The easement document submitted have not been reviewed as they are private easements which pursuant to the Declaration of Covenant on sheet 1 of 2 are required to be granted and convey at the time the benefited or burdened properties are transfered to other. An easement by definition is "the right of one in land of another." Granting and easement to oneself is meaningless as the property owner enjoys full rights to the property as issue and attempts to limit them runs afoul of the merger doctrine or "the merger of estates." The areas subject to the proposed easements need to be shown on the Lot Line Adjustment as "New Proposed Private Easement for. . ." The depiction of these easements does not create them; just their intention. The applicant could record these instrument as "Definition of Easement" to be referenced in future conveyances but they should be established as such and not treated as a conveyance of rights where which is a unenforceable contract with ones self. The proposed references to these documents in NOTES: Item Nos. 1 and 3 in the "NOTES" block (Sheet 2 of 2) are not effective grants of easement as currently described. Remove the "ORIGINAL LOT AREAS" block. (Sheet 2 of 2) -it was required only for preliminary approval of the lot line adjustment. A minimum of one fire hydrant is required within 300-feet of the proposed buildings and two hydrants if the fire flow goes up to 1,500 gpm. Existing 6-inch water main can only provide minimum fire flow requirements of 1,000 gpm. 2. The fire impact fees are applicable at the rate of $479.28 per single family unit. This fee is paid at time of building permit. Credit will be granted for removal of any existing homes. 3. Fire department apparatus access roadways are required to be minimum 20-feet wide fully paved, with 25-feet inside and 45-feet outside turning radius. Fire access roadways shall be constructed to support a 30- ton vehicle with 322-psi point loading. Access is required within 150-feet of all points on the buildings. Dead end streets that exceed 150-feet in length require an approved turnaround. An approved 90-foot minimum cul- de-sac turnaround is required when the roadway exceed 300-feet long. 4. City of Renton street ordinance requires all homes on dead end street that exceed 500-feet long be equipped with an approved fire sprinkler system. I have completed a preliminary review for the above-referenced proposal. The following comments are based on the pre-application submittal made to the City of Renton by the applicant. WATER 1. The project is within the City's water service area in the Kennydale 320-hydraulic pressure-zone. There is an existing 6-inch water main (reference City water project plan W-0261) in Mountain View Ave N that can deliver a maximum flow rate of 1,400 gpm. The static water pressure is about 123 psi at ground elevation 36 feet. 2. There is an existing fire hydrant within 300 feet of the property which can deliver 1,000 gpm. There is an existing 1-incn water meter serving the existing house at 3001 Mountain View Ave N. and a %-inch meter for the existing house at 2909 Mountain View Ave N. 3. A separate domestic water service line (1-inch min) and water meter is required for each lot at the time of the application for building permits for the new residences. 4. The applicant shall verify with Renton Fire Prevention staff to determine if an additional hydrant is required and/or if a residential fire sprinkler system is required depending on the fire flow demand of the proposed development on the subject lots. 5. The development is subject to applicable water system development charges depending on the size and number of the water meter(s), and of water meter full installation fees. SANITARY SEWER 1. SURFACE WATER For future construction in the lots, drainage review is required for projects resulting in: a. 2,000 square feet or more of new and/or replaced impervious surface, or b. 7,000 square feet or more of land disturbing activity, or c. a proposal to construct or modify a drainage pipe or ditch that is 12 inches or more in size, or d. location in a flood hazard area, or e. location within a critical drainage, or f. a redevelopment project proposing $100,000 or more of improvements to an existing high use site, or g. the redevelopment project has a total of new plus replaced impervious surface of 5,000 square feet or more, and exceeds 50% of the assessed value of the existing site improvements. If the drainage review threshold is triggered, a drainage review complying with the City adopted 2009 King County Surface Water Manual and City Amendments is required. Based on the City's flow control map, this site falls within the Peak Rate Flow Control Standard (Existing Site Conditions). Storm water review will occur with the building permit on the lots and will require the implementation of flow control BMPs with the construction on the lots according to the surface water manual. TRANSPORTATION 1. Lot line adjustments must not impact the access to all the affected lots. 2. Lot line adjustments shall not create any landlocked parcel without access. Access must be provided either by direct connection to the public street, or by access easement. 3. For the future construction of houses in the lots, payment of the transportation impact fee is applicable on the construction of the single family houses at the time of building permit issuance. The current transportation impact fee rate is $717.75 per single family house. The impact fee for this type of land use will increase on January 1, 2014, to $1,430.72 per single family house. The 2.33 acre site is located within the R-8 zoning designation. The Lake Washington Ordinary High Water Mark (OHWM) encroaches onto the property approximately. Access for the proposed Lots 2-5 would gain access via Mountain View Blvd via private driveways. The applicant is proposing a 20-foot wide access easement across proposed Lot 3. Current Use: An existing single family residence is proposed to remain on Lot 1. The other single family residence located on site is proposed for demolition. Zoning/Density Requirements: The subject property is located within the R-8 zoning designation. The density range allowed in the R-8 zone is a minimum of 4.0 to a maximum of 8.0 dwelling units per acre (du/ac). The area of public and private streets and critical areas would be deducted from the gross site area to determine the "net" site area prior to calculating density. Additionally, the proposal is located within the Shoreline Master Program jurisdiction; Lake Washington, Reach-D. Shoreline regulations shall apply as an overlay and in addition to development regulations, including but not limited to zoning, environmental regulations, development standards, subdivision regulations, and other regulations established by the City. In the event of any conflict between shoreline policies and regulations and any other regulations of the City, shoreline policies and regulations shall prevail unless other regulations provide greater protection of the shoreline natural environment and aquatic habitat. Minimum Lot Size, Width and Depth -The minimum lot size permitted in the R-8 is 4,500 square feet for parcels greater than 1 acre in size and 5,000 square feet for lots 1 acre or less in size. The total lot area of the subject site is less than 1 acre; therefore a minimum Jot size of 5,000 square feet is applicable to the proposed project. A minimum lot width of 50 feet for interior lots and 60 feet for corner lots, as well as a minimum lot depth of 65 feet, is also required. The proposal appears to comply with the lot standards of the zone. Setbacks -Setbacks are governed by underlying zoning in chapter 4-2 RMC except in cases where specific shoreline performance standards provide otherwise. The required setbacks in the R-8 zone are 15 feet in front for the primary structure and 20 feet in front for the attached garage, 20 feet in the rear, 5 feet on interior side yards, and 15 feet on side yards along streets (including access easements but not shared driveways} for the primary structure and 20 feet on side yards along streets (including access easements but not shared driveways} for the attached garage. The rear yard setback for the existing residence does not comply with setbacks of the zone. The proposed lot lines for Proposed Lot 1 wauld be required to be altered in order to accommodate the required 20-foot rear yard setback for the existing residence. All new residential lots shall meet vegetation conservation provisions including the full required buffer area together with replanting and control of invasive species within buffers to ensure establishment and continuation of a vegetation community characteristic of a native climax community. Each lot must be able to support intended development without encroachment on vegetation conservation areas. Shorelines shall have a minimum one hundred foot (100'} vegetation management buffer measured from the OHWM of the regulated shoreline of the State. The applicant may request, along with the acceptance of a standard stream or lake study, the Administrator approve a reduction in the standard buffer widths/setbacks by up to twenty five percent (25%}. Buffer enhancement shall be required where appropriate to site conditions, habitat sensitivity, and proposed land development characteristics. The proposal appears to contain adequate area to comply with the required, or potentially reduced, setback requirements of the Shoreline Master Program. For the existing residence/lot the following vegetation buffers and building setbacks shall apply without a variance. Lot depth shall be measured from the OHWM in a perpendicular direction to the edge of the contiguously owned parcel or to an easement containing existing physical improvements for road access for two (2) or more lots. In cases where the depth of the vegetation conservation buffer/setback is modified, that portion of the first one hundred feet {100') from OHWM upon which development is to be located is permitted a maximum of fifty percent (50%) impervious surface. If the buffer depth is modified, that portion of the first one hundred feet (100') from OHWM upon which development is to be located shall be permitted up to 25% lot coverage. Building height is restricted to 30 feet from existing grade for the R-8 zone. However, up to 35 feet is allowed for single-family residences subject to the shoreline master program. If the maximum allowed height in the underlying zoning is less than the maximum allowed height in the shoreline overlay, a non-shoreline variance from the standards in chapter 4-2 RMC must be obtained from the Administrator to allow any height over the amount allowed in the underlying zone. Detached accessory structures must remain below a height of 15 feet. The gross floor area must be less than that of the primary structure. Accessory structures are also included in building lot coverage calculations. The proposal's compliance with the building standards would be verified at the time of building permit review for the new residences to be located on all lots. Access/Parking: Access to site is proposed via an existing 20-foot wide access easement. Each lot is required to accommodate off street parking for a minimum of two vehicles. Driveways: The maximum driveway slopes cannot exceed 15%, provided that driveways exceeding 8% are to provide slotted drains at the lower end of the driveway. If the grade exceeds 15%, a variance is required. Building Design Standards -All single family residences would be subject to the Residential Design Standards outlined in RMC 4-2-115. The proposal's compliance with the residential design standards would be verified at the time of building permit review for the new residences. Please take note of the following standards One of the following is required: • Lot width variation of 10 feet (10') minimum of one per four (4) abutting street-fronting lots, or • Minimum of four (4) lot sizes (minimum of four hundred (400) gross square feet size difference) for at least every four (4) abutting street fronting lots, or • A front yard setback variation of at least five feet (5') minimum for at least every four (4) abutting street fronting lots. Docks -The applicant would be required to record a prohibition on new private docks on the face of the lot line adjustment. The development standards require that all pervious areas within the property boundaries be landscaped. The minimum on-site landscape width required along street frontages is 10 feet. Please refer to landscape regulations (RMC 4-4-070) for further general and specific landscape requirements (enclosed). The conceptual landscape pion submitted with the pre-application materials is required to be revised ta include a 10-/oot wide on-site landscape strip on each lot Environmental Review: The applicant is not proposing to increase the number of existing lots and as a result would be exempt from Environmental Review. Permit Requirements: The proposal would require a Let Line Adjustment. All land use permits would be processed within an estimated time frame of 6-8 weeks.
