The boom will be anchored on the banks of the Black River, and consist of a foating boom aligned across the river at approximately 72 degrees to the flow of the Black River. The boom is proposed to be approximately 320 feet long and the area of disturbance is a total of 1,600 square feet. The width along each cable is 10 feet (5 feet on each side of the cable). The preferred alignment and anchors point locations were chosen by the City of Renton and KingCounty in order to minimize disturbance to shoreline vegetation and the existing walking trail. On the South bank, a total of 4 Spruce trees would need to be relocated. These trees were installed as part of a recent revegetation effort would be transplanted outside of the 10 - foot wide swath. In addition, 10 small maple and alder trees would be removed. In addition, up to 7 alder trees would be removed. A critical areas exception is also being required by the City of Renton in order to remove and transplant vegetation. It is expected that the construction would occur between early October and mid-November, 2010. The construction would take 3 to 5 days to complete. The purpose of the debris barrier is to keep the Black River Pump Station from being overwhelmed by large floatingdebris (e.g., wooden pallets, logs, etc.) in the event of a flood exceeding the existing capacity of the Howard Hanson Dam. The upstream face of the Black River Pump Station is equipped with a coarse screen to protect the pumps from debris and a rail -mounted system for debris removal. The pump operator (King County Flood Control District) is concerned that the capacity of the screens and removal system could be insufficient for the debris -loading associated with a 25,000 cubic foot per second (cfs) flood in the Valley. The proposed debris barrier would trap large debris before it reaches the pump station screens. Flooding that could occur in association with the conditions at the Howard Hanson Dam is considered to be an "emergency" for purposes of the project. EXEMPTION JUSTIFICATION: Pursuant to RMC4-3-050C.5.h.i and ii, Emergency Activities in Critical Areas and Associated Buffers, of the Critical Areas Regulations an exemption is hereby granted: i. Emergency Activities: Emergency activities are those which are undertaken to correct emergencies that threaten the public health, safety and welfare pursuant to the criteria in subsection C9b of this Section. An emergency means that an action must be undertaken immediately or within a time frame too short to allow full compliance with this Section, to avoid an immediate threat to public health or safety, to prevent an imminent danger to public or private property, or to prevent an imminent threat of serious environmental degradation. ii. Emergency Tree/Ground Cover Cutting or Removal by Agency or Utility: Removal of trees and/or ground cover by any City department or agency and/or public or private utility in emergency situations involving immediate danger to life or property, substantial fire hazards, or interruption of services provided by a utility. FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-3-050C.5: 1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation. All removed trees shall be retained as large woody debris in the stream/buffer and wetland/buffer corridors, where feasible. DECISION: An exemption from the critical areas regulations is approved for the removal/relocation of vegetation in order to accommodate the Black River Pump Station Debris Barrier during the time period October to mid-November, 2010. The project area is minimally vegetated with a mixture of grass and invasive plant species (primarily Himalayan blackberry), and the project alignment was selected jointly by the City of Renton and King County to minimize vegetation disturbance. The area upstream of the pump station and the project area is densely vegetated with coniferous and deciduous vegetation, and serves as a Great blue heron rookery. The habitat impacts of this project will be minimal, as we will only clear grass and small shrubs along the alignment of the debris barrier attachments and anchors (10 -foot wide swath on each bank). The site will be seeded and mulched immediately following construction. Once installed, the floating boom will not be a passage barrier for adult or juvenile fish. The floating boom and anchor points will not affect other wildlife (such as herons) once installed, though birds may perch on the boom itself and feed. Salmon habitat upstream of the pump station is limited by water quality; however, salmonids do migrate up the Black River and through a fish ladder in the pump station and juveniles rear in Springbrook Creek. Bull trout use in this system is unknown; however, Springbrook Creek provides rearing and spawning habitat for threatened Chinook salmon and steelhead_ Fish species are not likely to be affected by this project due to the distance from the ordinary high water mark, as well as the short duration of work. However, various bird species (e.g., bald eagle, great blue heron) may be impacted due to noise and construction disturbance adjacent to nesting and perching habitat. There are no wetlands within the project area. 0 9 City of Renton Shoreline Exemption Project Narrative Name: Black River Pump Station Debris Barrier Size: 320 linear feet (floating boom); 1600 ft2 clearing area on bank Location: Black River Pump Station 550 Monster Road Renton, WA 98057 Parcel #: 377920-0090 Background: The Black River Pump Station was initially constructed in 1971, and consists of a dam across the historic Black River channel and eight pumps that sit atop the dam. The dam prevents flooding of the levee -protected area in the northeast portion of the lower Green River valley that would otherwise backflow via the Black River Channel. The pumps convey Springbrook Creek and flows from local drainages system from the landward side of the levee system to the Green River via the Black River_ Damage to the right abutment of Howard Hanson Dam has raised the threat of flooding in the Green/Duwamish River Valley. The U.S. Army Corps of Engineers has notified downstream communities of a situation at the Howard Hanson Dam that may require the release of more water than usual during extreme rain events. As a result of this increased water release, parts of the Green River valley are at a higher risk of flooding. The USACE has produced flood maps showing the depths and extents of a flood through the Green/Duwamish River valleys resulting from a high flow release of 25,000 cfs_ Normal maximum flow releases from the Howard Hanson Dam are 12,000 cfs. If such a flood occurs, the Black River Pump Station is designed to relieve flooding in portions of the City of Renton by pumping water from the Black River basin to the Green/Duwamish River. The Black River Pump Station also blocks flows from the Duwamisb River to prevent flooding back into the Black River, Springbrook Creek, and the Earlington Industrial Park in Renton. The Black River Pump Station has a pumping capacity of 3,000 cfs and is located approximately 1,000 feet upstream of the confluence with the Green/Duwamish River, in Renton. The upstream face of the pump station is equipped with a coarse screen to protect the pumps from debris and a rail -mounted system for debris removal. King County Flood Control District, the pump station operator, is concerned that the capacity of the screens and removal system could be insufficient for the debris loading associated with a 25,000 cfs flood in the Renton valley. Brief Description of Proposed Work: King County proposes to install a floating debris retention structure (TUFFBOOM Log and Debris Boom; www.tuffhoom.com) upstream of the Black River Pump Station. This will consist of metal anchors on the banks and a floating boom aligned across the river at approximately 72 degrees to the flow of the Black River (see 75% plans, attached). The floating boom is approximately 320 feet long. The preferred alignment and anchor point locations were chosen by the City of Renton and King County in order to minimize disturbance to shoreline vegetation and a walking trail. Basis for Exemption Request: King County requests a Shoreline Exemption from the City of Renton because the project is "emergency construction necessary to protect property from damage by the elements." (see Background) 9 Anticipated Dates of Work: October 4,2010— November 12, 2010 (3-5 days of work) Other Permits Required: SEPA — This project is covered by King County's programmatic SEPA: King County Flood Protection Facility Maintenance and Flood Damage Repair Program (2007-2012). Though the project is covered, it should be considered exempt from SEPA compliance under WAC 197-11-880, in that it is considered an "action that must be undertaken immediately or within a time too short to allow full compliance with this chapter, to avoid an imminent threat to public health or safety [and] to prevent an imminent danger to public or private property..." King County is the lead agency for this project. Hydraulic Project Approval — King County will be applying for a HPA from the Washington Department of Fish & Wildlife (Larry Fisher, Area Habitat Biologist)_ Current and proposed use of site: The site is currently used for utility and public use. The proposed project will not change these land uses, rather it will help protect and maintain the current use in the case of a large flood event. The City of Renton owns the parcel upon which the proposed work will take place. The City has requested that this work be completed in advance of the 2010-2011 flood season. Special site features: The site is adjacent to the Black River channel (see Habitat and Stream Assessment below). There are no wetlands in the proposed work area- Soils/Drainage: The alluvium in the project area is predominantly fine silts and clays of the Woodinville silt loam unit.
