtown (CD). The pre -application packet indicates that the proposal is to convert an existing funeral home into a religious institution for Faith Temple Community Church. The existing building is approximately 7,000 square feet and is three levels. The applicant is not proposing any structural changes to the existing building. The proposal includes a total of 29 surface parking stalls. The site is located within a seismic hazard area. Current Use: The property currently contains an existing single family residence used as Faull Stokes Funeral Home. Zoning: The subject property is located within the Center Downtown (CD) zoning designation. Development Standards: The project would be subject to RMC 4-2-110A, "Development Standards for Commercial Zoning Designations" effective at the time of complete application (noted as "CD standards" herein). A copy of the current standards is included herewith. Currently a Religious Institution use is permitted as a Conditional Use Permit granted by the Hearing Examiner. However, there is currently a proposal to re-evaluate which permits would be required for religious institutions to operate in the City's commercial zoning designations. The applicant will be required at the time business license application or building permit to provide detailed parking information (i.e. stall and drive aisle dimensions) and calculations of the subject site, specifically the number of seats provided in the main auditorium. If the proposal provides more or less parking than required by code, a request for a parking modification would need to be applied for and granted. This detailed written request should be submitted by the applicant along with the formal land use application. Additionally, the proposal would need to be revised in order to provide bicycle parking based on 10 % of the required number of parking stalls. it should be noted that the parking regulations specify standard stall dimensions. Surface parking stalls must be a minimum of 9 feet x 20 feet, compact dimensions of 8% feet x 16 feet, and parallel stall dimensions of 9 feet x 23 feet; compact surface parking spaces shall not account for more than 30 percent of the spaces in the surface parking lots. ADA accessible stalls must be a minimum of 8 feet in width by 20 feet in length, with an adjacent access aisle of 8 feet in width for van accessible spaces. The appropriate amount of ADA accessible stalls based on the total number of spaces must be provided. Surface parking lots with 15 -- 50 stalls shall provide a minimum of 15 square feet of landscaping per parking space. The landscaping shall be used to buffer impacts of the parking lot. Please refer to landscape regulations (RMC 4-4-070 and RMC 4-4-080F.7) for further general and specific landscape requirements (enclosed). Landscaping— Except for critical areas, all portions of the development area which are not covered by structures, required parking, access, circulation or service areas, must be landscaped with native, drought -resistant vegetative cover. The minimum on-site landscape width required along street frontages is 10 feet. Please refer to landscape regulations (RMC 4-4-070 and RMC 4-4-080F.7) for further general and specific landscape requirements (enclosed). A conceptual landscape plan and landscape analysis meeting the requirements in RMC 4-8-1200.12, shall be submitted at the time of land use application. Refuse and Recycling Areas— Refuse and recycling areas are required to meet the requirements of RMC 4-4-090, "Refuse and Recyclables Standards" (enclosed). Based on the proposal for 7,000 square feet of non-residential area; a minimum area of 100 square feet shall be provided for recycling and refuse deposit areas. It is unclear whether or not the existing refuse and recycle area would comply with the requirements of the code. Environmental Review The project is Categorically Exempt from SEPA requirements and, therefore, Environmental Review would not be required. Critical Areas The site is located within a seismic hazard area. As there are no structural alterations proposed the applicant would not be required to provide a geotechnical analysis. It is the applicant's responsibility to ascertain whether additional critical areas are present on the site. The Conditional Use Permit application fee is $2,000 and would be reviewed in an estimated timeframe of 12 weeks. As an alternative the applicant may apply for a Type II Temporary Use Permit. The Type 11 Temporary Use Permit application fee is $2,000 and would be reviewed in an estimated timeframe of weeks. All permits are discretionary permits. Temporary Permit Review Process: Once a complete land use application package has been accepted for initial review, the Planning Division will post three notices of the pending application at or near the subject site and mail notices to property owners within 300 feet of the project site. The proposal will be routed to other City departments and other jurisdictions or agencies who may have an interest in the application. The reviewers have two weeks to return their comments to the Planning Division. In review of the proposal, the Planning Division will ensure the following criteria have been addressed: • The Temporary Use will not be materially detrimental to the public health, safety, or welfare, nor injurious to property or improvements in the vicinity of the Temporary Use • Adequate parking facilities and vehicle ingress and egress are provided to serve the Temporary Use and any existing uses on the site • Hours of operation of the Temporary Use are specified, and would not adversely impact surrounding areas • The Temporary Use will not cause nuisance factors such as noise, light, or glare which adversely impacts surrounding uses • If applicable, the applicant has obtained the required right-of-way use permit After review of the proposal and any staff or public comment, the Planning Division will issue a decision. Recitals The Owners own real property in the City legally described in Exhibit A, attached. The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some risk in building the model homes. In consideration of the inherent risks associated with the construction of buildings in advance of the recording of the plat, the City requires the owner to execute an indemnification agreement prior to any model home construction activities. Owners understand and acknowledge that, should the model home construction not comply with the proposed lot configuration of the final plat, that no variances to development standards for either the lots or the homes may be granted as such a situation would be considered a "self-induced hardship". 5. Owners acknowledge that they understand that any construction begun prior to the recording of the final plat must be in compliance with all City zoning and subdivision requirements (e.g_ setbacks, lot coverage, etc.) or removed prior to recording of the final plat.
