The subject site is located in the Residential -8 dwelling units per acre (R-8) zoning classification (Exhibit 1). The portion of the fence located along NE s'" St has been constructed approximately 4 feet from the property line. The remainder of the fence is proposed to be located approximately 5 feet from the Duvall Ave NE property line. Fence materials would include l"x4" or l"x6" cedar boards and pressure treated 4"x4" posts (Exhibit 2). The fence posts would be placed at a minimum every 4 feet and a maximum of 8 feet. Renton Municipal Code (RMC 4-4-040D.2.d) restricts fences within a side yard setback along-a- street to a maximum height of 48-inches {4 feet). Fences along the rear property line are allowed to be a maximum of 72-inches; except when abutting a public street then the fence shall be limited to 49-inches. The applicant proposes to construct a 6-foot fence which encroaches 11 feet into the side yard setback along-a-street (NE gth St) and 10 feet into the rear yard setback along-a-street (Duvall Ave NE). The applicant states the purpose of the proposed fence is for privacy. The submitted site plan (Exhibit 3) indicates the location of the proposed fence. No fencing is proposed within the Clear Vision Area at the corners of Duvall Ave NE and NE g<h St or NE gth St and Chelan Pl NE. The applicant is proposing four feet of landscaping between the fence and the property line along NE g<h St and five-feet between the fence and the property line along Duvall Ave NE (Exhibit 3). The proposal does not comply with the landscaping requirments of the code. Per RMC 4-4-070F, 10 feet of on-site landscaping is required along all public street frontages. In order to provide adequate permanent landscaping along the front of the existing/proposed fence, staff recommends as a condition of approval, the applicant set back the existing/proposed, six-foot, fence at least 10 feet from all property lines. Alternatively, the applicant may choose to reduce the height of the existing/proposed fence to four feet. A revised site plan shall be submitted to and approved by the Current Planning Project Manager prior to the installation/reinstallation of a six foot fence. Additionally, staff recommends as a condition of approval, the applicant submit a detailed landscape plan demonstrating compliance with the 10-foot on-site landscaping requirement. Landscaping shall be a mix of ornamental trees and shrubs. The landscape plan shall be submitted to and approved by the Current Planning Project Manager prior to the installation/reinstallation of a six foot fence. APPEALS: Appeals of permit issuance must be filed with the City of Renton Hearing Examiner by 5:00 p.m. on March 12, 2013. When I purchased the residence the fence was in deteriorating condition. Several of the fence posts were rotten and multiple panels were leaning and in danger of collapsing. After removing the fence a new fence was installed using natural cedar l"x5"x6' fence boards and 4"x4"x8' pressure treated fence posts. The new fence is the same height as the previous fence at 6'. The modulation of the fence follows the contour of the land, descending as you move from east to west. The current fence follows a similar design pattern as surrounding fences in the neighborhood and surrounding neighborhoods. Due to the winter weather landscaping along the fence will take place in the spring. Please see attached picture for landscaping details. Fence will also be treated with environmentally recommended stain for protection against inclement weather. Current fence does not detract from the quality of the residential environment, landscaping will cover current blank wall along public roadway. Current fence compliments the environment and is aesthetically pleasing while not presenting a hazard to vehicles or pedestrian traffic.
