The proposal is to construct a single-family house with a 17-foot rear yard setback where 20 feet is required per RMC 4-1-110A (Exhibit 3). The applicant proposes to comply with all other development and residential design standards required of single-family residences in the R-8 zone. The parcel is generally flat. Temporary erosion control would be provided at the time of house construction. The proposed 17-foot rear yard setback would abut a pipestem driveway on the lot to the north. I C. Vain (received May 15, 2012) I D. FINDINGS: Having reviewed the written record in the matter, the City now makes and enters the following: 1. Request: The applicant has requested approval of an administrative variance from RMC 4-2- 1l0A for a rear yard setback of 17 feet where 20 feet is required. 2. Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance request. The applicant's site plan is provided as Exhibit 3. 3. Existing Land Use: The subject parcel is surrounded on all sides by single-family residences in the R-8 zone (Exhibits 1 and 2). 4. Zoning: The subject property is in the Residential-8 dwelling units per acre (R-8) zone (Exhibit 3). 5. Topography: The site is generally flat. 6. Lot Size: The total area of the lot is 4,648 square feet. Public Comment: A letter of opposition to the proposed project was received on May 15, 2012 (Exhibit 4). That letter stated that consideration would be given to withdrawing opposition if more information was provided to the writer regarding the house plans and effects on the surrounding properties. On May 29, 2012 staff left a voicemail for the person in opposition to the proposed project with detailed information. No return telephone call has been received. I E. CONSISTENCY WITH VARIANCE CRITERIA: Section 4-9-2508.5.0 lists 4 criteria that Reviewing Official is asked to consider, along with all ather relevant information, in making a decision an an Administrative Variance application. These include the following: The Reviewing Official shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a_ That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant maintains that special circumstances apply to the subject site as a result of its location on a corner. Setbacks required in the R-B zone are: 15 feet front yard; 15 feet side yard along a street; 5 feet internal side yard; and 20 feet rear yard. The parcel is located at the northwest corner of North 36th Street and Park Avenue north. Many of the neighboring lots are of similar size to the subject property. However, these lots do not have side yards located along streets and, therefore, are not subject to providing a 15-foot side yard setback as is the subject property. In order to build an adequately sized Single-family house, the applicant is proposing to reduce the required 20-foot rear yard setback to 17 feet. The size of the subject site is similar in size to other lots in the vicinity (Exhibit 1); however, these other lots, because they are not corner properties would be subject only to 5-foot side yard setbacks. The corner location ofthe site, therefore, limits the building envelope to a smaller size than would be allowed on neighboring internal lots. Because of lot size and location staff concurs with the applicant that special circumstances apply to the subject property in that adhering strictly to all of the yard setback requirements would restrict the size of the future house to be built on this lot. Requiring the applicant to comply with all of the setback regulations would impose an undue hardship on the applicant. The applicant would adhere to the front, side yard along a street, and internal side yard setback requirements. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant contends that the proposed rear yard setback would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is situated. The proposed 17-foot rear yard would abut a pipestem driveway for the lot to the north (Exhibits 1 and 2). . Because the applicant would adhere to the required front and side yard setbacks, and the requested reduced rear yard setback would abut a driveway thus providing adequate separation from the rear of the home to the north, staff concurs with the applicant that the proposal would not be materially detrimental to the public welfare or injurious to the property or improvements in thevicinity and zone. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that the proposed rear yard setback variance would not constitute a grant of special privilege. Several other properties along the north side of North 36th Street on the same block have existing rear setbacks of less than 20 feet (Exhibit 1). Therefore, staff be.lieves that approval of a reduced rear yard setback would not constitute a grant of special privilege. d. That the approval as determined by the Reviewing Official is a minimum variance that will accomplish the desired purpose: The applicant contends that the request for a rear yard setback of 17 feet is the minimum variance needed to accomplish the goal of constructing a future single-family residence. While a house with a smaller footprint which would satisfy the required rear yard setback could be built on the subject site, the requested variance for a 17-foot rear yard setback is the minimum variance that would accomplish the applicant's desired purpose of constructing a reasonably sized single-family residence on this corner lot. Therefore, staff agrees with the applicant and supports the variance for less than the required 20-foot rear yard setback in the R-8 lone. I F. CONCLUSIONS: 1_ Zoning: The proposal would meet the development standards of the R-8 zone with the exception of the rear yard setback for which the variance from RMC 4-2-110A is being sought. 2. Administrative Variance: The applicant's proposal for a 17-foot rear yard setback meets the four criteria to be considered in making a decision on a variance request as specified in RMC 4- 9-250B.5: (a) The applicant suffers an undue hardship and the variance is necessary because of special circumstances that apply to the property; (b) The granting of the variance would not be materially detrimental to the public welfare or injurious to property or improvements in the surrounding area; (c) The approval is not a grant of special privilege; and, (d) The approval of the variance is the minimum to accomplish the desired purpose. 3. Exisitng Surrounding Land Uses: The proposal will not result in changes to existing land uses which are single-family residential. Several houses in the surrounding area have been constructed with rear yards less than the required 20 feet. LAND USE ACTION APPEALS, REQUEST FOR RECONSIDERATION, & EXPIRATION The administrative land use decision will become final if the decision is not appealed within 14days of the effective date of decision. APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on June 21, 2012. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals to the Examiner are governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton City Clerk's office, Renton City Hall-7th Floor, (425) 430-6510. Appeals must be filed in writing, together with the required fee to the Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. RECONSIDERATION: Within 14 days of the effective date of decision, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation offact. After review ofthe reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. EXPIRATION: The variance(s) approval will expire two (2) years from the date of decision. A variance one (1) year extension may be requested pursuant to RMC 4-9-250B.17. THE APPEARANCE OF FAIRNESS DOCTRINE: provides that no ex parte (private one-on-one) communications may occur concerning the land use decision. The Doctrine applies not only to the initial deciSion, but to Appeals to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing through the Hearing Examiner. All communications are public record and this permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence in writing. HANSON CONSULTING LLC April 16,2012 Bernasconi Residence Setback Variance Justification A setback variance from the required 20 foot setback is justified as follows: City of Renton Planning Division APR 2 (}2012 • The applicant suffers an undue hardship because ofthe size and shape of the property. The lot is a comer lot 50 foot X 93 foot. Renton's code requires new comer lots to be wider to accommodate the side street setback of 15 feet. At the time that the lot was platted the setback was less in King County. The lot is platted at 102 feet deep as is most other lots in the subdivision however somehow about 9 feet has been lost in the survey of this block. Most other lots in the subdivision allow a deeper house to be built than does this lot. A number of houses along Park Ave N do not meet the setback along Park Ave N. The proposal is meeting the required 15 foot setback along Park Ave N but cannot meet the 20 foot setback for the rear yard and construct a reasonable sized house as others have recently built in the area. • The granting of the variance will not be materially detrimental to the public. The proposal will meet the front and side yard setback along the two streets. The adjacent lot to the north has an access easement abutting the rear yard of the proposed house. No other house is immediately adjacent to the rear yard. A reduction of the rear yard should have little impact to the lot to the north. • The approval of the variance will not constitute a grant of special privilege inconsistent with other properties in the area. A number of houses along Park Ave N do not meet the setback required by the RMC. This lot is different in depth than most in the subdivision. The lot was platted at 102 feet deep but only about 93 feet is remaining on the ground per the recent survey • The approval is the minimum variance that will accomplish the desired purpose. Because of the small size of the comer lot meeting the present setback for all the yards will not allow a reasonable sized house to be built as many others in the area have done.
